Our records indicate a letter was sent to you on April 2, 2012, advising you that your Minor
Conditional Use Permit (MCUP) No. MCUP 07-07 will expire on August 21, 2012, unless an
extension request is filed and approved. To date, we have either not received a response or an
application to extend your Minor Conditional Use Permit. We are enclosing a copy of the letter
previously sent to you. If we do not receive an application by August 21, 2012, your permit will
expire. Once your permit expires, you will be required to submit an application for a .!l!1.Y!!: Minor
Conditional Use Permit or discontinue operating the use for which the permit was issued.
Please be advised that in the event your permit expires and you subsequently apply for a new
permit, the application would again be subject to the full discretionary review process of the
designated decision-making authority (Planning Commission and/or City Council). This means

6. This project shall comply with all conditions and mitigation measures, which are required
as part of the Zone 5 Local Facilities Management Plan and any amendments made to
that Plan prior to the issuance of building permits.
7. This Minor Conditional Use Permit is granted for a period of 5 years from August 21,
2007 through August 21, 2012. This permit may be extended by the Planning Director
for a reasonable period of time not to exceed 5 years upon written application of the
permittee made no less than 90 days prior to the expiration date. The Planning
Director may not grant such extension, unless the Director finds that there are no
substantial negative effects on surrounding land uses or the public's health and welfare.
If a substal)tial negative effect on surrounding land uses or the public's health and
welfare is found, the extension shall be denied or granted with conditions which will
eliminate or substantially reduce such effects. There is no limit to the number of
extensions the Planning Director may grant.
8. MCUP 07-07 shall be reviewed by the Planning Director on a yearly basis to determine if
all conditions of this permit have been met and that the use does not have a substantial
negative effect on surrounding properties or the public health, safety and general
welfare. If the Planning Director determines that: 1) the minor conditional use permit
was obtained by fraud or misrepresentation; or 2) the use for which such approval is.
granted is not being exercised; or 3) the conditions of approval have not been met; or 4)
the minor conditional use permit is being or recently has been exercised contrary to any
of the terms or conditions of approval; or 5) the use for which such approval was
granted has ceased to exist or has been suspended for one year or more; or 6) the use
is in violation of any statute, ordinance, law or regulation; or 7) the use permitted by the
minor conditional use permit is being or has been so exercised as to be detrimental to
the public health, safety or welfare or so as to constitute a nuisance, the Planning
Director shall hold an informal public hearing and after providing the permittee the
opportunity to be heard, the planning director may revoke and terminate the minor
conditional use permit in whole or in part, reaffirm the minor conditional use permit,
modify the conditions or impose new conditions.
9. Prior to the issuance of a building permit, owner/applicant shall submit to the City a
Notice of Restriction to be filed in the office of the County Recorder, subject to the
satisfaction of the Planning Director, notifying all interested parties and successors in
interest that the City of Carlsbad has issued a Minor Conditional Use Permit on the
real property owned by the owner/applicant. Said Notice of Restriction shall note the
property description, location of the file containing complete project details and all
conditions of approval as well as any conditions or restrictions specified for inclusion in
the Notice of Restriction. The Planning Director has the authority to execute and record
an amendment to the notice, which modifies or terminates said notice upon a showing of
good cause by the owner/applicant or successor in interest.
10. This approval shall become null and void if building permits are not issued for this
project within 18 months from the date of project approval.
11. Interior noise levels in the portion of the building occupied by SDGA shall be
attenuated to 45 dB CNEL as verified through an acoustical study.

12. All students attending SDGA shall be 18 years of age or older.
13. If, at any time in the future, the total enrollment at SDGA exceeds 180 students,
the applicant shall apply for an Amendment to MCUP 07-07. The Amendment shall
be accompanied by a parking analysis to ensure that adequate parking is
available for all the uses located in the existing building at 1050 Camino Vida
Roble.
14. Approval of MCUP 07-07 shall not become effective until the City Council has
approved an Amendment to Specific Plan 181 (SP181(F)) permitting "Educational
Facilities, Other" within the boundaries of the Specific Plan.
Code Reminders:
15. Approval of this request shall not excuse compliance with all applicable sections of the
Zoning Ordinance, Specific Plan 181 and all other applicable City ordinances in effect
at time of building permit issuance, except as otherwise specifically provided herein.
16. Premise identification (addresses) shall be provided consistent with Carlsbad Municipal
Code Section 18.04.320.
Engineering:
17. Future discretionary acts or projects within this Specific Plan shall comply with the City's
requirements of the National Elimination System (NPDES) permit and the City's
Standard Urban Storm Water Mitigation Plan (SUSMP), both of the latest editions, to
reduce surface pollutants to acceptable level prior to discharge to sensitive areas.
NOTICE
Please take NOTICE that approval of your project includes the "imposition" of fees, dedications,
reservations, or other exactions hereafter collectively referred to for convenience as
"fees/exactions."
You have 90 days from the date of final approval to protest imposition of these fees/exactions.
If you protest them, you must follow the protest procedure set forth in Government Code
Section 66020(a), and file the protest and any other required information with the City Manager
for processing in accordance with Carlsbad Municipal Code Section 3.32.030. Failure to timely
follow that procedure will bar any subsequent legal action to attack, review, set aside, void, or
annul their imposition.
You are hereby FURTHER NOTIFIED that your right to protest the specified fees/exactions
DOES NOT APPLY to water and sewer connection fees and capacity charges, nor planning,
zoning, grading or other similar application processing or service fees in connection with this
project; NOR DOES IT APPLY to any fees/exactions of which you have previously been given a
NOTICE similar to this, or as to which the statute of limitations has previously otherwise

This decision may be appealed by you or any other member of the public to the Planning

Project conditions: (Note: The following identifies specific conditions necessary to achieve
Fire Department approval.)
Before Fire can begin to consider the applicants request for a "Minor Conditional Use
Permit" or even a "Specific Plan-Amendment" Fire would insist that applicant should
consult with a registered architect for a complete code analysis. At first glance it is the
opinion of the Carlsbad Fire Depa1·tment that this proposed use may or may not be
appropriate for this particular building. I would further my comments to say that this is
not and should not be considered a "B" occupancy and likely should not be considered a
"A-3" occupancy, but should be considered an "A-2.1" occupancy. I base this opinion on
the simple fact that the occupant load or capacity is based on square footage and not ou
seating. IfTable-10-A of theCA Building Code is used to determine the occupant load and
used for the exiting requirements, you would find that this project would accommodate
more than 300 persons, thus making it an A-2.1 occupancy.
There are specific construction or building types that are permitted for an A--2.1
occupancy. I cannot make that determination with the information provided, hence the
request to have the applicant consult with an architect.

light we use if we place it around dark surfaces without anything to reflect the light.
Unshielded lights cause a glare and reduce what they eye can see.
2. All types of exterior doors should be illuminated during the hours of darlmess, with a
minimum maintained one (1) foot-candle of light, measured within a five-foot radius on
each side of the door at ground level.
3. Recessed areas of buildings or fences, which have a minimum depth of two feet, a
minimum height of five feet, and do not exceed six (6) feet in width and are capable of
human concealment, should be illuminated with a minimum maintained 0.25 foot-
candles of light at ground level during the hours of darlmess. This recommendation
applies to defined recessed areas, which are within six feet of the edge of a designated
walking surface with an unobstructed pathway to it, not hindered by walls or hedgerow
landscaping a minimum of two (2) feet in height.
4. All exterior pedestrian walkways, interior common corridors, and open parking lots
should be illuminated with a minimum maintained one (1) foot-candle of light on the
walking or driving surface during the hours of darlmess.
5. Metal halide is a good commercial purpose light.
6. Overhead light poles should not be placed in an area planted with shade trees or other
canopy producing species. Only basic ground cover, including but not limited to hedges
and shrubs, should be used.
7. The parking and drive surface lighting should have a rated average bulb life of not less
than 10,000 hours.
8. Accessible luminaries should have vandal resistant light fixtures and be not less than
three feet in height from ground level when used to illuminate walkways and a
minimum of eight feet in height from ground level when illuminating surfaces
associated with vehicles. Light fixtures should be deemed accessible if mounted within
fifteen feet vertically or six feet horizontally from any accessible surface or any adjoining
roof, balcony, landing, stair tread platform or similar structure.
Landscaping
1. To provide greater visibility, demonstration of ownership (territorial reinforcement), an
enhanced pedestrian environment, and a suitable buffer with the adjoining properties,
the basic landscaping theme should consist of low ground cover with a maximum height
of 2 feet and canopy trees with a minimum lower canopy of 6 feet.
2. Overhead light poles should not be placed in an area planted with shade trees or other
canopy producing species. Only basic ground cover, including but not limited to hedges
and shrubs, should be used.
3. Use security landscaping in areas to deter loitering or entrance where pedestrians are
not wanted.
Addressing
1. Numerals should be located where they are clearly visible from the street on which they
are addressed. They should be of a color contrasting to the background to which they
are affixed.
2. Numerals should be no less than six inches in height, if located less than 100 feet from
the centerline of the addressed street or 12 inches in height if placed further than 100
feet from the centerline of the addressed street.
3. The numerals should be illuminated during the hours of darkness.
4. The rear doors of all building should have address numbers not less than six inches in
height and be of a color contrasting to the background to which they are affixed.
5. Buildings with a total square footage of at least 10,000 square feet should have rooftop
numbers placed parallel to the addressed street, screened from public view and only
visible from the air. The numerals are to be white, block lettered, constructed of weather
resistant material, and placed against a black background. Address numbers are to be a
minimum of four feet in height and 18 inches wide
Doors
1. The police department recommends that hollow steel doors be a minimum sixteen (16)
U.S. gauge and have sufficient reinforcement to maintain the designed thickness of the
door when any locking device is installed.
2. Only use glass doors with fully tempered glass or rated burglary resistant glazing.
Protect all exterior doors with security hardware.
3. Equip all doors with a latch cover constructed of steel. Ensure the latch cover is a
minimum of .125 inch thick. Attach the latch cover to the outside by welding or with
non-removable bolts spaced apart on not more than ten-inch centers.
4. Construct the jamb of all aluminum frame-swinging doors to withstand 1600 pounds of
pressure in both a vertical distance of three inches and horizontal distance of one inch
each side of the strike, to prevent violation of the strike.
5. Equip rear doors used for shipping and receiving and employee entrances with a viewer.
6. A single or double door shall be equipped with a double cylinder deadbolt with a bolt
projection exceeding one inch or a hook-shaped or expanding deadbolt that engages the
strike sufficiently to prevent spreading. The deadbolt lock shall have a minimum of five-
pin tumblers and a cylinder guard.
Windows
1. Equip movable windows with security hardware and burglar resistant glazing.
2. Cover other vulnerable non-movable windows with burglar resistant glazing. Windows
of commercial buildings are vulnerable to breakage during the hours of darkness when
the business is non-operational especially windows within 40 inches of any door locking
mechanism
3. Glaze should be constructed of either two part laminated glazing with a 0.60 inch inner
layer or burglary resistant glazing
Roofs
1. All skylights on the roof of any building should be provided with rated burglary resistant
glazing material securely fastened with bolts that are non-removable from the exterior.
2. All hatchway openings on the roof of any building should be secured as follows:
a. If the hatchway cover is of wooded material, it should be covered on the inside
with at least sixteen (16) gauge steel metal or its equivalent and attached with
screws.
3. All air duct or air vent opening exceeding ninety-six (96) square inches on the roof,
exterior doors, or exterior walls of any building should be secured by covering the same
with the following:
a. Iron bars of a least number four (4) steel or equivalent, spaced no more that five
(5) inches apart on center, at each direction, welded at all point of intersection,
or one by one-fourth (1 X Y.,) inch flat steel or equivalent, spaced no more the
five (5) inches apart on center, welded at all points of intersection.
Trash Enclosures
1. Position the trash enclosures away from areas of shipping and receiving.
Alarm Systems
1. Consider an alarm system, the police department recommends a "verified system" in an
effort to eliminate false alarm activations and increase breach detection. A verified
system is verified through audio or visual components. In areas that are deserted
without natural surveillance during the late night, it is necessary to create surveillance
through the use of alarms and monitoring systems.
2. If considering electronic assess as a security feature, consider managed electronic
access.

The requested Minor Specific Plan Amendment is to add a use, trade-school or
"educati®nal facilities, other" (Section 21.04.137), to the permitted uses within the
Specific Plan area. The "educational facilities, other'' uses would be subject to approval
of a Minor Conditional Use Permit.
The San Diego Golf Academy (SDGA) is a private-institution that trains students for
operating and management positions in the golf industry. The trade-school, which offers
a two-year training curriculum, is currently located in the City of Vista. SDGA proposes
to relocate their San Diego school facilities to the City of Carlsbad within a 20,000 square
foot space in the Carlsbad Airport Centre Specific Plan area. SDGA sees the City of
Carlsbad and more specifically the available space at 1950 Camino Vida Roble as the
ideal San Diego location for their facilities given the City's ties to the golf industry, the
site's proximity to Palomar Airport, and availability of residential rental properties for
their students.
SDGA proposes to use 20,000 square feet of existing office space for offices for their
regional staff, 2 conference rooms, 2 computer labs, 5 classrooms, a library, a golf club
repair training room, and an indoor training area. SDGA currently has an average
emollment of 180 students; however, only half of the emolled students are present at the
facility at any one time.
