The proposed unmanned wireless telecommunications facility will be located at the Elm Water Tank facility at the northeast corner of Carlsbad Village Drive and Donna Drive. Although the site is zoned RA, it is currently developed as a public utility (water tank) and required conditional use permit findings can be made for the proposed telecommunications facility. Description and Justification The proposed conditional use permit is requested to install a Sprint PCS Wireless telecommunications facility at the subject site. The unmanned facility, which will be located at the Elm Water Tank site, will consist of three sectors of antennas, each sector containing two antennas, for a total of 6 panel antennas mounted on a 22'6" tall faux broad leaf tree and a 299 square feet equipment cabinet. The equipment cabinets will be enclosed in a vault on the outside of the existing fence amidstthe existing landscaping on site. Sprint PCS is a nationwide wireless carrier licensed by the Federal Communications Commission (FCC) to provide mobile telephone, two-way radio, paging, data services and wireless internet access for the public and private sectors including all emergency services to the community. The proposed facility will provide PCS service to the surrounding residences and people driving along Carlsbad Village Drive and other streets in the vicinity of the facility. The proposed project is subject to the following regulations: Residential Agricultural Zone (R-A) (Chapter 21.08 of the Carlsbad Municipal Code); Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code); City Council Policy Statement; Policy 64 - Wireless Communication Facilities; and Growth Management (Chapter 21.90 of the Carlsbad Municipal Code). The project's compliance with each of the above regulations is discussed in detail in the sections below. Residential Agricultural Zone 4909 Murphy Canyon Road, Suite 320, San Diego, CA 92123 7:858.244.1026 F: 858.244.1032 www.velocitel.net Solutions Beyond Borders The proposed development is consistent with all applicable development standards and guidelines required by the R-A zone for setbacks, coverage, and architecture since the proposed facility complies with the height limit of 30 feet in that the tree with antennas will be 22'-6" high, with top of the antennas at 24 feet. The center of the faux broad-leaf tree is 25 feet from the property line along Carlsbad Village Drive. The required front yard setbacks for RA-10,000 zone is 20 feet. The proposal does not increase the lot coverage, floor area, or parking demand for the site. The following required conditional use permit findings for the proposed telecommunications facility can be made: The proposed use is: a) necessary and desirable for the development of the community in that the community benefits of wireless communications include improved telecommunications service for emergency services and individuals; b) consistent with the General Plan in that the subject site is designated as RLM, Low to Medium Density Residential but it is currently developed as a public facility (water tank) and the proposed project is also a quasi-public utility use; and c) not detrimental to permitted uses in the Residential-Agricultural zone in that the use is integrated into the existing water tank and the landscaping on-site and requires no significant changes to the site design or function. The proposed site is adequate in size and shape to accommodate the use in that the proposed antennas will be mounted on a faux broad leaf tree and will blend in with the existing landscaping on the site and the equipment cabinets will be enclosed in a vault and surrounded by existing shrubs on the subject site. All features necessary to adjust the requested use to the existing use are provided in that the proposed antennas will be mounted on a faux broad leaf tree and will blend in with the existing landscaping on the site and the equipment cabinets will be surrounded by landscaping that will match existing shrubs on the subject site, and the street system serving the proposed use would not be impacted by the proposed conditional use in that the additional vehicle trips are limited to occasional equipment maintenance by service personnel. City Council Policy Statement: Policy 64 - Wireless Communications facilities The City Council adopted a policy regarding prioritization for the location of Wireless Communications Facilities (WCF) on October 3, 2001. The guidelines state that wireless facilities should be located on buildings and structures, not on vacant land. In addition, WCFs should locate, in order of priority, on industrial, commercial, public, other non- residential, public utility, park, or community facility property. Design guidelines of the policy state that all aspects of a WCF, including the supports, antennas, screening methods, and equipment should exhibit "stealth" design techniques so they visually blend into the background or the surface onto which they are mounted. The policy encourages collocation wherever feasible and appropriate. The project complies with this policy in that the proposed facility will be located on a site already improved with a public facility, the water tank. The proposed antennas will be mounted on a faux broad leaf tree, exhibiting a stealth design. The proposed faux tree does meet the setback requirement of RA-10,000 zone of 20 feet from the front property line but is not consistent with the setback guidelines contained in the policy. Pursuant to the wireless policy, the proposed faux tree should be set back 24 feet from the property line.
