To view the SUSMP, refer to the Engineering Standards (Volume 4, Chapter 2) at www.carlsbadc@.gov/standards. Initially this questionnaire must be completed by the applicant in advance of submitting for a development application (subdivision, discretionary permits and/or construction permits). The results of the questionnaire determine the level of storm water standards that must be applied to a proposed development or redevelopment project. Depending on the outcome, your project will either be subject to 'Standard Stormwater Requirements' or be subject to additional criteria called 'Priority Development Project Requirements'. Many aspects of project site design are dependent upon the storm water standards applied to a project Your responses to the questionnaire represent an initial assessment of the proposed project conditions and impacts. City staff has responsibility for making the final assessment after submission of the development application. If staff determines that the questionnaire was incorrectly filled out and is subject to more stringent storm water standards than initially assessed by you, this will result in the return of the development application as incomplete. In this case, please make the changes to the questionnaire and resubmit to the City. If you are unsure about the meaning of a question or need help in determining how to respond to one or more of the questions, please seek assistance from Land Development Engineering staff. As depicted in attaclnrent one. This proposed AT&T teleconnnunication site will utilize directional transmit panel antennae configured in four (4) sectors. The antennae are planned to be n:xJtmted behind the rooftile ofthe subject building, with their centers at least 39.6 feet above grade directed at 0 (sector A), 80 (sector B), 180 (sector C), and 280 (sector D) degrees true north. The antennas specified are KMW tmdel AM-X-CD-16-65-00T, with 0 degrees downtih for all sectors. Technical specifications of these antennae are provided in attachment two. The sectorized antennas are designed to transmit with an effective radiated power (ERP) ofup to 1,156 watts per sector within a bandwidth between approximately 704 and 834 MHz (utilizing LTE and UTMS technology collectively referred to in this bandwidth as cellular frequencies) and with an ERP of up to 1,668 watts per sector within a bandwidth between approximately 1,740 and 1,874 MHz (utilizing LTE and UTMS technology collectively referred to in this bandwidth as PCS frequencies). Calculation Methodology, Results & Recommendations Calculations were made in accordance with the reconnnendations contained in the Federal Comnnmications Cormnission, Office of Engineering and Technology Bulletin 65 (edition 97-01, page 24, equation 10 ) entitled ''Evaluating Compliance with FCC-Guidelines for Human Exposure to Radiofrequency Electromagnetic Fields." Several assumptions were made in order to provide the most conservative or ''worse case" projections of power densities. Calculations were made assuming that all channels were operating simultaneously at their maxirrnnn design effective radiated power. Attenuation (weakening) of the signal that would result from surrmmding fOliage or buildings was ignored. Buildings can reduce the signal strength by a :factor of 10 (ie., 10 dB) or m:>re depending upon the construction material The ground or other sur:fu.ces were considered to be perfect reflectors (which they are not) and the RF energy was assumed to overlap and interact constructively at all locations (which they would not) thereby resulting in the calculation of the maxirrnnn potential exposure. In fact, the accumulations of all these very conservative assumptions will significantly overestimate the actual exposures that would typically be expected from such a :facility. However, this method is a prudent approach that errs on the side of safety. 1 .. The rmximum public RF exposure from this AT&T fucility was calculated to be less than 1.5% of the FCC public safety standard. This total exposure is comprised of 5.4 Jl W/crrr ( ie., ~ 1.2% of the public safety standard at cellu1ar frequencies) and less than 2.6 Jl W/crrr ( ie., ~0.3% of the public safety standard at PCS frequencies). RF exposure expressed in percent of the FCC public exposure standard as a :fimction of distance from the proposed fucility at ground level is shown in appendix A. RF Safety Standards The two most widely recognized standards for protection against RF field exposure are those published by the Atrerican National Standards Institute (ANSI) C95.1 and the National Council on Radiation Protection and measurement (NCRP) report #86. The NCRP is a private, congressionally chartered institution with the charge to provide expert analysis of a variety of issues (especially heahh and safety recommendations) on radiations of all forms. The scientific analyses of the NCRP are held in high esteem in the scientific and regulatory comm.mity both nationally and internationally. In fuct, the vast majority of the radiological heahh regulations currently in existence can trace their origin, in some way, to the recommendations of the NCRP. All RF exposure standards are frequency-specific, in recognition of the differential absorption of RF energy as a :fimction of frequency. The most restrictive exposure levels in the standards are associated with those frequencies that are most readily absorbed in humans. Maxinnnn absorption occurs at approximately 80 MHz in adults. The NCRP maxinnnn allowable continuous occupational exposure at this frequency is 1,000 JlW/crrr. This compares to 5,000 JlW/crrr at the most restrictive of the PCS frequencies (~1,800 MHz) that are absorbed nrnch less efficiently than exposures in the VHF TV band. The traditional NCRP philosophy ofproviding a higher standard ofprotection for members ofthe general population compared to occupationally exposed individuals, prompted a two-tiered safety standard by which levels of allowable exposure were substantially reduced fur ''uncontrolled " (e.g., public) and continuous exposures. This measure was taken to account fur the fuct that workers in an industrial environment are typically exposed no more than eight hours a day while members of the general population in proximity to a source of RF radiation may be exposed continuously. This additional protection fuctor also provides a greater margin of safety for children, the infirmed, aged, or others who might be more sensitive to RF exposure. After several years of evahmting the national and international scientific and biomedical literature, the members of the NCRP scientific committee selected 931 publications in the peer-reviewed scientific literature on which to base their recommendations. The current NCRP recommendations limit continuous public exposure at PCS frequencies to 1,000 Jl W/crrr. The 1992 ANSI standard was developed by Scientific Coordinating Connnittee 28 (SCC 28) under the auspices of the Institute of Electrical and Electronic Engineers (IEEE). This standard, entitled '1EEE Standards for Safety Levels with Respect to Hmnan Exposure to Radio Frequency Electromagnetic Fields, 3kHz to 300 GHz" (IEEE C95.1-1991), was issued in April1992 and subsequently adopted by ANSI. A 2 • revision ofthis standard (C95.1-2005) was completed in October 2005 by SCC 39 the IEEE International Connnittee on Electromagnetic Safety. Their recommendations are similar to the NCRP recommendation for the maximnn permissible exposure (MPE) to the public PCS frequencies (950 1.1 W/crri for continuous exposure at 1 ,900 MHz) and incorporates the convention of providing fur a greater margin of safety for public as compared with occupational exposure. Higher whole body exposures are allowed fur brief periods provided that no 30 minute time-weighted average exposure exceeds these aforementioned limits. On August 9, 1996, the Federal Communications Connnission (FCC) established a RF exposure standard that is a hybrid of the current ANSI and NCRP standards. The rrnxirrnnn permissible exposure values used to assess environmental exposures are those of the NCRP (ie., maximnn public continuous exposure at PCS frequencies ofl,OOO JlW/crri ). The FCC issued these standards in order to address its responsibilities under the National Environmental Policy Act (NEP A) to consider whether its actions will "significantly affuct the quality of the hmnan environment." In as fur as there was no other standard issued by a federal agency such as the Environmental Protection Agency (EPA), the FCC utilized their rulemaking procedure to consider which standards should be adopted. The FCC received thousands of pages of comments over a three-year review period from a variety of sources including the public, academia, federal health and safety agencies (e.g., EPA & FDA) and the telecomrmmications industry. The FCC gave special consideration to the recommendations by the federal health agencies because of their special responsibility fur protecting the public health and safety. In met, the maximnn permissible exposure (MPE) values in the FCC standard are those recommended by EPA and FDA. The FCC standard incorporates various elements ofthe 1992 ANSI and NCRP standards which were chosen because they are widely accepted and technically supportable. There are a variety of other exposure guidelines and standards set by other national and international organizations and governments, most of which are similar to the current ANSI/IEEE or NCRP standard, figure one. The FCC standards ''Guidelines for Evaluating the Environmental Effucts of Radiofrequency Radiation" (Report and Order FCC 96-326) adopted the ANSI/IEEE definitions fur controlled and uncontrolled environments. In order to use the higher exposure levels associated with a controlled environment, RF exposures rrrnst be occupationally related (e.g., PCS company RF technicians) and they rrrnst be aware of and have sufficient knowledge to control their exposure. All other environmental areas are considered uncontrolled (e.g., public) for which the stricter (ie., lower) environmental exposure limits apply. All carriers were required to be in compliance with the new FCC RF exposure standards for new telecommunications facilities by October 15, 1997. These standards applied retroactively fur existing telecommunications facilities on September 1, 2000. The task for the physica~ biologica~ and medical scientists that evaluate health implications of the RF data base has been to identifY those RF field conditions that can produce harmful biological effucts. No panel of experts can guarantee safe levels of exposure because safety is a null concept, and negatives are not susceptible to proof What a dispassionate scientific assessment can offur is the presumption of safety when RF-:field conditions do not give rise to a demonstrable harmful effect. Summary & Conclusions The RF exposure from the proposed AT&T facility as specified above will be in full compliance with FCC RF public safety standards. Wireless telecommunications transmitters, by design and operation, are low- power devices. Even wx:ler maximal exposure conditions, in which all the channels from all antennas are operating at full design basis power, the maximnn RF exposures will be less than 1.5% of the public safety 3 • standard at any publically accessible location This maximum exposme is approxirmtely 65 times lower than the FCC public exposme standards for these frequencies. A chart of the electromagnetic spectnnn and a comparison of RF power densities from various connnon somces is presented in figm-es two and three respectively in order to place exposmes from wireless telecorrnmmications systems in perspective. It is important to realize that the FCC maxirrrum allowable exposmes are not set at a threshold between safety and known hazard but rather at 50 times below a level that the majority of the scientific comnnmity believes tmy pose a health risk to hmnan populations. Thus the previously mentioned maxirrrum exposme from the site represent a "safety tmrgin" from this threshold of potentially adverse health effucts of more than 3,330 times. Given the low levels of radiofrequency fields that would be generated from this fucility, and given the evidence on biological effucts in a large data base, there is no scientific basis to conclude that harmful effucts will attend the utilization of the proposed wireless telecorrnrrunications facility. This conchtsion is supported by a large numbers of scientists that have participated in standard-setting activities in the United States who are overwhehningly agreed that RF radiation exposme below the FCC exposme limits has no dermnstrably harmful effucts on lrumans. These findings are based on my professional evaluation of the scientific issues related to the health and safety of non-ionizing electrmmgnetic radiation and my analysis of the technical specification as provided by AT&T. The scientific discipline of Health Physics is devoted to radiation protection, which, among other things, involves providing analysis of radiation exposure conditions, biological effects research, regulations and standards as well as recommendations regarding the use and safety of ionizing and non-ionizing radiation. In addition, Dr. Bushberg has extensive experience and lectures on several related topics including medical physics, radiation protection, (ionizing and non-ionizing), radiation biology, the science of risk assessment and effective risk communication in the public sector. Dr. Bushberg's doctoral dissertation at Purdue University was on various aspects of the biological effects of microwave radiation. He has maintained a strong professional involvement in this subject and has served as consultant or appeared as an expert witness on this subject to a wide variety of organizations/institutions including, local governments, school districts, city planning departments, telecommunications companies, the California Public Utilities Commission, national news organizations, and the U.S. Congress. In addition, his consultation services have included detailed computer based modeling of RF exposures as well as on-site safety inspections and RF & ELF environmental field measurements of numerous transmission facilities in order to determine their compliance with FCC and other safety regulations. The consultation services provided by Dr. Bush berg are based on his professional judgement as an independent scientist, however they are not intended to necessarily represent the views of any other organization. Dr. Bushberg is a member of the main scientific body of International Committee on Electromagnetic Safety (ICES) which reviews and evaluates the scientific literature on the biological effects of non- ionizing electromagnetic radiation and establishes exposure standards. He also serves on the ICES Risk Assessment Working Group that is responsible for evaluating and characterizing the risks of non- ionizing electromagnetic radiation. Dr. Bushberg was appointed and is serving as a member of the main scientific council of the National Council on Radiation Protection and Measurement's (NCRP). He is also a Scientific Vice-President of the NCRP, a member of the NCRP Board of Directors and chairs its committee on Radiation Protection in Medicine. In addition, Dr. Bushberg is a member of NCRP's scientific advisory committee on Non-ionizing Radiation Safety. The NCRP is the nation's preeminent scientific radiation protection organization, chartered by Congress to evaluate and provide expert consultation on a wide variety of radiological health issues. The current FCC RF exposure safety standards are based in large part on the recommendations of the NCRP. Dr. Bushberg was elected to the International Engineering in Medicine and Biology Society Committee on Man and Radiation (CO MAR) which has as its primary area of responsibility the examination and interpreting the biological effects of non-ionizing electromagnetic energy and presenting its findings in an authoritative and professional manner. Dr. Bushberg is also a member of a six person U.S. expert delegation to the international scientific community on Scientific and Technical Issues for Mobile Communication Systems established by the Federal Communications Commission. That the site for the proposed conditional use is adequate in size and shape to accommodate the yards, setbacks, walls, fences, parking, loading facilities, buffer areas, landscaping and other development features prescribed in this code and required by the City Planner in order to integrate the use with other uses in the neighborhood in that the proposed antennas are located behind an existing mansard roof. In addition, the equipment is located within an enclosure constructed of split-face CMU walls adjacent to the existing hangar building and thereby exhibits stealth design techniques. 4. That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use in that the proposed unmanned WCF use would require, on average, only monthly maintenance visits and occasional visits in response to operational problems. 5. That the City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15303 (New Construction of Small Structures) of the state CEQA Guidelines. In making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project. 6. The City Planner has reviewed each of the exactions imposed on the Developer contained in this resolution, and hereby finds, in this case, that the exactions are imposed to mitigate impacts caused by or reasonably related to the project, and the extent and the degree of the exaction is in rough proportionality to the impact caused by the project. Conditions: 1. Approval is granted for MCUP 13-01 as shown on Exhibits "A"-"L" dated October 15, 2013 on file in the Planning Division and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. 2. If any of the following conditions fail to occur, or if they are, by their terms, to be implemented and maintained over time, if any of such conditions fail to be so implemented and maintained according to their terms, the City shall have the right to revoke or modify all approvals herein granted; deny or further condition issuance of all future building permits; deny, revoke, or further condition all certificates of occupancy issued under the authority of approvals herein granted; record a notice of violation on the property title; institute and prosecute litigation to e • MCUP 13-01-NS0026 PALOMAR AIRPORT October 15, 2013 Page 3 compel their compliance with said conditions or seek damages for their violation. No vested rights are gained by Developer or a successor in interest by the City's approval of this Minor Conditional Use Permit. 3. Staff is authorized and directed to make, or require the Developer to make, all corrections and modifications to the MCUP 13-01 documents, as necessary to make them internally consistent and in conformity with the final action on the project. Development shall occur substantially as shown on the approved Exhibits. Any proposed development different from this approval shall require an amendment to this approval. 4. The Developer/Operator shall and does hereby agree to indemnify, protect, defend and hold harmless the City of Carlsbad, its Council members, officers, employees, agents, and representatives, from and against any and all liabilities, losses, damages, demands, claims and costs, including court costs and attorney's fees incurred by the City arising, directly or indirectly, from (a) City's approval and issuance of this Minor Conditional Use Permit, (b) City's approval or issuance of any permit or action, whether discretionary or non-discretionary, in connection with the use contemplated herein, and (c) Developer/Operator's installation and operation of the facility permitted hereby, including without limitation, any and all liabilities arising from the emission by the facility of electromagnetic fields or other energy waves or emissions. 5. The Developer shall comply with all applicable provisions of federal, state, and local ordinances in effect at the time of building permit issuance. 6. This project shall comply with all conditions and mitigation measures, which are required as part of the Zone 5 Local Facilities Management Plan and any amendments made to that Plan prior to the issuance of building permits. 7. MCUP 13-01 shall be reviewed by the City Planner on a yearly basis to determine if all conditions of this permit have been met and that the use does not have a substantial negative effect on surrounding properties or the public health, safety and general welfare. If the City Planner determines that: 1) the minor conditional use permit was obtained by fraud or misrepresentation; or 2) the use for which such approval is granted is not being exercised; or 3) the conditions of approval have not been met; or 4) the minor conditional use permit is being or recently has been exercised contrary to any of the terms or conditions of approval; or 5) the use for which such approval was granted has ceased to exist or has been suspended for one year or more; or 6) the use is in violation of any statute, ordinance, law or regulation; or 7) the use permitted by the minor conditional use permit is being or has been so exercised as to be detrimental to the public health, safety or welfare or so as to constitute a nuisance, the City Planner shall hold an informal public hearing and after providing the permittee the opportunity to be heard, the City Planner may revoke and terminate the minor conditional use permit in whole or in part, reaffirm the minor conditional use permit, modify the conditions or impose new conditions. 8. This Conditional Use Permit is granted for a period of 10 years from October 15, 2013 through October 14, 2023. This permit may be revoked at any time after a public hearing, if it is found that the use has a substantial detrimental effect on surrounding land uses and the public's health and welfare, or the conditions imposed herein have not been met. This permit may be extended for a reasonable period of time not to exceed 10 years upon written application of the • • MCUP 13-01-NS0026 PALOMAR AIRPORT October 15, 2013 Page4 permittee made no less than 90 days prior to the expiration date. The Planning Commission may not grant such extension, unless it finds that there are no substantial negative effects on surrounding land uses or the public's health and welfare. If a substantial negative effect on surrounding land uses or the public's health and welfare is found, the extension shall be denied or granted with conditions which will eliminate or substantially reduce such effects. There is no limit to the number of extensions the Planning Commission may grant. 9. Prior to the issuance of a building permit, owner/applicant shall submit to the City a Notice of Restriction to be filed in the office of the County Recorder, subject to the satisfaction of the City Planner, notifying all interested parties and successors in interest that the City of Carlsbad has issued a Minor Conditional Use Permit on the real property owned by the owner/applicant. Said Notice of Restriction shall note the property description, location of the file containing complete project details and all conditions of approval as well as any conditions or restrictions specified for inclusion in the Notice of Restriction. The City Planner has the authority to execute and record an amendment to the notice, which modifies or terminates said notice upon a showing of good cause by the owner/applicant or successor in interest. 10. This approval shall become null and void if building permits are not issued for this project within 18 months from the date of project approval. 11. Developer shall report, in writing, to the City Planner within 30 days, any address change from that which is shown on the permit application. 12. Developer/Operator shall comply with the Federal Communication Commission's guidelines on limits for human exposure to radio frequency (RF) electromagnetic fields. Within six (6) months after the issuance of occupancy, and with any time extension or amendment request, the Developer/Operator shall submit to the City Planner either (1) verification that the project is categorically excluded from having to determine compliance with the RF exposure guidelines per 47 CFR §1.1307(b)(1); or (2) a project implementation report which provides cumulative field measurements of RF emissions of all antennas installed at the subject site. The report shall quantify the RF emissions and compare the results with the exposure limits established by the FCC guidelines. Said report shall be subject to review and approval by the City Planner for consistency with the Project's preliminary report on RF exposure submitted with the initial project application and for consistency with the FCC guidelines. If, on review, the City finds that the Project does not meet the FCC guidelines, the City may revoke or modify this conditional use permit. Engineering: 13. Developer shall comply with the city's Stormwater Regulations, latest version, and shall implement best management practices at all times. Best management practices include but are not limited to pollution treatment practices or devices, erosion control to prevent silt runoff during construction, general housekeeping practices, pollution prevention and education practices, maintenance procedures, and other management practices or devices to prevent or reduce the discharge of pollutants to stormwater, receiving water or stormwater conveyance system to the maximum extent practicable.
