Holzmiller Planning Director City of Carlsbad 2075 Las Palmas Drive Carlsbad, California 92009-4859 RE Opus Southwest Carlsbad Airoort Center Dear Mr. Holzmiller: At our meeting on April 28, 1987 we agreed to consider additional setbacks beyond those required by code and the CC&R of the Park. After reviewing the request and looking at several alternatives, we find that we are unable to accommodate your request. To do so would require a redesign of the project and a significant loss in square footage. Since, this approval process has become very time consuming and frustrating, I will take the liberty to review what has happened. - December 10, 1986 - Plan submitted for review. - January 7, 1987 - We received comments back. - February 22, 1987 - Resubmitted plans for review. - March 12, 1987 - Meeting regarding Hillside Ordinance as it relates to our proposal. We were told that whether or not we were subjected to the Hillside Ordinance was unknown at that time. We were also informed that the only other issues to be resolved were the relocation of a dumpster and a reduction in the amount of retaining wall. I might add that this was essentially the same plan that was submitted on December 10, 1986. - April 2, 1987 - At City's request we submitted a rendering of the project as visualized from Palomar Airport Road. - April 8, 1987 - A section of same was submitted at City's request. - April 28, 1987 - A meeting was held regarding the project. At this time we were informed that we were not subject to the Hillside Ordinance, however, an additional fifteen (15) foot setback would be required from the top of the slope. Holzmiller May 19, 1987 Page Two As stated earlier we have examined this request and do not find it feasible. When one considers the fact that there is no ordinance, to our knowledge, regarding the additional setback and the fact that Phase I is already set back from eleven (11) to fifteen (15) feet and Phase I1 from twelve (12) to twenty-seven (27) feet further than the required fifty (50) foot setback, I don't understand the continuing delays and additional requests for this project. We have tried several times to reach you by telephone but the calls have not been acknowledged. I would appreciate your attention to this matter as soon as possible so we may procccd with this project.
