The City of Carlsbad’s annual Growth Management Traffic Monitoring Report has identified an intersection “level of service” (LOS) failure at Palomar Airport Road and El Camino Real during both the a.m. and p.m. peak hours. A mitigation measure has been identified which will bring the peak hour LOS at this intersection to an acceptable level. This mitigation measure involves the construction of two dual right turn lanes - northbound to eastbound and westbound to northbound. The Developer/Owner acknowledges that all development within the City must participate in mitigating traffic impacts at this intersection through the incorporation of mitigation measures into the project design as well as the payment of a pro-rata share for financing the above-noted improvements. In consideration of the above, I agree that a pro-rata traffic condition will be incorporated into the proposed project and that I will pay my pro-rata cost of financing the above-noted improvements. I agree to this condition to mitigate the significant traffic impacts down to a point where the effects are clearly insignificant and there is no substantial evidence that the proposed project could have a significant cumulative traffic impact at the intersection of Palomar Airport Road and El Camino Real. Can the CEQA exemption for lnfill Development Projects (Section 15332) still be used when traffic failures at PAR/ECR have been identified--but also mitigated through a traffic fee? A. This new section exempts infill projects of less than five acres from environmental review. Such projects must also be consistent with: the general plan; zoning; no significant impacts to traffic, etc.; no value as a habitat for endangered species; and, adequately served by all utilities. Currently, the City Council has determined that, for smaller projects, a temporary solution to the PAR/ECR problem is the payment of a fee. However, a permanent solution hasn't been determined yet which means the CEQA review of that solution hasn't been done yet. When it has been, there will no longer be a CEQA issue. Until then the CEQA issue remains and smaller projects (only suggested to use for 4 units or less with no other environmental issues) can be handled as follows: 1. As part of the application submittal, the applicant must sign a statement (available at the front counter and under H: Word\lnfill Mit Agrmt.doc) acknowledging that there is a traffic failure under growth management, that everyone needs to participate in the solution, and that the project has been designed to mitigate its proportional impact by the payment of a pro-rata fee. 2. A condition to pay the project's fair share is added to resolution 3. A statement of the above is added to the Environmental Section of the staff report and an Exemption is filed. 4. If the applicant does not agree beforehand, then a Mitigated Neg Dec must be prepared and he would have to agree later. Sooner ... later ... the choice is his.
