Description/Explanation: The proposed project involves the following: • General Plan Amendment - to allow RMH, RM, RLM and N land uses, and to modify the boundaries of the OS designation to be more closely in conformance with the actual limits of steeply sloping and vegetation areas. • Zone Change - to eliminate the P-C zoning over the property and replace it with zones corresponding to the above-referenced land uses, including R-l, RD-M, C-l and OS. • LCP Amendment - to eliminate the Mello II LCP Land Use requirement for a master plan, and to modify the land uses in accordance with the requests above. • Tentative Subdivision Map - a request for a 179-lot subdivision over 174 acres involving Planning Areas D, F, G, H, I, J, and K of old Kelly Ranch. • Coastal Development Permit - a request for coastal development permit in accordance with the tentative subdivision map. • Hillside Development Permit - a request for a hillside permit for the subdivision in accordance with Hillside Ordinance requirements. • Zone 8 Local Facilities Management Plan Amendment - proposed modifications to the approved Zone 8 LFMP to bring the document up-to-date relative to the modified Kelly plans and updated public facility information. This amendment was determined to be necessary to provide analysis and approval of modified facilities programs for the Parks, Circulation and Sewer Collection sections of the Zone 8 Plan. Our proposed amendment has been reviewed by Staff and is now ready for action by the Planning Commission and City Council. Three property owners exist within Zone 8, Kelly Land Company, Kirgis Trust, and the City of Carlsbad. We have tried for several months to receive written agreement to proceed with this amendment from the Kirgis Trust. Mr. Charles Kirgis was provided a copy of the amendment on July 8, 1998. We have assured him that Kelly Land Company is providing full funding for the professional tasks necessary to prepare the amendment. To date, we have not received any response from Kirgis on this matter. In compliance with Section 21.90.120(d) of the Carlsbad Municipal Code, Kelly Land Company hereby requests that the City Council permit Kelly Land Company to prepare the subject Zone 8 Local Facilities Management Plan Amendment on behalf of the Zone 8 landowners. Open items include verification from the WD regarding water and sewer projects, as well as the financing for Cannon Road. Cannon Road financing is still in the works, and we felt it best to wait until that issue is clarified since it is a key factor with regards to this development. David Mauser and Lloyd are working out the specifics with Larry Clemens, and I believe the Leadership Team will be briefed at some point prior to inclusion in the Financing Plan. That's all for now.! Larry Clemens, dated March 23, 1998. We compared data and conclusions in the report to the capacity of the existing sewer system and proposed improvements to the sewer system. Following are our comments: We note that "Table I-L: Zone 8 Sewage Generation" does not match the EDU's and Phasing listed in the table shown in ATTACHMENT B. We are assuming that the table in ATTACHMENT B is correct. ATTACHMENT B shows that at buildout Kelly Ranch will be 963 EDU's, and the "Park" will be 800 EDU's. We assume the "Park" is the future Veterans Park. The old master plan for the park states that it may include a conference center, cultural arts center, amphitheater, and tennis center. It appears that the 800 EDU's for the Park are excessive. Is there any information to support the estimate of 800 EDU's? It is requested that this information be presented if known. The report correctly states that the Kelly Ranch project Planning Areas D, G, H, I, J, K,L,M, N are entirely tributary to the South Agua Hedionda Interceptor Sewer (SAHI). However, not all portions of the SAHI will be constructed in the time required to meet all phases shown for these Kelly Ranch Planning Areas. Currently, the District is completing the environmental documentation through the City Planning Department on the sewage lift station and forcemain for SAHI. These facilities will complete SAHI along Cannon Road. The design of these facilities are scheduled to occur in Fiscal Year 1998/99. Construction is planned to occur beginning in 1999/2000, with completion in 2001. However, the Kelly Ranch phasing shows that it will be at buildout in 2001. Subsequent phases of the Kelly Ranch development beyond serving Planning Area "E" are uncertain. The report states that development of Phases I through IV (1998-2000) will not generate sewage at a rate that requires construction of SAHI. From this statement the report assumes that there is sufficient capacity in the North Agua Hedionda Interceptor Sewer to accommodate the project at buildout. However, the report did not correctly account for all the future EDU's committed to the North Agua Hedionda Interceptor Sewer. Based on the resulting flow rate of 0.9 mgd, we do not concur that there is adequate capacity in the North Agua Hedionda Interceptor Sewer for all phases of Kelly Ranch. 5. Those developments tributary to the North Agua Hedionda Interceptor Sewer have a higher priority compared to developments out of this sewer basin. The developments tributary to the North Agua Hedionda Interceptor include Calavera Hills Village "Q", Rancho Real, and Kelly Ranch Area "A" and Area "C". It is noted that Calavera Hills Village "T" is tributary to the SAHI. 6. In 1997, the District evaluated the theoretical flow rate currently tributary to the existing North Agua Hedionda Interceptor Sewer and compared that estimate to the capacity of the sewer pipeline and the Foxes Lift Station. Foxes Lift Station pumps all sewage tributary to the North Agua Hedionda Interceptor Sewer. From the analysis it was concluded that approximately 0.5 mgd of additional capacity remains. This flow rate equates to an additional 1100 EDU's, approximately, that can be accommodated above the existing number of connections. 7. The North Agua Hedionda Interceptor Sewer is under high ground water and infiltration and inflow occurs. This situation can contribute to conditions that may reduce its available capacity. Therefore, it may be warranted to meter the flow in the sewer pipeline to verify its remaining capacity. Based on our review, the Kelly Ranch Phases I and II for Planning Area "E" can be accommodated prior to completion of SAHI. The remaining phases and Planning Areas will need to be evaluated on a case by case basis. Sincerely, William E. Plummere February 26, 1998 TO: ASSOCIATE ENGINEER CHRISTER WESTMAN FROM: Associate Engineer Steven Jantz ZONE 8 LFMP AMENDMENT The following reflect comments and issues with the contents of the Zone 8 LFMP Amendment based on reviews by David Mauser, Mike Shirey and myself: 1. In my opinion, the document does not sufficiently analyze the impacts of future development within the influence area of Zone 8. The majority of the analysis is based on the predication that since the revised densities is less than the approved LFMP, that the previous findings of no impact still apply. However, there has been considerable amount of changes in the past 10 years with increases of surrounding development, future development potential with adjacent and near properties, capacity limitations with existing support infrastructure and the adoption of various funding mechanisms that shed new light on the facility adequacy findings. The basis of most of the chapters is a comparison to the predictions and resulting conditions of the previous LFMP. As we all know, the projections for Zone 8 development, as well as the content and development horizon surrounding properties, many of the original assumptions need complete updating. Short term projection of Zone 8 development plus the addition of new existing and future development must be developed in order to fully analyze the impacts of incremental development and the determination of threshold limits. Each individual chapter should begin evaluation with current data and justified based on the performance standard. Each chapter should be able to verify that either no impacts occur or identify the threshold limitation where mitigation is required to ensure conformance with the performance standard. These statements and threshold limits are the basis for the establishment of conditions for public facility construction. 2. The format for LFMP's required the development of a building projection chart estimating the yearly development of not only Zone 8 but the surrounding land parcels in order to accurately determine the public facility threshold limits. This evaluation is the most important element hi the determination of facility demand. The LFMPA submittal does not include such an analysis. 3. The approved Zone 8 LFMP is still in effect and the condition that a finance plan guaranteeing the construction of all identified deficiencies must be approved by the Council prior to recordation of the first final map within the zone. Certain improvements are currently guaranteed with the payment of fees. However, those infrastructure improvements that are developer responsibilities must be financially guaranteed in an approved finance plan. 4. As outlined in item 1 above, based on the determination of threshold limits, timing of construction and ultimate financial arrangements can be made to coincide with anticipated demand increases. I did not itemize the corrections and comments recommended in the LFMPA submittal. I have attached a copy of Dave Hauser's memo and the marked up version of the Zone 8 LFMP(A). I think the comments and suggested revisions in the document are self explanatory and should be used to begin discussions on the final analysis of impacts. These subsequently result in increases in the emission of carbon monoxide, reactive organic gases, oxides of nitrogen and sulfur, and suspended particulates. These aerosols are the major contributors to air pollution in the City as well as in the San Diego Air Basin. Since the San Diego Air Basin is a "non-attainment basin", any additional air emissions are considered cumulatively significant: therefore, continued development to buildout as proposed in the updated General Plan will have cumulative significant impacts on the air quality of the region. To lessen or minimize the impact on air quality associated with General Plan buildout, a variety of mitigation measures are recommended in the Final Master EIR. These include: 1) provisions for roadway and intersection improvements prior to or concurrent with development; 2) measures to reduce vehicle trips through the implementation of Congestion and Transportation Demand Management; 3) provisions to encourage alternative modes of transportation including mass transit services; 4) conditions to promote energy efficient building and site design; and 5) participation in regional growth management strategies when adopted. The applicable and appropriate General Plan air quality mitigation measures have either been incorporated into the design of the project or are included as conditions of project approval. Operation-related emissions are considered cumulatively significant because the project • is located within a "non-attainment basin", therefore, the "Initial Study" checklist is marked "Potentially Significant Impact". This project is consistent with the General Plan, therefore, the preparation of an EIR is not required because the certification of Final Master EIR 93-01, by City Council Resolution No. 94-246, included a "Statement Of Overriding Considerations" for air quality impacts. This "Statement Of Overriding Considerations" applies to all subsequent projects covered by the General Plan's Final Master EIR, including this project, therefore, no further environmental review of air quality impacts is required. This document is available at the Planning Department. CIRCULATION: The implementation of subsequent projects that are consistent with and included in the updated 1994 General Plan will result in increased traffic volumes. Roadway segments will be adequate to accommodate buildout traffic; however, 12 full and 2 partial intersections will be severely impacted by regional through-traffic over which the City has no jurisdictional control. These generally include all freeway interchange areas and major intersections along Carlsbad Boulevard. Even with the implementation of roadway improvements, a number of intersections are projected to fail the City's adopted Growth Management performance standards at buildout. To lessen or minimize the impact on circulation associated with General Plan buildout, numerous mitigation measures have been recommended in the Final Master EIR. These include 1) measures to ensure the provision of circulation facilities concurrent with need; 2) provisions to develop alternative modes of transportation such as trails, bicycle routes, additional sidewalks, pedestrian linkages, and commuter rail systems; and 3) participation in regional circulation strategies when adopted. The diversion of regional through-traffic from a failing Interstate or 11 Rev. 03/28/96 State Highway onto City streets creates impacts that are not within the jurisdiction of the City to control. The applicable and appropriate General Plan circulation mitigation measures have either been incorporated into the design of the project or are included as conditions of project approval. Regional related circulation impacts are considered cumulatively significant because of the failure of intersections at buildout of the General Plan due to regional through-traffic, therefore, the "Initial Study" checklist is marked "Potentially Significant Impact". This project is consistent with the General Plan, therefore, the preparation of an EIR is not required because the recent certification of Final Master EIR 93-01, by City Council Resolution No. 94-246, included a "Statement Of Overriding Considerations" for circulation impacts. III. PROJECT DESCRIPTION AND BACKGROUND The Zone 8 Local Facilities Management Plan was originally adopted in February 1989. Since that time little activity had occurred in Zone 8 until recent approvals for Kelly Ranch Village "E". The amendment will revise the assumptions of the four identified sections (parks, water, circulation, and sewer) of the plan in accordance with the changes incurred by the approval of Village "E". The remaining sections are unaffected. ANALYSIS Facilities Plan Amendment The proposed Zone 8 Local Facilities Management Plan (LFMP) amendment is to reflect a reduction in land use density. Specifically, the 1989 LFMP projected 1,224 dwelling units within Zone 8 at buildout. This amendment projects 1,153 dwelling units (du) which is a reduction of 71 du. The reduction in units is as a result of approving 144 du in Village "E" versus the 215 du projected in the LFMP. The amended zone plan is based on an estimation of potential development capacity per existing ordinances and constraints. The table above provides a summary of the Zone 8 requirements and sources of funding. Following is a brief analysis of each of the three sections of the LFMP which have been modified. Parks There currently exists a demand for 77.3 acres of park within Park District 1 (Northwest Quadrant) and there is an existing supply of 81.9 acres. The existing surplus is 4.6 acres. The buildout demand is projected at 108.2 acres and buildout supply projected at 160.4 which will be LFMP 87-08(A) - KELLY RANCH December 16, 1998 Page 3 a 52.2 acre surplus. Park facilities will be satisfied through the payment of park-in-lieu fees and public facilities fees. Water The Carlsbad Municipal Water District master plan updated in 1997 identifies sources and capacity for water supplies throughout Zone 8. The updated master plan has determined that the Evans Point water tank is no longer necessary because water supply and storage is available elsewhere. The requirement to dedicate land for the tank has been eliminated. Circulation The primary reason for amending this section is to update the existing circulation inventory and zone plan performance criteria. The original LFMP assumed development timing based on the Kelly Ranch Master Plan approved in 1983. No development occurred and subsequently performance dates passed without circulation improvements being completed. The revised Special Conditions are the best estimate of when circulation facilities must be completed based on the current assumptions. Circulation facilities will be satisfied through the concurrent improvement of a portion of Cannon Road with the development of Kelly Ranch Village "E"; construction of Cannon Road between El Camino Real and Paseo Del Norte prior to 2000 or coincident with development of Kelly Ranch south of Cannon Road and/or the Kirgis property; and the construction of Faraday Avenue prior to 2005 or concurrent with the development of Veteran's Memorial Park. (This portion of Faraday is currently in the design and permitting process.) Sewer Similar to circulation facilities, the Zone Plan has been updated to include current Zone 8 development assumptions, and the Special Conditions have been modified to reflect those assumptions. Sewer facilities will be temporarily satisfied by available capacity in the North Agua Hedionda Interceptor and ultimately through the construction of the South Agua Hedionda Interceptor. Finance Plan The financing provisions for the various facilities are outlined below. City Administrative and Library Facilities Community Facilities District (CFD) No. 1 was formed by the City in 1991 to finance a number of facilities for citywide benefit, including City Administrative and Library facilities. All properties within Zone 8 are currently within CFD No. 1. LFMP 87-08(A) - KELLY RANCH December 16,1998 Page 4 Wastewater Treatment Capacity The Encina Water Pollution Control Facility has adequate capacity to serve the City for at least five years into the future. Payment of normal sewer connection fees by all development within Zone 8 is the only financing mechanism required. Parks The developers within Zone 8 will be required to pay park-in-lieu fees and PFF. Circulation Cannon Road will be financed through the Cannon Road West Assessment District. The developer will be responsible for construction and is eligible for some reimbursement in accordance with that district. Faraday Avenue is being funded through the City's Capital Improvements Program. Open Space No special financing mechanism is required for open space. Schools The developer has entered into an agreement with the Carlsbad School District for school financing. This agreement is binding on all parties and has not been superceded by recent legislation. Drainage Water and Sewer The developer will be required to construct drainage, water, and sewer facilities to serve proposed development pursuant to an improvement agreement with the City, and/or to pay the required fees. V. ENVIRONMENTAL REVIEW The project is a planning document and amending the plan to reduce buildout assumptions will not have an adverse effect on the environment. All development within LFMP Zone 8 will be evaluated on an individual basis and require environmental analysis. A Negative Declaration was issued for the project by the Planning Director.
