The intent of this letter is to provide notification that Sprint has engaged Alcatei-
Lucent to evaluate site conditions and perform construction at multiple Sprint
facilities around the country. These services may include performing on-site
inspections and studies, and application for, or negotiations of, additional rights and
entittements for the facility. If modifications to our current real estate agreement are
necessary, Alcatei-Lucent is authorized to perform these services on behalf of
Sprint. This authorization is valid for Sprint "Network Vision" project and is effective
until March 1, 2013.
Sprint Nextel values its relationships with our landlords and the communities where
our facilities are located and has instructed Alcatei-Lucent to protect our good
standing in all matters. To that extent, please accept this as our authorization for you
allow access to the site and to discuss possible changes that may be proposed at
the facility with Alcatei-Lucent.
In the event that you have questions related to this project and need to speak with

To address post-development pollutants that may be generated from development projects, the City requires that new
development and significant redevelopment priority projects incorporate Permanent Storm Water Best Management
Practices (BMP's) into the project design per the City's Standard Urban Stormwater Management Plan (SUSMP). To
view the SUSMP, refer to the Engineering Standards (Volume 4, Chapter 2) at www.carlsbadca.gov/standards.
Initially this questionnaire must be completed by the applicant in advance of submitting for a development application
(subdivision, discretionary permits and/or construction permits). The results of the questionnaire determine the level of
storm water standards that must be applied to a proposed development or redevelopment project. Depending on the
outcome, your project will either be subject to 'Standard Stormwater Requirements' or be subject to additional criteria
called 'Priority Development Project Requirements'. Many aspects of project site design are dependent upon the
storm water standards applied to a project.
Your responses to the questionnaire represent an initial assessment of the proposed project conditions and impacts.
City staff has responsibility for making the final assessment after submission of the development application. If staff
determines that the questionnaire was incorrectly filled out and is subject to more stringent storm water standards than
initially assessed by you, this will result in the return of the development application as incomplete. In this case, please
make the changes to the questionnaire and resubmit to the City.
If you are unsure about the meaning of a question or need help in determining how to respond to one or more of the
questions, please seek assistance from Land Development Engineering staff.
A separate completed and signed questionnaire must be submitted for each new development application submission.
Only one completed and signed questionnaire is required when multiple development applications for the same project
are submitted concurrently. In addition to this questionnaire, you must also complete, sign and submit a Project Threat
Assessment Form with construction permits for the project.
Please start by completing Section 1 and follow the instructions. When completed, sign the form at the end and submit
this with your application to the city.

Project Objectives
The proposed site maintenance and technology upgrade is intended to provide the residents of
Carlsbad who are served by this facility, the latest in wireless technology by improving call
quality, data transmission and speed.
Alternative Site Analysis
The following locations were evaluated for possible locations for the facility:
NA. Proposed is the modification and maintenance upgrade to an existing Sprint installation
Findings/Burden of Proof
The project site is located in an existing developed industrial area. Industrial building have
proved themselves to be ideal locations for wireless telecommunication uses because the wireless
use can be integrated into the site design having no impact to the functioning of this land use or
surrounding land uses. Sprint is unaware of any negative visual impact generated by the existing
facility and the new proposal will reduce potential visual impacts even further by reducing the
number of fa<;ade mounted panel antenna on site. The proposed site maintenance will not
significantly change the appearance of this facility and consequently no visual impact is
anticipated with project approval.
Wireless telecommunication is now an indispensable part of everyday life and wireless
customers expect to be provided nearly flawless radio coverage at all locations and at all times.
The subject project will provide improved radio coverage, improved data reception and
transmission and improved data download speeds within the surrounding area to the benefit of
the general health, safety, welfare and convenience of the public in the vicinity ofthis facility. In
addition all the antennas will be screened to match the building architecture.
The proposed project is in conformance with all city General Plan goals by furthering the health,
safety, welfare and convenience of city residents with the improvement and continued operation
of a wireless telecommunication facility in an area of the city currently experiencing diminished
wireless service. The proposed project is in conformance with all Federal Communications
Commission (FCC) regulations and standards for wireless telecommunication facilities as
documented in the attached FCC RF Certification form. All height, site and screening
requirements have been met by this project. The installation is emergency 911 compatible with
all wireless carriers.
Sprint is authorized and regulated by the Federal Communications Commission (FCC) to operate
their wireless systems in the Southern California market area. Transmit power is typically
between 100 to 500 watts per antenna sector, transmitting and receiving at a frequency of 1850.0
-1865.0, and 1930.0-1945.0 MHz. These levels are well below the safety standards established
by the FCC and no health impacts are anticipated with this project in conformance with city
goals for telecommunication uses. In addition, Sprint does not oppose co-location on the subject
building or project site and has left space for additional wireless carriers. This project design

will provide mitigation of future wireless development in the area by allowing for the
concentration of additional facilities at one location, thereby minimizing the spread of these
facilities throughout the community and providing mitigation of the potential visual impact in
more view sensitive locations.
The proposed facility will be unmanned requiring approximately one maintenance visit
per month and will not have any significant impact to existing roadways and on and off
site circulation nor have any impact on the character of existing development in the
neighborhood

Sprint Nextel is one of the fastest growing nationwide service providers offering all digital voice,
messaging and high-speed data services to nearly 30 million customers in the United States.
Sprint Nextel is a "telephone corporation", licensed by the Federal Communications Commission
(FCC) to operate in the 1850.0 -1865.0, and 1930.0-1945.0 MHz frequencies, and a state-
regulated Public Utility subject to the California Public Utilities Commission (CPUC). The
CPUC has established that the term "telephone corporation" can be extended to wireless carriers,
even though they transmit signals without the use of telephone lines.
Sprint Nextel will continue to operate this facility in full compliance with the regulations and
licensing requirements of the FCC, Federal Aviation Administration (FAA) and the CPUC, as
governed by the Telecommunications Act of 1996, and subsequent modifications, the Middle
Class Tax Relief and Job Creation Act of2012 (Section 6409) and other applicable laws.
The enclosed application is presented for your consideration. Sprint Nextel requests a favorable
determination and approval of a substantial conformance to modify its existing base station.

frequency electromagnetic (RF-EME) modeling for Sprint Site SD35XC 119 located at 71 00 Aviara
Resort Drive in Carlsbad, California to determine RF-EME exposure levels from proposed Sprint
wireless communications equipment at this site. As described in greater detail in Section 11.0 of this
report, the Federal Communications Commission (FCC) has developed Maximum Permissible Exposure
(MPE) Limits for general public exposures and occupational exposures. This report summarizes the
results of RF-EME modeling in relation to relevant FCC RF-EME compliance standards for limiting human
exposure to RF-EME fields.
This report contains a detailed summary of the RF EME analysis for the site.

This project involves the removal of three (3) existing antennas and replacement with three (3)
proposed Sprint wireless telecommunication antennas on a rooftop located at 71 00 Aviara Resort Drive
in Carlsbad, California. There are three Sectors (A, B, and C) proposed to be replaced at the site, with
one (I) antenna that may be re-installed per sector.
Based on drawings and aerial photography review, there appears to be no collocated carriers on the
rooftop.
2.0 LOCATION OR ALL APPROVED (BUT NOT INSTALLED) ANTENNAS AND FACILITIES AND
EXPECTED RF LEVELS FROM THE APPROVED FACILITIES
There are no antennas or facilities that are approved and not installed based on information provided to
EBI and Sprint at the time of this report.
3.0 NUMBER AND TYPES OF WTS WITHIN I 00 FEET OF THE PROPOSED SITE AND
ESTIMATES OF CUMULATIVE EMR EMISSIONS AT THE PROPOSED SITE
There are no other Wireless Telecommunication Service (WTS) sites observed within I 00 feet of the
proposed site.
4.0 LOCATION AND NUMBER OF THE SPRINT ANTENNAS AND BACK-UP FACILITIES PER
BUILDING AND NUMBER AND LOCATION OF OTHER TELECOMMUNICATION FACILITIES
ON THE PROPERTY
Sprint proposes the removal of three (3) existing antennas and replacement with three (3) proposed
Sprint wireless telecommunication antennas on a rooftop located at 71 00 Aviara Resort Drive in
Carlsbad, California. There are three Sectors (A, B, and C) proposed to be replaced at the site, with
one (I) antenna that may be re-installed per sector. In each sector, there is proposed to be one antenna
transmitting in the 1900 MHz frequency range. The Sector A antenna will be oriented 60° from true
north. The Sector B antenna will be oriented 180° from true north. The Sector C antenna will be
oriented 290° from true north. The bottom of the Sector A antenna will be approximately 4.1 feet
above the main roof level. The bottoms of the Sector Band C antennas will be approximately 2.9 feet
and 3.1 feet above the sloped roof, respectively.
Based on drawings and aerial photography review, there appears to be no collocated carriers on the
rooftop.
5.0 POWER RATING FOR ALL EXISTING AND PROPOSED BACKUP EQUIPMENT SUBJECT TO
THE APPLICATION
The operating power for modeling purposes was assumed to be 20 Watts per transmitter for the 1900
MHz antenna and there will be two (2) transmitters operating at this frequency.
6.0 TOTAL NUMBER OF WATTS PER INSTALLATION AND THE TOTAL NUMBER OF WATTS
FOR ALL INSTALLATIONS ON THE BUILDING
The effective radiated power (ERP) for the 1900 MHz transmitters combined on-site is 1,771 Watts.

7.0 PREFERRED METHOD OF ATTACHMENT OF PROPOSED ANTENNA WITH PLOT OR ROOF

Based on the information provided to EBI, the information indicates that the proposed antennas are to
be pipe-mounted within an existing concealment chimney on the rooftop and operating in the directions,
frequencies, and heights mentioned in section 4.0 above. The antennas are to be mounted on a large
hotel with a pool area to the east of the antennas and another recreational area to the north. The
properties to the west appear to consist of Aviara Golf Course with a wooded corridor separating it
from the hotel. The roadway called Blue Heron Place to the south.
8.0 ESTIMATED AMBIENT RADIO FREQUENCY FIELDS FOR THE PROPOSED SITE
Based on worst-case predictive modeling, there are predicted areas on accessible rooftop-level
walking/working surfaces related to the proposed Sprint antennas that exceed the FCC's general public
exposure limit at this site. At the nearest walking/working surfaces to the proposed Sprint antennas, the
maximum power density is 343.50 percent of the FCC's general public limit (68.70 percent of the FCC's
occupational limit). Based on worst-case predictive modeling, there are no areas at ground level related
to the proposed Sprint antennas that exceed the FCC's occupational or general public exposure limits at
this site. At ground level, the maximum power density generated by the Sprint antennas is 0.90 percent
of the FCC's general public limit (0.18 percent of the FCC's occupational limit). The inputs used in the
modeling are summarized in the RoofView® export file presented in Appendix B.
9.0 SIGNAGE AT THE FACILITY IDENTIFYING ALL WTS EQUIPMENT AND SAFETY
PRECAUTIONS FOR PEOPLE NEARING THE EQUIPMENT AS MAY BE REQUIRED BY THE
APPLICABLE FCC ADOPTED STANDARDS (DISCUSS SIGNAGE FOR THOSE WHO SPEAK
LANGUAGES OTHER THAN ENGLISH)
Signs are the primary means for control of access to areas where RF exposure levels may potentially
exceed the MPE. It is recommended that additional signage be installed for the new antennas making
people aware of the antennas locations. There are fields in front of the proposed Sprint antennas and
therefore barriers are recommended.
Additionally, there are areas where workers elevated above the rooftop may be exposed to power
densities greater than the general population and occupational limits. Workers and the general public
should be informed about the presence and locations of antennas and their associated fields.
Access to this site is unknown. To be conservative, it is assumed that the general public is able to access
the rooftop.

11.0 FEDERAL COMMUNICATIONS COMMISSION (FCC) REQUIREMENTS
The FCC has established Maximum Permissible Exposure (MPE) limits for human exposure to
Radiofrequency Electromagnetic (RF-EME) energy fields, based on exposure limits recommended by the
National Council on Radiation Protection and Measurements (NCRP) and, over a wide range of
frequencies, the exposure limits developed by the Institute of Electrical and Electronics Engineers, Inc.
(IEEE) and adopted by the American National Standards Institute (ANSI) to replace the 1982 ANSI

The FCC guidelines incorporate two separate tiers of exposure limits that are based upon
occupational/controlled exposure limits (for workers) and general public/uncontrolled exposure limits
for members of the general public.
Occupational/controlled exposure limits apply to situations in which persons are exposed as a
consequence of their employment and in which those persons who are exposed have been made fully
aware of the potential for exposure and can exercise control over their exposure. Occupational/
controlled exposure limits also apply where exposure is of a transient nature as a result of incidental
passage through a location where exposure levels may be above general publiduncontrolled limits (see
below), as long as the exposed person has been made fully aware of the potential for exposure and can
exercise control over his or her exposure by leaving the area or by some other appropriate means.
General public/uncontrolled exposure limits apply to situations in which the general public may be
exposed or in which persons who are exposed as a consequence of their employment may not be made
fully aware of the potential for exposure or cannot exercise control over their exposure. Therefore,
members of the general public would always be considered under this category when exposure is not
employment-related, for example, in the case of a telecommunications tower that exposes persons in a
nearby residential area.
Table I and Figure I (below), which are included within the FCC's OET Bulletin 65, summarize the MPE
limits for RF emissions. These limits are designed to provide a substantial margin of safety. They vary by
frequency to take into account the different types of equipment that may be in operation at a particular
facility and are "time-averaged" limits to reflect different durations resulting from controlled and
uncontrolled exposures.
The FCC's MPEs are measured in terms of power (mW) over a unit surface area (cm2). Known as the
power density, the FCC has established an occupational MPE of 5 milliwatts per square centimeter
(mW/cm2) and an uncontrolled MPE of I mW/cm2 for equipment operating in the I 900 MHz frequency
range. These limits are considered protective of these populations.

MPE limits are designed to provide a substantial margin of safety. These limits apply for continuous
exposures and are intended to provide a prudent margin of safety for all persons, regardless of age,
gender, size, or health.
Personal Communication (PCS) facilities used by Sprint in this area operate within a frequency range of
800-1900 MHz. Facilities typically consist of: I) electronic transceivers (the radios or cabinets)
connected to wired telephone lines; and 2) antennas that send the wireless signals created by the
transceivers to be received by individual subscriber units (PCS telephones). Transceivers are typically
connected to antennas by coaxial cables.
Because of the short wavelength of PCS services, the antennas require line-of-site paths for good
propagation, and are typically installed above ground level. Antennas are constructed to concentrate
energy towards the horizon, with as little energy as possible scattered towards the ground or the sky.
This design, combined with the low power of PCS facilities, generally results in no possibility for

exposure to approach Maximum Permissible Exposure (MPE) levels, with the exception of areas directly
in front of the antennas.
Statement of Compliance
A site is considered out of compliance with FCC regulations if there are areas that exceed the FCC
exposure limits and there are no RF hazard mitigation measures in place. Any carrier which has an
installation that contributes more than 5% of the applicable MPE must participate in mitigating these RF
hazards.
12.0 LIMITATIONS
This report was prepared for the use of Sprint Nextel. It was performed in accordance with generally
accepted practices of other consultants undertaking similar studies at the same time and in the same
locale under like circumstances. The conclusions provided by EBI are based solely on the information
provided by the client. The observations in this report are valid on the date of the investigation. Any
additional information that becomes available concerning the site should be provided to EBI so that our
conclusions may be revised and modified, if necessary. This report has been prepared in accordance
with Standard Conditions for Engagement and authorized proposal, both of which are integral parts of
this report. No other warranty, expressed or implied, is made.
13.0 SUMMARY AND CONCLUSIONS
EBI has prepared this Radiofrequency Emissions Compliance Report for the proposed Sprint
telecommunications equipment at the site located at 71 00 Aviara Resort Drive in Carlsbad, California.
EBI has conducted theoretical modeling to estimate the worst-case power density from Sprint antennas
to document potential MPE levels at this location and ensure that site control measures are adequate to
meet FCC and OSHA requirements. As presented in the preceding sections, based on worst-case
predictive modeling, the worst-case emitted power density may exceed the FCC's general public limit
within approximately 4 feet of Sprint's proposed antennas at the main roof level. Modeling also indicates
that the worst-case emitted power density will not exceed the FCC's occupational limit at the main roof
level.
Signage is recommended at the site as presented in Section 9.0. Posting of the signage and installation of
the recommended barriers brings the site into compliance with FCC rules and regulations.

Land Development Engineering has completed its review of the above referenced project for
application completeness and has determined that the application and plans submitted for this
project are complete and suitable for continued review. Engineering staff does not have any
comments to add to the project. Please add the following conditions to the approving
resolution/letter:
1. Developer shall comply with the City's Stormwater Regulations, latest version, and shall
implement best management practices at all times. Best management practices include
but are not limited to pollution treatment practices or devices, erosion control to
prevent silt runoff during construction, general housekeeping practices, pollution

2. That the requested use is not detrimental to existing uses or to uses specifically permitted in the
zone in which the proposed use is to be located in that the modified WCF is located within a
preferred non-residential location (commercial zone) as listed in Location Guideline A.1.a. of City
Council Policy Statement !'lo. 64, and all aspects of the WCF exhibit stealth design and the
replacement antennas are located within a faux chimney behind RF screen walls which are stucco
finished to match the existing building and the modified equipment cabinets are located within
the building. The WCF use is not precluded by the project site's underlying C-T zoning or the
Aviara Master Plan MP 177. Furthermore, the modification to the WCF will not result in any
additional building coverage, does not visually impact the existing site or building design, as the
antennas are located behind RF screen walls which blend in with the existing architecture and the
modified equipment cabinets are located within the building.
3. That the site for the proposed conditional use is adequate in size and shape to accommodate the
yards, setbacks, walls, fences, parking, loading facilities, buffer areas, landscaping and other
development features prescribed in this code and required by the City Planner in order to integrate
the use with other uses in the neighborhood in that the replacement antennas are located within a
faux chimney behind RF transparent screen walls which are stucco finished to match the existing
building, and the modified equipment cabinets are located within the building. The minor
modifications are designed to blend in with the existing building and will not impact the
appearance of the building.
4. That the street system serving the proposed use is adequate to properly handle all traffic generated
by the proposed use in that the modified WCF requires, on average, one monthly maintenance
visit and occasional visits in response to operational problems.
5. That the modified WCF is consistent with City Council Policy No. 64 in that it is located in a preferred
location (commercial zone) as listed in Location Guideline A.l.a. of City Council Policy Statement
No. 64 and exhibits stealth design, as the replacement antennas are located within a faux chimney

6. That the City Planner has determined that the project belongs to a class of projects that the State
Secretary of Resources has found do not have a significant impact on the environment, and it is

documents pursuant to Section 15301 -Existing Facilities of the state CEQA Guidelines. In making
this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the
state CEQA Guidelines do not apply to this project.
7. The City Planner has reviewed each of the exactions imposed on the Developer contained in this
resolution, and hereby finds, in this case, that the exactions are imposed to mitigate impacts caused
by or reasonably related to the project, and the extent and the degree of the exaction is in rough
proportionality to the impact caused by the project.
Conditions:
1. Approval is granted for MCUP 12-05 -SPRINT FOUR SEASONS SITE as shown on Exhibits "A"-"K"
dated June 7, 2013 on file in the Planning Division and incorporated herein by reference.
Development shall occur substantially as shown unless otherwise noted in these conditions.

2. If any of the following conditions fail to occur, or if they are, by their terms, to be implemented and
maintained over time, if any of such conditions fail to be so implemented and maintained according
to their terms, the City shall have the right to revoke or modify all approvals herein granted; deny or
further condition issuance of all future building permits; deny, revoke, or further condition all
certificates of occupancy issued under the authority of approvals herein granted; record a notice of
violation on the property title; institute and prosecute litigation to compel their compliance with said
conditions or seek damages for their violation. No vested rights are gained by Developer or a
successor in interest by the City's approval of this Minor Conditional Use Permit.
3. Staff is authorized and directed to make, or require the Developer to make, all corrections and
modifications to the Minor Conditional Use Permit documents, as necessary to make them
internally consistent and in conformity with the final action on the project. Development shall occur
substantially as shown on the approved Exhibits. Any proposed development different from this
approval shall require an amendment to this approval.
4. The Developer/Operator shall and does hereby agree to indemnify, protect, defend and hold
harmless the City of Carlsbad, its Council members, officers, employees, agents, and representatives,
from and against any and all liabilities, losses, damages, demands, claims and costs, including court
costs and attorney's fees incurred by the City arising, directly or indirectly, from (a) City's approval
and issuance of this Minor Conditional Use Permit, (b) City's approval or issuance of any permit or
action, whether discretionary or non-discretionary, in connection with the use contemplated herein,
and (c) Developer/Operator's installation and operation of the facility permitted hereby, including
without limitation, any and all liabilities arising from the emission by the facility of electromagnetic
fields or other energy waves or emissions.
5. The Developer shall comply with all applicable provisions of federal, state, and local ordinances in
effect at the time of building permit issuance.
6. This project shall comply with all conditions and mitigation measures, which are required as part of
the Zone 19 Local Facilities Management Plan and any amendment made to that Plan prior to the
issuance of building permits.
7. MCUP 12-05 shall be reviewed by the City Planner on a yearly basis to determine if all conditions of
this permit have been met and that the use does not have a substantial negative effect on
surrounding properties or the public health, safety and general welfare. If the City Planner
determines that: 1) the minor conditional use permit was obtained by fraud or misrepresentation; or
2) the use for which such approval is granted is not being exercised; or 3) the conditions of approval
have not been met; or 4) the minor conditional use permit is being or recently has been exercised
contrary to any of the terms or conditions of approval; or 5) the use for which such approval was
granted has ceased to exist or has been suspended for one year or more; or 6) the use is in violation
of any statute, ordinance, law or regulation; or 7) the use permitted by the minor conditional use
permit is being or has been so exercised as to be detrimental to the public health, safety or welfare
or so as to constitute a nuisance, the City Planner shall hold an informal public hearing and after
providing the permittee the opportunity to be heard, the City Planner may revoke and terminate the
minor conditional use permit in whole or in part, reaffirm the minor conditional use permit, modify
the conditions or impose new conditions.
8. This Conditional Use Permit is granted for a period of ten (10) years from June 7, 2013 through June
6, 2023. This permit may be revoked at any time after a public hearing, if it is found that the use has
a substantial detrimental effect on surrounding land uses and the public's health and welfare, or the

conditions imposed herein have not been met. This permit may be extended for a reasonable
period of time not to exceed ten (10) years upon written application of the permittee made no less
than 90 days prior to the expiration date. The Planning Commission may not grant such extension,
unless it finds that there are no substantial negative effects on surrounding land uses or the public's
health and welfare. If a substantial negative effect on surrounding land uses or the public's health
and welfare is found, the extension shall be denied or granted with conditions which will eliminate
or substantially reduce such effects. There is no limit to the number of extensions the Planning
Commission may grant.
9. Prior to the issuance of a building permit, owner/applicant shall submit to the City a Notice of
Restriction to be filed in the office of the County Recorder, subject to the satisfaction of the City
Planner, notifying all interested parties and successors in interest that the City of Carlsbad has issued
a Minor Conditional Use Permit on the real property owned by the owner/applicant. Said Notice of
Restriction shall note the property description, location of the file containing complete project
details and all conditions of approval as well as any conditions or restrictions specified for inclusion
in the Notice of Restriction. The City Planner has the authority to execute and record an amendment
to the notice, which modifies or terminates said notice upon a showing of good cause by the
owner/applicant or successor in interest.
10. This approval shall become null and void if building permits are not issued for this project within 18
months from the date of project approval.
11. Developer shall report, in writing, to the City Planner within 30 days, any address change from that
which is shown on the permit application.
12. Developer/Operator shall comply with the Federal Communication Commission's guidelines on limits
for human exposure to radio frequency (RF) electromagnetic fields. Within six (6) months after the
issuance of occupancy, and with any time extension or amendment request, the
Developer/Operator shall submit to the City Planner either (1) verification that the project is
categorically excluded from having to determine compliance with the RF exposure guidelines per 47
CFR §1.1307(b)(1); or (2) a project implementation report which provides cumulative field
measurements of RF emissions of all antennas installed at the subject site. The report shall quantify
the RF emissions and compare the results with the exposure limits established by the FCC guidelines.
Said report shall be subject to review and approval by the City Planner for consistency with the
Project's preliminary report on RF exposure submitted with the initial project application and for
consistency with the FCC guidelines. If, on review, the City finds that the Project does not meet the
FCC guidelines, the City may revoke or modify this conditional use permit.
Engineering:
13. Developer shall comply with the City's Stormwater Regulations, latest version, and shall implement
best management practices at all times. Best management practices include but are not limited to
pollution treatment practices or devices, erosion control to prevent silt runoff during construction,
general housekeeping practices, pollution prevention and educational practices, maintenance
procedures, and other management practices or devices to prevent or reduce the discharge of
pollutants to stormwater, receiving water or stormwater conveyance system to the maximum extent
practicable. Developer shall notify prospective owners and tenants of the above requirements.

14. Approval of this request shall not excuse compliance with all applicable sections of the Zoning
Ordinance and all other applicable City ordinances in effect at time of building permit issuance,
except as otherwise specifically provided herein.
15. Premise identification (addresses) shall be provided consistent with Carlsbad Municipal Code Section
18.04.320.
NOTICE
Please take NOTICE that approval of your project includes the "imposition" of fees, dedications, reservations,
or other exactions hereafter collectively referred to for convenience as "fees/exactions."
You have 90 days from the date of final approval to protest imposition of these fees/exactions. If you protest
them, you must follow the protest procedure set forth in Government Code Section 66020(a), and file the
protest and any other required information with the City Manager for processing in accordance with
Carlsbad Municipal Code Section 3.32.030. Failure to timely follow that procedure will bar any subsequent
legal action to attack, review, set aside, void, or annul their imposition.
You are hereby FURTHER NOTIFIED that your right to protest the specified fees/exactions DOES NOT APPLY
to water and sewer connection fees and capacity charges, nor planning, zoning, grading or other similar
application processing or service fees in connection with this project; NOR DOES IT APPLY to any
fees/exactions of which you have previously been given a NOTICE similar to this, or as to which the statute of
limitations has previously otherwise expired.
This decision may be appealed by you or any other member of the public to the Planning Commission within
ten days of the date of this letter. Appeals must be submitted in writing to the Planning Division at 1635
Faraday Avenue in Carlsbad, along with a payment of $638.00. The filing of such appeal within such time
limit shall stay the effective date of the order of the City Planner until such time as a final decision on the
