Thorman regarding your issue of concern in respect to the potential for golf balls to be hit outside of the property's boundaries, we have provided you with the details of our testing at the polo fields which demonstrate that there is very little chance for a ball to be hit off the property. In order to give you further assurances, we agree to the following conditional use: ''The facility will be restricted to supervised testing by robots and qualified testers. The facility will not be available for recreational use." You had a further requirement that Callaway Golf Company accept liability for personal injury and property damage resulting from the use of the test facility. We accept this as a normal course of doing our business, and would be willing to furnish a certificate of insurance if the need arose. We look forward to many years of successful testing at the site.
