The Carlsbad Airport Centre Owners' Association is a non profit mutual benefit corporation set up to promote the wellbeing of the Carlsbad Airport Centre. The Carlsbad Airport Centre is an industrial complex located adjacent to the McCellan Palomar Airport. It has been brought to my attention that the City of Carlsbad had (approximately one year ago) approved.plans for a building located at 5861 Edison Place, Carlsbad, California 92008. Apparently, there were some irregularities concerning the approval of this structure. More specifically, the City agreed to allow the owners of the building to perform canstruction beyond the normal setback requirements. The Carlsbad Airport Centre has conditions, covenants and restrictions which run with the land and regulate all buildings located within the development. These CC&R's dictate that all proposed structures be submitted to an architectural review committee so that uniform standards throughout the project will be maintained. Apparently, approval for the above-referenced building was given by your office without regard for the CC&R's which run with the land. Unfortunately, it is my understanding that portions of this building do not conform with the uniform standards within the park and we are now trying to remedy these problems after construction has commenced. Marty O'Rentyak City of Carlsbad May 22, 1997 Page 2 In an effort to prevent future problems such as this, we formally request that you inform all individuals who submit plans to your department for building at the Carlsbad Airport Centre, that there are covenants, conditions and restrictions which run with the land and dictate additional building requirements above and beyond that of the City of Carlsbad. You can refer them'to either my office or the Carlsbad Centre Corporate Office located at 2026 Palomar Airport Road, Carisbad, CA 92008; telephone 929-2800.
