Actually, the parking lot is owned by the Parking Authority and leased to the City. The City, the Parking Authority and Plaza Camino Real, a Limited Partnership,, entered into an agreement whereby Plaza Camino Real operates and maintains the parking lot. It is very similar to a lease but not technically a lease. CenterMark Properties, Inc., is a general partner of Plaza Camino Real. If you have any questions about this, please let me know. I have the following comments: CALIFORNIA .CAFE AND DELI/CUP 88-18fA> Condition No. 3 of Resolution No. 3622 should be deleted. According to Bob Greaney, this is an outdated condition which no longer applies since the Carlsbad Municipal Water District has merged with the City. Please delete this condition from the planning department's list of standard conditions. PLAZA CAMINO REAL BUS TURN-OUT/PP 24 f Fl 1) The City of Carlsbad owns the Plaza Camino Real parking lot but the City leases it to the Parking Authority. The Parking Authority has a lease with the CenterMark Properties, Inc. Please amend the staff report to show the Parking Authority as a Lessee. 2) Wouldn't it be more accurate to amend Finding No. 3 in Resolution No. 3640 to state that there will be no increase in traffic generated by the proposed project? I also recommend adding a finding stating that the project .-will reduce onsite conflicts between vehicular traffic and bus traffic. This gives greater support to the Negative Declaration. These two changes would also be consistent with the EIA, sections 25, 27 and 29. ENCINAS CREEK-MORGAN/GPA 93-03/LCPA 93-03/ZC 93-03 1) Please remove the references to "staff" in Finding No. 2 of Resolution No. 3650. The existing NCTD bus transfer/parking facility at Plaza Camino Real is located along the shopping center's entry driveway off of Marron Road immediately west of the Robinsons-May Company Department store. The existing driveway currently accommodates automobile and truck traffic as well as serving as a bus transit center. The proposed modification would convert this multi-use driveway/five space bus transit center to an exclusive use bus driveway with eight bus loading bays and transit island. The NCTD is proposing this modification to the existing transit center for purposes of: 1) responding to existing and anticipated bus ridership demand, 2) creating a more attractive and functional bus-transit center, and 3) eliminating the need for buses to travel through the Plaza Camino Real parking lot to exit the site. This project was previously heard before the Planning Commission and unanimously recommended for approval on February 20, 1991. However, because the North County Transit District did not at that time have the unanimous support of all mall anchor tenants, this project could not be heard by the City Council. On October 15, 1993, Centermark Properties, Inc., the managing general partner of Plaza Camino Real, submitted a letter to the City indicating consensus support of all anchor stores for this project. City staff, Centermark Properties, and the NCTD have negotiated this proposal, and all conclude that this is a good solution. Since the City Parking Authority is the owner of the property upon which this project is proposed, Planning staff requests that members of the Parking Authority be informed of this proposal as required. The responses to your lists of items and issues are as follows: LIST OF ITEMS NEEDED TO COMPLETE APPLICATION: 1. Identify the existing zone (C-2) and Land Use (RRI) on the site plan. RESPONSE: These items have been indicated on a new Sheet, No. 1A, "Site Plan - Existing Conditions", and "Site Plan - Parking Lot Layout". Ten (10) copies of Sheet 1A are submitted with this letter. 2. Plot the location of the nearest mall buildings on the site plan. RESPONSE: This has been indicated on Sheet 1A. 3. Identify the height and sign area of the information sign. RESPONSE: The sign will be no more than 72" in overall height. The sign area will measure 3' by 4'. This information has been added to sheet No. 5. Ten (10) new copies of sheet No. 5 showing this modification have been submitted with this letter. 4. Based en our architect's discussion with City staff, indicating this en the new sheet is sufficient to meet City requirements. ISSUES OF CONCERN: Planning: 1. No connercial advertising shall be permitted en bus shelters, information sign or concrete seat walls. RESPONSE: Agreed. NCTD has no plans to place any advertising in the facility. We do plan to put bus schedule information in the shelters, and place a directory showing the layout of the facility in the information sign referred to above. Engineering: 1. A maintenance agreement with the City may be needed. RESPONSE: We believe such an agreement may be needed, and would probably be a three-way agreement involving the City, the mall parking lot management entity, and NCTD. We would appreciate your guidance as to whom in the City we should work with on this. 2. A maintenance agreement with mall parking lot management entity may be needed. RESPONSE: Agreed, per above. 3. Some type of lease agreement may be needed. RESPONSE: NCTD has been operating a bus transfer center at the existing location in the Plaza Camino Real parking lot since the late 1970's under existing operating agreements. We are unclear as to the background on this area of concern, and request further clarification from the City staff. NCTD believes that, with this submittal, we have fully complied with all previous and current City requirements for the filing of application No. PP 24(F). At this time, NCTD respectfully requests the City's assistance in expediting the final review of this project and scheduling it for the public hearing process. This project represents an important improvement in the provision of public transit service in the City of Carlsbad, and the construction "window" is rapidly shrinking before the 1994 holiday shopping season makes construction impossible this year. ft Thank you in advance for your efforts to make this project a reality. The application is deemed complete for engineering purposes even though the application lacks a title report. The plan is the same as was approved before. Therefore we are finding the application complete with no significant issues. MINOR ISSUES The project involves expansion of the bus site on City property that furnishes parking for the mall. Although the project has had prior approval, all issues related to the expansion may not have been addressed and it appears worthwhile to (re)state the issues we see at this time: A. This letter will confirm to you that all of the anchor stores have reviewed the plans for the proposed Transit Center at Plaza Camino Real and have given the approvals required by the Reciprocal Easement Agreement covering the shopping center.
