I have gotten involved in your request for your project located in the Carlsbad Airport Center. I have reviewed the plans and discussed with staff your request for minimal setback from the top of slope along Palomar Airport Road. I am in basic agreement with staff that additional setbacks are necessary on this project. Staff, however, has indicated .to me that they would be receptive to a building setback of 15 feet from top of slope be averaged along the Palomar Airport Road frontage. In reviewing your plans, it is apparent that you could meet this average 15-foot distance from top of slope with very little change to the footprint of your building. In response to your comments regarding the fact that there is no ordinance requiring the additional setback, staff does have the discretion to require setbacks over and above those called for in the PM Zone, since the development standards in that zone require a minimum of 50 feet from any major, prime, or secondary arterial. This project does require a Planned Industrial Permit. A P. I .P. can be issued if the Planning Director makes certain findings, one of which is consistency with the intent and purpose of the PM Zone. This finding cannot be made without the provision for additional setbacks. It is our opinion that we must preserve our view corridors along our major streets, such as Palomar Airport Road, and we can only do that by insuring that we have adequate setbacks and open space areas to create a feeling of openess as you are driving through or around the industrial park areas. We have made our final decision regarding the setback and are prepared to deny your project unless an average 15-foot setback from top of slope is provided. i j- George Mikesh May 28, 1987 Page 2 You do, however, have the ability to appeal this decision to the City's Planning Commission. If you choose to do so, please contact me in writing and I will carry forward your request for relief to the Planning Commission at our earliest convenience. If, however, you choose to modify your Site Plan to show a minimum 15-foot average setback from top of slope along Palomar Airport Road, please revise your plans and submit them to the City, attention Brian Hunter. I am not aware of any other problems associated with your project and we will expidite the issuance of the permit as soon as the Site Plan has been accepted by the City.
