MINOR SUBDIVISION 811
I was cleaning off my desk today and came across a note that I was supposed to verify some
information with you, specifically, what would be required prior to building penmit Issuance on
Minor Subdivision 811. I can't recall whether I did verify this information with you, so I am
sending you this letter. I hope I have not caused any disruption in your plans or alterations
from information I had given you.
The following is based on the August 22, 1990 letter to Bob Ladwig that, I believe, you refenred
to in our telephone conversation. A copy of that letter is attached. I have researched item
number 1 on that letter and found that the installation of the 28 feet of pavement was deleted
when the approval of the grading plan and Drawing No. 314-1 was approved. Therefore, the
same conditions would apply to your minor subdivision in that the 28 feet of pavement on
Adams would not be required prior to issuance.
Item No. 2, grading to provide the additional 8 feet of shoulder for vehicle pari<ing, on the
property frontage would be required. This would also include grading the driveway to assure
that no major grade breaks would be needed for the future, ultimate improvements to the
street.
In regards to the sewer needs of property to the north of MS 811, a sewer analysis must be
done to determine if that property to the north could gravity flow to Adams prior to building
permit issuance on MS 811. If not, then an Offer of Dedication for a sewer easement
extending across MS 811 would be necessary. This easement can be private.
I hope this confirms the information that we were discussing and, again, I apologize for the

In response to your letter dated August 8, 1990 we agree with your basic understanding
regarding the City's improvement and easement requirements with minor changes. Prior
to building permit issuance the City is requiring the following: ' '
1. Provision for the installation of 28 feet of pavement on Adams Street from
Chestnut Avenue to the north property line of the unit requesting building
permit issuance. Ultimately this shall include all three subdivision property
frontages.
2. Grading to provide for an additional eight foot shoulder for vehicle parking
immediately adjacent to the property frontage.
3. Grading at the driveway to assure that no major grade transitions are needed
in the future to connect the driveway to the ultimate improvements.
4. The back parcels for the two southerly subdivisions MS 819 and MS 841 shall
offer to dedicate the westem most 15 feet of their property as a public sewer
easement. The City will not accept the offer at this time. The proposed sewer
line shall be to a minimum 6 inch pipe size and shall be designed to ultimately
connect to the sewer line in Chestnut Avenue. If the offer to dedicate is made
on the parcel map no separate dedication fee will be required.
5. The northem most subdivision MS 811 will be required to analyze the sewer
needs of the property to the north. If this north property cannot be served by
a gravity sewerline in Adams Street, the offer to dedicate a sewer easement
shall be extended across the MS 811 property as well.

6. Drainage shall be handled individually by each of the properties requesting
building permits.
None of these required improvements shall relieve the owners from the obligation to
constmct the street improvements to Adams Street under the respective Future
Improvement Agreement.

The Subdivision Map Act and the Carlsbad Municipal Code sets a
fifty (50) day time restriction on Planning Coinmission processing
of Tentative Maps and a thirty (30) day time limit for City
Council action. These time limits can only be extended by the
mutual concurrence of the applicant and the City. By accepting
applications for Tentative Maps concurrently with applications
for other approvals which are prerequisites to the map; i.e..
Environmental Assessment, Environmental Impact Report, Condominium
Plan, Planned Unit Development, etc., the fifty (50) day time
limits and the thirty (30) day time limits are often exceeded.
If you wish to have your application processed concurrently,
this agreement must be signed by the applicant or his agent. If
you choose not to sign the statement, the City will not accept
your application for the Tentative Map until all prior necessary
entitlements have been processed and approved.
The undersigned understands that the processing time required by
the City may exceed the time limits, therefore the undersigned
agrees to extend the time limits for Planning Commission and
City Council action and fully concurs with any extensions of
time up to one year from the date the application was accepted
as complete to properly review all. of the applications.

NOTICE OF APPROVAL OF TENTATIVE PARCEL MAP
MINOR SUBDIVISION NO. 811
Notice is hereby given that a Tentative Parcel Map has been approved on property
generally located on the west side of Adams Street between Basswood and Chestnut and
more particularly described as 3401 Adams Street.
The project involved is described as subdividing one 24800 S.F. single family residential
lot into two residential lots.

STATEMENT OF THE MATTER: Per City of Carisbad Code Section 20.24.140(b) and the
Califomia Subdivision Map Act Section 6645.5(d) any interested person adversely affected
by this decision of the City Engineer may appeal it to the City Council. An appeal to the
City Council must be filed at the City Clerks Office and an appeal fee of $275.00 paid.
The appeal must be filed with the City Clerk in writing within 10 days of the date of the
final approval letter (Attached). If you wish to file an appeal please contact the City
Clerks office in person.

Whereas no review of the conditions of the letter of preliminary approval was requested
by the appropriate date; and whereas the requirements of the Califomia Environmental
Quality Act and the City of Carlsbad Environmental Protection Ordinance of 1973 relating
to the subject proposed parcel map have been examined by the Planning Director and
declared to have a non-significant impact upon the environment; and whereas negative
findings delineated by Section 20.24.130 of the Carlsbad Municipal Code have not been
made; and whereas this minor subdivision is found to be in conformity with the General
Plan of the City of Carlsbad; therefore, a final decision has been made to approve the
subject tentative parcel map subject to the conditions set forth in the preliminary
approval letter.

PROPOSED MINOR SUBDIVISION NO. 811
A preliminary decision has been made, pursuant to Section 20.24.120 of the City of
Carlsbad Municipal Code, to approve the tentative map of the proposed minor subdivision
subject to the following conditions:
1. Final parcel map shall comply with the Land Use Planning Office interdepartmental
memorandum for Minor Subdivision No. 811, dated August 2, 1989 (copy
included).
2. The Subdivider shall provide separate sewer, water, gas and electric services with
meters to each of the units.
3. All required fees and deposits shall be paid prior to final parcel map recordation.
(See attached list.)
4. The tentative parcel map approval shall expire two (2) years from the date of the
letter containing the final decision for tentative map approval.
5. The applicant may request a review of the conditions in writing within ten (10)
days of the date of this approval.
6. All lots within this project shall conform to current Zoning Ordinance (Title 21)
with respect to size, setbacks, and land use.
7. The applicant shall pay park-in-lieu fees to the City prior to the approval of the
final map as required by Chapter 20.44 of the Carlsbad Municipal Code.
8. Prior to approval of the final map the developer shall enter into an agreement
with the City to pay any drainage area fees established as a result of the
forthcoming Master Drainage Plan Update.

9. The subdvider shall be responsible for paying recording fees for all agreements,
easements and documents required for this project.
10. The developer shall enter into lien contract for the futiire improveinent of a half
""^hw^ street width of 30 feet along the subdivision/project frontage prior to approval of
(-^ the parcel map.
11. The owner of the subject property shall execute a Hold Harmless Agreement
^^^^^.^0^ regarding the panhandle lot prior to approval of the parcel mapl
12. The developer shall enter into an agreement to pay fees for imdergroimding of all
existing overhead utility lines along the boundary of the subdivision prior to final
map approval.
13. Additional drainage easements and drainage stmctures shall be provided or
installed as may be required by the City Engineer.
The owner of the subject property shall execute a hoM..h5UTl4|!S5,,£5gjeement
regarding drainage across the adjacent property prior to approval of the the HhaT
iriap for this project.
15. Unless a standard variance has been issued, no variance from City Standards is
authorized by virtue of approval of this tentative parcel map.
16. The developer shall comply with all the rules, regulations and design requirements
of the respective sewer and water agencies regarding services to the project.
17. The developer shall be responsible for coordination with S.D.G.&E., Pacific
Telephone, and Cable TV authorities.
18. This project is also approved under the express condition that the applicant pay
the additional public facilities fee adopted by the City Council on Apnl 22, 1986,
and any development fees established by the City Council pursuant to Ordinance
No. 9791 or subsequent ordinance adopted to implement a growth or development
management system or public facilities phasing plan to fulfill the subdivider's
agreement to pay the public facilities fee dated June 14, 1989, a copy of which
is on file with the City Clerk and is incorporated by this reference. If the fees are
not paid, this application will not be consistent with the General Plan and
approval for this project shall be void.
19. A note will be placed on the Jinal map requiring a hydrology study prior to the
issuance of building permits. " The hydrology study will include a method to
provide for drainage from Parcel 2 to offsite. It will also include calculations
showing the developed flows crossing property lines from Parcel 2 are less than
or equal to undeveloped flows as a result of the proposed drainage system.

20. The drainage system shall be designed to ensure that runoff resulting from a 10-
year frequency storm of a 6 hours or 24 hours duration under developed condi-
tions, is equal to or less than the mnoff from a storm of the same frequency and
duration under existing developed conditions. Both 6 hour and 24 hour storm
durations shall be analyzed to determine the detention basin capacities necessary
to accomplish the desired results.
21. This project is approved upon the express condition that building permits will not
be issued for development of the subject property unless the City Engineer /
l^^^j«N,j^determines that sewer facilities are available at the time of application for such ^
^^g»J^r*l^.^^t^/*-^g^gj. permits and will continue to be available until time of occupancy. This note
shall be placed on the final map. *"
22. Prior to parcel map recordation, the subdivider shall grant a covenant for easement
for a 5 foot wide private draiange easement as shovm on the tentative parcel map.
This shall allow for the drainage from Parcel 1 to flow onto Parcel 2. The
covenant for easement shall be shown and the recording information called out on
the~parcel map.

The Planning Director has completed a review of the application for a two lot
Minor Subdivision, creating one panhandle lot located along the west side of
Adams Avenue at APN: 205-112-14. lot 2 of the Optimo Tract, according to Map
No. 1805, in the R-1-7,500 Zone. After careful consideration of the
circumstances surrounding this request, the Planning Director has determined that
the two findings required for approving a lot split creating one or more
panhandle lots, can be made and therefore, recommend approval of this request
based on the following findings and conditions:
Findings:
1. The subdivision of this property at the density proposed exceeds the
density permitted by City Council Resolution No. 8703 and Proposition E
which set a limit on the number of residential dwelling units allowed in
the northwest quadrant.
2. The density of the project (3.57 du.acre) complies with the dwelling unit
projections of Zone 1 which demonstrated that sufficient developments in
Zone 1 have been approved below the density control points which are
necessary to ensure compliance with the dwelling unit limitation of City
Council Resolution No. 8703 and Proposition E.
3. Sufficient public facilities to serve the density of the project are being
provided so that the City's public facilities plans will not be adversely
impacted.
4. The properties cannot be adequately served with a public street without
panhandle lots due to unfavorable conditions resulting from the location
of existing structures in the vicinity.
5. Subdivision panhandle lots will not preclude or adversely affect the
ability to provide full public street access to other properties within
the same block.
6. The proposed subdivision is consistent with all elements of the City's
General Plan, including the land use element which designates this site
for R-1-7500.
7. The proposed project will not result in adverse environmental impacts and,
it has been found to be categorically exempt under CEQA, Section: Class
No. 15315, Minor Land Divisions.
8. The project is consistent with all City Public Facility Policies and
Ordinances^ and with Title 21 of the City's Municipal Code.
Conditions:
1. The panhandle lots shall each have three non-tandem parking spaces with
an approach not less than 24 feet in length with a proper turnaround area
to permit complete turnaround for forward access to the street. Said
parking and turnaround shall be subject to the approval of the City
Engineer.
2. An improved driveway shall be provided within the access portion of the
lot from the street or public easement to the parking area on the buildable
lot at least fourteen feet wide for single lots and twenty feet wide when
serving more than one lot. The minimum clearance shall be ten feet. The
driveway shall be constructed to accommodate public service vehicles with
a minimum of two-inch think asphalt concrete paving on proper base with
rolled edges.
3. Structures permitted in the access portion of the lots shall be limited
to mailboxes, fences, trash enclosures, landscape containers and name
plates. Except for mail boxes, the structures shall not be greater than
forty-two inches in height located within twenty feet of the street
property line or greater than six feet in height beyond this point.
4. Prior to final map approval, the property owners shall enter into an
agreement subject to the approval of the Planning Director and City
Attorney's approval to hold the City or any other public service agency
harmless from liability for any damage to the driveway when being used to
perform a public service.
5. The lots shall have a minimum depth of 90 feet.
6. The buildable portions of the panhandle lots shall be all portions of the
lots that have a width of greater than 35 feet.
The front yard of Parcel 2 is defined as the lot line that separates both
parcels and runs parallel to Adams Avenue (the rear lot line of Parcel 1).

The Planning Director has completed a review of the application for a two lot
Minor Subdivision, creating one panhandle lot located along the west side of
Adams Avenue at APN: 205-112-14, lot 2 of the Optimo Tract, according to Map
No. 1805, in the R-1-7,500 Zone, After careful consideration of the
circumstances surrounding this request, the Planning Director has determined that
the two findings required for approving a lot split creating one or more
panhandle lots, can be made and therefore, recommend approval of this request
based on the following findings and conditions:
Findings:
1. The subdivision of this property at the density proposed exceeds the
density permitted by City Council Resolution No. 8703 and Proposition E
which set a limit on the number of residential dwelling units allowed in
the northwest quadrant,
2. The density of the project (3,57 du,acre) complies with the dwelling unit
projections of Zone 1 which demonstrated that sufficient developments in
Zone 1 have been approved below the density control points which are
necessary to ensure compliance with the dwelling unit limitation of City
Council Resolution No. 8703 and Proposition E.
3. Sufficient public facilities to serve the density of the project are being
provided so that the City's public facilities plans will not be adversely
impacted,
4. The properties cannot be adequately served with a public street without
panhandle lots due to unfavorable conditions resulting from the location
of existing structures in the vicinity.
5. Subdivision panhandle lots will not preclude or adversely affect the
ability to provide full public street access to other properties within
the same block.
6. The proposed subdivision is consistent with all elements of the City's
General Plan, including the land use element which designates this site
for R-1-7500.
7. The proposed project will not result in adverse environmental impacts and,
it has been found to be categorically exempt under CEQA, Section: Class
No. 15315, Minor Land Divisions.
8. The project is consistent with all City Public Facility Policies and
Ordinances, and with Title 21 of the City's Municipal Code.
Conditions:
1. The panhandle lots shall each have three non-tandem parking spaces with
an approach not less than 24 feet in length with a proper turnaround area
to permit complete turnaround for forward access to the street. Said
parking and turnaround shall be subject to the approval of the City
Engineer.
2. An improved driveway shall be provided within the access portion of the
lot from the street or public easement to the parking area on the buildable
lot at least fourteen feet wide for single lots and twenty feet wide when
serving more than one lot. The minimum clearance shall be ten feet. The
driveway shall be constructed to accommodate public service vehicles with
a minimum of two-inch think asphalt concrete paving on proper base with
rolled edges,
3. Structures permitted in the access portion of the lots shall be limited
to mailboxes, fences, trash enclosures, landscape containers and name
plates. Except for mail boxes, the structures shall not be greater than
forty-two inches in height located within twenty feet of the street
property line or greater than six feet in height beyond this point.
4. Prior to final map approval, the property owners shall enter into an
agreement subject to the approval of the Planning Director and City
Attorney's approval to hold the City or any other public service agency
harmless from liability for any damage to the driveway when being used to
perform a public service.
5. The lots shall have a minimum depth of 90 feet.
6. The buildable portions of the panhandle lots shall be all portions of the
lots that have a width of greater than 35 feet.
The front yard of Parcel 2 is defined as the lot line that separates both
parcels and runs parallel to Adams Avenue (the rear lot line of Parcel 1),

In response to your letter dated August 8, 1990 we agree with your basic understanding
regarding the City's improvement and easement requirements with minor changes. Prior
to building permit issuance the City is requiring the following: ' *
1. Provision for the installation of 28 feet of pavement on Adams Street from
Chestnut Avenue to the north property line of the unit requesting building
pennit issuance. Ultimately this shall include all three subdivision property
frontages.
2. Grading to provide for an additional eight foot shoulder for vehicle parking
immediately adjacent to the property frontage.
3. Grading at the driveway to assure that no major grade transitions are needed
in the future to cormect the driveway to the ultimate improvements,
4. The back parcels for the two southerly subdivisions MS 819 and MS 841 shall
offer to dedicate the westem most 15 feet of their property as a public sewer
easement. The City will not accept the offer at this time. The proposed sewer
line shall be to a minimum 6 inch pipe size and shall be designed to ultimately
connect to the sewer line in Chestnut Avenue. If the offer to dedicate is made
on the parcel map no separate dedication fee will be required.
5. The northem most subdivision MS 811 will be required to analyze the sewer
needs of the property to the north. If this north property cannot be served by
a gravity sewerline in Adams Street, the offer to dedicate a sewer easement
shall be extended across the MS 811 property as well.
