Pleasanton, CA 94588 FINAL DECISION LETTER OF TENTATIVE PARCEL MAP REVISION Project ID: MS 04-08(A) Project Name: LA COSTA TOWN SQUARE APN: 223-060-31, 32: 223-050-68. 70 The city engineer has completed a review of the application for a revised tentative parcel map, MS 04- 08(A), generally located at Rancho Santa Fe Road and La Costa Avenue. The city engineer has made a determination pursuant to the Carlsbad Municipal Code 20.24.080 to approve the tentative parcel map revision based on the findings and subject to the revised conditions listed below. Whereas: a. A request was submitted to revise the conditions of approval reflected in the Final Approval of Tentative Parcel Map for MS 04-08 dated June 3, 2010; and b. Condition 10 of the June 3, 2010 approval requires the recording of a prepayment agreement and payment of a fee for the construction of Rancho Santa Fe Road, to the satisfaction of the City Attorney and City Engineer, and c. Similar conditions requiring a prepayment agreement for Rancho Santa Fe Road are contained in the resolutions of approval for the La Costa Town Square development (CT 01-09, condition 27 of PC Reso 6581; CT 08-03, condition 30 of PC Reso 6582; CT 08-07, condition 29 of PC Reso 6583), and d. Resolution 93-262 approved by City Council on September 14,1993, establishing the form ofthe prepayment agreement, sets the EDU allocation for determination ofthe fee, and notes that the number of each type of unit, and the allocation for non-residential units, shall be made by the City Engineer, and e. Said Resolution notes that "The City Engineer is not required to make a determination on the number of EDUs for any project until adequate information is available", and f. Condition 1 of the June 3, 2010 approval clearly states that "No development is proposed or approved based upon this subdivision". Therefore the city engineer has determined: a. The appropriate EDU allocation for the prepayment agreement cannot be determined because no development is proposed by the minor subdivision, and c. The discretionary approvals that will allow the EDU allocation to be determined are conditioned to require the prepayment agreement, rendering the prepayment agreement condition on MS 04-08 redundant, so d. The subject tentative parcel map revision has been approved per the findings and conditions set forth in said Preliminary Decision letter subject to the following: Condition #10 is deleted: 10. Prior to approval of the parcel mapi Dovolopor shall cause Property Owner to exocuto and submit to the City for recordation a Prepayment Agreement with tho City for prepayment of the obligation for funding to improve Rancho Santa Fe Road> which will satisfy the special condition in tho Zono 11 LFMP requiring a financing plan guaranteeing construction of Rancho Santa Fe Road. The Prepayment Agreement shall bo in a form to the satisfaction of the City Attorney and City Engineer.
