This is to advise that the City of Carlsbad has approved the above-described project on October 23, 2001, and has made the following determination regarding the above-described project. 1. The project will have a significant effect on the environment 2. An Environmental Impact report was prepared for this project pursuant to the provisions of CEQA. 3. Mitigation measures were made a condition of the approval of the project. 4. A statement of Overriding Considerations was adopted for this project. 5. Findings were made pursuant to the provisions of CEQA. ENVIRONMENTAL IMPACTS Direct, indirect and cumu- lative impacts of the pro-posed action and alterna-tives on water resources,b io log ica I resou rces, to-pography/geology, airquality, health and safety,land use, noise, transpor-tation, aesthetics, cultural resources, utilities, and the local economy were ana- lyzed in the EIS. Environ- mental [ustice implica- tions were analyzed as well. The DON determined that all potential environ- mental impacts from theproposed proiect would beless than significant, andthat there would be no dis-proportionate adverse ef-fects to minority or low-in- come populations. Consistent with these con- clusions, the CaliforniaCoastal Commission has concurred that the pro- posed project is consistent, to the maximum extentpracticable, with enforce-able policies of the Califor-nia Coastal Program. TheDON will obtain a dredg- ing and disposal permit from the Corps of Engi-neers and a Water QualityCertificate from the Re-gional Water QualityBoard. While the analysis in the EIS concluded that therewould be no significant im-pacts, the DON has agreedto implement two enhance-ment measures as part ofthe proposed action: 1) astudy of California leasttern foraging successaround manmade, in-wa-ter structures In San DiegoBay and 2) creation of twofish habitat structures at the Naval Amphibious Base Enhancement Area using concrete from exist- ing piers. Implementation of these enhancement measures is expected toadvance ongoing efforts toprotect the marine envi-ronment in San Diego Bay. RESPONSE TOCOMMENTS ON THE FEIS The DON received no com- ments on the FEIS. CONCLUSIONSAfter carefully weighing all of the information andanalysis presented duringthe EIS process, the DONdetermined that demoli-tion of Piers 10 and II andconstruction of a single-deck, pile-supported re-placement pier (Alterna-tive 1) best minimizes en-vironmental impacts while meeting operational re- quirements of modern ships homeported in the San Diego region In a cost-effective manner.
