. NOTE: The law requires that all of the conditions set forth in the fol-
lowing three Sections MUST be-established before amendment to a precise
plan can be granted. You must prove that you are ENTITLED "to amend-
ment to a precise plan.
1. That there are special c~rcumstances or conditions applying to the
land or buildings for which the adjustment is sought, which circum-
stances or conditions are peculiar to such land or buildings and do not
apply generally to the land or buildings in the r.aighborhood.
The service station was designed and constructed to serve local as well as transient
freeway potential. ·Proposed facility is designed to provide an attractive and convenient
rest and refreshment center for the traveling public.
2. That the granting of such amendment to precise plan will not· be materially
detrimental to the public welfare or injurious to the property or improve-
ments in such vicinity and zone.in which the property is located: The
proposed ·facility conforms to all sanitation and health standards set forth by t,....h-e----
County of San Diego and City of Carlsbad.
3. That the granting of such amendment to precise plan will not adversely
affect the Comprehensive General Plan: The proposed facility conforms to
architectural design of building and is a p.ermissive urse of property under present zoning.
NOTE: The City Planning Commission is required by law to make a written
finding of facts from the showing the applicant makes that beyond a rea-
sonable doubt the three above enumerated conditions apply.
