Dear Mr. Grim:
I am in, receipt of your letter of December 18; ZOOl, regarding the proposed development at
the west of McClellan-Palomar Airport (PIP. 00-04. and 00-05). Unfortunately, this letter .'
. arrived. ,after the last meeting of SANDAG for the .year.2001. SANDAG's authority as. the ' .
,Airport Land Use Commission (ALUC) terminated December 31, 2001. lhi3 San- Diego County I
Regional Airport Authority is now.the ALUC for the region. ..>
You requested an administrative review of the proposed development. Your letter indicates -
that this property would be developed -in -accordance with the land uses decribed in
Categoq 9 on page 9 of the CLUP. While your letter4ndicates that conditions wil4 be placed

. propeity in the Flight Activity Zone, these lots also are within the 75 CNEL. We believe that a
stdfhdrninistrative approval was inappropriate because the CLUP was amended in 1994 with .,
the new expanded CNEL, placing the property in the 75 CNEL.
Because. there .is a time limit of 60 days for ALUC :adion, we wilt immediately notify the . ' "
Regional Airport Authority of this matter, SO that the new agency can proceed to resolve this' . '.
,:.issue. An appropriate action may be. to seek a CWP-amendment from the-Authority *hat ' '
would allow for a "conditionally compatible" designation for the types of developmenrbeing . .
proposed (Category 9 in the CLUP). We are committed to working with the new,ALUC and the - '
City of Carlsbad to help resolve this issue. ,
