Dear Mr. White:
Your letter of August 3, 1976, has been discussed with the
City Manager, Park and Recreation Director and Planning
Director. We appreciate the problem discussed in your
letter, and have reevaluated our suggestion in regards to
additional park dedications. We are satisfied at this
time to recommend that the parks agreement be forwarded
to the Council in accord with the existing draft including
a provision that the parks requirement for each individual
subdivision shall be satisfied out of the land bank arrange-
ment for Parcel K and the ranch buildings.
As you know, the City of Carlsbad has recently enacted a new
planned community zone. That zone provides that for devel-
opments such as yours, which has an approved master plan,
all subsequent developments shall be processed through the
device of a planned unit development permit. In the event
the developer does not wish to proceed in that manner, the
ordinance requires that he apply for a master plan amendment
to bring the master plan into accord with the new ordinance.
The PUD Ordinance contains certain open space and recrea-
tional amenity requirements over and above the park dedica-
tion requirements which should satisfy the need for any
individual neighborhood parks. In the event the master plan
amendment process is utilized we could reevaluate the parks
program for the Ranch and make provisions for any necessary
neighborhood parks with a set-off perhaps-from the existing
K-l Dedication Requirement.
As indicated in my letter of July 15, 1976, we would appre-
ciate your proceeding to secure the necessary access easement
to the Park, affording us an opportunity to review the lan-
guage of the easement deed prior to its execution. We would
also appreciate the return of the draft parks agreement with any

necessary changes indicated so we can proceed to schedule
a meeting at which we can place the matter in a posture
for submission to the City Council.
