PCD 98-03: AVIARA INFORMATION CENTER RELOCATION TO KELLY RANCH
COMPLETENESS REVIEW AND INITIAL ISSUES STATEMENT
Engineering Department staff have completed a review of the above-referenced project for
application completeness and have determined that the application and plans submitted for the
project are incomplete and unsuitable for continued review due to the following
incomplete items:
1. Please place a property ownership title block on the plan and have the property owner
sign and date the plan.
2. Please have the engineer/architect of work sign, date and stamp the plan with their
registration number.
3. The Preliminary Title Report (PR) indicates numerous easements (which must be for all
of Kelly Ranch). Please plot the applicable easement(s) with the recordation
information, and, future disposition(s).
4. Staff recently reviewed this proposed project as a Preliminary Review (PRE 98-33).
Many of the issues identified as part of the preliminary review were not addressed.
Therefore, all outstanding preliminary review issues are now considered "completeness"
items and must be adequately resolved/addressed in accordance with the following:
a) As previously requested, please submit the site plan at a scale of 1" = 20' or
40' showing the proposed temporary location of the information center.
(Items to look at are the slopes/easements for Cannon Road and site
access.)
b) As previously requested, please show the interim grading and grading
quantities on the site plan.
c) As previously requested, please address any interim drainage facilities that
may be required.
d) As previously requested, please show and define the limits of Cannon Road
(fully improved), including, right of way, grading and slope easements.
e) As previously questioned, will the information center, at the temporary
location, be occupied or used by the owners or the public? If so, sewer,
water and utilities must be available. Address this issue.
f) As previously requested, please dimension the site plan.

Engineering staff have the following minor additional comments (Engineering Issues):
1. As mentioned in a correspondence, dated June 3, 1998, from Paul Klukas to Associate
Planner, Christer Westman, some type of security and removal "sunset" date would
probably be required for the removal of the information center if the permanent
installation were not to occur.
2. Please show how access to the site will be provided/maintained when this segment of
Cannon Road is constructed.
3. Please indicate any fencing for the project.
4. If the project is approved, a haul route permit will be required to relocate the Information
Center from Aviara to Kelly Ranch.
5. Please be advised, engineering staff are not commenting on the "Concept Site Plan" for
the permanent location at this time. Comments for the future permanent location will be
provided when a final Site Development Plan is submitted.
6. Enclosed for the applicant's review for making the requested revisions is a red-lined
check print of the project. This check print must be returned with the revised plans
to facilitate continued staff review.

A preliminary review of your project was conducted on June 11, 1998. Listed
below are the issues raised by staff. Please note that the purpose of a preliminary
review is to provide you with direction and comments on the overall concept of
your project. The preliminary review does not represent an in-depth analysis of
your project. Additional issues of concern may be raised after your application is
submitted and processed for a more specific and detailed review.
Planning:
1. Staff has a concern that this site may not be appropriate for the temporary
storage of the structure. It will be some time yet before the surrounding area
develops and its remote location may create an attractive nuisance.
2. Staff encourages Aviara Land Associates to pursue an extension which would
allow the structure to remain in place until such time that the Kelly Ranch site
can be permanent versus temporary.
3. At such time that the move is requested, a Planning Commission Determination
(PCD) is the appropriate mechanism for approval.
Engineering:
If you should choose to go forward with the request to the Planning Commission,
the following comments will apply to the application.

PRELIMINARY REVIEW
Engineering Department staff have completed a preliminary review of the above-referenced
project. The concept of temporarily storing the Aviara Information Center on Area "F" of the
Kelly Ranch "core area" Master Tentative Map is potentially acceptable to engineering staff.
However, staff does have some comments and issues of concern, as follows:
1. As mentioned in a correspondence, dated June 3, 1998, from Paul Klukas to Associate
Planner, Christer Westman, some type of security and removal "sunset" date would
probably be required for the removal of the information center if the permanent
installation were not to occur.
2. Please submit a better site plan (1" = 20' or 40' scale) showing the temporary and
permanent locations of the information center.
3. Please show the interim grading and grading quantities on the site plan.
4. Please address any interim drainage facilities that may be required.

Aviara Land Associates and Larry Clemens has decided to offer the following
to the Agua Hedionda Lagoon Foundation:

development area) to the Foundation for use as a public
Visitor Center. ,
• Providing the Foundation with ownership of the Aviara
, Information Center structure, for placement onto Area F,
upon approval of the necessary City permits.

BACKGROUND:
The Aviara Information Center was constructed on Aviara Planning Area 23
as a "temporary" facility. If s CUP allows its use in Aviara only for a specific
period of time. The approximately $1 million building was constructed in a
format that allows its ultimate disconnection into sections to accommodate
transport for installation elsewhere.
The Information Center's present location, PA 23, has been-sold to The
Brehm Companies. The sales agreement stipulates that Aviara Land
Associates must remove the structure completely from PA 23 by 12/31/98.
The proposed receptor site, Kelly Ranch Area F, is located with the Mello II
segment of the Carlsbad LCP. It is a proposed lot within the "Core Area"
subdivision of Kelly Ranch, which is presently in the EIR process and will

likely be scheduled for public hearing in January or February, 1999. The "Core
Area" submittal designates the site for neighborhood commercial uses, but
Aviara Land Associates will request a modification of. this proposed use to
open space, public facility or some such use to accommodate the visitor
center. . v
Pursuant to the arrangement with the Agua Hedionda Foundation, Aviara
will process the permits necessary to transport the structure to Area F, and
subsequently the necessary permits for final placement of the structure (SDP,
CP, etc.) on the site as a visitor center. At this time the building relocation is
the primary need.
PROPOSED PROJECT: .
Aviara's goal is to process the permits necessary in order to temporarily place
the structure on Area F, and if necessary, keep it up on blocks or jacks (no
hook-ups). In order to create a level area, it would be necessary to do a small
amount of leveling of the site (under 1000 cu. yds.) A foundation .slab would
presumably not be poured until SDP approval was granted. As shown on the
attached preliminary site plan, the structure would be temporarily stored in
the future parking lot location, so that it would not interfere with eventual
slab construction.1 In the event that a future SDP is not forthcoming for some
reason, Aviara would agree to provide some form of security for removal of
the structure from the site.
Building relocation permits typically involve a the processing of a Planning
Commission Determination (PCD). As a result, it has been my conclusion
that this is the proper process for this temporary relocation. We have here,
however a somewhat unusual circumstance. Please discuss this matter in a
preliminary review and provide me with Staff conclusion as to whether this
relocation can be accomplished within the necessary time frame, and what
permitting process to use.
