The District had prior to this point in time anticipated executing a mitigation agreement with the Kaiza Poinsettia Corporation (the "Developer"), the applicant for the proposed Poinsettia Shores Master Tentative Map (CT 94-01/HDP 94-03) (the "Project"). It is presently anticipated that approval of a mitigation agreement will occur after consideration of certain issues by the Board of Trustees of the District on July 13, 1994. This letter is therefore submitted pending the execution of such mitigation agreement, and to memorialize our discussions relative to the Project, which will be considered by the Planning Commission of the City of Carlsbad at its July 6, 1994 meeting. In this regard we understand that although Finding No. 6 of the proposed Planning Commission Resolution No. 3678, included with the staff report for the Project, provides for the payment of school fees or the execution of a school mitigation agreement to ensure the availability of school facilities to serve the Project, you have indicated that Condition No. 14 of Planning Commission Resolution No. 3678 will be the operative school facilities impact mitigation condition relative to the Project. Based on our discussions with you, we understand that Condition No. 14 requires the Developer to demonstrate evidence to the satisfaction of the Planning Director of school impact mitigation prior to map approval, and that Condition No. 14 is included in order to conform with the mitigation condition applied to this Project's related General Plan Amendment (GPA 94-01) as approved by the City Council on January 4, 1994. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 3683, RECOMMENDING APPROVAL of the Finance Plan for Local Facilities Management Zone 9, based on the findings and subject to the conditions contained therein. H. PROJECT DESCRIPTION AND BACKGROUND A Local Facilities Management Plan (LFMP) for Zone 9 was originally adopted by the City Council on July 11, 1989. The LFMP has been amended once (January 4,1994) to reflect land use and circulation changes to the Poinsettia Shores Master Plan. Both the original LFMP and the amendment contain conditions of approval requiring that a comprehensive financing plan for specified public facilities be adopted prior to approval of the first final map, grading permit, or building permit within the zone, whichever occurs first. The present request is submitted in order to satisfy that condition. The Poinsettia Shores Master Plan (MP 175 [D]) specifies a mix of residential and travel- service commercial uses, with an unplanned area to be addressed at a later time. The LFMP amendment which accompanied the new Master Plan analyzed the public facilities requirements of the proposed development. This Finance Plan is intended to provide funding mechanisms meeting City requirements for all of the needed facilities identified in the LFMP. in. ANALYSIS Planning Issues 1. Does the proposed Zone 9 Finance Plan comply with all requirements of the Growth Management Ordinance (Chapter 21.90 of the Carlsbad Municipal Code) and related policies, standards, and guidelines? LFMP 87-09(B) - ZONE 9 . .NANCE PLAN JULY 6, 1994 PAGE 2 The proposed Finance Plan is in conformance with the Growth Management Ordinance (Chapter 21.90 of the Carlsbad Municipal Code) and related policies, standards, and guidelines. The Finance Plan provides acceptable financial guarantees for all required public facilities, assuring that the facilities will be in place at time of need. The complete Financing Plan is provided as Exhibit "A". CFD No. 1 was formed by the City in 1991 to finance a number of facilities of Citywide benefit. All undeveloped properties within Zone 9 are already participating in CFD No. 1. A combination of CFD No. 1 and payment of PFF constitutes the required financial guarantee for these two facilities. Wastewater Treatment Capacity. The Phase IV expansion of the Encina Water Pollution Control Facility has been completed, guaranteeing adequate capacity to serve the City for at least five years into the future. Payment of normal sewer connection fees by all development within Zone 9 is the only financing mechanism required. LFMP 87-09(B) - ZONE v FINANCE PLAN JULY 6, 1994 PAGE 3 Parks. CFD No. 1 will finance improvements to Veterans Memorial Park. Funding for Phase I improvements to Poinsettia Park are included in the City's adopted 1994-95 to Buildout Capital Improvement Program. Funding for Zone 19 park is guaranteed by a letter of credit from the Zone 19 developer. Therefore, the combination of CFD No. 1 taxes, payment of normal PFF (for all development) and PIL (for a portion of the residential project) satisfies the requirement for a financial guarantee for parks. Circulation. CFD No. 1 will finance improvements to the Poinsettia/I-5 interchange. Completion of the Avenida Encinas connection will be constructed by the developer concurrent with the first phase of project development pursuant to an improvement agreement with the City. Other circulation improvements will be funded by PFF. Therefore, a combination of CFD No. 1, PFF, and improvement agreement will provide the required financial guarantee for circulation facilities. Open Space. No special financing mechanism is required for open space. Schools. The City's recently adopted standard school condition which is included in this Financing Plan will provide the required financial guarantee for school. Drainage, Sewer and Water. The developer will be required to construct drainage, sewer, and water facilities to serve proposed development pursuant to an improvement agreement with the City, and/or to pay the required fees. This provides the required financial guarantee for drainage, sewer, and water facilities. IV. ENVIRONMENTAL REVIEW The proposed Financing Plan is covered by a previously approved Negative Declaration for Master Plan Amendment 175 (D) and Local Facilities Management Plan Amendment 87-09 (A) issued by the Planning Director on August 12, 1993.
