HomeMy WebLinkAboutPIP 94-01; Innovative Time; Planned Industrial Permit (PIP) (7)t r c March 15,1994 BSHA Design Group, Inc. 919 Fourth Avenue Suite 200 San Diego, CA 92101 The City has completed a review of the application for a Planned Industrial Permit for development located on Edison Place within the Carlsbad Airport Centre, Specific Plan 181(A), (parcel #2 of Parcel Map 15687). It is the Planning Director's determination that the project is consistent with the CitJls Planned Industrial Zone regulations (Chapter 21.34) and with all other applicable City ordinances and policies. The Planning Director, therefore, APPROVES this request based on the following: The site indicated by the Planned Industrial Permit it adequate in size and shape to accommodate the proposed use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required by this chapter have been provided. The improvements indicated on the Planned Industrial Permit located in such a manner to be related to existing and proposed streets and highways. The improvements as shown on the Planned Industrial Permit consistent with the intent and purpose of this zone and all adopted development, design, and performance standards as set forth in this chapter. The proposed project is compatiile with the sunounding future land uses since surrounding properties are designated for Planned Industrial development on the General Plan. The project is in prior compliance with Environmental Impact Report 81-06 for Specific Plan 181, and no additional significant adverse environmental impacts would occur as a result of implementation of this project. The applicant is by condition, required to pay any increase in public facility fee, or new construction tax, or development fees, and has agreed to abide by any additional requirements established by a Local Facilities Management Plan prepared pursuant to Chapter 21.90 of the Carlsbad Municipal Code. This will ensure continued availability of public facilities and will mitigate any cumulative impacts created by the project. 2075 Las Palmas Drive - Carlsbad. California 92009-1 576 (61 9) 438-1 161 @ b PIP 94-01 - Innovative Time March 15,1994 PAGE 2 7) This project is consistent with the City's Growth Management Ordinance as it has been conditioned to comply with any requirement approved as part of the Local Facilities Management Plan for Zone 5. 8) The project is consistent with the Palomar-McClellan Comprehensive Land Use Plan as detennined by the San Diego Association of Governments. 1) Approval is granted for PIP 94-01 as shown on %%its "A" - "I", dated March 15,1994, on file in the Planning Department and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. 2) All uses established in this structure shall be consistent with Section 21.34.020 (Permitted Uses). 3) Unless otherwise stated, this industrial project shall comply with all applicable City ordinances and requirements. 4) The developer shall provide the City with a reprodualle 24" x 36", mylar copy of the site plan as approved by the Planning Director. The site plan shall reflect the conditions of approval by the City. The plan copy shall be submitted to the City Engineer and approved prior to building, grading, fbl map, or improvement plan submittal, whichever occurs first. 5) This project is also approved under the express condition that the applicant pay the public facilities fee adopted by the City Council on July 28,1987 (amended July 2,1991) and as amended from time to time, and any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to implement a growth management system of facilities and improvement plan and to fulfill the subdivider's agreement to pay the public facilities fee dated July 15, 1993, a copy of which is on file with the City Clerk and is incorporated by this reference. If the fees are not paid this application will not be consistent with the General Plan and approval for this proj.ect will be void. 6) This project shall comply with all conditions and mitigation me- which may be required as part of the Zone 5 Local Facilities Management Plan and any amendments made to that Plan prior to the issuance of building permits. 7) If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposed by this approval or imposed by law on this project are challenged this approval shall be suspended as provided in Govunmcnt Code Section 65913.5. If any such condition is determined to be invalid this approval shall be indid unless the City Council determines that the project without the condition complies with all requirements of law. 8) Approval of this request shall not excuse compliance with all sections of the Zoning Brdinance and all other applicable City ordinances in effect at time of building permit issuance. 9) This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. t - PIP 94-01 - Innovative Time March 15,1994 PAGE 3 c Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Planning Director. Enclosure shall be designed to accommodate recycling bins and be of similar colors and/or materials to the project to the satisfaction of the Planning Director. All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, in substance as provided in Building Department Policy No. 80-6, to the satisfaction of the Directors of Planning and Building. No outdoor storage of material shall occur onsite unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief and the Planning Director. The applicant shall prepare a detailed landscape and higation plan which shall be submitted to and approved by the Planning Director prior to the approval of grading or building plans, whichever occurs first. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. All landscape plans shall be prepared to conform with the Guidelines Manual and submitted per the landscape plan check procedures on file in the Planning Department. Prior to final occupancy, a letter from a California licensed landscape architect shall be submitted to the Planning Director ce-g that all landscaping has been installed as shown on the approved landscape plans. The applicant shall pay a landscape plan check and inspection fee as required by Section 20.08.050 of the Carlsbad Municipal Code. All landscape and irrigation plans shall show udsting and proposed contours and shall match the grading plans in terms of scale and location of improvements. Any signs proposed for this development shall at a minimum be designed in confomance with the City's Sign Ordinance and Specific Plan 181(A) and shall require review and approval of the Planning Director prior to installation of such signs. Building iden&ation and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addressis shall contrast to their background color. Prior to the issuance of a Certificate of Occupancy there shall be a Notice of Restriction placed on the deed to this property subject to the satisfaction of the Planning Director n0-g all interested parties and successors in interest that the City of Carlsbad has issued a Planned Industrial Pennit 94-01 on the real property owned by the declarant. Said notice of restriction shall note the prop- description and location of the pCrma file, which containsob~nsand~o~~~~onthc~. Saidnotkemaybemodified i PIP 94-01 - Innovative Time March 15,1994 PAGE 4 or terminated only with the approval of the Planning Director, Planning Commission or City Council of the City of Carlsbad whichever has final decision authority for this project. This project is located within the Carlsbad Airport Centre Specific Plan. All development design shall comply with the requirements of that plan. Unless a standards variance has been issued, no variance from City Standards is authorized by virtue of approval of this site plan. The applicant shall be responsible for coordination with S.D.G.&E, Pacific Bell Telephone, and Cable T.V. authorities. The applicant shall comply with all the rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project. Prior to building permit issuance the applicant shall pay all current fees and deposits required. Pretreatment of the sanita~~ sewer discharge from this project may be required. In addition to the requirements for a sewer connection permit the applicant shall conform to the requirements of Chapter 13.16 of the Carlsbad Muniapal Code. The applicant shall apply for an industrial waste water discharge permit concurrently with the building permit for this project. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, the applicant shall submit to and receive approval from the City Engineer for the proposed haul route. The ap3licant shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. The developu shall exercise special care during the construction phase of this project to prevent offsite siltation Planting and erosion control shall be provided in accordance with the Carlsbad Municipal Code and the City Engineer. Reference Chapter 11.06. The applicant shall comply with the City's requirements of the National Pollutant Discharge Elimination System (NPDES) permit. The applicant shall provide best management practices to reduce surface pollutants to an acceptable level prior to discharge to sensitive areas. : P c PIP 94-01 - Innovative Time March 15,1994 PAGE 5 Plans for such improvements shall be approved by the City Engineer prior to issuance of building permit. Water Conditions: 35) The entire potable water system, reclaimed water system and sewer system shall be evaluated in detail to insure that adequate capacity, pressure and flow demands are met. 36) The Developer shall be responsible for all fees, deposits and charges which will be collected at the time of issuance of the building permit. The San Diego County Water Authority capacity charge will be collected at issuance of application for meter installation. 37) Sequentially, the Developers Engineer shall do the following: A. Meet with the Fire Marshal and establish the fire protection requirements. B. Prepare a colored reclaimed water use area map and submit to the Planning Department for processing and approd C. Schedule a meeting with the District Engineer for review, comment and approval of the preliminary system layout usage (G.P.M. - E.D.U.) plan for potable, reclaimed and sewer systems prior to the preparation of improvement plans. 38) This project is approved upon the expressed condition that building permits will not be issued for development of the subject property unless the water district serving the development determines that adequate water senice and sewer facilities are available at the time of application for such water senice and sewer permits will continue to be available until time of occupancy.
