RE: Management Zone 7 - Growth Projections.
Dear Michael:
Thanks to you and your staff for meeting with us to discuss
the growth projections for this Management Zone yesterday.
As we discussed at this meeting, the Calavera Hills Master
Plan and the city's General Plan do not correspond well
with each other with regard to the gross acreage of residential
land use categories. I believe that the discrepancies
are partly due to the fact that the General Plan was amended
several months after the Calavera Hills Master Plan amendment
took place.
The Master Plan, in determining the maximum units per village,
counted the open space contained within village boundary
lines in the calculation. A good example where this occurred
is Village U which has a maximum unit count of 249 units
on 62.2 acres. This provides for a maximum of 4 units
per acre (RLM designation) . This Village also had a requirement
that the units were to be clustered in the flatter, more
usable portions of the site. The remaining land was to
remain open space but it was intended to be counted in
the density calculations. When the General Plan was later
amended, the flatter, more usable land on this Village
was designated RLM and the remaining portion was designated
as open space. This created an inconsistency between the
Master Plan and the General Plan.
You asked us to recalculate our growth projections for
this zone based on the Master Plan criteria. We did this
and would now like you to review our findings and the assump-
tions used in making these findings.
Assumptions
For gross residential acreage, we used the gross acreages
of each residential village as contained in the Calavera

Hills Master Plan. From these acreages, we will subtract
out the environmental constraints (both 100% and 50% constraints
per the Growth Management Plan) . The net acreage that
results will be multiplied by the Control Point for each
residential land use category and a total unit count for
the entire zone will be obtained. From this number, we
will subtract out the existing and approved units within'
the zone which leaves the remaining unit count for the
Management Zone.
We are in the process of revising our maps to reflect this
methodology, but we would first like your concurrence on
our assumptions. If you agree with our methodolgy, we
would like to set up a meeting with you and your staff
to review the new exhibits and projections. Because we
would rather not proceed too far on our exhibits without
the city's concurrence, we would greatly appreciate a response
by next Wednaesday.

SUBJECT: Local Facilities Management Plan, Zone 7-
Submittal of the Constraints Map.
Dear Mike:
Attached please find the revised constraints map for
Management Zone 7. This constraints map was prepared by
Tony Lawson, ADL Planning Associates,and reviewed and
verified by me. The map and the attached build out
projection numbers correspond to the methodology adopted as
part of the Citywide Facilities Management Plan.
Since some time has passed since our last meeting on this
subject, I would like to briefly summarize the approach we
took in the preparation of this plan as agreed to by the
Planning staff. A verification letter written to the staff
is included which summarizes our past understanding.
As you know, the Master Plan was amended by Ordinance 9708,
February 21, 1984 to reflect some major land use changes.
After the Master Plan was amended, the City amended the
General Plan to reflect the changes. This General Plan
amendment was a clean up amendment intended to bring the
General Plan and Master Plan into conformity. The re-
sulting General Plan amendment, however, did not accurately
reflect the Master Plan amendments that occurred.
I won't go into detail here, but the attached letter uses
Village U as an example where the Master Plan contemplated
more units then would be allowed under the General Plan.
Village U was intended to be a clustered development in the
flatter more usable areas. The entire Village was intended
to be counted towards density. The General Plan amendment,
however, designated the remainder of Village U as Open
Space, which cannot be counted for density. This resulted
in a greatly reduced unit count than could be permitted by
the Master Plan.

The Planning staff indicted that it could support an
overall Zone 7 unit count based on the Master Plan villages
instead of the General Plan. The staff indicated that they
anticipated potential conflicts with existing Master Plans
and that the population and unit limits of the Growth
Management Ordinance and Proposition E reflect allowances
for existing Master Plans.
Please review the constraints map and the corresponding
build out table. We need confirmation as soon as possible
so we can complete the Local Facility Management Plan for
Zone 7. Thank you for your cooperation.

The purpose of this letter is to confirm your buildout numbers
for Zone 7. Your projections show the following:

The above mentioned numbers include the approved 653 units of
villages Q + T within the 1,83* existing/approved category.
When these two projects are redesigned to conform with Growth
Management Control Points, the Hillside Ordinance and the
revised Planned Development Ordinance the units that are reduced
from these two areas may be retained within Zone 7.

The City Attorney has determined that the Local Facilities
Management Plans are projects under CEQA and, therefore, will
be required to address all of the appropriate requirements.
As a result, the Environmental Impact Assessment Form - Part
I will be required to be made a part of the official Local

RE: CALAVERA HILLS
Further to our telephone conversation yesterday, I am putting my
queries in writing.
As you know, the Federal Assets Disposition Association (FADA) of
Dallas, Texas is accepting bids for 517.48 acres in Calavera
Hills, formerly owned by Cesco Development and acquired by Vernon
Savings & Loan under foreclosure procedures. I understand that
Zone 7 includes all of Calavera Hills which includes 280 acres
owned and developed by Pacific Scene, as well as the 517.48 acres
now under consideration. In order to make an intelligent bid we
need to know the status of the project in the planning process
and the allowable densities. Specifically, here are my questions:
(1) For the 517.48 acres of Calavera Hills formerly owned by
Cesco Development, how many dwelling units and of what
type will be allowed in total and how many have been allowed
for in villages T and U which are ready for final mapping?
Have tentative maps been approved for any of the other
villages?
(2) Is the project exempted from the building moratorium and can
building permits be pulled upon final mapping and
satisfaction of the local Facilities Management Plan?
(3) What is a good estimate of the time required fro the
Facilities Management Plan for Zone 7 to be developed and
approved?
I would appreciate receiving the information as soon as possible.

Dear Mr. Rutledge:
I have enclosed a copy of the Calavera Hills Master Plan which
should answer in part your query regarding how many dwelling
units and of what type will be allowed in total. Please remember
these are maximum possible, not guaranteed, numbers. Village T
has 466 units. Village U does not have a tentative map. Perhaps
you should be referring to Village Q which has 204 units and is
nearing the final map stage. The only other tentative map is L-
1.
There is no building moratorium. If you have a final map and a
fully mitigated City Council approved Local Facilities Management
Plan, you are eligible to receive building permits.
There is no good estimate as to when the Local Facilities
Management Plan for Zone 7 will be approved as it has yet to be
submitted. I would suggest you contact the consultant preparing
the plan, Mr. William N. Hofman, at (619) 438-1465, if you have
any further questions regarding this zone plan.

Enclosed are staff's comments regarding the Local Facilities
Management Plan for Zone 7, submitted April 12, 1988. It is
important to understand these are initial comments and are not
intended to be a complete review of the plan. The following
comments will be useful in preparing a plan for the City to
accept for technical review. Listed below are items that were
not included in the plan as submitted and which make it
unacceptable for technical review by the City. These items
include:
1. 200 scale vertical/horizontal cross sections of
circulation element roadways.
2. An accurate general plan map.
3. All environmental documentation performed in zone to
date.
4. A downstream analysis of drainage.
5. Map and name of service agency for water distribution,
along with a cost estimate for specific funding
analysis.
6. An analysis of Elm between 1-5 and El Camino Real and
at the 1-5 Interchange

Listed below are comments of a more minor nature, but they will
still have to be addressed in the final text.
1. Provide methodology documentation and specific finding
analysis for circulation.

5. Provide consultant's phone number and address on title
page.
Again, these comments are not meant to be a complete critique,
but are intended to enable you to prepare an acceptable Local

This is to advise you of our intentions to solicit and accept a
purchase contract from the list of buyers that have expressed an
interest in this project.
Following our acquisition in April, we were overwhelmed by the
interest shown by buyers/users/brokers which caused us to take
some additional time to consider the various sales opportunities.
We have now determined that it is in the best interest of the
project, the project owner, and for the City of Carlsbad,
California, to proceed with the sale of Villages "T" and "Q"
subject to the terms of the Purchase Agreement and Escrow
Instructions and the Site Development Agreement included
herewith.
We realize that the housing product developed on Villages "T" and
"Q" is critical to the success of those villages and to our
subsequent development of all the remaining tracts in Calavera
Hills Zone 7. Therefore, we are interested in selling to a
builder/developer that helps us to maintain a high degree of
value and city/community confidence in this and all subsequent
villages developed.
We consider our good working relationship with the City of
Carlsbad imperative to the overall success of this development.
We, therefore, specifically prohibit any inquiries of any nature
for any reason to the City from any and all potential
purchasers. Once we have totally executed a formal contract with
a purchaser, we will allow for that party to discuss this project
with the City in our or our engineers'/lawyers'/Planners'

Enclosed are staff's comments upon the primary technical review of
the Zone 7 plan. A date specific response to our input will ensure
a timely processing of the zone plan. Please address the following
comments.
1. Exhibit 2; add "Facilities" after "City Administrative",
add "quadrant" after "northeast".
2. Add General Condition No. 9, page 12; approval of this
plan does not constitute prior discretionary review for
projects within Zone 7. All future projects shall
undergo review per Title 21 of the Carlsbad Municipal
Code. The plan establishes the maximum allowable number
of residential units for facilities planning purposes
only. The plan does not guarantee any specific
residential density.
3. Page 11, item 4; change 1987 to 1986.
4. Exhibit 4; NE corner, identify OS.
5. Exhibit 14; footnote parentheses for future du's.

9. Exhibit 49; show performance versus constrained open
space.
10. Schools are a district wide concern. If schools do not
meet the standard in this zone, then no other zones in
the district meet the standard.
11. Sewer;
A. Use the accepted performance standard that has been
adopted in the previous zone plans word for word.
B. Propose to have a section describing the Calavera
Hills Reclamation Plan. Provide the information
such as date built, MGD capacity, and the type of
treatment, necessary upgrades and reclaiming
capabilities. This should almost be a specific
section within itself within the plan.
C. Under the same scenario there should be a separate
section describing the Vista/Carlsbad Interceptor.
This section should deal with percent capacities of
the two cities, the upgrades that are necessary and
when those upgrades are required. This zone does
impact the capacity of this interceptor.
D. Under mitigation, this plan proposes a pump station
in Phase 7(C) but the mitigation section does not
include the requirement to construct this pump
station and the estimated cost. Please provide this
information.
E. Combine charts.
12. Water;
A. Use the adopted performance standard used in the
previous zone plans.
B. Performance standards also include an analysis of
the ten day storage capacity. This analysis was not
in this plan.
C. Exhibit 60 - Some of the designations using the
legends are quite similar and hard to decipher.
Review the graphic and consider other legend
designations.
D. Combine some of these charts.

E. Include estimated costs for all water facilities and
itemized in the mitigation section.
13. Circulation;
A. The analysis indicates that construction of Cannon
road west of El Camino Real is assumed in 1990. If
this section is not built or not funded, this zone
therefore impacts El Camino Real to Palomar Airport
Road and possibly Palomar Airport Road to 1-5. Does
this zone propose to build Cannon Road west? If
not, provide analysis for El Camino Real and Palomar
Airport Road to 1-5.
B. The mitigation does not include a portion of Cannon
Road from College Boulevard to El Camino Real.
Please provide.
C. This zone also assumes Cannon Road from College to
El Camino Real is a two-lane collector in 1995.
Currently this is not funded and should be included
in proposed mitigation.
Staff expects response to our comments within 10 days. A follow
up meeting is scheduled for July 28, 1988 at 10:00 a.m. in this
office. At that time, draft conditions will be provided.

On July 14, 1988 City staff met with you regarding initial
comments on Local Facilities Management Plans for Zones 7. At
that time, a follow-up meeting was scheduled for July 28, 1988
with the understanding that a complete resubmittal addressing our
requirements would be made on July 25, 1988; thereby, allowing
review time prior to our July 28 meeting. No such resubmittal
has occurred.
Staff's ability to respond in a timely and concise manner, to
allow the plan to proceed forward in an expeditious fashion, is
predicated upon all parties maintaining agreed upon schedules.
Due to the intricate and complex nature inherent to these plans,
logic dictates a time specific focused approach to processing.
Your failure to resubmit in a timely fashion, agreed upon by all
parties, essentially adds another meeting date to our schedule
and delays the ultimate adoption of the plan.
If our timetable is unreasonably demanding upon your ability to
respond or unforeseeable contingencies have effected your
response time, then please communicate with this office your
present processing desires.

Dear Mr. Hunter:
This letter is written in response to your letter of July
26, 1988 regarding the processing of the Zone 7 Local
Facilities Management Plan. First of all, the statements
made in this letter regarding scheduling are incorrect and
need to be clarified. As you know, Sheila Donovan, Mark
Rael of Christensen and Associates and I were all in
attendance at the meeting of July 14, 1988. At no time
during or after this meeting was a July 25, 1988 submittal
deadline stated. In fact, the resubmittal date given to us
was July 28, 1988. We have met this deadline by recently
submitting the Zone 7 revisions. Had we been aware of a
July 25, 1988 submittal deadline, we would have responded
accordingly.
Secondly, the tone of your letter is very disappointing and
discouraging to us. We have worked diligently with your
staff to prepare the best Local Facility Management Plan
possible. We believe that a good working relationship has
been developed between our staffs and we wish to maintain
this. Letters such as the one you have written, especially
when based on inaccurate information, are not conducive to
a good overall working relationship. I would suggest that
a phone call at the time you believe a deadline is missed
would be more helpful and would allow earlier resolution of
any problem that may arise.

As shown in the enclosed Board Agenda Item of Carlsbad Unified
School District, the District is in the process of acquiring
the Junior High School site (20.06 acres) located in Zone 7
to the west of Calaveras Lake. Eventually, this school site
will front on College Boulevard on its western boundary.
This property is being acquired from Alltex Inc., 701 Palomar
Airport Road, Carlsbad, California 92009, through an agreement
which will exchange parcel tax and developer fee credit for
the land valuation, site preparation costs, and certain
off-site improvements. Any remaining parcel tax and developer
fees from Zone 7 will be applied to school construction on the
site. Additional new funding sources for school construction
will need to be addressed at a later stage in Zone Plan
development.
It should be noted that within Zone 7 there is currently Hope
Elementary School with a capacity of 600 students up on
Tamarack Avenue and the proposed Junior High School site.
These two sites should adequately meet school needs within
Zone 7.

BACKGROUND INFORMATION
The School Location Plan of July, 1982 initially reflected a Carlsbad Unified
School District junior high school located near the western end of Calaveras
Lake on the future route of College Boulevard. Later, in the adopted City of
Carlsbad Calavera Hills Project, this 20-acre school site became Village S in
the Plan. Since then, Calavera Hills has become Planning Zone 7 of the
Citywide Facilities and Improvements Plan.
CURRENT CONSIDERATIONS
For several months now, the District staff has been working with Lawrence
Whittington of Alltex, Inc., 701 Palomar Airport Road, Carlsbad, California,
regarding the dedication of the 20-acre College Boulevard school site to the
District. Alltex, Inc. will be completing the Zone 7 Master Plan and
completion of the Calavera Hills Project.
Essentially, the proposal is for the District to provide parcel tax/developer
fee credit for the value of the school site, site development work at cost, and
certain improvements to College Boulevard. Generally, it is similar to other
recent school site acquisition agreements within the District.
A map of the school site is contained in Exhibit A. A plat map and legal
description have not yet been received. Other documentation will be provided
at the Board meeting.
FINANCIAL IMPLICATIONS
Acquisition of a badly needed school site in the Tri-City/Calavera Hills area.
More information will be presented at the Board meeting.
RECOMMENDATION
It is respectfully recommended that the Board of Trustees accept the dedication
agreement for the College Boulevard Junior High School Site of 20 acres.
SUPERINTENDENTS RECOMMENDATION: Recommend approval of staff recommendation.

Does this section imply that the drain will be constructed by the
developer to be reimbursed from zone fees in Zone 14? At this time I am
not aware of any intent to use special assessment districts to pay for
storm drain construction, nor is the City prepared to carry the cost of

P113 -EXHIBIT 46 - FINANCING MATRIX
Circulation - The funding for the second and third phases of College
Boulevard are shown as being the responsibility of Zone 14 or adjacent
developers. Although this may be the case, where does the financing
come from if Zone 14 does not develop on schedule? Would Zone 7 halt
development to wait for nearby development to provide the road, or would
an assessment district or Mello-Roos district be proposed to solve the
problem? Are there existing agreements with Zone 14 or other property
owners securing the construction of the road? I would recommend that we
determine the second funding option in these cases. Exhibit 72, P4
shows the developer as the fall back funding method. We should show the
same here.
P148- EXHIBIT 67 - FINANCING MATRIX - SEWER
Although I understand some of the uncertainty in the timing and sequence
of improvements, I do not understand why we cannot specify the funding
source under each alternative. These improvements appear to be pri-
marily developer responsibilities. The funding option section should
indicate this in the first column. The same comment applies to Exhibit
71, P5 & 6.

specify the new deadlines which apply. The 90 days will end on March 26, 1989.
The latest City Council meeting date for approval of the Plan is thus March 21st.
If the Plan is submitted to us for Department Head Review by January 11, 1989,
it could be scheduled for Planning Commission hearing as early as February 15th.
This would allow ample time to hold the City Council hearing on or before March
21st. Submittal of the Plan for Department Head Review after January llth could
of course alter this schedule.
In either case, City staff will endeavor to review the Plan in a timely manner,
being mindful of the property owner's desire to see the Plan adopted as soon as

Subject: Sewer Facilities for the Zone 7 - LFMP.
Dear Lloyd:
Enclosed please find a summary of the proposed sewer mitigation
we are proposing for completion of the Zone 7 Local Facilities
Management Plan. We are requesting a meeting with you and Steve
Jantz to present our proposal in more detail, however, a summary
of our proposal is provided below for your review.
We feel that sewer facilities within Zone 7 are basically two
separate issues that can be addressed as follows: 1) Sewer
conditions as they apply to Villages Q (CT 83-32) and T (CT 83-
19) and 2) sewer facilities required as a condition of
development for the remaining villages in Zone 7.
Existing Facilities Within Zone 7
The Calavera Hills Water Reclamation Plant, located in Village H,
was built in 1981 to provide sewer service to Calavera Hills.
However, the plant has never been activated and will only become
operational if there is a capacity problem at Encina WFCF. At
present, the existing lift stations originally built to serve the
plant, now collect and convey sewerage through North Agua
Hedionda Interceptor to the Encina WFCF. Although the NAHI
currently serves all existing development within Zone 7, the
Sewer Master Plan shows the zone divided into three phases each
to be served by a different interceptor at build out as follows
(See Attached Exhibit "A"):
Phase A - Vista/Carlsbad Interceptor
Phase B - North Agua Hedionda Interceptor
Phase C - South Agua Hedionda Interceptor

Conditions of Approval for Q and T;
Tentative tract maps and Planned Development permits were
approved for Villages Q and T on September 4, 1984. The
conditions of these maps relating to sewer assumed that the
Calavera Hills Treatment Plan would ultimately provide sewage
treatment for the developments. As designed, the western portion
of Village Q would gravity flow to the existing Simsberry Lift
Station which would then pump sewer flows to an existing line in
Tamarack Avenue. This line flows down Tamarack to the west into
the North Agua Hedionda Interceptor (NAHI).
The eastern portion of Village Q and all of Village T would
gravity flow southward to a new lift station located in Village
W. This lift station would pump sewer flows up to Tamarack to
the west which would then gravity flow westward into the NAHI.
It was intended that this lift station service Q, T and other
villages in southeast Calavera Hills until a gravity line to
Cannon Road is ultimately built.
The City has indicated that its ultimate goal is to have all
projects gravity flow into ultimate interceptor lines. We concur
with this objective, however, we believe that temporary lift
stations as originally contemplated for Villages Q and T should
be allowed until ultimate lines are put in place. There are two
reasons for this:
1) The tentative maps for these projects have been
previously approved and designed to accommodate a
temporary system: and
2) The temporary system will not jeopardize the City's
ability to ultimately have all projects within Zone 7
gravity flow at the time the major sewer lines are
constructed (ie. Cannon road and the Vista/Carlsbad
Interceptor).
Future Facilities within Zone 7;
After Q and T, we understand that the financing for a gravity
line must be guaranteed prior to any final map approvals. The
special conditions that we would propose to ensure that this
happens are:
Special Conditions for Phase A;
With the exception of Villages Q and T, prior to the
recordation of any final map, issuance of building
permit or grading permit, whichever occurs first within
Phase A of Zone 7, the developers must provide a
financing mechanism guaranteeing the construction of a
gravity line from the existing Simsberry Lift Station
north to the Zone 7 boundary.
Development within Zone 7 will continue to use the existing Lift
Station until a connection through Zone 25 to the Vista Carlsbad
Interceptor is provided by the developers of Zone 25.
Condition of Approval for Phase C;
With the exception of Villages Q and T, prior to the
recordation of any final map, issuance of building
permit or grading permit, whichever occurs first within
Phase C of Zone 7, the developers must provide a
financing mechanism guaranteeing the construction of a
gravity line from the new pump station south to the
Zone 7 boundary.
Conditions of Approval for Phase B;
There are no special conditions for Phase B. Existing
facilities are in place to serve this area.

Regarding Zone 7, our records indicate that Alltex, Inc. is the property owner
responsible for preparing the Local Facilities Management Plan. Recently you
have indicated that William Lyon Co. is now the property owner. If this is true,
staff needs the following:
1. A letter from Alltex indicating that they have
no further interest in the property.
2. A letter from William Lyon Co. stating that they
assume responsibility for costs of city review
and processing of the plan and that HPA will continue
as the consultant for the plan.
The following is a corrected schedule for adoption of the plan. Staff had
previously indicated that we needed the plan by January llth for department head
review. However, the department head review was completed several months ago.
Therefore, the following timeline is recommended:
Submit 4 copies of revised draft as soon as possible for
final review by Growth Management staff.
Submit 25 copies by January 31st for Planning Commission
Public Hearing, to be held on February 15th.
Submit final 25 copies by February 24th for City Council
Public Hearing to be held on March 14th or March 21st.
As indicated in the above schedule, this zone plan must be noticed for public
hearing by February 1, 1989. Therefore, a completed plan must be submitted, or
the plan must be withdrawn, before February 1st. Otherwise, staff will have no
choice but to notice the plan for denial.
Staff believes this schedule is realistic, but of course it is subject to delay
due to unforeseen factors. In order to adhere to this schedule, it is important
that all required changes be made expeditiously.

Subject: Sewer Mitigation for the Zone 7 - LFMP.
Dear Phil:
This letter is in response to your telephone conversation with
Bill Hofman on February 23, 1989, regarding a meeting with the
City to resolve the Sewer mitigation for the Zone 7 - LFMP. Per
your request, this letter indicates our recommendation for the
mitigation of sewer impacts within Zone 7. We feel that the
mitigation shown below is a equitable solution to the sewer issue
within Zone 7. Specifically, the mitigation takes into account
the property owner's rights under existing sewer agreements (Lake
Calavera Hills' Associates and the City of Carlsbad, January 20,
1982 and Lake Calavera Hills Associates and Cedric E. Sanders,
October 14, 1982) and the City's build out requirements per the
Sewer Master Plan.
We are requesting a meeting with you and Steve Jantz to discuss
our proposal in more detail, however, a summary of our proposal
is provided below for your review.
Existing Facilities Within Zone 7
The Calavera Hills Water Reclamation Plant, located in Village H,
was built in 1981 to provide sewer service to Calavera Hills.
However, the plant has never been activated and the City has
indicated it will only become operational if there is a capacity
problem at Encina WFCF or it becomes economically feasible to
operate. At present, the existing lift stations originally built
to serve the plant, now collect and convey sewerage through the
North Agua Hedionda Interceptor to the Encina WFCF. Presently,
however, the NAHT1A located along Tamarack Avenue within Zone 7,
is at capacity and will need to be replaced prior to any further
development within Zone 7. In addition, the NAHT1B (Kelly Drive)
is close to capacity and may need upsizing in the near future.

Although the NAHI currently serves all existing development
within Zone 7, the Sewer Master Plan shows the zone divided into
three phases each to be served by a different interceptor at
build out as follows:
Phase A - Vista/Carlsbad Interceptor
Phase B - North Agua Hedionda Interceptor
Phase c - South Agua Hedionda Interceptor
Phased Development Within Zone 7
As designed per the Master Plan, Village Q located within Phase A
of Zone 7, would gravity flow to the existing Simsberry Lift
Station which in turn, pumps sewer flows to the existing NAHT1A
line at Tamarack and Elm Avenue. This line flows down Tamarack
to the west into the North Agua Hedionda Interceptor (NAHI) . As
previously indicated, the NAHT1A is currently at capacity and the
NAHT1B may need to be upsized in the near future.
The eastern portion of Village Q and all of Village T would
gravity flow southward to a new lift station located in Village
W. This lift station would pump sewer flows up to the existing
NAHI near Tamarack and Elm.
The City has indicated that its ultimate goal is to have all
projects gravity flow into the V/C, SAHI and NAHI facilities. We
concur with this objective, however, we believe that temporary
lift stations as originally contemplated and required per the
Master Plan for Villages Q and T should be allowed until build
out sewer facilities are put in place. There are two reasons for
this:
1) The tentative maps for these projects have been
previously approved and designed to accommodate a
temporary system; and
2) The temporary system will not jeopardize the City's
ability to ultimately have all projects within Zone 7
gravity flow at the time the major sewer lines are
constructed (ie. SAHI and the Vista/Carlsbad
Interceptor).
Based on the discussion above, we believe the following
mitigation measures adequately address the city's needs and
resolves our concerns for the Zone 7 - LFMP.
Special Conditions for Zone 7;
1. Prior to occupancy for any development within Zone 7,
adequate trunk line capacity must be available in the
NAHT1A.
2. Prior to occupancy for any development within Zone 7,
adequate trunk line capacity must be available in the
NAHT1B.
Financing:
The cost for construction of the NAHT1A ($300,000) and
the NAHT1B ($360,000) will be financed by the
developers in Zone 7. However, the developers of Zone
< 7 will be subject to total reimbursement for both the
NAHT1A and NAHT1B by other development served by these
facilities and through sewer fee credits.
Special Conditions for Phase A:
1. Prior to the recordation of any final map, issuance of
building permit or grading permit, whichever occurs
first within Phase A of Zone 7, the developers must
provide a financing mechanism guaranteeing the
construction of a gravity line from the existing
Simsberry Lift Station north to the Zone 7 boundary. -7
Development within Zone 7 may continue to use the
existing lift station until a connection through Zone
25 to the Vista/Carlsbad Interceptor is provided by the
developers of Zone 25.
Financing;
The cost of financing the gravity line to the Zone 7/25
boundary shall be reimbursed to the developers of Zone
7 in the form of sewer fee credits.
Phase C;
Special Conditions
1. Prior to the recordation of the final map for Villages
Q and T, within Phase C of Zone 7, a financing plan
shall be in place guaranteeing the construction of the
following facilities:
a. Pump station to be located within Village W.
b. Gravity lines to pump station from proposed
development.
c. Force main from pump station to existing NAHT near
Tamarack and Elm.
2. Except for Villages Q and T, prior to the recordation
of any final map, issuance of grading or building
permit, whichever occurs first, for any development
within Phase C of Zone 7, a financing plan shall be in
place guaranteeing the construction of the SAHT2B and
SAHT2C.
,-—Financing;
The financing plan for the construction of the SAHT2B
and SAHT2C may be in the form of a fee program that
would guarantee funding for these facilities at a
future date or through the formation of an assessment
district.
The estimated cost for construction of all facilities
is $732,000. If financing is provided by the
developers of Phase C, they will be subject to
reimbursement for both the SAHT2C and SAHT2B by future
development in other zones that are served by these
facilities.

A. Construction of a temporary pump station to
service all units in Phase C that can gravity flow

C. Yearly operational and maintenance costs for the
temporary pump station.
D. Removal of the temporary pump station and
restoration of the pump station site upon

RE: LFMP ZONE 7 - TRAFFIC
This is in response to your letter dated May 24, 1989 regarding the I.C.U.
analysis of the College Boulevard and Elm Avenue intersection.
The I.C.U. analysis of this intersection was not completed in accordance with
City guidelines. The issue arose when a SANDAG traffic model computer run
indicated that the stretch of College Boulevard between Elm Avenue and Lake
Boulevard is projected to be running approximately 42,000 trips per day. In
accordance with the City's Circulation Guidelines Manual, this road segment is
anticipated to be operating at a Level of Service E which is unacceptable.
A second level of analysis is required to be conducted on the entire road
segment. This analysis must also take into consideration the following
intersections:
1) College and Elm
2) College and Tamarack (4 leg intersection)
3) College and Tamarack ("T" intersection)
As the zone plan is currently written, there exists an unacceptable L.O.S. with
the College Boulevard link at buildout. The second level of analysis may
determine that the proposed traffic will be accommodated within major arterial
design standards. If not, then appropriate mitigation must be determined.

This letter is to serve as a synopsis of our meeting yesterday on the Zone 7
Local Facilities Management Plan. It also includes technical comments from Mr.
Jantz on the necessary corrections to the Engineering sections.
Nontechnical issues to be addressed include:
1. Please provide park threshold date on public facilities summary
chart, -Staff is aware that the threshold date is based solely on
developer projected phasing when compared to the performance
standard. When development occurs the threshold date will be
adjusted, if necessary, through monitoring.
2. On the property owners list, clarify difference between assessor
information and gross acreage. Update assessor parcel number for
Treetops, Ltd.
3. Buildout projections need to explain reliance on Master Plan over
existing General Plan.
4. Exhibit 13 - Discretionary action for L-l is SDP 85-13.
5. Exhibit 17 - Correct number for Zone 15. Carry down existing number
to total for Zones 18 and 25.
6. Exhibit 18 - Correct number for Zone 15 and Proposition E quadrant

The purpose of this letter 1s to respond to request for the City to toll
CT 83-32 and CT 83-19, Calavera Hills Villages Q and T.
The consideration to toll these maps Is a result of the City's decision to
pause on the processing of projects while it completes the necessary finanr^
program to guarantee needed Infrastructure as identified by the Growth
Management Plan. The City has taken the lead to create a comprehensive
financing program which can be Implemented consistently throughout the City.
This financing requirement imposed by the City makes 1t Impractical , process
CT 83-32 and CT 83-19 until the City Council has adopted Its comprehensive
financing plan. Due to this situation, the City has decided to toll these
maps from January 10, 1989 when the City Council took action to prepare a
comprehensive financing program. Tolling will continue until the City Council
approves a comprehensive dtywlde financing approach or January 1, 1990,
whichever occurs first. At that time, these maps will have 256 c - remaining
to be processed.
The processing of CT 83-32 and CT 83-19 will be stopped until this action is
taken or January 1, 1990. In the meantime, the completion of the Local
Facilities Management Plan for Zone 7 should be your utmost concern. itil
this plan 1s adopted by the City Council and the specific conditions met,
these maps will not be Hnaled.

sections. The Circulation section incorporates the findings from
the College Boulevard traffic analysis prepared by Weston Pringle
and Associates. The traffic analysis can be found in the
appendices.
The Northeast Quadrant Hydrology study prepared by Dr. Howard
Chang was submitted to Lloyd Hubbs on July 27, 1989. The
findings of the report have been incorporated into the Drainage
Section of the Zone 7 - LFMP.
It is our understanding that we will receive final comments and a
Planning Commission date upon completion of the Department Head

GENERAL CONDITIONS FOR ZONE 7
LFMP 89-7
1. All development within Zone 7 shall conform to the provisions
of Section 21.90 of the Carlsbad Municipal Code and to the
provisions and conditions of this Local Facilities Management
Plan.
2. All development within Zone 7 shall be required to pay a
public facilities fee pursuant to the standards adopted by
the City Council on July 28, 1987, and as amended from time
to time and all other applicable fees. Development in Zone
7 shall also be responsible for any additional fees to be
incorporated into this plan that are found to be necessary to
enable facilities to meet the adopted performance standard.
3. The City of Carlsbad shall monitor all facilities in Zone 7
pursuant to Subsections 21.90.130(c), (d) and (e) of the
Carlsbad Municipal Code.
4. All development in Zone 7 shall be in conformance with the
adopted Citywide Facilities and Improvements Plan as adopted
by City Council Resolution 8797 on September 23, 1986.
5. Periodic amendment to the Zone 7 Local Facilities Management
Plan is anticipated to incorporate newly acquired data, to
amend conditions and upgrade standards as determined through
the required monitoring program. Amendment to this Plan may
be initiated by action of the Planning Commission, City
Council or property owners at any time.
6. If a public facility or service is found not to be in
conformance with an adopted performance standard during the
yearly monitoring, or at any other time, the matter will be
immediately brought before the City Council. If the City
Council determines that a non-conformance does exist then no
future building or development permits shall be issued unless
an amendment to the CFIP or the LFMP for this zone is
approved by the City Council which addresses those facility
shortfalls and brings those facilities into conformance with
the adopted performance standards.
7. After adoption of this Plan by the City Council, no building
permits will be allowed unless the performance standards are
complied with.
8. Approval of this LFMP does not constitute prior environmental
review for projects within Zone 7. All future projects within
Zone 7 shall undergo environmental review per Title 19 of the
Carlsbad Municipal Code. Any mitigation measures determined
during a project's environmental review shall be complied with
in their entirety unless findings of overriding consideration
are made by the City Council.
9. Approval of this plan does not constitute prior discretionary
review for projects within Zone 7. All future projects shall
undergo review per Title 21 of the Carlsbad Municipal Code.
The plan establishes the maximum allowable number of
residential units for facilities planning purposes only. The
plan does not guarantee any specific residential density.

CITY ADMINISTRATIVE FACILITIES

WASTEWATER TREATMENT CAPACITY
The following actions shall be pursued jointly by each sewer
district to ensure adequate wastewater treatment capacity through
the year 2000:
A. Monitor Encina treatment plant flows on a monthly basis to
determine actual flow rates and to have an early warning of
capacity problems.
B. Actively pursue acceleration and phasing of treatment plant
Phase IV expansion to provide adequate capacity.
C. The six member agencies shall form an agreement to maximize
the utilization of available treatment capacity at Encina
WPCF.
PARKS
A. All development shall pay Park-in-Lieu Fees and Public
Facility Fees for Park District 2.
B. No residential development shall be allowed after 1992 unless
actions have been taken by the City to construct additional
park facilities.
DRAINAGE
A. All future development in Zone 7 will be required to construct
any future Zone 7 storm drain facilities identified in the
current Drainage Master Plan and revised Drainage Master Plan
as determined by the City Engineer. Any facilities necessary
to accommodate future development must be guaranteed prior to
the recordation of any final map, issuance of a grading permit
or building permit, for any development requiring future storm
facilities in Zone 7.
B. Prior to the recordation of the final map, issuance of grading
permit or building permit, whichever occurs first for any
specific village within Zone 7, the developers of that project
are required to:
1. Pay the required drainage area fees established in the
current Drainage Master Plan and;
2. Execute an agreement to pay any drainage area fees
established in the forthcoming revised Master Drainage
Plan.
C. WATERSHED A
1. Prior to the recordation of the first final map, issuance
of grading permit or building permit, whichever occurs
first within Watershed A of Zone 7, the developers are
required to financially guarantee the construction of the
36" continuation of the storm drain in College Boulevard
northerly into the City of Oceanside.
D. WATERSHED B
1. Prior to the recordation of the first final map, issuance
of grading permit or building permit, whichever occurs
first within Watershed B of Zone 7, the developers are
required to financially guarantee the construction of the
following storm drain facilities:
a. 30" storm drain (BF) crossing into Zone 14 from Zone
7B.
b. 30" storm drain crossing College Blvd.
c. 36" storm drain (BH-1) crossing into Zone 14.
d. 48" and 42" storm drains (BE) adjacent to Tamarack
Avenue.
2. Prior to recordation of the first final map, issuance of
a grading or building permit within Watershed B of Zone
7, the developers are required to guarantee Zone 7' s
proportional share of the following facilities to the
satisfaction of the City Engineer:
a. Sediment detention basin approximately 1-2 acres in
size to be installed in Zone 14 upstream of Rancho
Carlsbad Mobile Home Park.
b. Restoration by dredging and lining of approximately
3,500 feet of Agua Hedionda Creek from the Calavera
Lake Creek to El Camino Real bridge.
c. Provide a mechanism for the maintenance of the
sediment detention basin.
Prior to issuance of any building permits for dwelling
units draining south into Agua Hedionda Creek within
Watershed B of Zone 7, the sediment detention basin and
restoration of Agua Hedionda Creek shall be provided.
CIRCULATION
A. An on-going monitoring program shall be established to
evaluate the aspects of improvements, development, and demand
on circulation facilities. The required timing of
improvements is based upon the projected demand of development
in the zone and the surrounding region. This timing may be
modified without amendment to this plan, however, any
deletions or additions to the improvements will require
amending this local plan.
B. Prior to the approval of any tentative map for any future
development within Zone 7, except for Villages Q, T and LI,
the specific alignment for College Boulevard between Elm
Avenue and Cannon Road must be established. This shall
include the necessary environmental clearances and required
public hearings so that construction of College Boulevard can
accommodate future development. The funding for the
construction of College Boulevard will be guaranteed as
provided by Condition C below.
C. Prior to the recordation of the first final map, issuance of
grading permit or building permit, whichever occurs first,
within Zone 7, a comprehensive financing program guaranteeing
construction of the following circulation improvements shall
be approved:
1. IMPROVEMENTS NEEDED NOW
No improvements are needed.
2. IMPROVEMENTS NEEDED BY 1990
a. College Boulevard
College Boulevard from Elm Avenue to Lake Boulevard
shall be constructed to include the following
improvements:
1. Complete grading to ultimate right-of-way width
to major arterial standards.
2. Construction of four through travel lanes
including a fully landscaped median.
3. Improvement of Elm/College intersection to

any water reclamation facilities as identified in the future
Water Reclamation Master Plan as determined by the City
Engineer. Any water reclamation facilities necessary to
accommodate future development must be guaranteed prior to the
recordation of a final map, issuance of a grading permit or
building permit, whichever occurs first for any project in
Zone 7.
B. SERVICE AREA A
1. Water facilities will be provided at the time of
development to the satisfaction of CMWD. The existing
pressure reducing and pumping station at the intersection
of College Boulevard and Elm Avenue and the transmission
lines from this station to the existing 6.0 MG TAP
reservoir are installed.

III. DISCUSSION OF ENVIRONMENTAL EVALUATION
The Local Facilities Management Plan for Zone 7 is a facilities
planning document, the intent of the plan is to establish parameters
and thresholds that assure public facilities are available when
needed as determined by the City's adopted performance standards. To
accomplish this purpose occasionally locations and costs of public
facility improvements are estimated for informational purposes.
These estimates may result in increased development fees.
Traditionally the developer in maximizing their capital return passes
such fees on to the home buyer or tenant. This results in higher
priced housing which affects the availability of low and moderate
income housing. However, as real estate value is determined
primarily by location, without other market incentives, it is
unreasonable to assume the subject property would be developed with
either low or moderate income housing due to its view proximity to
the Pacific Ocean.

It is not the development fee that will force low and moderate income
families into other communities, but the existing nature of the
market place.
It is recognized that CEQA review for these public facilities
estimates is general, and does not satisfy CEQA requirements for the
specific project. The Zone 7 Local Facilities Management Plan
requires complete CEQA review prior to initialization of any public
or private project discussed in the Local Facilities Management Plan.

I. RECOMMENDATION
That the Planning Commission ADOPT Resolution No. 2936 recommending APPROVAL of
the Negative Declaration issued by the Planning Director and ADOPT Resolution
2937 recommending APPROVAL of Local Facilities Management Plan 7.
II. PROJECT DESCRIPTION AND BACKGROUND
As shown on Exhibit "A" Zone 7 is located in the northeastern quadrant of the
City adjacent to the southern edge of the City of Oceanside.
As shown on Exhibit "B" Zone 7 is primarily residential. Of the Master Plan's
819 total acres 744 are residential. General Plan residential densities range
from low (0-1.5 du/ac) to medium-high (8-15du/ac). Nonresident!al General Plan
land uses include the 18 acre Calavera Hills Park and 11.3 acres of Commercial.
III. ANALYSIS
1. . Does the proposed Local Facilities Management Plan for Zone 7 fulfill the
purpose, intent, and specific requirements of Section 21.90 of the Carlsbad
Municipal Code (Growth Management Program)?
2. Is the Local Facilities Management Plan for Zone 7 consistent with and
does it implement the 1986 Citywide Facilities and Improvement Plan?
DISCUSSION
The Growth Management Program requires that a Local Facilities Management Plan
be prepared for each Management Zone in order to show how compliance will be
maintained with the City's adopted public facility performance standards as
development occurs.

The first step in this process requires determining the buildout development
potential in the zone. The buildout projection for this zone is consistent with
the methodology contained in the 1986 Citywide Facilities and Improvements Plan
and the provisions of Proposition E which was approved by the citizens of
Carlsbad on November 4, 1986.
The 1984 Master Plan for Calavera Hills approved up to 3,863 dwelling units on
the property. When the Growth Management Control Points are applied to the net
developable acreage of the General Plan density ranges for the approved Master
Plan, the maximum number of allowable units is lowered to 2,333. It is
recognized that this number is being used for facilities planning purposes only
and is in no way guaranteed.
The plan phases the buildout development of the zone based on estimates of yearly
development activity. The phasing estimate is consistent with generalized
phasing assumptions used in the 1986 Citywide Facilities and Improvement Plan.
From these buildout and phased development projections, yearly phased demands
for public facilities may be projected and buildout demands identified. The plan
analyzes eleven (11) public facilities. This analysis compares the projected
public facility demands with the available and planned supply of public
facilities to ensure compliance with the adopted performance standards. Where
demands for facilities exceed supply, the plan proposes the necessary mitigation
to maintain conformance with the standard. This analysis is consistent with both
the 1986 Citywide Facilities and Improvement Plan and the Growth Management
Program.
The following chart provides a brief summary of the eleven public facilities
analyzed in the plan.

IV. ENVIRONMENTAL REVIEW:
The Local Facilities Management Plan for Zone 7 is a public facilities planning
document. The plan establishes parameters that ensure Carlsbad's public facility
performance standards are met and public facilities inadequacies mitigated to
accomplish this goal. The plan for informational purposes occasionally estimates
locations and costs of public facility improvements. The plan fully recognizes
that complete environmental review will be necessary once specific public
facility improvements are established.
Therefore, the Local Facilities Management Plan for Zone 7 will not cause any
significant environmental impacts and a Negative Declaration has been issued by
the Planning Director on August 19, 1988.

III. DISCUSSION OF ENVIRONMENTAL EVALUATION
The Local Facilities Management Plan for Zone 7 is a facilities
planning document, the intent of the plan is to establish parameters
and thresholds that assure public facilities are available when
needed as determined by the City's adopted performance standards. To
accomplish this purpose occasionally locations and costs of public
facility improvements are estimated for informational purposes.
These estimates may result in increased development fees.
Traditionally the developer in maximizing their capital return passes
such fees on to the home buyer or tenant. This results in higher
priced housing which affects the availability of low and moderate
income housing. However, as real estate value is determined
primarily by location, without other market incentives, it is
unreasonable to assume the subject property would be developed with
either low or moderate income housing due to its view proximity to
the Pacific Ocean.

It is not the development fee that will force low and moderate income
families into other communities, but the existing nature of the
market place.
It is recognized that CEQA review for these public facilities
estimates is general, and does not satisfy CEQA requirements for the
specific project. The Zone 7 Local Facilities Management Plan
requires complete CEQA review prior to initialization of any public
or private project discussed in the Local Facilities Management Plan.

IV. DETERMINATION (To Be Completed By The Planning Department)
On the basis of this initial evaluation:

the environment, and a NEGATIVE DECLARATION will be prepared.
