The Archaeological Technical Report included in the EIR Appendices contains the requirement for the mitigation measure. The mitigation measure was inadvertently omitted from the list of required mitigation measures. City Council Resolution No. 2001-318 Item number 1 shall be revised to include the following: Mitigation Measure 4.5-6. Sites 11569 and 11570: Prior to issuance of a grading permit in the Oaks area of sites 11569 and 11570, a qualified archaeologist shall prepare a data recovery research plan to be approved by the City Planning Director for the analysis, excavation and data recovery of the sites and preparation of a report placing the sites in historical context. Such analysis, excavation and report shall be completed by the qualified archaeologist prior to disturbance of the sites who shall comply with all legal requirements for Native American monitoring and notification if Native American remains are present. 2) The following should be inserted to the CEQA Candidate Findings to add Mitigation 4.5- 6 (Archaeological Condition) [to be added on page 48, insert immediately before Section 2.6.] 2.5.4 Archaeological Resources Impacts - La Costa Ridge/Oaks. Impact. Sites 11569 and 11570 are located in areas proposed for development in the northeastern portion of La Costa Oaks. Finding. With incorporation of the following mitigation measure, the identified direct significant impact would be avoided and thereby reduced below a level of significance. Mitigation Measure 4.5-6: Prior to the issuance of a grading permit in the Oaks area of sites 11569 and 11570, a qualified archaeologist shall prepare a data recovery research plan to be approved by the City Planning Director for the analysis, excavation and data recovery of the sites and preparation of a report placing the sites in historical context. Such analysis, excavation and report shall be completed by the qualified archaeologist prior to disturbance of the sites who shall comply with all legal requirements for Native American monitoring and notification if Native American remains are present. Factual Support and Rationale. Field archaeological studies, site visits and review of prior field investigations and reports identified the potential for significant archaeological artifacts as the investigations indicated the possible use of the sites as possible Native American camp or other activity sites requiring mitigation to avoid potential significant impacts. State law provides for specific procedures and coordination with the County coroner's office and Native American Heritage Commission in the event that human remains are discovered during the site investigations, which will be undertaken prior to any disturbance by a qualified archaeologist. Carlsbad's practices and procedures adhere to these State laws as well. The on-site investigation, recovery and preparation of the archaeologist's prior to any ground disturbance in the area of the sites report will fully mitigate the potential for significant impacts and any Native American remains or other sacred objects will be properly turned over to the most likely descendant, or consultation with that tribe or individual, with respect to any remains or sacred objects. As the Project area is substantially constrained by extensive designation of biological habitat and preserve areas and associated development or impact areas are thereby limited, avoidance was impractical and pre-disturbance on-site study, recovery and preparation of the accompanying report prior to disturbance is the most practical mitigation measure. 3) The addition of the following condition is at the discretion of the City Council and is provided in an effort to anticipate the possible desire to provide an expanded buffer between the western boundary of Neighborhood 3.15 and the homes on the east side of Calle Gavanzo. New condition to be placed on City Council Resolution No. 2001-318, Item 10: The following condition is to be added to P.O. Resolution No.5020, as condition 591: I. The future "Hillside Street" between Avenida Diestro and the extension of La Costa Ave. as shown on exhibit ZZZZ. and located within Planning Area 3.15 shall be considered a single loaded hillside street. The right of way width for this street shall be 47' with a single sidewalk located on the west side of the street. The reduction of street right of way shall cause the pad and the slope to be shifted to the east to allow for a greater buffer between homes fronting on Calle Gavanzo and the proposed slopes of this project. The proposed grading and pad configuration shown on the tentative map shall be revised to delineate this condition. The City Council is aware of your concerns. I wanted to take this opportunity to respond to the subjects you raised in your letter. One of the concerns you raised is in regard to the amount of development proposed. The Villages of La Costa project is proposed for an area of 1,866 acres. Preservation and enhancement of open space is an important aspect of the Villages of La Costa Master Plan. Areas proposed for an open space designation constitute approximately 892 acres or 48 percent of the Master Plan area. Development will be limited to the remaining areas. The proposed number of housing units for the property is less than the number allowed under the City's Growth Management Plan. An additional concern you raised is the issue of traffic impacting the road system particularly when the traffic generated from the San Elijo Hills project is included. Extensive traffic studies have been completed for the Villages of La Costa Project and are included in the Environmental Impact Report (EIR) for the project. The Engineering staff of the Cities of Carlsbad and San Marcos are coordinating on the construction plans for the realignment and widening of Rancho Santa Fe Road. The San Elijo Hills project has limitations placed on it by the City of San Marcos in regard to the maximum number of homes that can be built before various road improvements are required to be completed. Enclosed are several exhibits and tables from the Villages of La Costa Master Plan that will provide an overview of the proposed project. Page/Section Comment Chapter 4 - Standards and Guidelines 4.3.3 Exhibit numbers are wrong. 4.3.4 EIR calls out requirements that are more strict than the Hillside Development Regulations. Hillside Development allows exceptions, but EIR states that no slopes will be over 40 feet high. 4.3.4 Section is incomplete after Master Drainage Plan. Exhibit 4-1 What about an example of "rolling" the tops and bottoms of slopes? Exhibit 4-3..6 An easement more than "landscape buffer easement" will be required to allow construction and maintenance of the meandering public sidewalk. Exhibit 4-3..6 • Use the same symbols for pavement and base on all sections. 4.5.5 Are woodchips/shredded bark appropriate for riding bikes? 4.5.5 Typo "trial". 4.6.1.2 Change "noted below" in first paragraph to reference specific section. 4.6.1.6 Rear yard setback should reference Fire Management Zone restrictions. For lots that abut natural open space, the Fire Management Zone restrictions could potentially be more restrictive than the rear yard setback. Exhibit 5-A Neighborhood 1.12 shows as 9,000 s.f. lot size in table, 11,000 s.f. elsewhere. "Major Roadways"... shouldn't this read "Circulation Element Roadways"? 5.2.1.3 Typos "del mar", "Alga Road.." 5.2.4.1 Define "the first development phase" better... does this mean recordation of final map, pulling building permits, occupancy? 5.2.4.3 Provide letter or comments from School District verifying that school playgrounds will be available for inclusion in required open space. Quantify how much of the required or provided open space is represented by joint use playgrounds. Typo "per-dwelling-unit". [Verify that all the trail system will meet the definition of useable open space. Does this include the slopes or only the travel area of the trail?] 5.2.4.4 The language at the end of this section implies that no work will be done within the HCP hard line area. Please clarify. 5.2.5 [Staff has concern about planting street trees in the 4.5 feet between the sidewalk and the curb. 5.2.5.1 Clarify that the "may" in "such devices may be incorporated into project designs..." is at the discretion of staff and the City Council, not the developers. 5.2.5.3 Define when open cul-de-sacs are "appropriate". The lotting study shows a number of cul-de-sacs that were not designed as open. Exhibit 5-4 Verify that circulation layout in Neighborhood 1.3 is correct. Exhibit should show Poinsettia Lane extending east to the existing terminus, since construction of this link will be a requirement of the La Costa Greens project. Exhibit 5-5 [Do we really want a local trail leading right to the HMP area?] Verify SDG&E will approve locating a trail within their easement. Exhibit 5-D Fix neighborhood labels. 5.3.1 States that location and sizes of storm drain improvements will be determined as part of the master tentative map process, but master tentative map does not show sizes. Cotton 7306 Alicante Road #4 Carlsbad, CA 92009-6206 SUBJECT: PRESERVATION OF THE AREA AROUND BOX CANYON Dear Ms. Cotton: I am writing in response to your letter to the City Council concerning preservation of the land surrounding the Box Canyon area. Box Canyon and the undeveloped area surrounding it are owned by Real Estate Collateral Management Company. Morrow Development has submitted proposed applications for the overall area on behalf of the property owner which include a Master Plan. The Master Plan sequentially follows a previously approved document titled, "City of Carlsbad/Fieldstone/La Costa Associates Habitat Conservation Plan (HCP)/Ongoing Multi-Species Plan for Properties in the Southeast Quadrant of the City of Carlsbad, California." The HCP establishes areas of the property to be preserved as open space and those areas for which development can be proposed. The HCP was approved in 1995 by the U.S. Fish and Wildlife Service, the California Department of Fish and Game, and the City of Carlsbad after numerous years of work. Enclosed are some exhibits from the HCP which identify the conserved habitat parcels and the areas for development referenced on the map as "Impact Areas". The area shown on the Rancheros/Southeast II Subarea is approximately 1,278.2 acres of which 521.4 acres are conserved habitat parcels. For the area shown on the Northwest subarea there are a total of 662 acres with 181.09 acres being conserved habitat. The total area of conserved habitat is 702.49 acres. The Villages of La Costa Master Plan proposes increasing the conserved acreage to a total of 864.8 acres. Box Canyon and a considerable area around it are within the conserved habitat parcels. The proposed Morrow Development project referred to as the Villages of La Costa is not proposing to alter the conservation parcel boundaries for the box canyon area. The Villages of La Costa project is being reviewed by the City of Carlsbad and other agencies and an Environmental Impact Report (EIR) is currently being prepared to analyze the potential impacts of the project. I will add your name to our notification list for the Villages of La Costa project so that you will receive a notice in the mail of the availability of the Draft EIR as soon as it is ready for public review and comment.
