SUBJECT: PIP 00-04 and PIP 00-05
Dear Mr. Grim:
I am in receipt of your letter of December 18, 2001, regarding the proposed development at
the west of McClellan-Palomar Airport (PIP 00-04 and 00-05). Unfortunately, this letter
arrived after the last meeting of SANDAG for the year 2001. SANDAG's authority as the
Airport Land Use Commission (ALUC) terminated December 31, 2001. The San Diego County
Regional Airport Authority is now the ALUC for the region.
You requested an administrative review of the proposed development. Your letter indicates
that this property would be developed in accordance with the land uses described in
Category 9 on page 9 of the CLUP. While your letter indicates that conditions will be placed
on the development of the parcels to bring them into compliance with the restrictions on
property in the Flight Activity Zone, these lots also are within the 75 CNEL. We believe that a
staff administrative approval was inappropriate because the CLUP was amended in 1994 with
the new expanded CNEL, placing the property in the 75 CNEL.
Because there is a time limit of 60 days for ALUC action, we will immediately notify the
Regional Airport Authority of this matter, so that the new agency can proceed to resolve this
issue. An appropriate action may be to seek a CLUP amendment from the Authority that
would allow for a "conditionally compatible" designation for the types of development being
proposed (Category 9 in the CLUP). We are committed to working with the new ALUC and the
City of Carlsbad to help resolve this issue.
