The City of Carlsbad has conducted an environmental review of the
above described project pursuant to the Guidelines for
Implementation of the California Environmental Quality Act and the
Environmental Protection Ordinance of the City of Carlsbad. As a
result of said review, a Negative Declaration (declaration that the
project will not have a significant impact on the environment) is
hereby issued for the subject project. Justification for this
action is on file in the Planning Department.
A copy of the Negative Declaration with supportive documents is on
file in the Planning Department, 2075 Las Palmas Drive, Carlsbad,
California 92009; Comments from the public are invited. Please
submit comments in writing to the Planning Department within ten
(10) days of date of issuance.

III. DISCUSSION OF ENVIRONMENTAL EVALUATION
The Local Facilities Management Plan for Zone 24 is a facilities
planning document, the intent of the plan is to establish parameters
and thresholds that assure public facilities are .available when
needed as determined by the City's adopted performance standards. To
accomplish this purpose occasionally locations and costs of public
facility improvements are estimated for informational purposes.
These estimates may result in increased development fees.
Traditionally the developer in maximizing their capital return passes
such fees on to the home buyer or tenant. This results in higher
priced housing which affects the availability of low and moderate
income housing. .However, as real estate value is determined
primarily by location, without other market incentives, it is
unreasonable to assume the subject property would be developed with
either low or moderate income housing due to its proximity to the
Pacific Ocean and the existing General Plan designation.

specific project. The Zone 24 Local Facilities Management Plan

IV. DETERMINATION (To Be Completed By The Planning Department)
On the basis of this initial evaluation:
X I find the proposed project COULD NOT have a significant effect on
the environment, and a NEGATIVE DECLARATION will be prepared.

this case because the mitigation measures described on an attached

I. RECOMMENDATION
That the Planning Commission ADOPT Resolution No. 2792
recommending APPROVAL of the Negative Declaration issued by the
Planning Director and ADOPT Resolution 2793 recommending
APPROVAL of Local Facilities Management Plan 24.
II. PROJECT DESCRIPTION AND BACKGROUND
As shown on Exhibit "A" Zone 24 is located in the northwestern
quadrant of the City immediately east of Local Facilities
Management Zone 8.
As shown on Exhibit "B" Zone 24 is primarily residential. Of
the Zone's 201.5 total acres 181.7 are residential. General
Plan residential densities range from low (0-1.5 du/ac) to
medium (4-8 du/ac). Nonresidential General Plan land uses
include 14.4 acres of Open Space and 5.4 acres of circulation
element roadway.
III. ANALYSIS
1. Does the proposed Local Facilities Management Plan for
Zone 24 fulfill the purpose, intent, and specific
requirements of Section 21.90 of the Carlsbad Municipal
Code (Growth Management Program)?
2. Is the Local Facilities Management Plan for Zone 24
consistent with and does it implement the 1986 Citywide
Facilities and Improvement Plan?

DISCUSSION
The Growth Management Program requires that a Local Facilities
Management Plan be prepared for each Management Zone in order
to show how compliance .will be maintained with the City's
adopted public facility performance standards as development
occurs. '.-'_•
The first step in this process requires determining the
buildout development potential in the zone. The buildout
projection for this zone is consistent with the methodology
contained in the 1986 Citywide Facilities and Improvements Plan
and the provisions of Proposition E which was approved by the
citizens of Carlsbad on November 4, 1986.
The plan phases the buildout development of the zone based on
estimates of yearly development activity. The phasing estimate
is consistent with generalized phasing assumptions used in the
1986 Citywide Facilities arid Improvement Plan.
From these buildout and phased development projections, yearly
phased demands for public facilities may be projected and
buildout demands identified. The plan analyzes eleven (11)
public facilities. This analysis compares the projected public
facility demands with the available and planned supply of
public facilities to ensure compliance with the adopted
performance standards. Where demands for facilities exceed
supply, the plan proposes the necessary mitigation to maintain
conformance with the standard. This analysis is consistent
with both the 1986 Citywide Facilities and Improvement Plan and
the Growth Management Program. ;
The Local Facilities Management Plan identifies one facility
which currently does not conform with the adopted performance
standard.
Open Space - A shortfall of 1.17 acres exists in Zone
. 24. As part of this Local Facilities
, Management Plan an . attempt has been made
to bring this facility into conformance
with the adopted performance standard.

ENVIRONMENTAL REVIEW:
The Local Facilities Management Plan for Zone 24 is a public
facilities planning document. The plan establishes parameters that
ensure Carlsbad's public facility performance standards are met and
public facilities inadequacies mitigated to accomplish this goal.
The plan for informational purposes occasionally estimates
locations and costs of public facility improvements. The plan
fully recognizes that complete environmental review will be
necessary once specific public facility improvements are
established.
Therefore, the Local Facilities Management Plan for Zone 24 will
not cause any significant environmental impacts and a Negative
Declaration has been issued by the Planning Director on August 19,
1988.

Thank you for taking the time to review the Zone 24 Local Facilities Management
Plan. It is a planning document to assess the adequacy of existing and proposed
public facilities when compared to future buildout demand and adopted performance
standards. The reason your two specific concerns were not addressed lies in the
nature of that assessment.
First, Road "C" (Sunset) is not a circulation element roadway. The zone plan
only addresses major circulation element roadways of the General Plan. While
the developer might have already made plans for their property, the zone plan
in no way sets the location of Road "C". That action will take place with the
subdivision of the adjacent property; an action of which you will be made aware.
Second, the proposed assessment district is in a very preliminary state. The
nature of the improvements to be included, as well as the benefit area of those
improvements, are still being assessed. The Local Facilities Management Plan
for Zone 24 addresses only the need for specific facilities and estimates their
cost. It does not set the specific financing mechanism for those improvements
nor does it speak to contracts of obligation between individual property owners.
Those will be determined as development and financing proposals are brought
forward to the City.
Thank you again for your input. It is important that we are made aware of your /
concerns so as to incorporate them into the City's future.

We are in receipt of the Public Facilities Plan
nbtebook for Zone 2U and appreciate the immense amount of
planning it represents. It plainly deals with those
facilities needed to support development and not with inter-
ior plans.
However, we have a couple of concerns that rise again.
One is the location of Road "C" (Sunset). It appears crossing
midway through our small property on the large map accompanying
the binder. .We have said before and we say again — this is
totally unacceptable to us. We recall that you told us earlier
that a letter of agreement would be needed between the property
developer to the west of us; however, we simply want to go on
record at this time in registering this concern.
It seems certain that the developers have already made
plans for their properties. Should that be so and the location
of this Road C is indeed where shown, we certainly hope that
changes would have to be made.
Our second concern regards the assessment district necesse-
sary to pay for all the development reauired. We were assured
by Stephen Bieri and Doug Avis that they as major property
developers expected to bear those costs. Small landowners within
Zone 2k were not to be charged.
We have not been contacted by the developer on either side
of us regarding either of these two issues. It is important
that this not be left to the final moments after their planning
is complete. Why has nothing been said about plans that affect
our property so strongly?
We first expressed our concern in a letter to Frank
Aleshire in October 1985. Since that time we've kept in con-
tact with Mike Howes and then more recently in a meeting with
you on February 8, 1988.
We are certainly interested and concerned with the
planning process as it affects our 3h acres. Information and
reports as to the hearingsand meetings are-very welcome.

FOR WATER CONSERVATION AND WATER RECLAMATION
To reduce water demand, implement the water conservation measures described
here.
Required
The following State laws require water-efficient plumbing fixtures in
structures:
o Health and Safety Code Section 17921.3 requires low-flush toilets and
urinals in virtually all buildings as follows:
"After January 1, 1983t all new buildings constructed in this state
shall use water closets and associated flushometer valves, if any, which
are water-conservation water closets as defined by American National
Standards Institute Standard A112.19.2, and urinals and associated
flushometer valves, if any, that use less than an average of 1-1/2
gallons per flush. Blowout water closets and associated flushometer
valves are exempt from the requirements of this section."
o Title 20. California Administrative Code Section I604(f) (Appliance
Efficiency Standards) establishes efficiency standards that give the
maximum flow rate of all new showerheads, lavatory faucets, and sink
faucets, as specified in the standard approved by the American National
Standards Institute on November 16, 1979, and known as ANSI
A112.18.1M-1979-
o Title 20. California Administrative Code Section I606(b) (Appliance
Efficiency Standards) prohibits the sale of fixtures that do not comply
with regulations. No new appliance may be sold or offered for sale in
f California that is not certified by its manufacturer to be in compliance
with the provisions of the regulations establishing applicable
efficiency standards.
o Title 2k of the California Administrative Code Section 2-5307(b)
(California Energy Conservation Standards for New Buildings) prohibits
the installation of fixtures unless the manufacturer has certified to
the CEC compliance with the flow rate standards.
o Title 24. California Administrative Code Sections 2-5352(i) and (j)
address pipe insulation requirements, which can reduce water used before
hot water reaches equipment or fixtures. These requirements apply to
steam and steam-condensate return piping and recirculating hot water
piping in attics, garages, crawl spaces, or unheated spaces other than
between floors or in interior walls. Insulation of water-heating
systems is also required.
o Health and Safety Code Section 40^7 prohibits installation of
residential water softening or conditioning appliances unless certain
conditions are satisfied. Included is the requirement that, in most
instances, the installation of the appliance must be accompanied by
water conservation devices on fixtures using softened or conditioned
water.
o Government Code Section 7800 specifies that lavatories in all public
facilities constructed after January 1, 1985, be equipped with
- - self-closing faucets that limit flow of hot water.
To be Implemented where applicable
Interior;
1. Supply line pressure; Water pressure greater than 50 pounds per square
inch (psi) be reduced to 50 psi or less by means of a pressure-reducing
valve.
2. Drinking fountains; Drinking fountains be equipped with self-closing
valves.
3. Hotel rooms; Conservation reminders be posted in rooms and restrooms.*
Thermostatically controlled mixing valve be installed for bath/shower.
k. Laundry facilities; Water-conserving models of washers be used.

6. Preserve and protect existing trees and shrubs. Established plants are
often adapted to low-water-using conditions and their use saves water
needed to establish replacement vegetation.
7. Install efficient irrigation sTystems that" minimize runoff
evaporation and maximize the water that will reach the plant roots.
Drip irrigation, soil moisture sensors, and automatic irrigation systems
are a few methods of increasing irrigation efficiency.
8. Use pervious paving material whenever feasible to reduce surface water
runoff and to aid in ground water recharge.
9. Grade slopes so that runoff of surface water is minimized.
10. Investigate the feasibility of using reclaimed waste water, stored
rainwater, or grey water for irrigation.
11. Encourage cluster development, which can reduce the amount of land being
converted to urban use. This will reduce the amount of impervious
paving created and thereby aid in ground water recharge.
12. Preserve existing natural drainage areas and encourage the incorporation
of natural drainage systems in new developments. This aids ground water
recharge .
13. To aid in ground water recharge, preserve flood plains and aquifer
recharge areas as open space.
FLOOD DAMAGE PREVENTION
In flood-prone areas, flood damage prevention measures required to protect a
proposed development should be based on the following guidelines:
1. It is the State's policy to conserve water; any potential loss to ground
water should be mitigated.
2. All building structures should be protected against a 100-year flood.
3. In those areas not covered by a Flood Insurance Rate Map or Flood
Boundary and Floodway Map, issued by the Federal Emergency Management
Agency, the 100-year flood elevation and boundary should be shown in the
Environmental Impact Report.
4. At least one route of ingress and egress to the development should be
available during a 100-year flood.
5. The slope and foundation designs for all structures should be based on
detailed soils and engineering studies, especially for hillside
developments..
6. Revegetation of disturbed or newly constructed slopes should be done as
soon as possible (utilizing native or low-water-using plant material).
7.. The potential damage to the proposed development by mudflow should be
assessed and mitigated as required.
8. Grading should be limited to dry months to minimize problems associated
with sediment transport during construction.

Last night the above mentioned Zone Plan was approved
by the Carlsbad Planning Commission. We expect it to
be in front of the City Council in the next few weeks.
I appeared on behalf of the project. One of the major
points I made was to respond to your letter to Michael
Holzmiller, of October 26, 1988. In that letter you
addressed v,two points, the alignment of the road near
your property and your involvement in the proposed
assessment district.
As it relates to the road, I told the Commission that
we had originally fought with the City staff to have
the road deleted to no avail. Also, I indicated that
we are aware of and sensitive to your desires relating
to the ultimate alignment, but that the matter would
ultimately be decided when the tentative map for the
Kelly Ranch project was reviewed. Also, our proposed
project does not prevent any alignment as we simply
terminate the alignment at the Kelly Ranch boundary.
It has always been our intention to not impose assessment
on the smaller property owners for the construction of
Cannon Road. We have, of course, never asked for support
from them for the development of the Zone Plan or the
engineering drawings for Cannon Road, which is approaching
$500,000. I also indicated this to the Planning Commission
qualified by the fact that if an assessment district is the
ultimate method to finance Cannon Road, the City will
ultimately set the individual assessments.
I hope this letter sheds some light on our continued
position relating to these two matters. My bringing them

up during the Public Hearing makes them a matter of public
record. I sincerely hope doing so will give you a level
of comfort relating to Steve's and my position.

made in this letter regarding scheduling are incorrect and
need to be clarified. As you know, Sheila Donovan, Chris
Mack of Rick Engineering and I were all in attendance at
the meeting of July 14, 1988. At no time during or after
this meeting was a July 25, 1988 submittal deadline stated.
In fact, the resubmittal date given to us was July 28,
1988. We have met this deadline by recently submitting the
Zone 24 revisions. Had we been aware of a July 25, 1988
submittal deadline, we would have responded accordingly.
Secondly, the tone of your letter is very disappointing and
discouraging to us. We have worked diligently with your
staff to prepare the best Local Facility Management Plan
possible. We believe that a good working relationship has
been developed between our staffs and we wish to maintain
this. Letters such as the one you have written, especially
when based on inaccurate information, are not conducive to
a good overall working relationship. I would suggest that
a phone call at the time you believe a deadline is missed
would be more helpful and would allow earlier resolution of
any problem that may arise.

As we discussed I have received your letter with the attached
authorization for Ho f man Planning Associates to prepare the Local
Facilities Management Plan for Zone 24. At this time, staff will
review the authorization forms against the property ownership in
Zone 24 and if all the property owners have indeed authorized
Ho f man Planning Associates to prepare the plan, we will begin the
content review immediately.
As we discussed, staff previously reviewed the Zone 24 plan
incorrectly because we had assumed that authorization had already
been obtained from 100% of the property owners. After we were
informed that 100% of the property owners had not reviewed the
plan, we notified you of this fact and stopped processing the

Dear Mr. Hofman:
Enclosed are staff's comments regarding the Local Facilities
Management Plan for Zone 24, submitted December 23, 1987. It is
important to understand that these are initial comments and are
not intended to be a complete technical review of the plan.
Listed below are items that were not included in the plan as
submitted and which make it unacceptable for technical review by
the City. These items include:
1. Analyze circulation using the adopted performance
standard and existing definition of impact.
2. Analyze open space using net developable acreage. Show
how pending Master Plan proposes to meet standard.
3. Itemize proposed development outside of five-minute
fire response time (i.e., Kelly Ranch, Carrillo Ranch).
4. Provide EIR 85-3 to document constraints analysis.
Listed below are comments of a more minor nature; however, these
must be addressed in the final text.
1. Clean up discrepancies between Exhibit 10 and Exhibit
12 (see net acres RL-1 and RM-1). Spelling.
2. For abbreviating a year, the appstrophe is placed
before the number (otherwise it reads as feet).

3. Repeat years on pages 2 and 3 of Exhibit 14.
4. Circulation has been omitted from page 31 which lists
all facilities to be analyzed.
5. Exhibit 15 should show Housing and Redevelopment north

shows 1991-92, please explain.
7. Page 59; Zone 24 does not have the lowest number pf
future dwelling units of all the management zones.
8. Clarify Exhibit 33 and 34 by identifying as "five-
minute" response time. I
9. Provide documentation of nonconstrained nature of
Exhibit 35.
10. Show "Evans Point" CT 86-1 on map in introduction.
11. Show relationship between sewer collection and water
reclamation.
12. Discuss water reclamation in water distribution
section. Provide map and name of service agency.
Again, these comments are not meant to be a complete critical
analysis of the plan, but are intended to enable you to prepare
an acceptable Local Facilities Management Plan. Please call me
