STORMWATER QTAMDAPHQ Development Services ' ^ ' AIM U AKUb Land Development Engineering QUESTIONNAIRE 1635 Faraday Avenue 760-602-2750 CARLSBAD E-34 www.carlsbadca.gov INSTRUCTIONS: To address post-devetopment pollutants that may be generated from development projects, the City requires that new development and significant redevelopment priority projects incorporate Permanent Storm Water Best Management Practces (BMP's) into the project design per the City's Standard Urban Stormwater Management Plan (SUSMP). To view the SUSMP, refer to the Engineering Standards (Volume 4, Chapter 2) at www.carlsbadGa.gov/standards. Initially this questionnaire must be completed by the applicant in advance of submitting for a development application (subdivision, discretionary permits and/or construction permits). The results of the questionnaire determine the level of storm water standards that must be applied to a proposed development or redevelopment project. Depending on the outcome, your project will either be subject to 'Standard Stormwater Requirements' or be subject to additional criteria called 'Priority Development Project Requirements'. Many aspects of project site design are dependent upon the storm water standards applied to a project. Your responses to the questionnaire represent an initial assessment of the proposed project conditions and impacts. City staff has responsibility for making the final assessment after submission of the devebpment application. If staff detennlnes that the questionnaire was incorrectly filled out and is subject to more stringent storm water standards than initially assessed by you, this will result in the retum of the development application as incomplete. In this case, please make the changes to the questionnaire and resubmit to the City. If you are unsure about the meaning of a question or need help in detemnlnlng how to respond to one or more of the questions, please seek assistance from Land Development Engineering staff. A separate completed and signed questionnaire must be submitted for each new development application submission. Only one completed and signed questionnaire is required when multiple development applicaUons forthe same project are submitted concurrently. In addition to this questionnaire, you must also complete, sign and submit a Project Threat Assessment Form with construction permits for the project. Please start by completing Step 1 and follow the instructions. When completed, sign the form at the end and submit this with your application to the city. STEP 1 TO BE COMPLETED FOR ALL PROJECTS To determine if your project is a priority development project, please answer the following questions: YES NO 1. Is your project LIMITED TO constructing new or retrofitting paved sidewalks, bicycle lanes or trails that meet the following criteria: (1) Designed and constructed to direct storm water runoff to adjacent vegetated areas, or other non-erodible permeable areas; OR (2) designed and constructed to be hydraulically disconnected from paved streets or roads; OR (3) designed and constructed with permeable pavements or surfaces in accordance with USEPA Green Streets guidance? 2. Is your project LIMITED TO retrofitting or redeveloping existing paved alleys, streets, or roads that are designed and constructed in accordance with the USEPA Green Streets guidance? Dear Mr. Worthing, The City Planner has completed a review of your application for a Nonconforming Construction Permit NCP 14-01 for additions to an existing triplex with nonconforming setbacks at 180 Walnut Avenue. A notice was sent to property owners within a 300 ft. radius of the subject property requesting comments regarding the above request. No comments were received within the ten day notice period (ending on May 15,2014). After careful consideration ofthe circumstances surrounding this request, the City Planner has determined that the four findings required for granting a Nonconforming Construction Permit can be made and therefore, approves this request based on the following findings and conditions. Findings: 1. The expansion/replacement ofthe structure and/or use would not result in an adverse impact to the health, safety and welfare of surrounding uses, persons or property in that the existing property is currently developed with a multiple-family residential triplex consistent with that as permitted in the R-3 zone and is surrounded by other multiple-family residential developments and single-family homes of similar sizes or larger to the north, south, east and west. In addition, the proposed areas of expansion comply with all current Planning, Building and Engineering standards. 2. The area of expansion shall comply with all current requirements and development standards of the zone in which it is located, except as provided in Subsection 21.48.050(A)(3) of this chapter in that the proposed areas of expansion comply with current front, side, and rear yard setback requirements, including all other development standards, such as building height and lot coverage. The expansion/replacement would result in a structure that would be considered an improvement to, or complementary to and/or consistent with the character ofthe neighborhood in which it is located in thatthe proposed renovations will significantly update and enhance the existing structure, creating a more visually appealing building. Moreover, the proposed renovated multiple-family residential triplex is comparable in size and height to other existing multiple-family residential developments and single-family homes adjacent to and within the vicinity of the project site. Therefore, the proposed project will be considered consistent with the character of the neighborhood in which it is located. 5. That the City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15301(e)(1), Existing Facilities, ofthe state CEQA Guidelines. In making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project. 6. The City Planner has reviewed each ofthe exactions imposed on the Developer contained in this resolution, and hereby finds, in this case, that the exactions are imposed to mitigate impacts caused by or reasonably related to the project, and the extent and the degree ofthe exaction is in rough proportionality to the impact caused by the project. Conditions; Note: Unless otherwise specified herein, all conditions shall be satisfied prior to issuance of a building permit. 1. Approval is granted for NCP 14-01 as shown on Exhibits "A" - "E" dated May 16, 2014 on file in the Planning Division and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. 2. The Developer/Operator shall and does hereby agree to indemnify, protect, defend and hold harmless the City of Carlsbad, its Council members, officers, employees, agents, and representatives, from and against any and all liabilities, losses, damages, demands, claims and costs, including court costs and attorney's fees incurred by the City arising, directly or indirectly, from (a) City's approval and issuance of this Nonconforming Construction Permit, (b) City's approval or issuance of any permit or action, whether discretionary or non-discretionary, in connection with the use contemplated herein, and (c) Developer/Operator's installation and operation of the facility permitted hereby, including without limitation, any and all liabilities arising from the emission by the facility of electromagnetic fields or other energy waves or emissions. 5. The Developer shall comply with all applicable provisions of federal, state, and local ordinances in effect at the time of building permit issuance. 6. Developer shall submit to the City Planner a reproducible 24" x 36" mylar copy of the Site Plan reflecting the conditions approved by the final decision-making body. 7. This project shall comply with all conditions and mitigation measures, which are required as part of the Zone 1 Local Facilities Management Plan and any amendments made to that Plan prior to the issuance of building permits. 8. Prior to the issuance of a building permit, the Developer shall provide proof to the Building Division from Carlsbad Unified School District that this project has satisfied its obligation to provide school facilities. 9. If any condition for construction of any public improvements or facilities, or the payment of any fees in-lieu thereof, imposed by this approval or imposed by law on this residential housing project are challenged this approval shall be suspended as provided in Government Code Section 66020. If any such condition is determined to be invalid this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. 10. Prior to the issuance of a Building Permit, owner/applicant shall submit to the City a Notice of Restriction to be filed in the office of the County Recorder, subject to the satisfaction of the City Planner, notifying all interested parties and successors in interest that the City of Carlsbad has issued a Nonconforming Construction Permit on the real property owned by the owner/applicant. Said Notice of Restriction shall note the property description, location of the file containing complete project details and all conditions of approval as well as any conditions or restrictions specified for inclusion in the Notice of Restriction. Project/Site Summary Information Table. Please see Planning Division Attachment No. 1 and add a Project/Site Summary Information table to Cover Sheet 1 of the proposed plans. We've included some of the information in this table based on our records of the site and some from information which you have already provided. For any areas that are left blank in the attached, please complete and include on your revised plans. The Site Plan needs to include the following general information: a. Location, size and use of all easements. b. Dimensions and locations of access, both pedestrian and vehicular; points of ingress and egress; off-street parking showing location, number and typical dimension of spaces. c. Distance between buildings and/or structures. d. Building setbacks (front, rear and sides). Please be aware that the Garfield Street frontage is considered the front yard based the narrowest portion ofthe lot (see Section 21.04.240 ofthe Carlsbad Munidpal Code (C.M.C)). As such, the west side of the lot is considered the rear yard, the north side of the lot is considered the interior side yard, and the south side ofthe lot adjacent to Walnut Avenue is considered the street side yard. Please label the site plan with the required setbacks per the R-3 Zone (see C.M.C. Section 21.16). These are as follows: Front = 20 ft. Interior Side = 10% of lot width = .10 x 78 ft. = 7.8 ft. III. Street Side = 10 ft. iv. Rear = 2x interior side yard = 2 x 7.8 = 15.6 ft. e. Location, height and materials of walls and fences. Floor Plans. ISSUES OF CONCERN Planning: 1. Please add the NCP 14-01 file number in the upper right-hand corner of every sheet. 2. Other than that specifically requested above to complete the NCP application, please remove all superfluous building permit information and notes from Sheet 1, and remove all of Sheets lA and Sheets 5-8. This information is subject to separate review and approval as part of the Building Permit process, which is not currently being processed. 3. Please add the Administrative Approval Block No. 1 to the Site Plan (Sheet 1 only). Exhibit "A" of the Equity Title Company Preliminary Report dated November21, 2013 refers to the recordation date of City Resolution No. 1021 as May 14, 1964. It appears that the document recorded May 19,1964. 2. The lead arrow on the south end of the westerly property line dimension of 68.18 should be revised to go to the northwesterly corner of the Walnut Avenue vacation rather than to the current right of way / property line. 3. The current half street width for the north side of Walnut Avenue in front of the site is 30' rather — than 35'. Please add a 40' half street width dimension for the south side of Walnut Avenue. Please add a 30' half street dimension for the east side of Garfield Street. The site plan required for a Nonconforming Construction Permit P-28 should be of a scale large enough to clearly depict the information required by Section 1, A and B ofthe permit.
