Findings of Exemption (attach as necessary):
1. The City of Carlsbad Planning Department has completed an Environmental Initial
Study for the above referenced property, including evaluation of the proposed
project's potential for adverse environmental impacts on fish and wildlife resources.
2. Based on the completed Environmental Initial Study, the City of Carlsbad Planning
Department finds there is no evidence before the City of Carlsbad that the proposal
will have potential for an adverse effect on wild life resources or the habitat upon
which the wildlife depends.
3. The City of Carlsbad has on the basis of substantial evidence, rebutted the
presumption of adverse effect contained in AB 3158 Chapter 1706 Section 753.5(d).
Certification:
I hereby certify that the lead agency has made the above findings of fact and that
based on the initial study and hearing record the project will not individually or
cumulatively have an adverse effect on wildlife resources, as defined in Section 711.2 of
the Fish and Game Code.

the Financing Plan and changes to reflect current status of certain facilities
ENVIRONMENTAL IMPACTS
STATE CEQA GUIDELINES, Chapter^, Article 5, section 15063 requires that the City conduct an
Environmental Impact Assessment to determine if a project may have a significant effect on the environment.
The Environmental Impact Assessment appears in the following pages in the form of a checklist. This
checklist identifies any physical, biological and human factors that might be impacted by the proposed project
and provides the City with information to use as the basis for deciding whether to prepare an Environmental
Impact Report or Negative Declaration.
* A Negative Declaration may be prepared if the City perceives no substantial evidence that the project or
any of its aspects may cause a significant effect on the environment. On the checklist, "NO" will be checked
to indicate this determination.
* An EIR must be prepared if the City determines that there is substantial evidence that any aspect of the
project may cause a significant effect on the environment. The project may qualify for a Negative
Declaration however, if adverse impacts are mitigated so that environmental effects can be deemed
insignificant. These findings are shown in the checklist under the headings "YES-sig" and "YES-insig"
respectively.
A discussion of potential impacts and the proposed mitigation measures appears at the end of the form under
DISCUSSION OF ENVIRONMENTAL EVALUATION. Particular attention should be given to discussing
mitigation for impacts which would otherwise be determined significant.

DISCUSSION OF ENVIRONMENTAL EVALUATION
The proposed LFMP amendment and financing plan are covered by previously approved Negative Declarations
issued by the Planning Director on August 19, 1988 and November 1, 1990, (attached).
The prior environmental documentation prepared for LFMP 24 included considerations for all facilities
required as part of the Plan including Parks, Circulation, sewer, water, city administrative facilities and
library, wastewater, drainage, open space and schools. The proposed changes to the LFMP will not alter the
ability of the City to achieve these facilities nor significantly change potential environmental impacts of
implementing these facilities as covered by prior environmental documentation. There have been no
significant changes to the original project and there are no changes in circumstances under which significant
impacts will occur.
Although the Zone 24 LFMP did not originally include a financing plan, implementation of plan objectives
was inherent in the Zone 24 LFMP. The prior environmental documentation therefore covered impacts of
the financing of this plan.
The Evan's Point Reservoir and associated water lines have been deleted from the 1990 Water Master Plan
as the Carlsbad Municipal Water District determined that these facilities are unnecessary. The LFMP is being
amended to be consistent with the Water Master Plan. The Environmental impacts of providing needed water
facilities, as determined in the 1990 Water Master Plan, were reviewed in prior environmental documentation,
with the conclusion that there were no anticipated significant impacts from implementation of the Water
Master Plan. Project level environmental review will be required for the development of all water facilities
identified in the Master Plan.

DISCUSSION OF ENVIRONMENTAL EVALUATION

The Potable Water Master Plan is a summary of findings and recommendations concerning the existing
and ultimate conditions of the City's water distribution system. Included within the plan are only those
improvements to be constructed by the Carlsbad Municipal Water District. Improvements required by
any developer as conditioned by a specific project will be reviewed at the individual project level.
While this Master Plan makes specific recommendations as to the upgrades and new facilities, each
municipal project will receive its own environmental review and general plan consistency evaluation.
As, such, it has been determined that the Potable Water Master Plan does not produce any adverse
environmental effects in and of itself.
PHYSICAL ENVIRONMENT
1. The Potable Water Master Plan does not involve individual project approval and, therefore,
no unstable earth conditions or geologic hazards will result from this conceptual master
plan.
2. No specific project is proposed with this master plan, therefore, no change in topography or
unique physical features will result.

3. Each project suggested in this master plan will receive independent environmental review,
therefore, no site specific soils impacts will result from this plan.
4. This master plan will not result in any modification to any natural watercourse as it only
suggests conceptual improvements to be reviewed on a project-by-project basis.
5. Construction of each project will produce an incremental increase in aerosols and change
the radiative and evaporative properties of the surfaces. However, these increases will
be reviewed in more detail at the project specific environmental review process.

flora or fauna, including habitats and introduction of new species.

III. DISCUSSION OF ENVIRONMENTAL EVALUATION
The Local Facilities Management Plan for Zone 24 is a facilities
planning document, the intent of the plan is to establish parameters
and thresholds that assure public facilities are available when
needed as determined by the City's adopted performance standards. To
accomplish this purpose occasionally locations and costs of public
facility improvements are estimated for informational purposes.
These estimates may result in increased development fees.
Traditionally the developer in maximizing their capital return passes
such fees on to the home buyer or tenant. This results in higher
priced housing which affects the availability of low and moderate
income housing. However, as real estate value is determined
primarily by location, without other market incentives, it is
unreasonable to assume the subject property would be developed with
either low or moderate income housing due to its proximity to the
Pacific Ocean and the existing General Plan designation.

It is our understanding that the Planning Commission will consider
an LFMP Amendment for Zone 24 on October 20. Please be advised
that the status of Carlsbad Unified School District facilities has
changed since 1988 approval of the Zone 24 plan. For example, the
City's General Plan now reflects the 1989 School Location Plan. In
addition, the District has stated that school facilities are at
capacity and that no new development can be accommodated prior to
mitigation.
The real concern is that the amended LFMP is going to contain
outdated CUSD information which is no longer applicable. Since
there is an LFMP amendment application being processed, it seems
appropriate to address the school facility section including
financing at this point in the process.

City Council Direction Regarding School Facilities Financing
The Carlsbad Unified School District has requested the City to condition projects to
participate in a district proposed financing program for school facilities. The City Council
has indicated that certain aspects of the school district's proposal are inconsistent with the
Growth Management Plan, and the Council directed staff to apply the following condition:
"The developer or property owner shall obtain a letter from the Carlsbad
Unified School District indicating sufficient school capacity is available to
serve the proposed development prior to the approval of any final map,
grading permit or building permit, whichever first occurs. This may require
the developer or property owner to enter into a mitigation agreement or to
form or participate in a community facilities district pursuant to the Mello-
Roos Community Facilities District Act of 1982, as amended, to finance
schools. Any such mitigation agreement or Mello-Roos Community Facilities
District or any other financing scheme shall conform to the City's approved
growth management financing system, including City Council Policy
Statement No. 38, and including all planning and implementation policies
and standards."
This new condition will be recommended by staff to be applied to the Zone 24 Local
Facilities Management Plan amendment. The above wording has been transmitted to the
applicant. The City Council and the school district are continuing to meet to discuss this
issue, and if there is additional information resulting from those discussion, it will be
provided to the Commission as soon as it is available.

H- PROJECT DESCRIPTION AND BACKGROUND
The Zone 24 Local Facilities Management Plan (LFMP) was originally adopted on
December 20,1988. The plan included a condition requiring approval of a financing plan
prior to approval of any final map, building permit or grading permit within the zone. The
purpose of this amendment request is twofold: (1) to provide a financing plan pursuant
to that condition; and, (2) to amend the wording of the Parks, Circulation, Sewer, and
Water sections of the plan to reflect changed circumstances since 1988.
Since the Zone 24 LFMP was originally adopted, a number of events have occurred which
affect the amount of development and demand for public facilities in the zone. The key
events were:
1. Approval of the Eagle Canyon subdivision (CT 91 -02) and amendment of the
LFMP to allow an additional 29 dwelling units in Zone 24.
2. Approval of the Evans Point subdivision (CT 91-03) providing for 67 fewer
dwelling units than previously projected for this site in the 1988 LFMP.
3. Lower development projections and later phasing for virtually all properties
in the City as a result of economic conditions, which affect the demand for,
and financing of public facilities.
In addition, the status of certain facilities has changed either through the adoption of new
facility master plans or through new financing arrangements. These changes are described
in the Introduction section of the attached LFMP amendment and Financing Plan (Exhibit
"A"). The LFMP amendment recommends new conditions of approval where there has been
a significant modification of facility requirements, primarily hi Parks, Circulation, Sewer,
and Water.

Planning Issues
1. Does the proposed Zone 24 Local Facilities Management Plan amendment satisfy all
requirements of the Growth Management Ordinance (Chapter 21.90 of the Carlsbad
Municipal Code)?
DISCUSSION
The proposed amendment to the Zone 24 Local Facilities Management Plan has been
prepared in accordance with Chapter 21.90 of the Carlsbad Municipal Code. The original
Zone 24 LFMP contained a condition which required a Financing Plan be approved prior
to approval of any final map, building permit or grading permit within Zone 24. This
condition was required to ensure provision of all facilities needed to serve development in
Zone 24. The financing plan portion of this amendment is being processed in compliance
with that condition.
Further, the additional modifications proposed as part of this amendment are to address
certain changes in circumstances which affect the supply of, demand for, and financing of
public facilities. These changes affect Parks, Circulation, Sewer, and Water facilities. The
changes to these four facilities are summarized below. A more detailed discussion of the
changes is provided in the pertinent sections of Exhibit A.
Parks. When the original Zone 24 LFMP was adopted in 1988, development projections
at that time suggested that parks in the Northwest Quadrant would become inadequate by
1990 due to the significant increase in population. Therefore, the LFMP required certain
mitigation measures to be taken to provide additional park facilities on an accelerated
schedule. However, the increased demand for park facilities has not occurred due to lack
of development and the change in number of persons per dwelling unit. As a .result, park
facilities in the Northwest Quadrant have not fallen below the Growth Management
standard, and the previously required mitigation measures are no longer appropriate in
view of the reduced development projections for the quadrant. Staff is recommending that
the original park conditions be deleted and replaced with a new condition requiring
payment of Park In-Lieu and Public Facilities Fees.
Circulation. A significant change is recommended in the Zone 24 requirement relating to
Cannon Road. In 1988, an assessment district was being formed to finance Cannon Road,
and the LFMP included a condition requiring Zone 24 to provide a finance guarantee for
Cannon Road from 1-5 to El Camino Real. Subsequently, the assessment district effort was
dropped by the property owners. In re-examining the circulation needs in this portion of
the City, staff noted that Cannon Road is not located either within or adjacent to Zone 24,
and the zone does not require Cannon Road for access or to maintain an acceptable level
of service on other roads. In view of this, and in the absence of an assessment district, it
would not be appropriate to require Zone 24 to provide a full financial guarantee for the
road. Therefore, this LFMP amendment contains a new condition requiring Zone 24 to
provide a proportional share of the cost of the road through payment of a Zone Fee. The

precise amount of the fee will be calculated prior to approval of any final map in Zone 24.
Sewer. The Cannon Road assessment district was also intended to finance construction of
the South Agua Hedionda Interceptor (SAHI). The original LFMP included a condition
requiring that SAHI be "in place and operational to serve new development within Zone
24". In the absence of the assessment district, this condition is no longer feasible. Zone
24 will ultimately be required to connect to and utilize SAHI; however, prior to
construction of SAHI, it is acceptable for Zone 24 to connect to and utilize the North Agua
Hedionda Interceptor (NAHI) on an interim basis, provided there is adequate capacity
available at the time of development. This amendment changes the wording of the sewer
conditions of approval to reflect the new circumstances. Zone 24 will also provide its fair
share contribution to the ultimate financing of SAHI as determined by the Carlsbad
Municipal Water District.
Water. The 1990 Water Master Plan has deleted the Evan's Point reservoir and associated
water lines because the Carlsbad Municipal Water District has determined that these
facilities are unnecessary. Therefore, this LFMP amendment deletes the condition
contained in the 1988 Zone 24 LFMP requiring guaranteed financing for the Evan's Point
reservoir and associated transmission lines. All other potable water and reclaimed water
facilities required to serve Zone 24 will be constructed or appropriate fees paid at the time
of development.
All of the above changes are in accordance with Chapter 21.90 of the Carlsbad Municipal
Code. All other conditions of approval as contained in the original 1988 LFMP remain in
full force and effect. For the Commission's information, the following is a brief update on
the status of the other facilities that are not affected by the amendment:
City Administrative Facilities and Library. Community Facilities District (CFD) No. 1 was
formed in 1991 to finance a number of facilities of Citywide benefit. All properties in Zone
24 are already participating in CFD No.l. A combination of CFD No. 1 and payment of
Public Facilities Fee (PFF) constitutes the required financial guarantee for City
Administrative Facilities and Library.
Wastewater Treatment Capacity. The Phase IV expansion of the Encinas Water Pollution
Control Facility has been completed. Therefore, the special conditions stated in the 1988
LFMP are now satisfied.
Drainage. All development within Zone 24 will be required to construct drainage facilities
or pay any drainage area fee established by the revised Drainage Master Plan.
Open Space. The proposed open space within Zone 24 has been designed in compliance
with the latest adopted standards.
Schools. Pursuant to state law, Zone 24 will pay required school fees in effect at the time
of development.

IV. ENVIRONMENTAL REVIEW
The proposed LFMP amendment and Financing Plan are covered by previously approved
Negative Declarations issued by the Planning Director on August 19,1988 and January 29,
1991, respectively.
