RECOMMENDED CHANGE TO ZONE 21 LFMP AMENDMENT (LFMP 87-21 (A))
The Engineering Department is recommending a minor wording change to the
proposed revisions in the Circulation mitigation requirements listed on Exhibit "X". It
is suggested that the wording in the third paragraph under the Circulation section on
page 10 and the third paragraph under the Special Conditions section on page 94 be
revised to read as follows:
"Prior to the recordation of the first final map within Zone 21, a fee or other financing
program guaranteeing construction of Poinsettia Lane between El Camino Real and
Alga Road shall be approved by the City Council."
The proposed wording change is intended to provide the Zone 21 developers with the
flexibility to develop an alternative financing mechanism in the event that an
acceptable fee program can not be developed.

D. CIRCULATION
Circulation facilities fell into three mayor categories:

1. FREEWAY INTERCHANGES
Freeway Interchanges are included in the funding authorized in the
formation of Community Facilities District No. 1.
2. ARTERIAL ROAD SEGMENTS
Arterial Road Segments located within Zone 21 are Poinsettia Lane and
£3 Camino Real. Tbese facilities wffl be constructed through the normal
public improvement requirements of the subdivision map act and the
Carlsbad Municipal Code. Financing guarantees and threshold
compliance will be obtained by placing conditions on applicable tentative
map approvals.
Alternative forms of financing for these major facilities may be explored
_ by the City and/or any Zone 21 property owner/developer. Tliese options
include establishment of Local Facilities Management Fees, an assessment
district or other such option as may be acceptable to the City of Carlsbad.

On September 17, 1991, the City Council adopted the Zone 21 Local Facilities
Management Plan. This document is required as a part of the City's Growth Management
Plan and serves to identify facilities needs necessary to serve the ultimate development of
the properties within the Zone.
The City has recently begun to grant development approvals within Local Facilities
Management Zone 21. In the process, the staff has found that it is necessary to consider
amending conditions relating to School Facilities and Poinsettia Lane financing and design.

AMF.NDftdENT - Request for approval of an amendment to the Zone 21 Local
Facilities Management Plan to include revisions to the Circulation and School
Facilities sections.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 3688,
recommending APPROVAL of the amendment to the Zone 21 Local Facilities Management
Plan based on the findings and subject to the condition contained therein.
O. PROJECT DESCRIPTION AND BACKGROUND
The Zone 21 Local Facilities Management Plan (LFMP) was originally adopted on
September 17, 1991. To ensure the provision of adequate circulation facilities in
compliance with Growth Management standards for Zone 21, special conditions were
added to the Circulation Facilities section of the Zone 21 LFMP. One of the special
conditions requires that prior to recordation of the first final map or issuance of a grading
or building permit, the ultimate grade and alignment be established for Poinsettia Lane
between El Camino Real and Alga Road. This condition was imposed to ensure that a
reasonably accurate cost estimate to construct Poinsettia Lane was developed and a funding
mechanism was identified before development occurred within the zone.
Subsequent to approval of the Zone 21 LFMP, the Zone 20 LFMP was amended to include
a financing plan for the provision of public facilities. The financing plan of the Zone 20
LFMP proposed a zone fee program for the Poinsettia Lane and Alga Road arterials which
occur in Zones 19, 20 and 21. The fee program is intended to provide a way for
developments to contribute financially to the construction of the roads since they will all
benefit from these roadway improvements. The basic mechanism for constructing the roads
will be by improvement agreement with those property owners who have frontage on one
of the roads or who require one of them for access to their project.

A precise fee formula was not established in the Zone 20 financing plan because an
accurate cost estimate for the roadways was not available at that time. The Zone 20 LFMP
includes a condition requiring that a fee program be approved by the City Council prior to
approval of the first final map in the zone. It was noted at the time the Zone 20 LFMP
was approved that it may also be necessary to amend the Zones 19 and 21 LFMPs to
include the same condition.
Staff is currently working on developing a fee program for Poinsettia Lane. To this end,
a reasonably accurate cost estimate for the Poinsettia Lane extension has been developed
without fixing the alignment of the roadway. In addition, it has been determined that all
property owners within Zone 21 must participate in the financing of Poinsettia Lane. As
it will be possible to develop a financing program for Poinsettia Lane without fixing the
alignment of the roadway at this time, it appears that the establishment of the ultimate
alignment for Poinsettia Lane can be postponed until a property owner, located along one
of the proposed future alignments of the roadway, is prepared to develop. This would
eliminate the burdensome requirement for property owners located within the zone, but
not adjacent to the proposed alignments for Poinsettia Lane to fix the roadway alignment.
Regarding schools, the City Council recently adopted a new school condition to be applied
to all legislative approvals. Staff is recommending including this new condition whenever
a LFMP is amended. Therefore, the new school condition has been included in this
amendment request.
The following is a summary of the updated status of each of the facilities for Local
Facilities Management Plan Zone 21.
Citv Administrative Facilities. Library, and Parks. Community Facilities District (CFD) No.
1 was formed in 1991 to finance a number of facilities of Citywide benefit. All properties
in Zones 21 are required to annex into the City's Mello-Roos Community Facilities District.
A combination of CFD No. 1 and payment of Public Facilities Fee (PFF) constitutes the
required financial guarantee for City Administrative Facilities and Library. Park facilities
are guaranteed by a combination of park-in-lieu Fees and PFF in compliance with the
special condition of the LFMP.
Wastewater Treatment Capacity. The Phase IV expansion of the Encina Water Pollution
Control Facility has been completed. Wastewater treatment capacity is funded by sewer
connection fees. Ongoing monitoring of Encinas treatment plant flows is a condition of the
Zone.
Drainage. All development within Zone 21 will be required to construct any proposed
storm drain facilities established by the Revised Drainage Master Plan.

Circulation. With the required mitigation, as modified by this amendment, Zone 21 will
meet the standards of the Growth Management Ordinance.
Open Space. Open space within Zone 21 will be in compliance with the latest adopted
standards.
Schools. With the required mitigation, as modified by this amendment, Zone 21 will meet
the standards of the Growth Management Ordinance.
Fire. All fire facilities are in place for Zone 21 and the required performance standard has
been met.
Water and Sewer. All faculties will be provided pursuant to the 1990 Water Master Plan.
All potable water and reclaimed water facilities required to serve Zone 21 will be
constructed or appropriate fees paid at the time of development. Sewer facilities will be
provided to meet established standards.
HI. ANALYSIS
Planning Issues
1. Does the proposed amendment to the Zone 21 Local Facilities Management Plan
satisfy all requirements of the Growth Management Ordinance (Chapter 21.90 of
the Carlsbad Municipal Code)?
DISCUSSION
The proposed amendment to the Zone 21 Local Faculties Management Plan has been
prepared in accordance with Chapter 21.90 of the Carlsbad Municipal Code. The existing
LFMP requires as a condition of Zone 21 that prior to the recordation of the first final map
or issuance of a grading or building permit, whichever occurs first within the zone, the
ultimate grade and alignment be established for Poinsettia Lane between El Camino Real
and Alga Road. Upon receipt of recent development proposals within Zone 21, which were
not located along either of the two proposed roadway alignments for Poinsettia Lane, it
was determined that the condition as written was onerous. Consequently, staff is
recommending that this condition be modified to read: "Prior to the recordation of the first
final map or issuance of a grading or building permit, whichever occurs first for property
located adjacent to either of the two alternative alignments of Poinsettia Lane within Zone
21, the ultimate grade and alignment shall be established for Poinsettia Lane between El
Camino Real and Alga Road".

In addition, staff is recommending that a new Circulation Special Condition be added which
will ensure funding of the Poinsettia Lane. This condition would read "prior to recordation
of the first final map within Zone 21, a fee program guaranteeing construction of Poinsettia
Lane between El Camino Real and Alga Road shall be approved by the City Council." The
modification of the existing condition and the addition of the new condition would alleviate
the overly burdensome condition of requiring property owners located within the zone, but
not adjacent to the proposed roadway alignments, to fix the alignment of Poinsettia Lane.
Finally, staff is recommending that the School Special Condition be amended. This change
is in accordance with City Council direction requiring that the new school condition be
applied to all legislative approvals. These changes are consistent with the City's Growth
Management Ordinance (Chapter 21.90 of the Carlsbad Municipal Code).
IV. ENVIRONMENTAL REVIEW
The proposed LFMP amendment is covered by a previously approved Negative Declaration
issued by the Planning Director on May 2, 1991.

SCHOOLS
Prior to the approval of any final map or the issuance of any permits within Zone 21, the applicant for
the final map or permit shall submit evidence to the City that impacts to school facilities have been
mitigated in conformance with the City's Growth Management Plan to the extent permitted by
applicable state law for legislative approvals. If the mitigation involves a financing scheme such as a
Mello-Roos Community Facilities District which is inconsistent with the City's Growth Management Plan
including City Council Policy Statement No. 38, the developer shall disclose to future owners in the
project, to the maximum extent possible, the existence of the tax and that the school district is the
taxing agency responsible for the financing district.
SEWER COLLECTION SYSTEM
A. All Watersheds
All development within Zone 21 will be required to pay the appropriate Sewer Connection Fees and
Sewer Benefit Area Fees prior to issuance of any building permits.
B. North Batiquitos Sewer Basin
Watershed A:
1. Prior to the recordation of the first final map, issuance of grading or building permit, whichever
occurs first for any development in Watershed A of Zone 21, a financing mechanism
guaranteeing the construction of the following sewer facilities must be provided:
a. The North Batiquitos Trunk System (NBT2) from Watershed A to the North Batiquitos
Interceptor.
2. Prior to occupancy of any development in Watershed A of Zone 21, construction of the following
sewer facilities must be completed:

2. Phasing
The Carlsbad Unified School District recently adopted a new school location plan.
The district has also adopted a finance plan based on the Mello-Roos financing
mechanism. The new school location plan projections also dictate a spatial
relationship to each LFMP zone. Since build out numbers for Zones 10, 21 and
17 were not available at the time of the school location plan preparation, the Zone
10 elementary site (SE quadrant) is considered to be very general. Future changes
in population intensity and distribution expectations could cause a westward shift
(to the SW quadrant) of the existing Zone 10 school location.
The location plan also indicated that one additional elementary school will be
needed in the southwest quadrant in the future. The exact location for the future
elementary school is yet to be determined by the CUSD.
B. ADEQUACY FINDINGS
For the purposes of long range planning, Carlsbad Unified School District considers all
existing facilities at capacity. The smallest increment of demand area used by the District
for facility analysis is the quadrant. Additional school sites have been identified in the
southwest quadrant. K-8 students generated from Zone 21 will attend Aviara Oaks
School, while grades 9-12 students will continue to attend Carlsbad High School.

Special Conditions
Prior to the approval of any final map or the issuance of any permits within Zone 21, the
applicant for the final map or permit shall submit evidence to the City that impacts to school
facilities have been mitigated in conformance with the City's Growth Management Plan to the
extent permitted by applicable state law for legislative approvals. If the mitigation involves a
financing scheme such as a Mello-Roos Community Facilities District which is inconsistent with
the City's Growth Management Plan including City Council Policy Statement No. 38, the
developer shall disclose to future owners in the project, to the maximum extent possible, the
existence of the tax and that the school district is the taxing agency responsible for the financing
district.
IV. FINANCING
The District has adopted an alternative method to provide funding for school facilities in the
form of a "Facility Financing Plan." The plan is a Mello-Roos based program. If the District
elects to initiate the strategy outlined in the Facility Financing Plan, existing school collection
fees will be discontinued and replaced with a new financing system.

Department finds there is no evidence before the City of Carlsbad that the proposal

presumption of adverse effect contained in AB 3158 Chapter 1706 Section 753.5(d).
