Donation of Park Site. The applicant will donate the 10 acre park site to the city, at the time the applicant's surrounding property is developed (Parcel K). Negotiations to arrange for said donation are to com- mence upon the approval of applicant's application herein. The donation is to include all improvements existing on said acreage, including the historical ranch mansion, the patios, and all of the landscaping and trees and accompanying buildings. The appli- cant considers this 10 acre site to be the most valuable portion of the ranch and considers the improvements and specimen plants and trees to be of very high economic value. It is understood that the purpose of the donation is to meet the City of Carlsbad's ordinance requirements for park donation. II. Schools. . A. Richmar District. Elementary School Site i-2 is to be reserved for donation to the Richmar School District. If it is determined that the development generates enough students in the district to Carlsbad Planning Commission August 4, 1972 Re: Carrillo Ranch Page Two warrant the school, then the site will be donated by the appli- cant and developed by the district. In the event the school is not warranted, the site will be returned to the applicant for future residential development. B. Carlsbad School District. Elementary School Site i-1 is to be reserved for donation to the-Carlsbad School District. If it is"determined that the development generates enough students in the district to warrant the school, then the site will be donated by the applicant and developed by the district. In the event the school is not warranted, the site will be returned to the applicant for future residential development. Further, if it is determined that more children are generated by the development than can be accomodated within the school site, the applicant will contribute moneys according " to 'the formula for excess students. Because of the intended higher than average sales price of the sites per unit, it is tentatively concluded that the development would probably not generate a number of students in excess of the capacity of the one school. III. Airport. The applicant represents that at the time it submits precise plans pertaining to the northerly 1,000 feet of the property,' it will give notice to the County of San Diego Airport Use Commission so that the said department will have an opportu- nity to purchase whatever rights, if any, are required for airport use, prior to any improvements being constructed. IV. The word "applicant", as used above, is defined to "applicant or its successor in interest." Thank you for your consideration in this matter.
