RECOMMENDATION That the Planning Commission ADOPT Resolution No. 2762 recommending APPROVAL of the Negative Declaration issued by the Planning Director and ADOPT Resolution 2763 recommending APPROVAL of Local Facilities Management Plan 20. II. PROJECT DESCRIPTION AND BACKGROUND As shown on Exhibit "A" Zone 20 is located in the southwestern quadrant of the City immediately east of Local Facilities Management Zone 4. As shown on Exhibit "B" Zone 20 is primarily residential. Of the Zone's 764.2 total acres 718 are residential. General Plan residential densities range from low (0-1.5 du/ac) to medium (4-8 du/ac). Nonresidential General Plan land uses include 16.2 acres of Open Space. III. ANALYSIS 1. Does the proposed Local Facilities Management Plan for Zone 20 fulfill the purpose, intent, and specific requirements of Section 21.90 of the Carlsbad Municipal Code (Growth Management Program)? 2. Is the Local Facilities Management Plan for Zone 20 consistent with and does it implement the 1986 Citywide Facilities and Improvement Plan? STAFF REPORT LFMP 20 Page 2 DISCUSSION The Growth Management Program requires that a Local Facilities Management Plan be prepared for each Management Zone in order to show how compliance will be maintained with the City's adopted public facility performance standards as development occurs. The first step in this process requires determining the buildout development potential in the zone. The buildout projection for this zone is consistent with the methodology contained in the 1986 Citywide Facilities and Improvements Plan and the provisions of Proposition E which was approved by the citizens of Carlsbad on November 4, 1986. The plan phases the buildout development of the zone based on estimates of yearly development activity. The phasing estimate is consistent with generalized phasing assumptions used in the 1986 Citywide Facilities and Improvement Plan. From these buildout and phased development projections, yearly phased demands for public facilities may be projected and buildout demands identified. The plan analyzes eleven (11) public facilities. This analysis compares the projected public facility demands with the available and planned supply of public facilities to ensure compliance with the adopted performance standards. Where demands for facilities exceed supply, the plan proposes the necessary mitigation to maintain conformance with the standard. This analysis is consistent with both the 1986 Citywide Facilities and Improvement Plan and the Growth Management Program. The Local Facilities Management Plan identifies one facility which currently does not conform with the adopted performance standard. Parks - A shortfall of 4.24 acres exists in Park District 3 (Southwest Quadrant). As part of this Local Facilities Management Plan an attempt has been made to bring this facility into conformance with the adopted performance standard. The following chart provides a brief summary of the eleven public facilities analyzed in the plan. STAFF REPORT LFMP 20 Page 4 ENVIRONMENTAL REVIEW: The Local Facilities Management Plan for Zone 20 is a public facilities planning document. The plan establishes parameters that ensure Carlsbad's public facility performance standards are met and public facilities inadequacies mitigated to accomplish this goal. The plan for informational purposes occasionally estimates locations and costs of public facility improvements. , The plan fully recognizes that complete environmental review will be necessary once specific public facility improvements are established. Therefore, the Local Facilities Management Plan for Zone 20 will not cause any significant environmental impacts and a Negative Declaration has been issued by the Planning Director on May 27, 1988. Adjustment Plat #367 was requested to effectuate a boundary adjustment between the Sudan Interior Mission and Laurel Tree Investment Company properties for the purpose of establishing a property line boundary for future College Blvd.. This action is an exception under the provisions of section 21.90.030 (10) of the Zoning Ordinance, "Growth Management". Michael Holzmlller has indicated that the resultant property lines are well within reasonable interpretation of the boundary locations established by the City under section 21,90.100 "Local Facilities Management Zones". In discussion with staff, there appears to be agreement regarding the propriety of the adjustment plat. Since the Adjustment Plat will record prior to the parcel map, the property located within Zone 20 is unaffected by the parcel map except as conditioned by the City for the granting of the easement for College. The granting of the easement does not constitute a land division, nor does it involve approval of a development c permit. The confusion appears to be over the designation of a portion of the property as"Parcel 2". This Is conventional wording and should be changed to show "Parcel 2" as a "not a part" area to clearly show that the limit of the requested division is the portion of the property located in Zone 5. This is provided for in subdivision map act section 66424.6 and reflects the intent of the applicant . This effort has been a cooperative one between the City and the involved property owners for nearly a year- The "not a part" approach appears to clearly show that no development permit is granted with the requested action, while at the same time accomplishing the mutual goal of clearly defining those portions of the property located in the respective Growth Management Zones. ___ . ... As we discussed on the phone Friday, if you wish to make any changes to the zone plan, the property owners within Zone 20 will need to officially notify the City that they wish to reopen the plan to consider possible changes. The procedure for reopening the zone plan is specified in Section 21.90 of the Carlsbad Municipal Code deal ing,with the Growth Management Program. What I would suggest is for you to obtain authorization on behalf of the property owners similar to that used in receiving authorization to prepare the plan initially. This response applies to all projects submitted within zones with approved Local Facilities Management Plans as well. As you are aware, the preparation of Local Facilities Management Plans are required to address the City's Public Facility Performance Standard for Open Space. Specifically, this standard requires 15% additional open space to be set aside which is not environmentally constrained and is above and beyond those requirements already in place by the City. The Local Facilities Management Plan for Zone 20 provides one scenario of how the open space performance standard could be met. Each zone plan, unless accompanied by the preparation of a master plan will be required to show how the Open Space standard can be met. Each project submittal within Zone 20 will be required to show how it meets the Open Space standard. It must show how it provides the necessary open space and does not in any way preclude future development within the zone from meeting the Open Space standard. The plan for Zone 20 utilized landscape setbacks along College Boulevard and Poinsettia Lane as well as improvements to the SDG&E easements in order to show how open space could be provide. As you mentioned in your letter, the Zone 20 Plan requires authorization from SDG&E prior to approving the use of their easements to count towards meeting the open space standard. It should also be noted that the City is in the process of reviewing its open space plan and the City Council has appointed a Citizens Committee to do so. This committee will be addressing what areas should be counted towards meeting the 15% Open Space standard. Before the proposed plans can be submitted, a common concern for all the clients we represent is how the City will interpret compliance with open-space standards. As we understand the open-space requirements approved for Zone 20, the 15-percent open-space mandate will be achieved by providing landscape setbacks along College Boulevard and Poinsettia Lane as well as improvements to the SDG&E easement. In the event that a property owner adjacent to one of the above improvement areas chooses to provide open space in another fashion, equal to or in excess to what is shown in the LFMP, the Planning Director will evaluate the request on a project-by- project basis. For those properties not located adjacent to one of the identified open-space areas, they need not provide any open space other than what may be required by the zoning district the property is located within. These properties could, however, be required to help pay for the improvement and maintenance of the open-space facilities as shown in the LFMP for Zone 20. If it is determined that providing open space within the SDG&E easement is not feasible, the 23 acres of open space would need to be picked up in other areas of Zone 20. Since one of the Special Conditions for Zone 20 requires authorization from SDG&E to improve their easement, this issue will be resolved prior to the first project being approved. Dear Phil: This letter is written to request that required financing guarantees as required by Local Facility Management Plans be timed to coincide with final map approval or building permits, whichever occurs first, instead of development permits (ie. the earliest discretionary approval). This issue surfaced out of the review of the Zone 24 plan. Staff indicated that it preferred financing guarantees to be tied to development permits. This would have precluded approval of any tentative maps or other discretionary permits until these financing guarantees were in place. This requirement is a change from the requirement placed on the Local Facility Management Plans for Zones 11, 12 and 19. As you recall, the requirement for a financing guarantee for public facilities for these plans was timed to coincide with final map approval. The only zone that the development permit requirement has been applied to is Zone 20. Requiring a financing guarantee in the form of bonding, public financing or other means prior to approval of a discretionary permit is impractical in a number of ways: 1. Lending institutions are unwilling to commit large financial expenditures without adequate security. The cost of facilities required for each zone is substantial. Without some security, it would be difficult if not impossible to implement a financing plan for any zone. While lenders are more likely to guarantee financing for a final map which has known improvements and high development 6994 El Camino Real, Suite 208 • Carlsbad • CA 92009 • [619] 438-1465 likelihood, they will ,not guarantee financing for projects with no entitlement. 2. Most comprehensive financing mechanisms such as assessment districts and Mello Roos districts are established based on a specific residential unit counts and/or commercial square footage amount. These counts are derived from approved tentative maps or other discretionary permits. Without established unit counts or square footage amounts, there is no guarantee that the developments will generate the necessary capital. The financing mechanisms, therefore, become guesses that are subject to future revisions. 3. Generally, assessment districts also require facilities to be designed prior to the resolution of intention. This would not be possible until the tentative map has been approved. City policy also requires that all discretionary permits be obtained before a district can be established. 4. The requirement of a financing plan being in place prior to discretionary approvals adds significant processing time to projects. Six months is the typical time taken to process a final map after tentative map approval. This time would be lost to a property owner waiting for the financing guarantee to be put in place. In discussions with you, it was indicated that the recent wording change from final map to development permit was due to the fact that commercial projects not requiring a final map could proceed without a financing guarantee. Of course, this was not the intent of the original wording. As an alternative, I would suggest the following: "Prior to approval of any final map or building permit, whichever occurs first, for any project located within Zone , financing shall be guaranteed for the following improvements:..." This wording ensures that neither residential nor non- residential building can take place without guaranteed financing of needed improvements and still provides for the processing of applications. Please consider this proposal as a feasible alternative to the latest wording contained in Zone 20. Call me if you have any questions. An important element within Zone 20 is the circulation analysis. The Local Facilities Management Plan Guidelines requires a map showing proposed alignments of circulation element roadways within the zone. I would like to point out that the alignment presented within the zone plan is only a conceptual alignment for the purpose of addressing future circulation element roads. The zone plan does not set specific alignments of future roadways and in no way "locks in" the alignment as shown. The intent is to identify potential concerns or impacts relating to the proposed routes of future circulation element roadways and also to assist in computing cost estimates for the construction of the road. However, a specific alignment for Poinsettia Lane must be adopted to facilitate the construction of this roadway. This procedure would include environmental review and public meetings before the City Council and Planning Commission. As a property owner affected by the alignment of Poinsettia Lane, you will be notified by mail of the date and time of these public meetings. The City encourages impacted property owners to attend these hearings and present their concerns. This enables the City Engineer to determine an alignment which will provide a safe and efficient street system for the City as a whole. However, reviewing zones one by one results in a piecemeal approach towards school requirements and has not proven satisfactory, particularly in view of the way they are being evaluated one by one. We are attempting to deal with pieces of the picture, rather than the entire picture. I would suggest that, as a minimum, we must examine quadrants, rather than zones, to get a larger, more accurate picture of schools facilities needs. PALOMAR AIRPORT ROAD (East and West) Based on discussions with Steve Jantz {City of Carlsbad) and Jack Henthorn (D.C.C.) the questions regarding Palomar Airport Road have been addressed 1n the traffic study. ALGA & EL CAMINO REAL* Based on the ICU analyses no intersection improvements at Alga/El Camino are needed unltl year 2010. If the Intersection improvements are implemented during the Intervening years (1990, 1995 and 2000) as shown in the traffic study, then the buHdout Impacts will be mitigated prior to their occurance. The over capacity condition occurs at year 2010, when the SANDAG numbers are used in the analyses. PALOMAR AIRPORT ROAD & PASEO DEL NORTE* In the ICU analyses the year 1995 over capacity condition was shown to be mitigated by the year 1990 improvements. It is estimated the Palomar/ Paseo Del Norte Intersection will actually need the improvements in the year 1992. * It should be remembered that the ICU analyses are based on the roadway connections shown in the City Arterial Phasing Plan but not necessarily the given roadway widths. Year 2010 Is when the SANDAG volumes are utilized, which triggers the need for the intersection Improvements. The year 2010 intersection geometries are shown 1n the report on Table 11 and in the ICU worksheet under the column "Geometries" "2010 lanes". PQINSETTIA LANE (Pacific Rim to College) The projected buildout daily volume for Polnsettia between Pacific R1m and College 1s 33,950 vehicles per day. Therefore with a year 2010, four lane roadway, with a 44,450 vehicle per day capacity a 0.76 V/C raio results. This indicates acceptable LOS C operations. -3- POINSETTIA (College to El Camino) Based on SANDAG year 2010 project volumes the Polnsettia roadway section between College and £1 Camlno is projected to operate with a 0.37 V/C ratio at LOS A assuming a four lane roadway. If a two lane roadway is provided a 0.73 V/C ratio at LOS C will result which also indicates acceptable operations. A separate analysis of Polnsettia from College to , El Camlno has been provided 1n the traffic study. EL CAMINO REAL (Palomar Airport Road to Alga) Less than 20 percent of the project traffic is expected to utilize El Camino Real between Palomar and Alga. If College Boulevard is connected between Palomar and Poinsettia then a very limited percentage of project traffic will utilize this section of roadway. The City expressed concern that 20 percent of project traffic may use El Camlno (Palomar to Alga) prior to the connection of College between Palomar and Poinsettia, It was projected that 20 percent of the north half traffic would utilize this section of El Camino, however, only 8 percent of the south half traffic was distributed to this segment. Therefore, the resulting total project traffic impacting this segment of El Camlno is less than 20 percent. The south hlaf distribution accounted for the Caminito De Las Ondas connection to Paseo Del Norte. This route is expected to serve the majority of the south half project traffic with a destination to the north. As a safety measure this segment of El Camino Real was analyzed assuming 20 percent of project traffic Impated this segment. Year 1994 was choosen for analysis, because in 1995 the connection of College between Palomar and Poinsettia will be provided and the percentage of project traffic ultllzlng El Camino (Palomar to Alga) will be reduced significantly. The year 1994 volume is projected at 18,430 vehicles per day. As I understand it, the primary agenda matter at this meeting was the above-referenced property. At that meeting, Mr. Sherman's real estate advisor, Bev Southers, was present and delivered her position statement on this particular property. What is of concern to this office is that all five members of the Commission made inquiry of Ms. Southers as to why no one had represented this property at earlier meetings of the Commission. Her response was simply that she had not been notified. Members of the Parks and Recreation Commission indicated to Ms. Southers that there had been numerous meetings on the Sherman Property and that they simply felt that the owner was not particu- larly interested with regard to how his property would be treated by the City. The fact that we have not been notified of these previous meetings is particularly puzzling to me since, on November 19, 1987, I wrote every addressee to this letter and indicated that Mr. Sherman was interested in the Park recommendation for imminent domain action, was intending to resist any such attempt and that we ^ V HARRISON E. DISCUSSION OF ENVIRONMENTAL EVALUATION The Local Facilities Management Plan for Zone 20 is a facilities planning document. The intent of the plan is to establish parameters and thresholds that assure public facilities are available when needed as determined by the City's adopted performance standards. To accomplish this purpose occasionally locations and costs of public facility improvements are estimated for informational purposes. These estimates may result in increased development fees. Traditionally the developer in maximizing their capital return passes such fees on to the home buyer or tenant. This results in higher priced housing which affects the availability of low and moderate income housing. However, as real estate value is determined primarily by location, without other market incentives, it is unreasonable to assume the subject property would be developed with either low or moderate income housing due to its view proximity to the Pacific Ocean. -7- DISCUSSION OF ENVIRONMENTAL EVALUATION (Continued) It is not the development fee that will force low and moderate income families into other communities, but the existing nature of the market place. It is recognized that CEQA review for these public facilities estimates is general, and does not satisfy CEQA requirements for the specific project. The Zone 20 Local Facilities Management Plan requires complete CEQA review prior to initialization of any public or private project discussed in the Local Facilities Management Plan. -8- IV. However, if there is currently no financing mechanism adopted for the construction of the necessary improvements, this zone will be required to propose a mitigation plan, including financing, guaranteeing the construction of the required street improvements. The road links which may need improvements are those circulation element roads which are impacted by 20% of the traffic generated from this zone. You will need to bring along all'of the people that are working on the Zone 20 plan to this meeting. This should include all of your consultants with the exception of Wes Pringle and Associates because a separate meeting will need to be scheduled to go through the entire circulation study. We will arrange a circulation meeting on Thursday. I would also suggest that you invite any interested property owners to attend this meeting as well. I believe it is important for them to get a first hand impression of how much work is needed to complete this plan in order to schedule it for the Planning Commission. General Comments The first five section: Executive Summary, Introduction, Buildout Projections, Phasing, and Zone Requirements will need to be revised. These sections are not the most up-to-date being used by the City and in the case of Buildout Projections and Phasing, they are incomplete as written. Facility Comments City Administrative Facilities With minor revisions and the addition of the 3,200 square feet of redevelopment space, this section will be acceptable. Jack Henthorn April 26, 1988 Pace 2 Library With minor revisions, this section will also be acceptable. Wastewater Treatment Capacity This section is not acceptable as written. The analysis addresses the wrong districts and not the district which services the demands in Zone 20. It will need to be totally revised. Parks This section will need to be revised. You must begin by including the demands for the entire park district today and Zone 20 as well as projecting the buildout demands for both the district and the zone. Please be prepared to explain how Zone 20's park demand is going to be met. As a note, schools will not be counted for meeting the parks performance standard until they are built and a joint use agreement is in place between the school district and the City. Drainage With minor revisions this section will be acceptable. Circulation The text portion of the circulation section has not been resubmitted or reviewed. Consequently, the proposed phasing of construction of College Boulevard and Poinsettia Lane have not been addressed. Also, the issue of the specific alignments of these circulation element roads has not been decided. College Boulevard is to go to a public hearing and an environmental review is still necessary prior to the adoption of the zone plan. As mentioned earlier in this letter, a separate meeting will be scheduled with your traffic consultant to discuss comments within the traffic study, there exists differences of opinions with the data presented in this report. Fire With minor revisions this section will be acceptable. Jack Henthom April 26, 1988 Paae 3 Open Space The intent of this standard is to require the property owners to provide a detailed plan showing how, when, and where performance standard open space will be provided in the zone as development occurs. This section is unclear and will require extensive revisions. As a note, schools do not count for meeting the open space standard. Schools This section needs to be explained further prior to having staff send it to the district for review. Sewer Collection A specific analysis is necessary for the sewer impacts on the San Marcos Interceptor. Also, the upgrading of the sewer pump station must coincide with the proposed development phasing. Water Distribution List all proposed facilities necessary for the ultimate development of the zone. As you can see there is a great deal of work needed to be accomplished in order to move this plan forward. It appears that the plan processing schedule will be unable to meet the state mandated time frames and, therefore, you would need to request a 90 day processing extension. Wastewater A. This section did not analyze wastewater impacts from Zone 20. It seems that the wastewater sections from Zones 11 and 12 were carbon copied and used as the analysis for Zone 20. This section will need to be revised completely to analyze wastewater impacts from this zone only. B. In Exhibit W-l it should indicate the Carlsbad Sewer Service District not Costa Real Municipal Water District. C. Under Encina WPCF Capacity Analysis - Engineering staff will supply the up-dated existing flow data just prior to the adoption of the zone plan. This information will not change the wastewater analysis for this zone. 2. Drainage A. On Table D-l - Center your columns underneath all the table headings in this chart. B. Under mitigation - The proposed master drainage plan facility designation DC is indicated that the cost will be shared with development in Zone 19. Actually the development within Zone 20 is only required to construct that portion of facility within the boundaries of Zone 20 or any necessary facilities outside the boundaries to ensure positive flow. Therefore, development within the zone is not required to coordinate construction of these facilities with any development within Zone 19. C. Under mitigation - It should be described that any development within the designated sub-basin boundaries will be required to construct the facilities within those sub-basins. This was accomplished in previous zone plans which designated phase boundaries with natural drainage sub-basin boundaries. Consequently, the developments within certain phase boundaries were required to construct the drainage facilities necessary to serve those individual phases. This will allow development within a specific area of Zone 20 to identify which drainage facilities will be required of the individual phases. 3. Sewer A. Exhibit SC-1, the correct title for the sewer district within Carlsbad is Carlsbad Sewer Service District. B. Exhibit S-l, 1) extend trunk-line BSMT2 to the boundaries of sub- zone 2 OB; 2) show Batiquitos Lagoon and identify the location of the North Batiquitos Interceptor; 3) under legend, (a) change the designation of the zone boundary this designation is hard to find; (b) the portion of the North Batiquitos Interceptor (NB5) is shown as a proposed system. C. The text contains numerous amounts of typographical and textural errors. The corrections will be returned to the consultant with the checkprints and must be corrected prior to the next submittal. D. Under facility analysis, it should be mentioned that the information contained in this section was derived from the new Carlsbad Sewer Master Plan of Sewerage prepared by Wilson Engineering, December 1987. E. Table 1 - Separate the Capacity analysis for the Buena Interceptor and the San Marcos Interceptor. Essentially analyze the downstream capacity under two separate charts. F. Zone 20 is going to utilize the San Marcos Interceptor only. This report should analyze the impact to this interceptor and delete any further information of the Buena Interceptor. -2- G. Item C of this study should indicate the Zone 20 service demand. The proposed development sewer, generation rate and the total sewer generated from this zone. H. Under Adequacy Findings - This section should indicate the adequacy of the San Marcos Interceptor with relation to the proposed service demand as previously discussed. I. Table 3 - Remove all notation to any sewer line which is not impacted by sewer from Zone 20. J. Under Financing - This section makes indication that the pump station at the North Batiquitos Interceptor is to be upgraded in the City's Capital Improvement Program between the years 1992 and 1997. Therefore, it should be analyzed as to what impacts that portion of Zone 20 will have on that pump station. If there is an indication that there is not adequate capacity at this pump station to handle development, the development in that portion of the zone will not be allowed to develop until such time that the pump station is upgraded. This upgrading could either be accomplished by the City or by development, but no further development will be able to continue until the upgrading is complete. It should be noted that the Zone 19 Plan indicates this facility will be upgraded in their first phase which is projected to be done in 1989. 4. Water A. Exhibit WS-1 - Indicate the complete name of all water districts which serve the City of Carlsbad. B. Exhibit WS-2 - Use a boulder designation for the zone boundary. C. There is a section missing within this study entitled "Proposed Facilities". This section should list all proposed facilities with the appropriate sizes, estimated locations and estimated cost. D. As a result, ten acres must be deducted from the RM designation and ten acres from the RLM designation for the Junior High School. Then for the Elementary School, ten acres must be deducted from the RLM acreage. The last item of any substance that we discussed dealt with the fact that Cobblestone was approved over the Growth Control Point. At some point in the future we will need to discuss how reductions in future development in Zone 20 will take place in order to make up for this overage. As we discussed on the phone, the constraints map as resubmitted is not acceptable and needs additional work. At our meeting on February 4th we discussed numerous items dealing with the constraints map that were not properly identified and needed to be revised by your engineer. At that time we showed you the constraints map as perlimitered by staff and the discrepancies included from your map and our calculations. It was our understanding at the meeting that each of these items would be corrected and returned to staff. After reviewing the resubmitted constraints map it appears that no work was done. The school sites have not been revised to reflect their actual acreage, boundaries of certain constraints have not been defined, and the topo lines that needed to be clearly identified have not been provided. With all of these items in mind, it is impossible for staff to complete the technical review of your constraints map and, therefore, we are unable to provide you with buildout numbers for the zone. It is of the utmost importance that you have your engineer review the comments that we have made on the constraints map as well as revising the boundaries as shown on the attached map which staff has pieced together from the assessor's parcel pages. Staff has also provided on that attached map a division of the General Plan land uses as well as an indication of open space that should be included in your zone and has not been to date. There are three ways that this can be accomplished. First, the City can prepare the plan with the costs accessed to the owners within the zone. Second, ALL property owners may jointly submit a plan. Thirdly, where a "joint" submission is not possible any group of owners may petition the Council for authorization to proceed with preparation and submittal. Development Consultants Consortium (D.C.C.) has been retained by three property owners to formulate a Local Facilities Management Plan for Zone 20. (see attachment 1 - client list - Zone 20) An effort to obtain the support of 100% of Zone 20's 39 property owners was begun in mid December 1986. Notices were sent to all owners of record inviting attendance at a meeting held on December 15, 1986, for the purpose of explaining the program and soliciting support. (see attachment 2) Twelve owners attended the meeting representing 424.25 of the zone's 779.38 acres. At the conclusion of the meeting theing thi owners verbally agreed to support preparation of the plan date 10 of the twelve ownerships have returned signed authorization forms. To In addition, a majority of the ownerships represented at the December meeting are committed to paying a pro-rata share of costs on a private basis. Several of the larger ownerships have agreed to pick up costs where a property owner does not desire to share in costs. This option will be made available to all property owners after build out projections are approved by the staff. (attachment 3) This letter was sent via registered mail for record keeping purposes. Registered receipts have been received from all owners. (copies are provided as attachment 4) After contacting all 39 property owners, we have received a total of 24 signed authorizations representing 668.29 acres, or 86% of the Zone's total land area. (see attachment 5 - authorization forms) In addition, 5 owners representing 70.18 acres have been contacted by telephone. Although they have stated that they do not object to the preparation of the plan, signed authorization forms have not been received from them. These owners represent an additional 9.0% of the zone's acreage. The final group of owners making up Zone 20 are those with whom there has been no direct contact other than a return receipt from the follow-up mailing. This group is made up of 4 property owners holding 32.29 acres or 4.1% of the zone's land area. Attachment 6 is a summary of the results of the efforts outlined above. Contact has been made with 100% of the zone's ownership. 95% have responded indicating no opposition to the preparation of the plan with 86% formally authorizing its preparation. Although efforts will continue to establish direct contact with the 4 remaining ownerships we are now seeking Council authoriza- tion to proceed with the Zone 20 Facilities Plan. In reviewing the plan, we also found many errors and problems with the technical analysis but those comments will be the subject of a subsequent communication. Our request to proceed was granted by the City Council on -April 7, 1987- Since we had requested and not received any comments regarding- build-out projections, it was decided to prepare the Zone 20 plan in May °fl9QL' During the preparation of the plan we were verbally~ra?i3v±S^3^that there was a discrepancy between our acreage calculations and those done by the City. Since- we were well into preparation of the plan we suggested that the acreage disparity be resolved during the "informal" review process. On June 24, 1987 w£ transmitted the Zone 20 plan for preliminary review. On- July 22, 1987 we were advised verbally that the "informal" review process was no longer in use due to pressures from activity in other zones. Zone 20 is an important link.in the development of the Southwest quadrant of the City. The two major circulation links in the area, College Boulevard and Pol nsettia-Lane, traverse this zone before linking up with other major circulation roads. These arterials are key elements in the future circulation demands . created by development in Zones 5 and 19. In addition Zone 20 contains the-site and financing means for the expansion and improvement of the Alta Mira park site. This undeveloped site" is currently needed to^ meet demands created by recent growth as the east side of Interstate 5 at Poinsettia Lane. Zone 20's 760+-acres are held by over 39 separate owners. Thirty two of these owners have formally banded together to support the preparation and processing of the Zone 20 plan. The methodology employed_in conducting the analysis and arriving at the required projection is assessed below. GROSS ACRES Gross acres were.determined for each General Plan land use . category contained within Management Zone by planimeter measurement of General Plan boundaries on a 500' scale base map. The total gross acres of Management Zone 20 is 782.74 acres and is categorized as follows: i Land Use Gross Acres Residential 729.37 Other* " 53.37 TOTAL 782.74 ! *See table 1 for list of other uses. ENVIRONMENTAL CONSTRAINTS Carlsbad's Growth Management Ordinance identifies several environmentally constrained land uses which may not be used in the calculation of residential density. These constraints fall into two categories: one hundred percent constrained land and fifty percent constrained land. Specifically, one hundred percent constrained land does not allow any land to be counted for residential density. Environmentally constrained lands were identified by aerial photographic interpretation, field investigations and review of public record,documents related to Management Zone 20. These constrained lands were mapped on a 500' scale map and then overlaid with General Plan land uses. The specific breakdown and the location oflthese lands in Management Zone 20 are displayed on Exhibip A. Environmentally constrained lands that may have existed on property that is now considered developed was not counted in the calculation of environmentally constrained lands. NET USABLE-ACRES^ (TABLE I) Once identified, the total amount of 100 percent environ- mentally constrained land was subtracted from the gross acres by General Plan land use category and one half the amount of 50 percent environmentally constrained lands was subtracted * from the gross acres by land use. (a)Whenever thefollowing terms are used in this chapter thev shall have the meaning established by this section unless from the context it is apparent that another intended: (1) "Citywide facilities and improvements plan" means a plan prepared and approved according to Section 21.90.090 identifying those facilities and improvements required on a citywide basis to serve the projected population of the City as established by the general plan and providing an outline and budget for financing certain facilities and improvements whichwill be provided by the City. (2) "Development permit" means any permit, entitlement or approval whether discretionary or ministerial issued under Title 20 or 21 of this code and any legislative actions such as zone chanaes, general plan amendments, or master plan approval,or amendment. (3) "Development" means any use to which land is put, building or other alteration of land and construction incident thereto. (4) "Facilities" means any schools, parks, open space, or recreational areas or structures providina for fire, library, or governmental services, identified in a facilities management plan. (5) "Improvement" includes traffic controls, streets and highways, including curbs, gutters, and sidewalks, bridges, overcrossings, street interchanaes, flood control or storm drain facilities, sewer facilities, water facilities and lighting facilities. (6) "Local facilities management plan" means a facilities management plan defined by Section 21.90.120 for a local facilities .management zone which is established accordina to Section 21.90.100. 21.90.030 General prohibition, exceptions. Developme~at permits and building permits for these projects shall be subject to any fees established pursuant to the citywi-e facilities and improvement plan and any applicable local facilities management plan. (1) Redevelopment projects. (2) Projects consisting of the construction or alteration of a single dwellina structure for a family on a lot owned by the family intending to occupy the structure, or not to exceed one nonowner-occupied house per individual for one or more lots owned prior to July 20, 1986. (3) Building permits and final maps for proiects identified in Section 2(F) of Ordinance No. 9791 (projects for which construction had commenced and were designated on the ran marked Exhibit A to Ordinance No. 9791 "as developina"). (4) Puilding permits for projects for which all required development permits were issued or approved on or before January 21, 1986. If all reouired development permits were issued for a portion of the project only, the exemption shall apply to that portion. (5) Building permits for projects for which all required development permits were issued or approved before July 20, 1986 and for which building permits could .have been issued under Ordinance No. 9791. if all required development permits were issued for a portion of the project only, the exemption shall apply to that portion. (6) Commercial and industrial projects with approved development permits or with a complete application on file with the City prior to June 11, 1986 for such permits. New permits for commercial and industrial projects located within an area that has been previously approved for such uses may also be processed and approved. (7) Projects by nonprofit entities for structures youth recreational, educational or guidance programs and girls clubs or private schools. (8) Zone changes or general plan amendments necessary to accomplish consistency between the general plan and zoning, to implement the provisions of the Local Coastal Plan or which the City Council finds will not increase the public facilities or services and which are initiated by the City Council or Planning Commission. (9) Public utility facilities and improvement projects without accommodations for permanent employees are exempt from the provisions of this chapter unless the City Council determines they are of sufficient size and scale to impact public facilities. (10) Adjustment plats. (11) Development permits for minor subdivisions located in the northwest quadrant of the City as defined in Ordinance No. 9791. Building permits for commercial or industrial construction on lots in such subdivisions may be approved. (1) If a tentative map or tentative parcel map was approved on or before January 21, 1986 then, after approval of the citywide facilities plan, a final map or parcel map r*ay be processed and approved before the adoption of a local facility management plan. The expiration period for those tentative maps shall be tolled until the citywide plan is adopted. The expiration of any development permits issued in conjunction with those maps shall be tolled until the applicable local facilities management plan is approved or, two years after the date the citywide plan is approved, whichever occurs first. j (2) If a tentative map or tentative parcel map was approved after January 21, 1986 and before July 20, 1986, but the approv-i of final map or parcel map was prohibited by Ordinance No. 9791 then approval of final maps and parcel maps is prohibited until after preparation of the applicable local facilities management plan. The expiration period of those tentative maps and tentative parcel maps, and any other development permits issued in conjunction with the maps shall be tolled until the local facilities management plan is approved, or two years after date the citywide facilities and improvements plan is approved, whichever occurs first. (e) The exemption for projects listed in subsection (c)j (3), (4), (5), and (6) shall expire on July 20, 1988. After thatl date all development permits for those projects shall be fully i subject to the provisions of this chapter. The exemptions for ' projects listed in subsection (c) (3), (4), (5), and (6) shall apply only so long as the facilities and improvements required a3 a condition to the issuance of final development permits have j been installed or are being installed pursuant to a secured i agreement. Any breach of such secured improvement agreement shall subject any remaining building permits for the project to the provisions of subsection (a). (f) Final or parcel maps for projects listed in subsection (c) (3), (4), (5), (6) and (7) which comply with all the requirements of the Subdivision Map Act and Title 20 of this Code which were filed with the City before July 20, 1986 may be approved by the City Council, or City Engineer as appropriate, after July 20, 1986. Upon approval, those projects shall be subject to the exemption of subsection (c). (g) The City Council may authorize the processing of and decision making on building permits and development permits for a project with a master plan approved before July 20, 1986 subject to the following restrictions: (1) The City Council finds that the facilities anc improvements required by the master plan are sufficient to meet the needs created by the project and that the master plan developer has agreed to install those facilities and improvement: to the satisfaction of the City Council. 5. < 1! 2 3 4 5 6 7 8 9 10 11 12 l*\ 14 i; sSSi1 * < * is03 Q ^ 2 I 8 S 16 181| 191' 20 i!'i21 |i 22! 23 24 I 25> i 26 i 27 28 (2) The master plan developer shall agree in writing that all facilities and improvement reouirements, including but not limited to the payment of fees established by the citywide facilities and management plan and the applicable local facilities management plan shall be applicable to development within the master plan area and that the master plan developer shall comply with those plans. (3) The master plan establishes an educational park and all uses within the park comprise an integral part of the educational facility. (4) Building permits for the 129 unit residential portion of Phase I of the project may be approved provided the applicant has provided written evidence that an educational entity will occupy Phase I of the project which the City Council finds is satisfactory and consistent with the goals and intent of the approved master plan. (5) Prior to the approval of the final map for Phase I the master plan developer shall have agreed to participate in the restoration of a significant lagoon and wetland resource area and made any dedications of property necessary to accomplish the restoration. (h) After making the findings in paragraph 1 the City Council may authorize the processing of and decision making on master plans subject to the requirements of paragraph 2. After the grant of the easement required by subparagraph (h)(iv) the tentative map for Phase I of the project, the site plan for the commercial development and the local coastal plan amendment may also be processed and approved. If such approvals are granted and, subject to all other provisions of this code, grading and building permits for construction of the golf course and first phase of the commercial portions of the project may be processed and approved. The processing and approval of all other developments and building permits within the master plan shall not occur unti after the citywide facilities plan and the local facilities management plan have been adopted by the City Council. (l)(i) That the master plan will provide all necessary public facilities for the project and will cure any facilities deficits in the area affected by the project. (ii) That the approval will not prejudice the preparation of the citywide facilities plan and will improve the level of public facilities and services in the area. (iii) That by the dedication of land and the construction of public improvements the project will make a significant contribution to the public facilities needs of the city and provide for the preservation or enhancement of significant environmental resources. (iii) The master plan applicant shall agree to participate in the restoration of a significant lagoon and wetland resource area. (iv) Prior to any processing on the paster plan the applicant shall grant an easement over the property necessary for the lagoon restoration and the right-of-way necessary for the widening of La Costa Avenue and its intersection with El Canuno Real. 21.90.031 Tolling of time for consideration of applications submitted before the effective date of this chapter. After approval of the citywide facilities and improvement plan and the applicable local facilities management plan applications for development permits which were accepted as complete before the effective date of this chapter shall have processing priority in relationship to the acceptance date. Until the approval of the plans all applicable time limits for processing the development permits shall be tolled. 21.90.032 Tolling of expiration of previously issued development permits. If a discretionary development permitf other than a development permit issued in conjunction with a subdivision map, issued prior to July 20, 1986 has an expiration period within which building permits must be issued and the issuance of building permits for the project is prohibited by this chapter then the expiration period shall be tolled until the applicable local facilities management plan is approved, or two years after the date the citywide plan is approved, whichever occurs first. 21.90.033 Extensions of prior approvals prohibited. After approval of an applicable local facilities management plan an extension of the expiration date of any development permit shall not be granted unless the extension is found to be consistent with the plan. The decision making body considering an extension may condition the extension upon compliance with the citywide plan and applicable local facilities management plan. 21.90.040 Compliance with this chapter. (a) No development permit shall be approved unless the approving authority finds that the permit is consistent with the citywide facilities and improvements plan and the applicable local facilities management plan. To ensure consistency the approving authority may impose any condition to the approval necessary to implement the plans. (b) No building permit shall be issued unless the fees required by this chapter, and any applicable local facilities management plan fees are first paid, and the permit is consister 7. CA 95715 C71 4) 752-1 554 FAX C71 4J 752-4058 ZONE 20 FINANCING PLAN CITY OF CARLSBAD The purpose of this plan is to assure the City of Carlsbad that financing is in place for all of the public facilities necessary to support buildout within Zone 20. I. CIRCULATION A. College Boulevard College Boulevard (from Palomar Airport Road to Poinsettia Lane) will be directly financed by several landowners within Zone 20. The landowners involved in this financing are the four landowners most directly benefiting from the construction of College Boulevard, as follows: 1. Cobblestone Sea Village (CS) 2. Laurel Tree Investors (LT) 3. KTS Nippon Inc. (KTS) 4. Woodward (W) The proposal set forth herein will allow road construction to occur in segments. As such, each of the above landowners will be responsible for the construction of a specific segment of College Boulevard (see Exhibit A) . Depending upon the development phasing of each parcel, any one landowner may be required to construct his own segment plus another landowner's segment, in order to provide motor vehicle access to his own property. In anticipation of such an occurrence, a reimbursement program will be set in place to mitigate any excessive costs incurred by any one landowner (see Exhibit B for phasing and reimbursement scenarios). In order to guarantee the construction of College Boulevard, at map recordation a landowner will provide a Letter of Credit, bond or other form of security acceptable to the City. B. Poinsettia Lane The construction of Poinsettia Lane will primarily impact the landowners in the eastern quadrant of Zone 20. Due to a lack of landowners anticipating development and the limited number of dwelling units planned in this quadrant, there are three potentially viable alternatives available for the financing of Poinsettia Lane. REAL ESTATE FINANCE AND PLANNING Page 2 1. Landowner-financed construction occurring in segments, as building activity is undertaken by the three landowners most likely to develop (see Exhibit C). Those landowners are as follows: a. Roesch (R) b. Seabluff Association (SB) o. Coast Waste (CW) As was recommended for College Boulevard, a reimbursement mechanism will also be established to compensate the three landowners who have paid more than their fair share (Exhibit D). Additionally, in the event any of the remaining landowners in the quadrant proceed with the development of their properties, in-lieu fees will be assessed at the time of building permit in order to reimburse the landowners who financed Poinsettia Lane. 2. The formation of either a Mello-Roos Community Facilities District (CFD) or an Assessment District (AD) encompassing all landowners within the eastern quadrant of Zone 20. The formation of either a CFD or an AD is contingent upon the approval of the area's landowners and assumes the ability of the land to provide sufficient collateral for a bond sale. The delayed development schedule of certain landowners within the quadrant suggests the use of a CFD to finance Poinsettia Lane, as this financing mechanism will provide the flexibility to exclude these landowners from the special tax until development occurs on their properties. 3. The inclusion of the east quadrant in the AD currently being formed to encompass the HPI Property (Zone 19). This alternative assumes that HPI would be willing to cooperate in the formation of an AD which includes parcels under outside ownership. If a public financing district was not established on these eastern quadrant properties, landowners would guarantee the construction of Poinsettia Lane by providing a Letter of Credit, bond or other form of security acceptable to the district at map recordation. Page 3 II. PARKS At the time that building activity is initiated within Zone 20, a park deficiency of 5 acres will exist. This deficiency will be mitigated by developer funding, which will be required of the landowner choosing to develop first. At that time, (currently anticipated to be 1989), $1 million will be provided to the City for park acquisition and improvement, as follows: A. $500,000 cash for acquisition of 5 acres of parkland B. At map recordation, a Letter of Credit, bond or other form of security acceptable to the City in the amount of $500,000 for park improvements. The developer providing this up-front funding will be reimbursed through in-lieu park fees contributed by the remaining landowners within the Zone.
