MS 04-11 ROMERIA CONDOMINIUM DENIAL WITHOUT PREJUDICE Whereas no review of the letter of preliminary denial was requested by the appropriate date; whereas, the city engineer finds that the tentative parcel map dpes not meet the requirements of Title 21 as required per Section 20.24.130(4) of the Carlsbad Municipal Code; whereas, the City Council, on February 13, 2007, adopted Resolution Number 2006-369, denying an appeal and upholding a planning commission decision to deny project related Condominium Permit 06-01 based on the finding that said condominium permit does not comply with all applicable development standards included within Title 21.45, as described therein; and whereas, a final decision has been made to deny without prejudice the subject tentative parcel map subject to the findings set forth herein and in the preliminary denial letter. The project involved is described as subdividing a four unit apartment complex into a four unit condominium project. APPLICANT: GINODIFANTE STATEMENT OF THE MATTER: Per City of Carlsbad Code Section 20.24.140(b) and the California Subdivision Map Act Section 66452.5(d) any interested person adversely affected by this decision of the City Engineer may appeal it to the City Council. An appeal to the City Council must be filed at the City Clerks Office and the appeal fee amount listed in the most recent edition of the Carlsbad "Community Development Fees" schedule must be paid. The appeal must be filed with the City Clerk in writing within 10 days of the date of the final approval letter (Attached). Box 2442 Capistrano Beach, CA 92624 RE : MS 04-11 ROMERIA CONDOMEVUMS Dear Mr. DiFante: On February 16, 2007, a preliminary denial letter of the above minor subdivision was sent to you from David Hauser, Deputy City Engineer. You were given an opportunity to review this preliminary decision with the City Engineer provided that you made said request in writting within 10 days of the date of the preliminary denial letter. On February 26, 2007, the City received a letter dated February 23, 2007 requesting such a meeting. I contacted you by phone on Thursday, March 8, 2007 to establish a time to meet. You indicated that you needed to talk to your project planner before we would meet and that you would call back Monday March 12th or Tuesday March 13th of next week to establish a meeting time. As of to date, neither I nor the project planner has received verbal or written correspondance from you to establish a meeting time. To facilitate final processing of this application, I am offering the following three meeting times in which all pertinent parties from the City will be available: Tuesday, April 24, 2007, 10 :00 AM at 1635 Faraday Avenue, Carlsbad. Thursday, April 26, 2007, 2 :30 PM at 1635 Faraday Avenue, Carlsbad. Monday, April 30, 2007,4 :00 PM at 1635 Faraday Avenue, Carlsbad. Please contact me to confirm a time to meet. Because the City must take action on this Minor Subdivision and we have provided adequate opportunity to meet per your request, we are hereby giving notice that the City intends to make a final decision on MS 04-11 by May 2, 2007 regardless of whether you chose to meet or not. MS 04-11 ROMERIA CONDOMINIUM - PRELIMINARY DENIAL A preliminary decision has been made pursuant to Section 20.24.130(4) of the City of Carlsbad Municipal Code, to deny the application for the tentative map of the proposed minor subdivision for the following reasons: The city engineer finds that the tentative parcel map does not meet the requirements of Title 21 as required per Section 20.24.130(4) of the Carlsbad Municipal Code, as the City Council, on February 13, 2007, adopted Resolution Number 2006-369, denying an appeal and upholding a planning commission decision to deny project related Condominium Permit 06-01 based on the finding that said condominium permit does not comply with all applicable development standards included within Title 21.45, as described therein. The applicant may request a review of the preliminary decision with the City Engineer in writing within ten (10) days of the date of this letter. Upon such written request the City Engineer shall arrange a time and place with the applicant for such review. DAVID A.
