LLC. a California Limited Liability Company, ("LessoO- The Lessor and Lessee »e at all times collectively refeired to hereinafter as the "Pteties" or individually as the "Party". For good and valuable considaation the receipt and sufficiency of which is herby acknowledged, the parties hereto agree as follows: 1. Premiseg; Lessor is the owner of a parcel of land (the "Land") and a building (the "Building) located in the City of Carlsbad, County of San Diego, State of California, commonly known as Westbluff Plaza, 6994 El Camino Real (die Building and Oe Land are collectively, die "Ptopaty^. The Land is more particularly described in Exhibit A annexed hereto. Lessee hereby leases irom Lessor aiqnoximately One Hundred Fifty (ISO) square feet of exterior space on the Land and space either adjacent to or on the roof of the Building for antennas, screening and cabling, along with the non-exclusive right to use any existing access and utility easements (collectively, the "Premises") relating to the Premises as described in Exhibit B annexed hereto. 2. Use; The Premises may be used 1^ Lessee for any activity in connection with the provision of communications services. Lessor agrees to cooperate with Lessee, at Lessee's expense, in making application for and obtaining all licenses, pennits and any and all other necessary afiprovals that may be requiied for Lessee's intended use of the Premises. Lessor shall at all times comply with all applicable laws, codes, rules and regulations reUting to the Lessee's use of the Premises and in conduct of Lessee's business. 3. Testa «adCoMtr«ctiiMi; a) Lessee shall have the right to enter upon the Propetty ibr the puipose of making appropriate engineering and boundary surveys, inspections, soil test borings, oUier reasonable necessaiy tests; and, constructing the Lessee Facilities (as defined in Paragraph 6(a) below) during dates and times approved by Lessor, approval of which shall not be unreasonably withheld. b) Lessee shall submit copies of the site plans, construction schedule, and specifications for Lessee's initial construction and any subsequent modifications involving material change to the size, height or appearance of the Lessee Facilities to the Lessor fbr prior approval, which approval will not be unreasonably withheld, conditiooed or deb^ed. Lessor shall give such approval or provide Lessee with its requests for changes within five (S) business d^ of Lessor's receipt ofthe Lessee's plans. If Lessor does not provide such approval or request for changes within such five (S) business day period. Lessor shall be deemed to have not approved the plans. If Lessor disapproves the plans then Lessee will provide the Lessor with revised plans, such revisions to be within Lessee's reasonable discretion. In the event Lessor disapfxoves of the plans upon a second (2nd) submission. Lessee may terminate diis Agreement. Lessor will not knowingly pennit or suffer any person to copy or utilize the plans for any puipose other than as provided in diis Agreement and will letum the plans to Lessee promptly upon request Lessor shall not be entitled to receive any additional conskleiation in exchange for giving its approval of Lessee's plans. c) If damage is done to the Property as a direct result of Lessee's negligence during installation of its Facilities, Lessor shall notify the Lessee of said damages and Lessee agrees to reimbinse Lessor for said repairs. 4. Term: The term of this Agreement shall be five (S) years commencing on the date Lessee starts con^ruction of the Lessee Facilities or twelve (12) months following the fiill execution of this Agreement, whichever first occurs (Commencement Date") and termination of die fifth anniversary of the Commencement Date (the "Term") unless otherwise terminated as provided in Paragraph 9. Lessee shall have the right to extend the Tom for three (3) successive five (S) year periods (the "Renewal Terms") on the same terms and conditions as set forth herein. This Agreement shall automatically be extended for each successive Renewal Term unless Lessee notifies Lessor of its intention not to renew ninety (90) days prior to the expiration of die Term or the succeeding Renewal Term. If Lessee remains in possession of the Premises at the expiration of this Agreeinent, except as otherwise |»ovided herein, this Agreement diall contiiHie in force upon the same terms and conditions as a month-to-month tenancy, except that Rent during any holdover period shall be equal to one hundred twenty-five percent (125%) of the monthly Rent payable before the expiration or termination of this Agreement. 5. Rent: a) Within fifteen (15) business days of the Commencement Date and on die first day of each mondi thereafter. Rent shall be payable to ALPACA PROPERTIES, LLC at c/o Colliers bitemational 4660 La Jolla Village Dr., Suite 200, San Diego CA 92122, or any address Lessor may designate from time to time; Attention: Cheryl McVay. b) Rent shall be increased on the first day of the month in which each anniversary of the Commencement Date occurs throughout the Term and eadi Renewal Term, includii^ any option periods if exercised, by four percent (4%) of the Rent for the previous year, 6. FacilWea; UtUities; Acceaa; a) Lessee has the right to erect, maintain and operate on the Premises communications facilities, utility lines, transmission lines, electronic equipment, transmitting and receiving antennas and supporting equipment and structures diereto ("Lessee Facilities"). In connection therewith. Lessee has the right to do all work reasonably necessaiy to prepare, maintain and alter the Premises for Lessee's business operations and to install transmission lines connecting the antennas to the transmitters and receivers. AU of Lessee's construction and installation woik shall be performed at Lessee's sole cost and expense, by Ucmsed and boodable contractors in a good and workmanlike manner. All equipment installed by Lessee diall remain Lessee's personal propeity and are not fixtures. All building structures and building improvements shall become the propeity of Lessor. Lessee has the right and obligation to remove all equipment at its sole expense on or before the expiration or eariier termination of this Agreement, and Lessor retanis die right to have Lessee remove all Lessee Facilities, including buildings and building improvements. Lessee shall repair any damage to die Premises caused by such removal and restore the Premises to the condition they were in prior to cmnmencement of this Agreement, reasonable wear and tear and loss by casualty and other causes beyond Lessee's control excepted. b) Lessee shall folly and (nompdy pay for all utilities fomished to the Premises for the use, operation and maintenance of the Lessee Facilities. Lessee shall install, at Lessee's expense, a separate electric meter and pay for electricity directly. Lessee shall pay for electricity and other utility services it consumes in its operations at the rate charged by the servicnig utility company. Lessee shall have the right to obtain separate utility service from any utility company that will provide service to the Propetty (including a standi^ power generator for Lessee's exclusive use). Lessor ^lees to sign such documents or non-exclusive easonents as may be reasonabty required by said utility companies to provide such service to the Premises, including the grant to Lessee or to the servicing utility company at no cost to Lessee, of a non-exclusive easement in, over, across or throug the Land as required 1^ such servicing utility company to provide utility services as provided herein. Any such non-exclusive easement necessaiy for such power or other utilities will be at a location acceptable to Lessor and die servicing utility ccmipany and shall not interfere with the use, peaceful possession and enjoyment of other tenants of the Lessor. c) Lessee, Lessee's employees, agents, subcontractors, lenders aiKi invitees shall have access to that portion of the Lessee Facilities as may be located on the roof of the Building and to the Premises without notice to Lessor twenty-four (24) hours a day, seven (7) days a week, at no charge, but shall be responsible for the repair of aity damage caused by such access ami the payment for said damage. Lessor grants to Lessee, and its agents, employees, contractors, guests and invitees, a non-exclusive ri^t and easement for pedestrian and vehicular ingress and egress across that portion of the Land described in Exhibit B. d) Lessor shall maintain all access roadw^ from the nearest public roadway to the Premises in a manner sufficient to allow pedestrian and vehicular access at all times under nonnal weather conditions. Lessor shall be responsible for maintaining and repairing such roadways, at its sole expense, except for any damage caused by Lessee's use of such roadways. 7. Interference: a) Lessee shall operate the Lessee Facilities in a manner so as noi to disturb or interfere with the communications configmations, equipment and fiequencies which exist on the Property on the Commencement Date, including, diose of Cox Communications PCS, LP, Pacific Bell Wireless, LLC, Nextel of California, Verizon Wireless, LLC and New Cingular Wireless PCS, LLC. Lessee Facilities shall compty with all non-interference rales of the Federal Communications Commission ("FCC") and shall also comply with provisions set forth in die attached 'Technical Requirements for Third-Party Collocation,' of Cox CommunicatitMis PCS, LP, a tenant of Lessor. Lessee hereby warrants that the Lessee Facilities and its use thereof, shall not expose the non-wireless tenants. existing wireless tenants, invitees and those using WestblufT Plaza to interference from the Lessee Facilities. b) Other than die facilities and equipment used or to be used by Cricket Communications, Inc., Verizon Wireless, Nextel of California, Inc., Cox Communications PCS, LP, New Cingular Wireless PCS, LLC and Pacific Bell Wireless, LLC, subsequent to die installation of die Lessee Facilities, Lessor shall not permit itself, its lessees or licensees to install new equipment on the Property or property contiguous thereto owned or controlled by Lessor, if such equi|»nent causes interference with Lessee's operations, provided that such equipment and operations are in compliance with all FCC reguhtions. Such interferemx shall be denned a material breach by Lessra-. In the event interference occurs. Lessen- agrees to take all reasonable action necessaty to eliminate such interference, in a reasonable time period. In the event Lessor feils to comply with this paragraph. Lessee may terminate this Agreement and/or pursue any other remedies available under this Agreenmit at law and/or at equity. 8- Taxes: Lessor acknowledges that for tax purposes: (i) the Lessee Facilities are deemed personal propeity and (ii) Lessee pays all personal propeity taxes on the Lessee Facilities directly to the State of California. In the event Lessw's real property taxes on the Land are increased as a direct resuk of die presence of the Lessee Facilitws thereon. Lessee shall reimburse Lessor for such increase, provided that Lessor cooperates with Lessee, at Lessee's sole cost and expense, in filing an appeal against such increase. Such reimbursement shall be due within thirty (30) days foltowing Lessee's receipt of a written request and reasonably accqitable evidence to Lessee of the increase from Lessor. Lessor shall not be entitled to any additional consideration fbr giving its cooperation. Additionalty, Lessee shall be entitled to keep all amounts recovered from such appeal, 9. Tcraaiaatio*; This Agreement may be teiminalBd without fimher liability as follows: (i) upon ninety (90) days notice, by either party upon a defiuilt of any covenant or term hoeof by the odier party, which default is not cured widiin thiity (30) days of receipt of written notice of default, provicted that the grace period for any monetaiy defeuh is ten (10) days from receipt of notice; or (ii) upon ninety (90) d^ prior notice; by Lessee fbr any reason or for no reason, provided Lessee delivers written notice of eariy tennination to Lessor no later dian ninety (90) days prior to the Commencement Date; or (iii) upon nin^ (90) days prior notice, by Lessee if it does not, after reasonable diligent effort, obtain or maintain any license, permit or other approval nece^ary for the construction and operation of the Lessee Facilities; or (iv) upon thirty (30) ditys prior written notice, by Lessee if Lessee is unable to occupy and utilizB the Premises due to an action of the FCC not initiated due to a failure by the Lessee to comply with the rules, regulations and directives ofthe FCC, but including without limitation, a take back of channels or change in fiequaicies; or (v) upon ninety (90) days prior written notice, hy Lessee if Lessee reasonably detennines that the Prmises are not appropriate for its eqierations for economic or technological reasons, including without limitation, signal interference. 10. DeatractitHi or CowlemMtiim: If the Premises or Lessee Facilities are damaged, destroyed, condemned or transferred in lieu of condemnation. Lessee may elect to terminate this Agreement as of the date of the damage, destruction, condemnation or transfer in lieu of condemnation by giving notice to Lessor no more than forty-five (45) days following the date of such damage, destruction, condemnation or transfer in lieu of condemnation. If Lessee chooses not to tetminate this Agreement, Rent shall be reduced or abated in proportkM to the actual reduction or abatement of use of the Premises. 11. InswnuKc: During die Term, any Renewal Tenn, and thereafter until removals required under Section 6 are complete, and prior to the Omunencement Date if Lessee enters Lessor's Property under Section 3(a), Lessee shall maintain, at its expense, commercial general liability insurance providing the greater of (i) H^BBHftcoverage per occurrence for bodily injury and property damage, or (ii) an amount of coverage that is usual and customary. LesMir diall be named an additional insured on Lessee's polky, and Lessee shall provide L^sor a certificate of insurance evidencing the coverage required by this paragraph within thirty (30) days of die Commencement Date, and on each policy renewal date thereafter. All policies of insurance covering property damage obtained by either party conceming the Propeity shall waive the insurer's right of subrogation against the other party. 12. Waiver of Snbrogatioa: Lessor and Lessee release each other and their respective principals, employees, representatives and agents, from any claims for damage to any person or to die Premises or to the Lessee Facilities therein caused by, or that resuh from, risks insured a^inst under any insurance policies carried by the parties and in force at the time of any such damage. Lessor and Lessee shall cause each insurance policy obtained by diem to provide that the insurance company waives all right of recoveiy by way of subrogation again^ the other in connection with any damage covered by any polii^. Neithv Lessor nor Lessee shall be liable to the other for any damage caused by fire or any of the risks insured against under any insurance policy required by Paragraph 11. 13. AssigBMicBt amA S«bletti»g: Lessee may not assign this Agreement, w odiCTvnse transfer all or any part of its interest in this Agreement or in the Premises without the prior written consent of Lessor, provide4 however, that Lessee may assign its interest to its parent company, any subsidiary or affiliate of it or its parent company or to any successor-in-interest or entity acquiring fifty-one percent (S1 %) or more of its stock or assets, subject to any financing entity's interest, if any. Lessor may assign this Agreement upon written notice to Lessee, subject to die assignee assumfaig all of Lessor's obligations herein. Notwithstanding anything to the contrary contained in diis Agreement, Lessee may assign, mortgage, pledge, hypothecate or otherwise transfer without consent its interest in this Agreement to any financing entity, w agent on behalf of any financing entity to whom Lessee (i) has obligations for borrowed money or in respect of guaranties thereof, (ii) has obligations evidenced by bonds, debentures, notes or similar instruments, or (iii) has obligations under or with respect to letters of credit, bankers acceptances and similar fecilities or in respect of guaranties diereof. 14. Wanrmtv of TiUe Md Oriet Eaioweate Lessor warrants that (i) Lessor owns the Propoty in fee simple and has rights of access diereto; (ii) Lessor has fiill ri^ to make and perform diis Agreement; and (iii) Lessor covenants and agrees with Lessee that upon Lessee paying the Rent and observing and performing all the terms, covenants and conditions on Lessee's part to be observed and perfoimed. Lessee may peacefiilty and quietly enjoy the Premises. Lessor agrees to indemnify and hold harmless Lessee from any and all claims on Lessee's leasehoM interest Lessee warrants that it has foil right to make and perform this Agreement and agrees to indemnify and hold Lessor harmless from all claims, actions, causes of action, costs, including reasonable attorney's fees arising from or relating to Lessee's use of the Premises and the Lessee Facilities. 15. Maintenance and Reiwira; Lessee shall maintain the Premises throughout the Term and all Renewal Teims in good condition, and make any needed repairs, except for damage caused by Lessor, its emplc^ees, agents, contractors, subcontractors, subtenants or invitees. Lessor shall have the right to enter upon the leased Premises upon prior written notice to Lessee to inspect maintain and make repairs without obligation to Lessee for any ofl&et reimbuisement or consideration. Except as set fcMlh in Paragraph 6(a) above, upon expiration or tennination hereof. Lessee shall restore the Premises to the condition in which it exited upon execution hereof. 16. Tf^lPf^ Snbatanets: Lessee agrees that it will not use, generate, store or dispose of any Hazaidous Material on, under, about or within the Land in violation of any law or regulation, and will not allow any third-party to do so. Lessor represents, wnrants and agrees (1) that neither Lessor nor, to Lessor's knowledge, any diird party has used, generated, stored or disposed of, or permitted die use, graieration, storage or disposal of, any Hazardous Material on, under, about or within the Land in violation of any law or regul^ion, and (2) that Lessor will not and will not permit any third party to use, genmitB, store or dispose of my Hazardous Material on under, about or widiin die Land in violation of any law or regulation. Lessor and Lessee each agree to defend, indemnify and hold harmless the other and die other's partneis, affiliates, agents and employees i^inst any and all tosses, liabilities, claims and/or costs (including reasonable attorney's fees and co^) arising from any breach of any representation, wmranty or agreement contamed in diis paragraph. As used in diis paragraph, "Hazardous Material" shall mean petroleum or any petrohnim product asbestos, any substance known by the state in which the Land is tocated to cause cancer and/or reproductive toxicity, and/or any substance, chemical or waste that is identified as hazardous, toxic or dangerous in any applicable federal, state or local law or regulation. This paragraph shall survive the termination of die Agreement 17. liabilitv and Indemitv: Lessee shall defend, indemnify and hold Lessor harmless from all claims (including attorneys' fees, costs and expenses of defiending against such claims) arising from the negligence or vrilHul misconduct of Lessee or Lessee's agents or employees, licensees, invitees, contractors and subcontractms in or about the Propoty. Lessor shall indemnify and hold Lessee harmless from all claims (including attorneys' fees, costs and expenses of defending against such claims) arising or alleged to arise from the acts or omissions of Lessor or Lessor's agents, employees, licensees, invitees, contractors or odier tenants occuiring in or about the Property. The duties described in this paragraph dudl survive termination of this Agreement 18. Miacellaneoiia: a) This Agreement constitutes the entire agreement and understandmg between the parties, and supersedes all offers, n^otiations and other agreements conceming the subject matter contained herein. Any amendments to this ^ireanent must be in writing and executed by both parties. b) If any provision of this Agreement is invalid or imenforceable with respect to any party, the remainder of this Agreement or die application of such provision to persons odier than dmse as to whom it is held invalid or unenforceable, shall not be affected and each provision of this Agreement shall be valid and enforceable to the fotlest extent peimitted by law. c) This Agreement shall be binding on and inure to die benefit of die successors and permitted assignees of the respective parties. d) Any notice or demand required herein shall be given personally, by certified mail, postage prepaid, retum receipt requested, by confirmed fax, or by reliable overnight courier to the widress of the respective party set forth on the signature page. Any notice served personalty shall be deemed delivered upon receipt service by liu»imile transmission shall be deemed delivered on the date of receipt as shown on die addressee's registry or certification of receipt or on the date receipt is refiised as shown on the records or manifest of the U.S. Postal Service or such other courier. The guideline from the FCC Office of Engineering and Technology is Bulletin 65 ("GET Bulletin 65"), Evaluating Compliance with FCC Guidelines for Human Exposure to Radio Frequency Electromagnetic Fields, Edition 97-01, published August 1997. Since 1996 the FCC periodically reviews these rules and regulations as per their congressional mandate. FCC regulations define two separate tiers of exposure limits: Occupational or "Controlled environment" and General Public or "Uncontrolled environment". The General Public limits are generally five times more conservative or restrictive than the Occupational limit. These limits apply to occessible areas where workers or the general public may be exposed to Radio Frequency (RF) electromagnetic fields. Occupational or Controlled limits apply in situations in which persons are exposed as a consequence of their employment and where those persons exposed have been made fully aware of the potential for exposure and can exercise control over their exposure. An area is considered a Controlled environment when access is limited to these aware personnel. Typical criteria are restricted access (i.e, locked or alarmed doors, barriers, etc) to the areas where antennas are located coupled with proper RF warning signage. A site with Controlled environments is evaluated with Occupational limits. All other areas are considered Uncontrolled environments. If a site has no access controls or no RF warning signage it is evaluated with General Public limits. Cricket Communications is predicted to contribute greater than 5% of the maximum permissible exposure (MPE) based on theoretical modeling using parameters supplied by the client. A detailed explanation of the 5% rule can be found in the Definition section of Appendix B. The compliance determination is based on Occupational MPE levels due to theoretical modeling and/or physical measurements, RF signage placement, and the level of restricted access to the antennas at the site. Measurements have also been performed to validate the assumptions used in our theoretical modeling of this site. Modeling is used for determining compliance and the percentage of MPE contribution. Measurements provide a view of MPE percentage levels at the site at the time of Sitesafe's visit and are used to validate modeling results. 3.2 Actions for Site Compliance Based on common industry practice and our understanding of FCC and OSHA requirements, this section provides a statement of recommendations for site compliance, RF alert signage recommendations have been proposed based on existing measurements and theoretical analysis of MPE levels, Sitesafe has documented the locations of any RF signs and barriers that are required for compliance. Barriers can consist of locked doors, fencing, railing, rope, chain, paint striping or tape, combined with RF alert signage. This site is compliant with the FCC rules and regulations. However, because Cricket Communications is predicted to contribute greater than 5% of the maximum permissible exposure (MPE), should the site be subsequently deemed non- complianf for any reason, any wireless operator(s) who contribute greater than 5% of the maximum permissible energy would be jointly liable for bringing the site into compliance. 200 N. General Maintenance Work: Any maintenance personnel required to work immediately in front of antennas and / or in areas indicated as above 100% of the Occupational MPE limits should coordinate with the wireless operators to disable transmitters during their work activities. Training and Qualification Verification: Ali personnel accessing areas indicated as exceeding the General Population MPE limits should have a basic understanding of EME awareness and RF Safety procedures when working around transmitting antennas. Awareness training increases a workers understanding to potential RF exposure scenarios. Awareness can be achieved in a number of ways (e.g, videos, formal classroom lecture or internet based courses). Physical Access Control: Access restrictions to transmitting antennas locations is the primary element in a site safety plan. Examples of access restrictions are as follows: • Locked door or gate • Alarmed door • Locked ladder access • Restrictive Barrier at antenna (e.g. Chain link with posted RF Sign) RF Sianaae: Everyone should obey all posted signs at all times. RF signs play an important role in properly warning a worker prior to entering into a potential RF Exposure area. Assume all antennas are active: Due to the nature of telecommunications transmissions, an antenna transmits intermittently. Always assume an antenna is transmitting. Never stop in front of on antenna. If you have to pass by an antenna, move through as quickly and safely as possible thereby reducing any exposure to a minimum. Maintain a 3 foot clearance from all antennas: There is a direct correlation between the strength of an EME field and the distance from the transmitting antenna. The further away from an antenna, the lower the corresponding EME field is. Site RF Emissions Diagram: Section 5 of this report contains an RF Diagram that outlines various theoretical Maximum Permissible Exposure (MPE) areas at the site. The modeling is a worst case scenario assuming a duty cycle of 100% for each transmitting antenna at full power. This analysis is based on one of two access control criteria: General Public criteria means the access to the site is uncontrolled and anyone can gain access. Occupational criteria means the access is restricted and only properly trained individuals can gain access to the antenna locations. 200 N. These diagrams use modeling as proscribed in OET Bulletin 65 and assumptions detailed in Appendix B. The key at the bottom of each diagram indicates if percentages displayed are referenced to FCC Occupational or General Public Maximum Permissible Exposure (MPE) limits. Color coding on the diagram is as follows: • Areas indicated as Gray are below 5% of the MPE limits. • Green represents areas predicted to be between 5% and 20% of the MPE limits. • Yellow represents areas predicted to be between 20% and 100% of the MPE limits, • Red areas indicated predicted levels greater than 100% of the MPE limits. General Population diagrams are specified when on area is accessible to the public; i.e. personnel that do not meet Occupational or RF Safety trained criteria, could gain access. If trained occupational personnel require access to areas that are delineated as Red or above 100% of the limit, Sitesafe recommends that they utilize the proper personal protection equipment (RF monitors), coordinate with the carriers to reduce or shutdown power, or make real-time power density measurements with, the appropriate power density meter to determine real-time MPE levels. This will allow the personnel to ensure that their work area is within exposure limits. The key at the bottom also indicates the level or height of the modeling with respect to the main level. The origin is typically referenced to the main rooftop level, or ground level for a structure without access to the antenna level. For example: Average from 0 feet above to 6 feet above origin and Average from 20 feet above to 26 feet above origin The first indicates modeling at the main rooftop (or ground) level averaged over 6 feet. Actual measurements locations at which these data points were collected are included in the RF emission diagram provided in Section 6 of this report. Two types of measurements were collected at each measurement location: maximum (peak) and spatial average. The spatial average measurement consists of a collection of ten (10) measurements within a ten (10) second time interval taken from zero (0) to six (6) feet in height. The purpose of this measurement technique is to identify the average power density over the dimensions of a typical human body. Table 2 below contains all the measurements collected from accessible areas located at the site at the time of Sitesafe's visit. Whenever possible, measurements are taken in front of the antenna in the transmitting direction. However, because of the antenna configuration at this site, specific emissions could not be discerned from nearby facilities, and no attempt was made to determine power density levels from a specific transmitting antenna. This inventory was verified on site, and was utilized by Sitesafe to perform theoretical modeling of RF emissions. The inventory coincides with the site diagrams in this report, identifying each antenna's location at San-128-A - Crazyburro Plaza. Software modeling was performed for all transmitting antennas located on the site. Sitesafe has further assumed a 100% duty cycle and maximum radiated power. The site has been modeled with these assumptions to show the maximum RF energy density. Sitesafe believes this to be a worst-case analysis, based on best available data. Areas modeled to predict emissions greater than 100% of the applicable MPE level may not actually occur, but are shown as a worsf-cose prediction that could be realized real time. Sitesafe believes these areas to be safe for entry by occupationally trained personnel utilizing appropriate personal protective equipment (in most cases, a personal monitor). Thus, at any time, if power density measurements were made, we believe the real- time measurements would indicate levels below those depicted in the RF emission diagram (s) in this report. By modeling in this way, Sitesafe has consen/atively shown exclusion areas - areas that should not be entered without the use of a personal monitor, carriers reducing power, or performing real-time measurements to indicate real-time exposure levels. Use of Generic Antennas For the purposes of this report, the use of "Generic" as an antenna model, or "Unknown" for an operator means the information about a carrier, their FCC license and/or antenna information was not provided and could not be obtained while on site. In the event of unknown information, Sitesafe will use our industry specific knowledge of equipment, antenna models, and transmit power to model the site. If more specific information can be obtained for the unknown measurement criteria, Sitesafe recommends remodeling of the site utilizing the more complete and accurate data. Information about similar facilities is used when the service is identified and associated with a particular antenna. If no information is available regarding the transmitting service associated with an unidentified antenna, using the antenna manufacturer's published data regarding the antenna's physical characteristics makes more conservative assumptions. In other words, any wireless operator that contributes 5% or greater of the MPE limit in an area that is identified to be greater than 100% of the MPE limit is responsible taking corrective actions to bring the site into compliance. Compliance - The determination of whether a site is safe or not with regards to Human Exposure to Radio Frequency Radiation from transmitting antennas. Decibel (dB) - A unit for measuring power or strength of a signal, Dufy Cycle-Ihe percent of pulse duration to the pulse period of a periodic pulse train. Also, may be a measure of the temporal transmission characteristic of an intermittently transmitting RF source such as a paging antenna by dividing average transmission duration by the average period for transmission. A duty cycle of 100% corresponds to continuous operation. Effective (or Equivalent) Isotropic Radiated Power (EIRP) - The product of the power supplied to the antenna and the antenna gain in a given direction relative to an isotropic antenna. Effective Radiated Power (ERP) - In a given direction, the relative gain of a transmitting antenna with respect to the maximum directivity of a half wave dipole multiplied by the net power accepted by the antenna from the connecting transmitter. Gain (of an antenna) - The ratio of the maximum intensity in a given direction to the maximum radiation in the same direction from an isotropic radiator. Gain is a measure of the relative efficiency of a directional antennas as compared to an omni directional antenna. Genera/ Population/Uncontrolled Environment - Defined by the FCC, as an area where RFR exposure may occur to persons who are unaware of the potential for exposure and who have no control of their exposure. General Population is also referenced as General Public. Generic Antenna - For the purposes of this report, the use of "Generic" as an antenna model means the antenna information was not provided and could not be obtained while on site. Max/mum Permissible Exposure (MPE) - The rms and peak electric and magnetic field strength, their squares, or the plane-wave equivalent power densities associated with these fields to which a person may be exposed without harmful effect and with acceptable safety factor. Occupational/Controlled Environment - Defined by the FCC, as an area where Radio Frequency Radiation (RFR) exposure may occur to persons who are aware of the potential for exposure as a condition of employment or specific activity and can exercise control over their exposure. OET Bulletin 65- Technical guideline developed by the FCC's Office of Engineering and Technology to determine the impact of Radio Frequency radiation on Humans. The guideline was published in August 1997. OSHA (Occupational Safety and Health Administration) - Under the Occupational Safety and Health Act of 1970, employers are responsible for providing a safe and healthy workplace for their employees. Spatial Average Measurement - A technique used to average a minimum of ten (10) measurements taken in a ten (10) second inten/al from zero (0) to six (6) feet. This measurement is intended to model the average energy an average sized human body will absorb while present in an electromagnetic field of energy. Specific regulations regarding this topic are listed in Part 1, Subpart I, of Title 47 in the Code of Federal Regulations. Currently, there are two different levels of MPE - General Public MPE and Occupational MPE. An individual classified as Occupational can be defined as an individual who has received appropriate RF training and meets the conditions outlined below. General Public is defined as anyone who does not meet the conditions of being Occupational. FCC and OSHA Rules and Regulations define compliance in terms of total exposure to total RF energy, regardless of location of or proximity to the sources of energy. It is the responsibility of all licensees to ensure these guidelines are maintained at all times. It is the ongoing responsibility of all licensees composing the site to maintain ongoing compliance with FCC rules and regulations. Individual licensees that contribute less than 5% MPE to any total area out of compliance are not responsible for corrective actions. OSHA has adopted and enforces the FCC's exposure guidelines. A building owner or site manager can use this report as part of an overall RF Health and Safety Policy. It is important for building owners/site managers to identify areas in excess of the General Population MPE and ensure that only persons qualified as Occupational are granted access to those areas. Occupational Environment Explained The FCC definition of Occupational exposure limits apply to persons who: • are exposed to RF energy as a consequence of their employment; • have been made aware of the possibility of exposure; and • can exercise control over their exposure. OSHA guidelines go further to state that persons must complete RF Safety Awareness training and must be trained in the use of appropriate personal protective equipment. In order to consider this site an Occupational Environment, the site must be controlled to prevent access by any individuals classified as the General Public. Compliance is also maintained when any non-occupational individuals (the General Public) are prevented from accessing areas indicated as Red or Yellow in the attached RF Emissions diagram. In addition, a person must be aware of the RF environment into which they are entering. This can be accomplished by an RF Safety Awareness class, and by appropriate written documentation such as this Site Compliance Report. All Cricket Communications employees who require access to this site must complete RF Safety Awareness training and must be trained in the use of appropriate personal protective equipment. 200 N. Wearing a PPM will properly forewarn the individual prior to entering an RF exposure area. Keep a copy of this report available for all persons who must access the site.
