John McCoy, 390 Oak Avenue, Carlsbad. Mr. McCoy expressed concern with regard to the section dealing, with frontyard setbacks from the garages, and suKgested that same be revised to 20 feet if there vill be parking in front of the garage. The Comniission recogni.tcd Mr. Joe Sandy,. 2956 Roosevelt, Carlsbad. Mr. Sandy addressed the section dealing with driveway widths, and stated his opinion that the widths outliaed in the Ordinance are not needed. He further requested that Staff gii^e consideration to same. Chaimian Farrow continued the public hearing. With regard to the setbacks from the garages. Bill Hofman explained that the Ordinance is set up for a garage facing the street which must be setback either less than five or greater than ten feet. With regard to street and driveway widths,> Mr. Hofman indicated that_ the figures are based on input received from the Police, Fire, and Engineering Departments. Following brief discussion, the Commission continued the matter to the meeting of April 14, 1982, to allow for a full Coiranission. With the aid of a transparency showing the location of the request, Charles Grimm gave the staff report, essentially as contained in the written report. I. PROJECT DESCRIPTION AND BACKGROUND The applicant is requesting a minor amendment to the La Costa Master plan which would allow the separate filing of a develop- ment plan on Neighborhood SE-15. Neighborhood SE-15 is located in the southeast portion of La Costa near the intersection of La Costa Avenue and Rancho Santa Fe Road (map attached). The change to the text, if approved, would occur on Page III-17. Before the Commission makes a determination however, they must first decide if the proposed amendment is a minor one. Section 21.38.120 of the P-C zone allows the Planning Commission to make minor amend- ments to the Master Plan. The La Costa Master Plan (MP-149(E) was approved by the City Council on December 2, 1980 (Ordinance No. 9570) and included those portions of La Costa zoned P-C which were not covered by the existing Master Plan (MP-149). SE-15 is part of the La Costa Commercial Core as designated by the General Plan. II. ANALYSIS Planning Issues 1. What effect on the development of this area will be created by the proposed change in the Master Plan text? Discussion The Land Use Element of the General Plan (P.42) states that a specific plan should be required for the Community Core area and that particular attention should be paid to possible land use and it's impact on surrounding uses. Since a Master Plan was also required for this area (P-C zone requirement), it was felt that a site development plan, required through the Master Plan, should be utilized to fulfill this specific plan requirement. Existing Section III-17 of the Master Plan states as follows: m. (SE-13) See Section III.E. above and n. below. n. (SE-14) The site development plan for this neighborhood shall be processed concurrent with the Neighborhoods SE-13 and SE-15. Commercial and office uses can be interspersed throughout all three neighborhoods as long as the square footage reserved for office use is not less than 25% of the total square footage of structures in all three neighborhoods. o. (SE-15) Same as m. above. The new wording proposed by the applicant would be as follows: m. (SE-13) See Section III.E. above and n. below. n. (SE-14) The site development plan for this neighborhood shall be processed concurrent with Neighborhood SE-13. Commercial and office uses can be interspersed through- out both neighborhoods as long as the square footage reserved for office use is not less than 25% of the total square footage of structures in both neighbor- hoods . o. (SE-15) See Section III.E. above. Essentially, the new wording allows the development of SE-15 by itself. Under the old language SE-13, SE-14 and SE-15 would have to be developed concurrently. The intent of this section was to make sure that the three areas were designed to be compatible with each other and with surrounding land use. Because SE-13 and SE-14 are separated from SE-15 by La Costa Avenue, a major arterial, staff does not feel that SE-15 needs to be developed at the same time as SE-13 and SE-14. The proposed language will not remove the development plan requirement from SE-15, so the city can still ensure compatibility with surrounding uses. As a result, staff has no objections to the proposed changes to the Master Plan text. III. ENVIRONMENTAL REVIEW The Planning Director has determined that this project has already been considered in conjunction with a previously cer- tified environmental document and therefore has issued a notice of Prior Environmental Compliance dated March 9, 1982. A copy of this notice is on file in the Planning Department. -2- IV. RECOMMENDATION It is recommended that the Planning Commission adopt Resolution No. 1935, APPROVING MP-149(I) based on the findings contained herein. ATTACHMENTS 1. PC Resolution No. 1935 2. The minor amendment, if approved, would permit the separate filing of a development plan on the 6-acre Community Neighborhood SE-15. Presently the Master Plan requires concurrent filing of a development plan for SE-15 together with the 51-acre Community Core area (Neighborhoods SE-13 and SE-14) across La Costa Avenue extension to the north (see attached map). To require the preparation of a development for the 51-acre Community Core at the time we are attempting to proceed with only a 6-acre site creates a totally unnecessary and unrealistic burden. Due to market conditions development of the 51-acre site is several years away. However, there is more immediate potential for the 6-acre site. This minor amendment would not alter the density, boundaries or involve an addition of a new use or group of uses or a rearrangement of uses on Neibhorhood SE-15. Enclosed is our check for $62.00 to cover the development processing fee for this request. I would appreciate your favorable consideration in this matter.
