About two years ago the Carlsbad City Planning Department made
arrangements with the Occidental Land Development Company to set
aside 10 acres for an elementary school site to serve its planned
subdivision development in the area. The property was temporarily
set aside in the most northeasterly corner of their holdings, which
is now adjacent to your property. .
Upon review of the site by the State School Planning Department and
the State Division of Aeronautics, the district was advised that the
10-acre site should be moved to a higher piece of ground. To do this
required that approximately 3 acres of the property would lie within
a property owned by your organization. We had understood from
personal conversation with you that there might be a possibility that
you would consider donation of school sites at some future date.
We have attached copies of a survey and legal description of the pro-
posed school site and are hopeful that you will be able to cooperate
with us in making the 3 acres more or less available for school pur-
poses as a portion of the 10-acre site. The manner in which the
district is handling property donations is as follows:
1. Through policies adopted by both Carlsbad City Council
and the school board, residential developers are requested
to make a financial contribution for school facilities in
the amount of §393 per dwelling unit.
2. If land is donated for school sites, an agreement is
reached as to its value and credit is then applied against
the number of units at the $393 fee, which, in most
instances, reduces the per unit fee.
3. After an agreement is reached, the property is then deeded
to the school district free and clear of encumbrances.

that you have had aoas recent sales which sight be useful in reaching
a value of the property dependent upon its location, the severity of
the terrain and whethar or not it is part of a master plan sever
development.
