Box 231 591 Encinitas, CA 92024 SUBJECT: Lots 23 and 24, at Dryden Place, Carlsbad Dear Mr. Gracey: Thank you for sending us copies of two letters, from Mr. Koerper of SANDAG, to the City of Carlsbad planning staff, regarding consistency conditions on property located adjacent to Palomar Airport. We are still reviewing the approvals of the properties referred to in these letters, but note at the onset that there is a significant distinction between lots 39-41 and Mr. Dirken's lots. Namely, lots 39-41 are not in the Flight Activity Zone, while Mr. Dirken's lots are in the Flight Activity Zone. We wish to reiterate the situation regarding the properties on Dryden Place, Carlsbad, which you represent. The City of Carlsbad requested that the San Diego Airport Land Use Commission (ALUC) approve the development of an amendment to the Palomar Airport Comprehensive Land Use Plan (CLUP). This amendment would list the consistency conditions to be imposed on the property that you represent and adjacent properties. The ALUC approved the request at its June 22, 2001, meeting. Following the vote of the ALUC, the City of Carlsbad and the County of San Diego, as Airport Manager, agreed upon a proposed CLUP amendment. This amendment was presented to the Palomar Airport Advisory Committee, but the Advisory Committee rejected it at its November 15, 2001, meeting. Your next step is to appeal to the City of Carlsbad, for an override of the vote of the Advisory Committee and for approval to submit the CLUP amendment to the ALUC for adoption. The ALUC staff cannot write a letter of consistency with the CLUP, even with conditions as listed in the previous projects, because the City of Carlsbad has imposed the requirement of a CLUP amendment on the property and the ALUC ordered the development of the CLUP amendment.
