RE: DECLARATION OF PARKING RESTRICTIONS DATED DECEMBER 2, 1988,
EXECUTED BY CARLSBAD OAKS EAST, LTD., AND RECORDED IN THE
OFFICIAL RECORDS OF THE COUNTY OF SAN DIEGO, CALIFORNIA, ON
DECEMBER 19,1988, AS INSTRUMENT NO. 88-651721 (THE “DECLARATION”)
Dear Ladies and Gentlemen:
The purpose of this letter is to confirm that the above-referenced Declaration was not intended to place
restrictions on the lot currently known as Lot 35 of Parcel Map No.15563 in the City of Carlsbad. The
Declaration should apply only to Lot 36. When Lots 35 and 36 were re-subdivided so that a portion of
Lot 36 was added to Lot 35, the Declaration should have been amended to release from the restrictions of
the Declaration that portion of Lot 36 which was added to Lot 35.
The City of Carlsbad does not intend to enforce the restrictions of the Declaration on Lot 35. In
connection with the process by which the owner of Lot 35 intends to obtain a Planned Industrial Permit,
the City will cause Lot 35 to be formally released from the Declaration.
