It should be noted that a bond has previously been posted for all related work along the boulevard. KSD understands this security, posted to guarantee completion of precise grading (DWG 463-D), will not be released until both the decorative fence and landscaping are constructed and completed to the City's satisfaction. However, if the permit condition amendment successfully occurs as described in item 3 below, the security will not be held for decorative fence and landscaping construction and completion. 1. KSD agrees to provide conceptual architectural plans for the landscaping and decorative fence on or before March 17', 2014. If the city has comments that require plan changes, KSD will revise and resubmit the plans with the objective of receiving the city's fmal conceptual plan approval by March 31, 2014. 2. KSD provides the attached engineer's probable cost estimate for the landscaping and decorative fence for your review and approval. KSD will also work to receive fmal city approval of the cost estimate by March 31, 2014. 3. By March 31, 2014, Poseidon Water Resources (PWR) will submit a permit condition amendment allowing the City of Carlsbad to use developer (KSD and/or Poseidon) funds intended for the construction of the landscaping and fencing work to instead be used for future Carlsbad Boulevard improvements (the "Carlsbad Coastal Corridor" project). Developer fimds will be based on the approved engineer's probable cost estimate. 4.
