Dear Dennis:
This letter is being written in response to our telephone conversation of September 17,
1996, regarding the required avigation easement on the above referenced project. As
required in Condition 14, of the project's approval letter, dated January 18, 1996,
"Prior to issuance of building permits, the Developer shall record an Avigation
Easement over Lots 3 and 4 to the County of San Diego endemnifying the City of
Carlsbad and file a copy of the recorded document with the Planning Director." As
you may recall, due to your desire to pull building permits prior to final map issuance,
the required avigation easement for the project was recorded over the entire parcel,
prior to the legal subdivision of the site.
I understand that at this time, you wish to remove the avigation easement over Lots 1
and 2. The City would not object to the removal of the avigation easement over Lots
1 and 2, as long as this action did not disrupt the avigation easement in place over
Lots 3 and 4, as required in the project's approval. As it was your decision to record
the avigation easement over the entire parcel in favor of the County of San Diego, it
will be up to the County of San Diego to determine if they wish to transfer back the
avigation easement which they now have obtained.
