I can't recall whether I did verify this information with you, so I am sending you this letter. I hope I have not caused any disruption in your plans or alterations from information I had given you. The following is based on the August 22, 1990 letter to Bob Ladwig that, I believe, you refenred to in our telephone conversation. A copy of that letter is attached. I have researched item number 1 on that letter and found that the installation of the 28 feet of pavement was deleted when the approval of the grading plan and Drawing No. 314-1 was approved. Therefore, the same conditions would apply to your minor subdivision in that the 28 feet of pavement on Adams would not be required prior to issuance. Item No. 2, grading to provide the additional 8 feet of shoulder for vehicle pari<ing, on the property frontage would be required. This would also include grading the driveway to assure that no major grade breaks would be needed for the future, ultimate improvements to the street. In regards to the sewer needs of property to the north of MS 811, a sewer analysis must be done to determine if that property to the north could gravity flow to Adams prior to building permit issuance on MS 811. If not, then an Offer of Dedication for a sewer easement extending across MS 811 would be necessary. This easement can be private. I hope this confirms the information that we were discussing and, again, I apologize for the delay in my response. If you do have questions, please call me at 438-1161, extension 4333. Prior to building permit issuance the City is requiring the following: ' ' 1. Provision for the installation of 28 feet of pavement on Adams Street from Chestnut Avenue to the north property line of the unit requesting building permit issuance. Ultimately this shall include all three subdivision property frontages. 2. Grading to provide for an additional eight foot shoulder for vehicle parking immediately adjacent to the property frontage. 3. Grading at the driveway to assure that no major grade transitions are needed in the future to connect the driveway to the ultimate improvements. 4. The back parcels for the two southerly subdivisions MS 819 and MS 841 shall offer to dedicate the westem most 15 feet of their property as a public sewer easement. The City will not accept the offer at this time. The proposed sewer line shall be to a minimum 6 inch pipe size and shall be designed to ultimately connect to the sewer line in Chestnut Avenue. If the offer to dedicate is made on the parcel map no separate dedication fee will be required. 5. The northem most subdivision MS 811 will be required to analyze the sewer needs of the property to the north. If this north property cannot be served by a gravity sewerline in Adams Street, the offer to dedicate a sewer easement shall be extended across the MS 811 property as well. 2075 Las Palmas Drive - Carlsbad. Drainage shall be handled individually by each of the properties requesting building permits. These time limits can only be extended by the mutual concurrence of the applicant and the City. By accepting applications for Tentative Maps concurrently with applications for other approvals which are prerequisites to the map; i.e.. Environmental Assessment, Environmental Impact Report, Condominium Plan, Planned Unit Development, etc., the fifty (50) day time limits and the thirty (30) day time limits are often exceeded. If you wish to have your application processed concurrently, this agreement must be signed by the applicant or his agent. If you choose not to sign the statement, the City will not accept your application for the Tentative Map until all prior necessary entitlements have been processed and approved. Final parcel map shall comply with the Land Use Planning Office interdepartmental memorandum for Minor Subdivision No. 811, dated August 2, 1989 (copy included). 2. The Subdivider shall provide separate sewer, water, gas and electric services with meters to each of the units. 3. All required fees and deposits shall be paid prior to final parcel map recordation. (See attached list.) 4. The tentative parcel map approval shall expire two (2) years from the date of the letter containing the final decision for tentative map approval. 5. The applicant may request a review of the conditions in writing within ten (10) days of the date of this approval. 6. All lots within this project shall conform to current Zoning Ordinance (Title 21) with respect to size, setbacks, and land use. 7. The developer shall be responsible for coordination with S.D.G.&E., Pacific Telephone, and Cable TV authorities. 18. " The hydrology study will include a method to provide for drainage from Parcel 2 to offsite. It will also include calculations showing the developed flows crossing property lines from Parcel 2 are less than or equal to undeveloped flows as a result of the proposed drainage system. The drainage system shall be designed to ensure that runoff resulting from a 10- year frequency storm of a 6 hours or 24 hours duration under developed condi- tions, is equal to or less than the mnoff from a storm of the same frequency and duration under existing developed conditions. Both 6 hour and 24 hour storm durations shall be analyzed to determine the detention basin capacities necessary to accomplish the desired results. 21. After careful consideration of the circumstances surrounding this request, the Planning Director has determined that the two findings required for approving a lot split creating one or more panhandle lots, can be made and therefore, recommend approval of this request based on the following findings and conditions: Findings: 1. The subdivision of this property at the density proposed exceeds the density permitted by City Council Resolution No. 8703 and Proposition E which set a limit on the number of residential dwelling units allowed in the northwest quadrant. 2. The density of the project (3.57 du.acre) complies with the dwelling unit projections of Zone 1 which demonstrated that sufficient developments in Zone 1 have been approved below the density control points which are necessary to ensure compliance with the dwelling unit limitation of City Council Resolution No. 8703 and Proposition E. 3. Sufficient public facilities to serve the density of the project are being provided so that the City's public facilities plans will not be adversely impacted. 4. The properties cannot be adequately served with a public street without panhandle lots due to unfavorable conditions resulting from the location of existing structures in the vicinity. 5. Subdivision panhandle lots will not preclude or adversely affect the ability to provide full public street access to other properties within the same block. 6. The proposed subdivision is consistent with all elements of the City's General Plan, including the land use element which designates this site for R-1-7500. 7. The proposed project will not result in adverse environmental impacts and, it has been found to be categorically exempt under CEQA, Section: Class No. 15315, Minor Land Divisions. 8. The project is consistent with all City Public Facility Policies and Ordinances^ and with Title 21 of the City's Municipal Code. Conditions: 1. The panhandle lots shall each have three non-tandem parking spaces with an approach not less than 24 feet in length with a proper turnaround area to permit complete turnaround for forward access to the street. Said parking and turnaround shall be subject to the approval of the City Engineer. 2. An improved driveway shall be provided within the access portion of the lot from the street or public easement to the parking area on the buildable lot at least fourteen feet wide for single lots and twenty feet wide when serving more than one lot. The minimum clearance shall be ten feet. The driveway shall be constructed to accommodate public service vehicles with a minimum of two-inch think asphalt concrete paving on proper base with rolled edges. 3. Structures permitted in the access portion of the lots shall be limited to mailboxes, fences, trash enclosures, landscape containers and name plates. Except for mail boxes, the structures shall not be greater than forty-two inches in height located within twenty feet of the street property line or greater than six feet in height beyond this point. 4. Prior to final map approval, the property owners shall enter into an agreement subject to the approval of the Planning Director and City Attorney's approval to hold the City or any other public service agency harmless from liability for any damage to the driveway when being used to perform a public service. 5. The lots shall have a minimum depth of 90 feet. 6. The buildable portions of the panhandle lots shall be all portions of the lots that have a width of greater than 35 feet. The subdivision of this property at the density proposed exceeds the density permitted by City Council Resolution No. 8703 and Proposition E which set a limit on the number of residential dwelling units allowed in the northwest quadrant, 2. The density of the project (3,57 du,acre) complies with the dwelling unit projections of Zone 1 which demonstrated that sufficient developments in Zone 1 have been approved below the density control points which are necessary to ensure compliance with the dwelling unit limitation of City Council Resolution No. 8703 and Proposition E. 3. Sufficient public facilities to serve the density of the project are being provided so that the City's public facilities plans will not be adversely impacted, 4. The properties cannot be adequately served with a public street without panhandle lots due to unfavorable conditions resulting from the location of existing structures in the vicinity. 5. Subdivision panhandle lots will not preclude or adversely affect the ability to provide full public street access to other properties within the same block. 6. The proposed subdivision is consistent with all elements of the City's General Plan, including the land use element which designates this site for R-1-7500. 7. The proposed project will not result in adverse environmental impacts and, it has been found to be categorically exempt under CEQA, Section: Class No. 15315, Minor Land Divisions. 8. The project is consistent with all City Public Facility Policies and Ordinances, and with Title 21 of the City's Municipal Code. Conditions: 1. The panhandle lots shall each have three non-tandem parking spaces with an approach not less than 24 feet in length with a proper turnaround area to permit complete turnaround for forward access to the street. Said parking and turnaround shall be subject to the approval of the City Engineer. 2. An improved driveway shall be provided within the access portion of the lot from the street or public easement to the parking area on the buildable lot at least fourteen feet wide for single lots and twenty feet wide when serving more than one lot. The minimum clearance shall be ten feet. The driveway shall be constructed to accommodate public service vehicles with a minimum of two-inch think asphalt concrete paving on proper base with rolled edges, 3. Structures permitted in the access portion of the lots shall be limited to mailboxes, fences, trash enclosures, landscape containers and name plates. Except for mail boxes, the structures shall not be greater than forty-two inches in height located within twenty feet of the street property line or greater than six feet in height beyond this point. 4. Prior to final map approval, the property owners shall enter into an agreement subject to the approval of the Planning Director and City Attorney's approval to hold the City or any other public service agency harmless from liability for any damage to the driveway when being used to perform a public service. 5.
