PROJECT DESCRIPTION: Local Facilities Management Plan for Zone 21 which

The City of Carlsbad has conducted an environmental review of the above described project
pursuant to the Guidelines for Implementation of the California Environmental Quality Act
and the Environmental Protection Ordinance of the City of Carlsbad. As a result of said
review, a Negative Declaration (declaration that the project will not have a significant
impact on the environment) is hereby issued for the subject project. Justification for this
action is on file in the Planning Department.

Local Facilities Management Plan Zone 21 is located south of Las Palmas Drive, north of

Carlsbad, San Diego County, CA.
Project Description:
The Local Facilities Management Plan for Zone 21 is a facilities planning document. The
intent of the plan is to establish parameters and thresholds that assure public facilities are
available when needed as determined by the City's adopted performance standards.
Findings of Exemption (attach as necessary):
1. The City of Carlsbad Planning Department has completed an Environmental Initial
Study for the above referenced property, including evaluation of die proposed
project's potential for adverse environmental impacts on fish and wildlife resources.
2. Based on the completed Environmental Initial Study, the City of Carlsbad Planning
Department finds that the proposed project will not encroach upon wildlife habitat
area, will have no potential adverse individual or cumulative effects on wildlife
resources, and requires no mitigation measures to be incorporated into the proposed
project which would affect fish or wildlife.

I.RECOMMENDATION
That the Planning Commission ADOPT Resolution No. 3242 recommending APPROVAL of
the Negative Declaration issued by the Planning Director and ADOPT Resolution 3243
recommending APPROVAL of Local Facilities Management Plan 21.
II.PROJECT DESCRIPTION AND BACKGROUND
As shown on Exhibit "1" Zone 21 is located in the southwestern quadrant of the City.
As shown on Exhibit "2" Zone 21 is primarily residential. Of the Plan's 262 total acres 242
are residential. General Plan residential densities range from low-medium (0-4 du/ac) to
medium (4-8 du/ac). The only nonresidential General Plan land use is 20 acres designated
as Elementary School.

1. Does the proposed Local Facilities Management Plan for Zone 21 fulfill the purpose,
intent, and specific requirements of Section 21.90 of the Carlsbad Municipal Code
(Growth Management Program)?
2. Is the Local Facilities Management Plan for Zone 21 consistent with and does it
implement the 1986 Citywide Facilities and Improvement Plan?

DISCUSSION
The Growth Management Program requires that a Local Facilities Management Plan be
prepared for each Management Zone in order to show how compliance will be maintained
with the City's adopted public facility performance standards as development occurs.
The first step in this process requires determining the buildout development potential in
the zone. The buildout projection for this zone is consistent with the methodology
contained in the 1986 Citywide Facilities and Improvements Plan and the provisions of
Proposition E which was approved by the citizens of Carlsbad on November 4, 1986.
The plan phases the buildout development of the zone based on estimates of yearly
development activity. The phasing estimate is consistent with generalized phasing
assumptions used in the 1986 Citywide Facilities and Improvement Plan.
From these buildout and phased development projections, yearly phased demands for public
facilities may be projected and buildout demands identified. The plan analyzes eleven (11)
public facilities. This analysis compares the projected public facility demands with the
available and planned supply of public facilities to ensure compliance with the adopted
performance standards. Where demands for facilities exceed supply, the plan proposes the
necessary mitigation to maintain conformance with the standard. This analysis is
consistent with both the 1986 Citywide Facilities and Improvement Plan and the Growth
Management Program. The Open Space Advisory Committee has reviewed the plan for
conformance with the adopted Open Space program.
IV. ENVIRONMENTAL REVIEW
The Local Facilities Management Plan for Zone 21 is a public facilities planning document.
The plan establishes parameters that ensure Carlsbad's public facility performance standards
are met and public facilities inadequacies mitigated to accomplish this goal. The plan for
informational purposes occasionally estimates locations and costs of public facility
improvements. The plan fully recognizes that complete environmental review will be
necessary once specific public facility improvements are established.
Therefore, the Local Facilities Management Plan for Zone 21 will not cause any significant
environmental impacts and a Negative Declaration has been issued by the Planning Director
on May 2, 1991.
The following chart provides a brief summary of the eleven public facilities analyzed in the
plan.

ENVIRONMENTAL IMPACTS
STATE CEQA GUIDELINES, Chapter 3, Article 5, section 15063 requires that the City conduct an
Environmental Impact Assessment to determine if a project may have a significant effect on the environment.
The Environmental Impact Assessment appears in the following pages in the form of a checklist. This checklist
8 identifies any physical, biological and human factors that might be impacted by the proposed project and
provides the City with information to use as the basis for deciding whether to prepare an Environmental
Impact Report or Negative Declaration.
* A Negative Declaration may be prepared if the City perceives no substantial evidence that the project or
any of its aspects may cause a significant effect on the environment. On the checklist, "NO" will be checked
to indicate this determination.
* An EIR must be prepared if the City determines that there is substantial evidence that any aspect of the
project may cause a significant effect on the environment. The project may qualify for a Negative
Declaration however, if adverse impacts are mitigated so that environmental effects can be deemed
insignificant. These findings are shown in the checklist under the headings "YES-sig" and "YES-insig"
respectively.
A discussion of potential impacts and the proposed mitigation measures appears at the end of the form under
DISCUSSION OF ENVIRONMENTAL EVALUATION. Particular attention should be given to discussing

DISCUSSION OF ENVIRONMENTAL EVALUATION
The Local Facilities Management Plan for Zone 21 is a facilities planning document. The intent of the plan
is to establish parameters and thresholds that assure public facilities are available when needed as determined
by the City's adopted performance standards. The land uses analyzed as taken from the adopted General Plan.
Locations and costs of facility improvements are estimates for information purposes only.
It is recognized that CEQA review for these public facilities is general and does not satisfy CEQA requirements
for the specific project. The Zone 21 Local Facilities Management Plan requires complete CEQA review prior
to initialization of any public or private project discussed in the Local Facilities Management Plan.

Thank you for your comments on the Zone 21 Financing section. The purpose of this
memo is to let you know what changes we are making in response to your comments,
or in some cases, why no change has been made. The numbering of the following points
corresponds to the numbering of your comments.
1. , In discussing with Jim Elliott how zones;wHKannex to the CFD, he provided an
^explanation which may be useful. First, only those zones with an already adopted
LFMP were included in the first formation of the CFD. This is specifically zones 7,
8, 9, 11, 12, .14, 15, 19,- 20, 22, and 24. Zone 1, 2/3, 4, and 6 will not ever be
included in the CFD. This leaves zones 10,13,16,17,18,21,23, and 25 to annex
at some future time. At the time these zones annex to the CFD, the procedure to
be followed will be as you have outlined in accordance with the Act. However,
there is flexibility in terms, of when properties annex. It would appear to be most
appropriate to require annexation in conjunction with approval of a development
entitlement which generates a demand for public facilities. Therefore, Jim and I
were in agreement that the Zone 21 Financing section should require annexation
as a condition of the first discretionary approval in the zone. A related question
is whether the entire zone must annex at that time or only the property that is
proposing development. We concluded that it is not necessary for the entire zone
to annex at once.
2. The date that the freeway interchanges are determined to be guaranteed will be
modified per your comment.
3. The Engineering Department will be looking at the feasibility of an assessment
district for Poinsettia Lane as part of the Zone 20 Specific Plan. The majority of
Poinsettia Lane will be in Zone 20, and whatever mechanism is used to finance it
will depend heavily upon what the Zone 20 property owners do. Therefore, the
Engineering Department recommends keeping our options open at this time.
4. All: references to reimbursement agreements are being modified per your

Dear Jack,
As you know, I have been working to get the Zone 21 Plan scheduled at the earliest
available Planning Commission date. We were initially trying for the June 5 meeting (next
Wednesday), but the new Financing section was not ready in time to make that meeting.
Next we looked at the possibility of June 19 or July 3. However, we have an unusually
large number of projects and reports going to the Planning Commission at this time, and
both of those agendas are already full. In fact, the Commission has added a special
meeting on June 12 specifically to hear the Open Space Element and the Parks and
Recreation Element. The Housing Element is scheduled for June 19, and the Building
Height report is scheduled for July 3, as well as several other controversial projects.
Zone 21 is now scheduled for July 17, pending final resolution of the wording of the
Financing section. It is anticipated that the financing language will be completed well
before the public noticing date for the July 17 meeting. Therefore, I believe we can feel
confidant with this date.
Please express my appreciation to the property owners for their patience during this
period. It was a pleasure meeting with them at your meeting on May 16. I look forward
to working with you and the property owners on the adoption of the Zone 21 plan.

FINANCING SECTION OF DRAFT ZONE 21 LFMP
Thank you for your undated memorandum enclosing a draft of the
financing section for the Zone 21 zone plan. I offer the following
comments:
1. The statement that the zone is required to annex to the CFD as
a condition of the first discretionary approval is confusing.
The time for the entire zone to be included in the CFD was
when it was formed. Annexation to the CFD must be made in
accordance with the procedures set out in the 1984 amendments
to the Mello-Roos Community Facilities Act of 1982 (Government
Code Section 53339 et seq., copy attached). According to
these procedures, the City Council must adopt a resolution of
intention to add the territory and hold a hearing on that
resolution of intention not less than 30 nor more than 60 days
after its adoption. You should work out an administrative
plan to coordinate these hearings with those required before
the Planning Commission and City Council on the development
itself.
2. The date that the freeway interchanges are determined to be
guaranteed should be 30 days after owner approval of the
Community Facilities District to be consistent with the
documents approving the District.
3. We should consider an assessment or improvement district for
Poinsettia Lane. Requiring each developer to build a portion
of that road will result in a patchwork quilt pattern of
improvements which we should avoid if possible.
4. We should change the word "shall" to "may" whenever we are
referring to a reimbursement agreement in favor of a developer
who constructs improvements in excess of those that would be
required by his individual development. The assessment
district can be coordinated with the improvement of Poinsettia
Lane required in Zone 20.
5. I could not locate a list or schedule of facilities
requirements correlated to individual development projects
within the zone as required by CMC §21.90.110(d)(4).
6. I could not locate a discussion of the proportionate share of
the cost of facilities and improvements identified in the
city-wide facilities and improvements plan attributable to
development of property within the zone as required by CMC
§21.90.110(e).

Attached is a draft Financing section from the Zone 21 LFMP for your review and
comment. This document differs significantly from the Financing sections of all prior Zone
Plans In that it is an attempt to fully meet the letter and Intent of the ordinance. This has
been done based on the assumption that the Mello Roos CFD will be certified and
formed, guaranteeing the Cltywide facilities.
Because this Is the first such zone plan, it was necessary to invent the format for it. The
key portions of the document have been highlighted to facilitate your review. The single
biggest change is that there will no longer be a separate Financing Plan. However, there
will still be a need for later actions to implement the financing mechanisms which will
provide the actual guarantee for the various local facilities. These actions could include
forming assessment district or Mello Roos districts, establishing zone fees, entering into
agreements, and other formal steps to carry out the financing program. We have referred
to this later step as the Financing Implementation Plan.
Your comments would be appreciated on both the format and content of this Financing
section. We want this zone plan to be "state of the art' in terms of financing and to reflect
exactly what you want to see in the Financing section of a LFMP.

FACILITIES FINANCING SUMMARY
The Local Facilities Management Plan concludes that Zone 21 will require over
$49,000,000 in local facilities (exclusive of Administrative, Library and Waste Water
Facilities) over the next 14 years as the zone builds out. Many of these facilities, such as
Macario Park and the Poinsettia Lane/Interstate 5 interchange are extremely expensive, of
City wide benefit and outside of the economic capability of any single owner in the zone.
As a result, the facilities financing section proposed in this plan relies heavily on
participation in the Mello Roos Community Facilities District.
Zone 21 is currently not included within the boundaries of Community Facilities
District No. 1. The Zone is required to annex to the CFD as a condition of the first
discretionary approval. Upon annexation into the District, the guarantee requirements for
facilities funded through the CFD will have been met.
The Zone 21 Local Facilities Management Plan reviews 11 specific facilities in
relationship to performance standards established by the growth management program.
A summary of required facilities in each group and the funding options discussed herein
is contained in Exhibit 39, Facilities Financing Matrices.
A detailed Local Facilities Financing Implementation Plan guaranteeing the financing or
construction of needed facilities will be prepared and adopted by the City Council prior
to the recordation of the first final map, issuance of a grading permit or building permit,
which ever occurs first.
I. CITY WIDE FACILITIES
Facilities discussed in this section are funded from municipal sources and are an integral
part of the City's on going capital improvement budgeting process.
A. CITY ADMINISTRATIVE FACILITIES
New maintenance, warehouse and administrative buildings are contained in this
category. These facilities will be funded with revenues generated through the
City's Public Facilities Fees, Sewer Fees and/or the Mello Roos Community
Facilities District. The projected cost of these facilities is $29,550,000.
This obligation will be met through the payment of fees and/or Community
Facilities District taxes.
B. LIBRARY
Library remodeling and the construction of a new Library facility in South

Carlsbad are contained in this category. Revenue sources for these facilities are the
City's Public Facilities Fee Program and the Community Facilities District.
This obligation will be met through the payment of fees and/or Community
Facilities District taxes.
C. WASTEWATER FACILITIES
The expansion, upgrading and management of facilities to process sewer effluent
are addressed in mis category. The projected $45,894,413 cost is funded entirely
from developer paid sewer fees. This facility is a part of an ongoing expansion
and upgrading process that will continue through build out.
This obligation will be met through the payment of fees.
H. QUADRANT BASED FACILITIES
A. PARKS
Zone 21 is in the City's southwest quadrant district for parks planning and service
purposes. Zone 21 shares responsibility for parks facilities with Growth
Management Zones 4, 9, 19, 20, 22,23 and a portion of Zone 6. These facilities
are also funded from traditional municipal sources through the City's on-going
capital improvements program.
Parks facilities required to serve the southwest quadrant include the recently
acquired Alta Mira park site located within Zone 20; the dedicated Zone 19
Community parks site and a shared portion of the Macario City wide park. The
projected cost of park facilities is $25,652,250. Actual construction of these
facilities is phased through build out of the southwest quadrant of the City.
All development within Zone 21 will be required to pay Public Facilities and Park
in lieu Fees to insure adequate funding of needed facilities through build out.
HI. ZONE LEVEL FACILITIES
Facilities addressed in this section are those demanded specifically as a result of
development within Zone 21. Funding of these facilities is generally the responsibility of
the development creating demand for the given facility through fee payment or direct
funding as an integral part of development. Facilities in this category may benefit adjacent
properties, properties within other zones or the general public. As a result, multi party
agreements may be required to insure that facility burdens are shared equitably.
A. DRAINAGE
Demand for these facilities is best determined by the City Engineer in conjunction
with the review of development plans. Prior to recordation of a final map
developers will be required to guarantee the construction of the Master Plan
facilities identified within the impacted watershed.
The developer of a given facility may receive credit for Drainage Fees which may
be payable for his development. If the cost of construction including design and
incidental costs, exceeds the total amount of Drainage Fees payable, the developer
shall enter into a reimbursement agreement with the City of Carlsbad to be
reimbursed for the excess amount from future Drainage fees collected by the City.
B. CIRCULATION
Circulation facilities fall into three major categories:

ARTERIAL ROAD SEGMENTS
INTERSECTIONS
1. FREEWAY INTERCHANGES
The expansion of Poinsettia Lane interchange is funded in the existing Bridge
and Thoroughfare District and proposed as a part of the City sponsored
Mello Roos Community Facilities District. This facility will be determined
to be guaranteed upon property owner approval of Community Facilities
District 1.
2. ARTERIAL ROAD SEGMENTS
Poinsettia Lane and El Camino Real improvements serve the circulation
needs for an area much larger than Zone 21. In the event that a developer
must advance funds for these facilities, a reimbursement agreement will
be necessary. If this agreement involves the City hi any capacity it will
require approval by the City Council.
Funding of the facility could be accomplished through a series of options
including, but not limited to, adjacent property owner/developers; Local
Facilities Management Fees; Community Facilities Districts; Assessment
Districts or other fee or improvement district approaches.
a. Poinsettia Lane
The Local Facilities Management Plan anticipates that
owners/developers will fund and build Poinsettia Lane concurrently
with, and as an integral part of, their developments. The City will
guarantee construction and compliance with circulation policies by
imposing conditions on applicable tentative maps.
b. El Camino Real
£1 Camino Real widening between Camino Vida Roble and Alga Road
is projected to be funded and constructed concurrently with
development of properties located adjacent to the required
improvements. The City will guarantee this facility and compliance
with circulation policies through the imposition of conditions of
approval on tentative map approvals granted on properties located
immediately adjacent to the required improvements.
Alternative forms of financing for these major facilities may be
explored by property owner/developers as a part of the Local Facilities
Financing Implementation Plan. These options include establishment
of Local Facilities Management Fees, a Community Facilities District,
an assessment district or other such option as may be acceptable to the
City of Carlsbad.
Until the Local Facilities Financing Implementation Plan is adopted and
the specific funding guarantees are in place, no building or grading
permits will be issued and final maps will not be approved for
recordation.
3. INTERSECTIONS
The funding guarantees for required intersection and road improvements are
provided as shown below:

agreement to reimburse the excess costs incurred from future fees collected
by the City.
C. SEWER
Facilities will be constructed concurrent with development on the basis of the
Sewer Master Plan requirements.

Financing Section for Draft Zone 21 LFMP
Attached is a draft Financing section from the Zone 21 LFMP for your review and
comment. This document differs significantly from the Financing sections of all prior Zone
Plans in that it is an attempt to fully meet the letter and intent of the ordinance. This has
been done based on the assumption that the Mello Roos CFD will be certified and
formed, guaranteeing the Citywide facilities.
Because this is the first such zone plan, it was necessary to invent the format for it. The
key portions of the document have been highlighted to facilitate your review. The single
biggest change is that there will no longer be a separate Financing Plan. However, there
will still be a need for later actions to implement the financing mechanisms which will
provide the actual guarantee for the various local facilities. These actions could include
forming assessment district or Mello Roos districts, establishing zone fees, entering into
agreements, and other formal steps to carry out the financing program. We have referred
to this later step as the Financing Implementation Plan.
Your comments would be appreciated on both the format and content of this Financing
section. We want this zone plan to be "state of the art" in terms of financing and to reflect
exactly what you want to see in the Financing section of a LFMP.

ZONE 21 FINANCING SECTION
This section has been prepared in compliance with section
21.90.1lO(d)(3) of the Carlsbad Municipal Code which outlines the
required contents of the Financing Plan section of a Local
Facilities Management Plan. The specific items to be included in
the Financing Plan section are as follows:
(1) Identification of those facilities that would otherwise be
provided as a condition of approval of a development project
or provided by a developer in order to establish consistency
with the General Plan or Titles 18, 20 or 21 of the Municipal
Code.
(2) Identification of those facilities for which new funding
methods are necessary to insure that sufficient funds are
available to construct facilities when required by the phasing
schedule.
(3) Identification of facilities that are required by more than
one Zone, in which case, the plan for each Zone shall be
coordinated. Coordination, however, shall not require
identical funding methods.
(4) A list of facilities requirements correlated to individual
development projects within the Zone.
(5) A table showing the proportionate share of the cost of
facilities identified in the Citywide Facilities and
Improvements Plan attributable to development in the Zone.
These five requirements are addressed in the following discussion:
The Zone 21 Local Facilities Management Plan reviews 11 specific
public facilities in relationship to performance standards
established by the Growth Management Program. A summary of
required facilities is contained in each specific facility's
analysis section and summarized in each section's Facility
Financing Matrix.
Exhibit "A" contains a complete list of facilities required by the
Zone 21 Local Facilities Management Plan including those required
to establish General Plan and Municipal Code consistency.
All facilities required to serve development in Zone 21 as
identified in this Local Facilities Management Plan will be
provided through a combination of annexation to and participation
in City of Carlsbad Community Facilities District No. 1 and as
conditions of approval of individual development projects. No new
funding methods or sources are required to insure that sufficient
funds will be available to construct facilities when required by
the phasing schedule.
Zone 21 is currently not included in the boundaries of Community
Facilities District No. 1. Properties within the Zone shall be
required to annex to the CFD on a property by property basis as a
condition of discretionary approval. Upon annexation into the
District, the guarantee requirements of facilities funded through
the CFD will have been met for the property (ies) annexed.
Exhibit B demonstrates the proportional relationship between
Zone 21 and the total demand and costs related to facilities
identified in the City wide Facilities and Improvements Plan as
required by section 21.90.110(d) (4) of the Carlsbad Municipal Code.
The relationship of Zone 21 facilities requirements to individual
projects/properties is shown in Exhibit-C—, Ownership/Facility
Correlation Matrix and Exhibit -D—, Ownership Location Map. The
ownership/facility correlation matrix indicates whether an
Individual property is initially responsible for guaranteeing an
entire facility (W), a portion of the facility (S) or none of the
facility (N).
on this basis, it is the obligation of the individual property
owner/developer to demonstrate prior to final map recordation, or
permit issuance, how any proposed development will meet the
requirements of the Zone 21 Local Facilities Management Plan.
REIMBURSEMENT
Any developer constructing facilities for which reimbursement may
be claimed shall be eligible for such reimbursement only upon
approval of the City Council of the City of Carlsbad to the extent
that funds are available from a specific facility related source of
revenue. The schedule of reimbursement shall be based on the
City's Capital Improvement Program (CIP) or the city's
determination of the availability of non obligated specific source
funds.
CFD FUNDED CITY WIDE FACILITIES
The following facilities will be provided through the payment of
Community Facilities District taxes and City fees:
- City Administrative Facilities
New maintenance, warehouse and administrative buildings
- Library Facilities
Library remodeling and construction of a new library facility
in South Carlsbad
DEVELOPER FUNDED FACILITIES
- Waste water Treatment Facilities
Encina Water Pollution Control Facility Phase IV expansion and
management of facilities to process sewer effluent. Future
facility upgrades are totally funded through sewer connection
fees.
- Parks
All development within Zone 21 will be required to pay Public
Facilities and Park in lieu fees to insure adequate funding
of need facilities through build out.
In addition, Community Facilities District Funds will be used
to fund Macario Canyon Park improvements.
- Drainage
Demand for these facilities is determined by the city
Engineer in conjunction with the review of development plans.
Prior to recordation of a final map, developers will be
required to guarantee the construction of the Master Plan
facilities identified within the impacted watershed.
- Circulation
Circulation facilities fall into three major categories:
FREEWAY INTERCHANGES
ARTERIAL ROAD SEGMENTS
INTERSECTIONS
FREEWY INTERCHANGES are included in the funding authorized in
the formation of Community Facilities District No. 1.
ARTERIAL ROAD SEGMENTS located within Zone 21 are Poinsettia
Lane and El Camino Real. These facilities will be constructed
through the normal public improvement requirements of the
subdivision map act and the Carlsbad Municipal Code.
Financing guarantees and threshold compliance will be obtained
by placing conditions on applicable tentative map approvals.
Alternative forms.of financing for these major facilities may
be explored by the City and/or any Zone 21 property
owner/developer. These options include establishment of Local
Facilities Management Fees, an assessment district or other
such option as may be acceptable to the city of Carlsbad.
INTERSECTIONS are guaranteed in accordance with the
following schedule:

CIRCULATION FACILITIES
I. PERFORMANCE STANDARD
No road segment or intersection in the zone nor any road segment or intersection out of the zone
which is impacted by development in the zone shall be projected to exceed a Service Level C
during off-peak hours, nor Service Level D during peak hours. Impacted means where twenty
percent or more of the traffic generated by the Local Facilities Management Zone will use the
road segment or intersection.
H. FACILITY PLANNING AND ADEQUACY ANALYSIS
This analysis determines whether or not the circulation system within Zone 21 conforms to the
adopted performance standards. It will also address all Circulation Element road segments and
intersections outside of Zone 21 impacted by twenty percent or more of the traffic generated by
Zone 21 to ensure conformance with the adopted performance standard.
This section is based on the Transportation Analysis For Facilities Management Zone 21
prepared by Urban Systems Associates, Inc, February, 1990.12 The report analyzes existing,
1992, 1995, 2000 and city build out conditions (2010). Assumptions were made in the traffic
report as to the location of residential development in each phase. These assumptions were
provided to the traffic engineer by the property owners of Zone 21. Based on these yearly
projections, the phasing of Circulation Element roadways located within Zone 21 are identified.
The location of proposed development within each phase is for planning purposes only. The
actual location and phasing of development may affect the timing for provision of Circulation
Element roadways within Zone 21, however, it will not change the requirement to provide these
roadways. The financial guarantee for proposed circulation element roadways will be provided,
however, the construction of the facility may not occur until the development requiring the need
for the roadways are constructed.
In the event that it is determined that circulation facilities need to be accelerated or delayed as
a result of changes in the location and/or timing of development, the timing of the required
improvements may be modified without amendment to this plan. However, any deletions or
additions to the list of improvements anticipated herein will require amending to this local plan.

A. INVENTORY
1. Circulation Element Roads Within Zone 21
As shown on Exhibit 34 on page —, a four lane segment of El Camino Real is the
only existing circulation element roadway located within Zone 21. This road
segment is designated as a six lane prime arterial by the City of Carlsbad. At
build out, Poinsettia Lane will be the only additional circulation element roadway
located within Zone 21. Poinsettia Lane is designated as a 4 lane major arterial
by the City of Carlsbad.
2. Identification of Impacted Road Segments and Intersections
As stated in the performance standard, impacted road segments and intersections
are those that have 20% or more of the Zone 21 traffic using them. It is possible
that certain road segments or intersections will not be analyzed for each study
year. The construction of additional road segments may decrease the distribution
on a road segment below 20% distribution.
Exhibits 35 through 38 on page - show the estimated percentage of traffic leaving
Zone 21 for the years 1993, 1995, 2000 and build out conditions. The road
segments and intersections that are impacted by Zone 21 are as follows:

B. PHASING
The traffic analysis prepared by Urban Systems Associates, Inc. is a detailed study
dealing with the specific traffic generated from within the boundaries of Zone 21. This
study analyzes the impacts of traffic on existing and proposed road segments and
intersections impacted by Zone 21. The report also proposes a mitigation plan to ensure
conformance with the adopted performance standard through build out.
The traffic analysis uses the proposed roadway system and intersection geometries for
existing conditions and the years 1993, 1995, 2000 and build out conditions as outlined
by the City of Carlsbad in their Network Alternative #1 Forecast13.
The time increments are used more as bench marks than actual completion dates. If a
future traffic analysis indicates that the timing of the necessary improvements needs to
be accelerated, or that the timing is premature, the required improvements must also be
adjusted to guarantee that conformance with the adopted performance standard will be
maintained.
Existing conditions were determined by performing peak hour counts at study
intersections and road segments as well as by analyzing 1989/90 data provided by the
City of Carlsbad, Caltrans, SANDAG and Urban Systems. Conditions for the year 1993
were evaluated using incremental increases in existing conditions using a regional growth
rate. The years 1995, 2000 and build out were evaluated using data developed from the
SANDAG/City of Carlsbad computer traffic forecast model for these years.
The street segment classifications show the peak hour volume per lane of the street
segment, the existing peak hour volume to capacity (V/C) ratio, and the street segment
level of Service (LOS) without mitigation and with mitigation. The peak hour capacity
per lane is assumed as 1,800 vehicles per hour per lane (VPHPL) for the City Surface
streets. The existing peak hour volumes are derived from adjacent intersection peak hour
counts, where available, or were assumed to be ten percent of street segment ADT with
a 60 percent peak direction per lane.

The purpose of this analysis is to evaluate impacted road segments and intersections
serving Zone 21 and propose a mitigation plan if these facilities are determined to
operate below the adopted performance standard. The phasing of development and
analysis of traffic impacts will be monitored on an annual basis. However, for the
purpose of this study, the timing of the necessary improvements will be presented in the
following increments:
Improvements needed now
Improvements needed prior to 1993
Improvements needed prior to 1995
Improvements needed prior to 2000
Improvements needed prior to Build Out
The phasing schedule noted above shall not limit needed traffic improvements to the
years mentioned. If a future traffic analysis indicates that the timing of the necessary
improvements has changed, the required improvements shall also be adjusted to guarantee
that conformance with the adopted performance standard will be maintained.
B. ADEQUACY FINDINGS
This section will analyze the existing and proposed intersections and road segments
affected by the traffic generated from Zone 21. In accordance with the adopted
performance standard, the existing and proposed traffic facilities within and surrounding
Zone 21 will be identified by an evaluated level of service. The performance standard
determines that during peak hours a level of service A-D as acceptable and a level of
service of E or worse to be unacceptable. If a facility is determined to fail to meet the
standard, a mitigation program must be prepared so that the facility will operate at an
acceptable level of service. The proposed mitigation program will be discussed more
thoroughly later in this report.
Traffic conditions for existing, 1993, 1995, 2000 and build out are shown below. The
level of service for impacted roadways and intersections are indicated and, if needed,
recommended circulation improvement needs are identified.

The LOS for the I-5/Poinsettia Interchange and intersection of Poinsettia Lane/Paseo Del Norte
assumes full improvements in 1993 through implementation of the City-Wide Mello-Roos
District. If these improvements are not provided by 1993, alternative financing and
improvements must be required prior to additional development within Zone 21.
It is projected that the Poinsettia Lane/Aviara Scenic Drive intersection requires removal of all-
way stops facing east and westbound traffic in 1994 with signal installation to follow in 1995
in order to provide an acceptable LOS. In addition, the intersection of Alga Road with
Poinsettia Lane requires signalization in 1995. With the above improvements, all intersections
and road segments are projected to operate at acceptable Levels of Service in 1995 to meet the
adopted performance standard.

Widening for a light-turn-only lane, east to south, will be provided at the Alga Road/El Camino
Real intersection in the year 2005 to ensure conformance with the performance standard. In
addition, El Camino Real will be widened from Camino Vida Roble to Alga Road to full width
by the year 2005. Restriping for three eastbound and westbound through lanes at the Poinsettia
Lane/Paseo Del Norte intersection will also be provided by build out.
With the above improvements, all intersections and road segments are projected to operate at
acceptable Levels of Service to meet the adopted performance standard through build out.
MITIGATION
Special Conditions
Individual project traffic analyses shall be required for projects proposing in excess of 50
residential units. In the event that these analyses indicate that certain facilities need to be
accelerated, or delayed, as a result of changes in the location and/or timing of development, the
timing of the required improvements may be modified without amendment to this plan.
However, any deletions or additions to the list of improvements anticipated herein will require
amending this local plan.
This provision does not eliminate the obligation to financially guarantee any facility identified
in this section prior to final map recordation or issuance of a grading permit or building permit.
A comprehensive financing program guaranteeing construction of the following circulation

The Zone 21 Local Facilities Management Plan application has been deemed complete. We
will continue processing it upon receipt of our usual application fee. It is appropriate with
the receipt of the fee to schedule a property owners meeting so that we may explain the
process and answer any questions they might have at this time.
The issues identified in our original review of the plan include the following:
1. Addition of a standard condition regarding financing (copy attached).
2. Parks - With the assumed phasing no permits will be allowed after 1994 unless the
City Council has taken action to guarantee additional park facilities.
3. Open Space - Include graphic with potential trail linkage identified in adopted open
space plan, and discussion of City Council action regarding Open Space Committee.
4. Schools - The existing Aviara Oaks School is K-8, therefore no future junior high
school is envisioned by the district.
5. Wastewater - City staff will provide updated information prior to public hearing.
6. Drainage - Review the hydrology analysis by Hillman Properties for Aviara Phase I.
Use this analysis to determine downstream pipe sizes.
7. Circulation - Revise the circulation analysis to include existing street segment
volumes and peak hour turn movements since the opening of the Alga - Poinsettia
connection.

OTYWIDE MELLO-ROOS CONDITION
Approval of any discretionary permit within Zone 21 shall be contingent upon the provision
of adequate public facilities to satisfy the Public facilities Element of the General Plan. At
this time a Mello-Roos Community Facilities District is proposed to finance the construction
of several Citywide facilities necessary to serve new development. If the Mello-Roos
Community Facilities District is not formed, oFif the Community Facilities District is formed
but the Zone 21 properties are not participants within that District, the required General
Plan Consistency finding cannot be made. No discretionary approvals, Building Permits,
Grading Permits, Final Maps, or development permits will be issued or approved unless an
alternate financing mechanism is provided by the developer and approved by the City
Council to finance the facilities that would have been or are included in the Community
Facilities District.

At its meeting of July 11, 1989 (see attached), at the request of the
Zone 21 property owners, the City Council authorized the preparation of
the Zone 21 Local Facilities Management Plan.
At that time it was anticipated that the Plan would be prepared solely
by Planning Systems, Inc. of Carlsbad. Although Planning Systems, Inc.
will continue to be involved in the process, an interdisciplinary team
approach to the Facilities Plan will now be used (team members are
listed on Exhibit 1).
The team will be managed by Mr. Jack E. Henthorn of Jack Henthorn and
Associates, under the primary direction of property owner
representatives, Mr. Dwight W. Spires, optionee of the Carlsbad I site,
and Mr. Larry Clemens, representing Carlsbad Partners.
This approach was endorsed during a property owner briefing held on
April 18, 1990, at the Olympic Resort in Carlsbad. A listing of those
in attendance is enclosed as Exhibit II. Those not in attendance were
provided a Meeting Summary as shown in Exhibit III.
Consultant selection has. been completed and contracts are currently
being executed. Mr. Henthorn will be in contact with you to arrange for
a "kick off" meeting with the property owner representatives and
principal consultants within the next week.
Mr. Spires, as a result of our option agreement, will be assuming my
role as primary property owner contact. As you are aware, he has
considerable experience with the City of Carlsbad's Growth Management
Program which should benefit the Zone 21 effort significantly.

The meeting was opened by Mr. Roy Mayemura, who introduced
Mr. Dwight Spiers, who has entered into an option to
purchase the Carlsbad X property and will be taking a
leadership role in the Zone 21 Local Facilities Management
Plan process.
Mr. Spiers, who has completed several major projects in the
Carlsbad area, briefed the attendees on his recent efforts
to activate the Zone 21 Local Facilities Management Plan
process. He noted that the success of the process will
require a combination of general and financial support of
all property owners in the Zone. He then introduced Mr.
Oack Henthorn, of Jack Henthorn and Associates, a local land
planning and project management company with experience in
Local Facilities Management Plan preparation and processing.
Mr. Henthorn outlined the general process required to
prepare a Local Facilities Management Plan, the budgetary
requirements and the associated time frame required for
adoption.
Mr. Spiers made recommendations regarding a consultant team
that he felt represented the best combination of technical
and political qualities available to insure successful
completion of the Local Facilities Management Plan process.
During the discussion period following the presentation the
following issues were discussed:
- alternative approaches to funding the $200,000+ cost of
preparing and processing the Local Facilities ManagementPlan and Local Facilities Financing Plan
- risks and benefits of attempting to process land use
changes concurrently with the Local Facilities Management
Plan
- cost sharing approaches, including potential advancing of
funds by owners of larger properties, with reimbursement
from others at some time in the future through private
agreement and the alternative of equal sharing on the
basis of each property's projected unit yield as per the
study prepared by V.T.N..
- the status of the Growth Management Zones surrounding
Zone 21
- the advantages/disadvantages of proceeding at this point
At the conclusion of the meeting it was agreed that Mr,
Spiers will contact the owners of the larger parcels in the
Zone to determine if they can come to agreement on advancing
the necessary funding to complete the plans. If the funding
commitments can be obtained, the consultant team will be
authorized to proceed immediately.
Once the process is underway, the owners of the Zone's
larger parcels will then start discussions regarding
possible reimbursement scenarios.
Each property owner will be receiving periodic status
reports as the process moves forward. In addition,
quarterly meetings will be held to discuss issues and
provide briefings on activity levels.

Hon. Mayor & Members of the Council:
Under the provisions of the City's Growth Management Program, a
Facilities Management Plan must be approved for each of the 25 Local
Facilities Management Zones. There are three ways that this can be
accomplished. First, the City can prepare the plan with the costs
assessed, to the owners within the Zone. Second, All property
owners may jointly submit a plan. Third, where a "joint" submission
is not possible, any group of owners may petition the Council for
authorization to proceed with preparation and submittal.
Planning Systems has been retained by Classic Development Corp. and
Maysak Investment Corp. to formulate a Local Facilities Management
Plan for Zone 21.
Attempts to contact property owners were begun on January 9, 1987.
A copy of the form letter sent is attached. Response by property
owners has been poor. A final effort to obtain the support of 100%
of Zone 21 's 15 property owners was begun in February, 1989.
Notices were sent to all owners of record inviting attendance at a
meeting held on March 9, 1989, for the purpose of explaining the
program and soliciting support. These letters were sent Registered
Mail with return receipt requested.

zone's 1572. #fc acres. At the conclusion of the meeting the owners
verbally agreed to support preparation of the plan.
Several of the larger ownerships have agreed to pick up costs where
a property owner does not desire to share in costs. This option
will be made available to all property owners after build-out
projections are approved by the staff. This eliminates the need for
City involvement in cost apportionment.
After contacting all 15 property owners, since January 9, 1987, we
have received a committment of 9 property owners representing 172.7
acres, or 63% of the Zone's total land area.
