In addition, please note that you have six months from the date the application was initially filed, January 25, 2007 to either resubmit the application or submit the required information. Failure to resubmit the application or to submit the materials necessary to determine your application complete shall be deemed to constitute withdrawal of the application. The Pacific View Estates HOA has no objection to Sprint's removal of one or more of the tall Eucalyptus trees which may be necessary to facilitate the best installation of the Sprint Facility. Provided Sprint and the city meet certain conditions, the HOA has no objection if all or part of the Sprint proposed installation is outside the current fence which separates the HOA's maintenance and irrigation responsibilities, from those of the Carlsbad City Water Department. Additionally, we would consider allowing Sprint to install its equipment cabinets within a subdivision entrance monument as roughly depicted on the attached photo. The antenna will be on the Carlsbad Village Drive frontage (07/26/2007) Greg Fisher - PACIFIC VIEW^STATES HOMEOWNER ASSOCIATION July 07.doc Page 2 Also discussed was the requirement for approval of the HOA for the ingress to the property currently being maintained/irrigated by the HOA which is the subject of a Development Agreement with the City. Per our July 12, 2007 letter, assurances are required that the existing landscaping and irrigation will be returned to, at least its present condition, after the project is completed. Since a point was made that the plan would include an "exceptional" landscaping plan, there may be a requirement for some remuneration to the HOA for continued maintenance and irrigation. The Pacific View Estates Home Owners Association looks forward to viewing the revised location plan when it is submitted by Trussnet. We are ready to discuss any of the above points. If for some technical or other reason the equipment cabinets can not be located in a monument structure, the cabinets and the'antenna should be moved as close to as possible to the intersection. Notice of Request for a Minor Conditional Use Permit Dear Mr. Fisher: My purpose is to formally respond to the notice advising me of a Minor Conditional Use Permit (MCUP) has been applied for to allow a Wireless Communication Facility (MCF) at 5950 Carlsbad Village Drive (Carlsbad Village Water Tank) Carlsbad, CA, and more particularly described as Lo6 61, Carlsbad Tract No. 72-11, Map 7682. I object to granting this MCUP. In addition, should the project continue to be considered I request a formal hearing in which all surrounding residents have an opportunity to speak out publicly. My reasons for objecting to this project are all those set forth in the letter to you from the Pacific View Estates Homeowner's Association (PVEHO) by David Woolard, Vice President for the Board of PVEHOA. In addition, I would like to emphasize that this project is ill conceived. It is clear that Government property and Commercial property is generally a considered a "preferred" location, while residential or private property is generally "not a preferred" location. Please consider the intent behind these classifications. Commercial property and Government property is typically somewhat isolated or at least a considerable distance from private residential homes. It is for this reason and not simply because of a property's ownership that Government or Commercial property is generally considered and classified as preferred. Residential property on the other hand is typically comprised of private homes surrounded by private residences. Because of the likely adverse effects from such projects (i.e. noise, adverse interference from microwave transmissions and communication devices, satellite and TV interference and objectionable appearance, etc.) residential and private property are generally to be classified as "not preferred". Please consider the actual location of this proposed development. It is in the midst of a private neighborhood. It is a very small piece of land, whose footprint barely extends beyond the water tank itself. It has residential homes immediately next to it on three sides. It is my contention that this property has been misclassified as preferred. Though government owned, because of its location, its size and the facts on the ground it should properly be classified exactly the same as all property immediately surrounding it, as not preferred. Please consider the intent behind classification rules. Blindly following the words behind establishing a "preferred" or "not preferred" classification for any project or property without considering the intent behind those rules is simply wrong. Any reasonable and objective person, including the Carlsbad Planning Department after looking at the property, its location, the characteristics of the neighborhood in which this project has been proposed would have to come to the conclusion that government property or not, a correct classification would be non preferred. Please reject the application and consider a location that would properly be a classified as a preferred location. I have objections not only to the fact that it would decrease the value of my home but also there have been health issues linked to living close to antennas. There are several concerns that need to be addressed: > According to the City's Policy Statement dated September 21, 2004 (Preferred Locations ) this site does not appear to conform to those guidelines as a " Preferred Location " The Site is surrounded on all but one side by residential properties. The remaining side is the recently approved Trails End residential development. The proposed tree antenna & the associated cabinets are not actually within the City's tank area but are located outside the Tank perimeter fence & are publicly accessible ( contrary to provision A,l,g. of the City's Location Guidelines ). Visibility of the antenna from Carlsbad Village Drive appears to contravene the A,3, visibility Guideline. > This Application appears to be a somewhat revised version of one submitted by Sprint in 2002. At that time the Board & several homeowners expressed concern about the close proximity of the equipment cabinets, especially to the home located at 2919 Austin Terrace, occupied by the Haskell family. Page 1 There was also concern about adverse effects of microwave transmissions on individuals, personal communication devices & satellite TV antenna performance in the neighborhood. None of those concerns has diminished with this new Application. > The new Application has addressed the location of the cabinets, but only partially. The HOA believes the cabinets should be located as far away as possible from any residence . In this case , that means locating them close to the intersection of Carlsbad Village Drive & Donna Drive ( see attached plan for better location than the plan submitted by Sprint.) > The Carlsbad Village Drive street frontage where it is proposed to install the cabinets is the subject of a Development Agreement between the City & our HOA. Under the Agreement, the HOA is responsible for maintaining the landscaping in this area, which has taken 6 years to establish. In view of the HOA's responsibilities in this area, the HOA would require written assurances from both the City & Sprint that any HOA landscaping or irrigation systems disturbed, damaged or removed are fully reinstated to at least their prior condition.. All of the forgoing should be backed up by a Sprint bond held by the City with terms agreed by us. No mature trees should be removed or compromised. The Board will be pleased to meet with you to discuss these arrangements. Page 2 Until the HOA receives satisfactory answers to the above concerns, please consider this letter as the HOA's formal objection to Sprint's application.
