STATENEirT OF AGREEMENT TENTATIVE PARCEL MAP CITY OF CARLSBAD The Subdivision Map Act and the Carlsbad Municipal Code sets a fifty (50) day time restriction on Engineering Department processing. This time limit can only be extended by the mutual concurrence of the Applicant and the City. By accepting applications for Tentative Parcel Maps concurrently with applications for Other approvals which are prerequisites to the Map (i.e., Environmental Assessment, Environmental Impact Report, Condominium Plan, Planned Unit Development, etc.), the fifty (50) day time limits are often exceeded. If you wish to have your application processed concurrently, this agreement must be signed by the Applicant or his agent. If you choose not to sign the statement, the City will not accept your application of the Tentative Parcel Map until all prior necessary entitlements have been processed and approved. The Subdivider shall sign a written statement to the effect that he has read Section 66427.1 of the Subdivision Map Act and that he shall make the required notifications to the tenants (statement attached). 2. The Subdivider shall provide separate sewer, water, gas and electric services with meters to each of the units. 3. All required fees and deposits shall be paid prior to final parcel map recordation. Store 2201 Valley Road Oceanside, CA 92054 WAIVER OF PARCEL MAP LUCIERNAGA CONDOMINIUM CONVERSION - CE 546, MS 809, CP 89-09 In response to your letter of January 5, 1990, I would like to apologize for the inconvenience incurred by the condominium conversion process. As you may or may not know, the conversion of an existing duplex into a condominium is considered a subdivision of property and is govemed by a body of State law known as the Subdivision Map Act. The State legislature requires that each City adhere to the same basic requirements regarding the subdivision and development of property. Your applications for two-unit condominium conversion (CP 89-09) and tentative parcel map (MS 809) have been approved previously by the City subject to several conditions as shown on the attached letters to you on August 14, 1989 and August 24, 1989. These same conditions apply to your project whether you choose to continue with the final parcel map process or waiver of parcel map process. The following conditions from MS 809 and CP 89-09 are still outstanding and must be completed before a certificate of compliance on your waiver of parcel map application can be issued by the City Engineer: 1. MS 809 Condition No. 7 - Prior to approval of the final map the developer shall enter into an agreement with the City to pay any drainage area fees established as a result of the forthcoming Master Drainage Plan Update (see attached agreement). 2. CP 89-09 Condition No. 6 - The applicant shall establish a homeowner's association and corresponding covenants, conditions and restrictions. Said CC&R shall be submitted to and approved by the Planning Director prior to final map approval (incorporate Condition No. 8 on CC&R). The City has adopted procedures which allow for the most rapid development of condo conversions permitted under State laws, the same laws govem our ability to impose fees for storm drainage purposes. Our City Council adopted ordinances which established drainage area fees and required that these fees be paid upon the subdivision of any property within the established drainage fee areas. Presently no drainage areas or fees have been established within the La Costa Area. This is because until very recently the La Costa Area was under the jurisdiction of the County Flood Control District. Several years ago this was passed over into City jurisdiction. In 1987 the City prepared and City Council adopted a Local Facilities Management Plan for Zone 6 pursuant to the requirements of the citizen approved Growth Management Program (Proposition "E"). The Zone 6 plan which includes your property requires that "prior to approval of further final maps within Zone 6, the developer shall pay or enter into an agreement with the City to pay for a proportional share of any drainage area fee established as a result of the forthcoming Master Drainage Plan Update." Attached are the following for your review: 1. Original of the Agreement to Pay Drainage Fees as Required by the Growth Management Program and the Adopted Local Facilities Management Plan for Zone 6. 2. First check comments on the legal description, plat, and letter requesting waiver of the parcel map. Please complete all the outstanding conditions listed earlier, execute the attached drainage agreement and have your surveyor correct the legal description and plat package. Please return the complete package to me including all check prints in order that we can continue with the issuance of the certificate of compliance. Christopher W. Enclosed you will find all of these items and the reasons for this request are as follows: 1. This minor subdivision is a condominium conversion that already exists and was built approximately 8 years ago, and as such, it already has paid for all fees for parks, schools, drainage, water and any other items that can be thought of that would impact a community. 2. Since it has it's own separate sewer lines, sidewalks, drainage, flood control, improved public roads, along with sanitary disposal facilities in addition to adequate water supplies that were all approved at the time it was built, it is inconceivable that by approving this subdivision, that there would be any additional burden placed upon the community as both of these units have been lived in, legally and without any problems for years. in summary, I would like to make a desperate plea. I have been processing this map for over 12 months and I appeal to your logic if not your compassion. Please take this waiver into consideration and let me get on with my life. You are correct in noting that a few developments were approved without adhering to this requirement. These were allowed due to a staff error in processing, which has since been corrected. With regard to the specifics of the agreement, the City is willing to consider recommendations for revision. The agreement which was provided to you was approved by our City Attomey. If you have problems with specific provisions of the agreement, we may be able to work out language acceptable to you and to our City Attomey. Such revisions are normally quite time-consuming, given our existing staff workload. You may wish to defer decision on this issue pending the release of the Master Drainage Plan update in the next few months. We anticipate bringing the Master Drainage Plan update including recommendations for the proposed Zone 6 drainage area fees for City Council approval within the next four to five months. We should have an estimate of the proposed drainage fee if any by March of 1990. We will make this information available to you as quickly as possible. Once again, we apologize for any inconvenience you may have suffered. The City endeavors to provide quality service to its citizens and developers alike. Store 2201 Valley Road Oceanside, CA 92056 SUBJECT: CP 89-09 The City has completed a review of the application for a two-unit condominium development located at 2711 and 2713 Luciernaga Street, Carlsbad, California. It is the Planning Director's Determination that based on the attached conditions, the project is consistent with the City's condominium regulations (Chapter 21.45) and with all other applicable City ordinances and policies. Further, the project has been found to be categorically exempt from environmental review according to Section 15303(3)(b) of the California Environmental Quality Act and a Notice of Exemption was filed on July 24, 1989. This letter, including the listed findings and conditions, constitutes approval of CP 89-09. Fi ndi ngs: 1. The project is consistent with the City's General Plan Land Use Element, and with all other elements of the City's General Plan. 2. Adequate public facilities necessary to serve this project will be provided as required by the City Engineer in conjunction with the approval of the parcel map required for this project. 3. The project is consistent with the design criteria and development standards of Chapter 21.45 (Planned Development Ordinance) of the City's Zoning Code, Conditions: 1. Approval is granted for CP 89-09 as shown on Exhibits "A"-"B", dated August 14, 1989, on file in the Planning Department and incorporated herein by reference. 2. The applicant shal1 establish a homeowner's association and corresponding covenants, conditions and restrictions. Said CC&R's shall be submitted to and approved by the Planning Director prior to final map approval. 7.
