Not Joint Venture. Nothing herein contained shall be construed to create a partnership of joint venture between Owner and Contractor. 36. Notice. All notices required or permitted under this Contract shall be in writing and shall be effective upon personal delivery to Owner or Contractor or upon being deposited in the United States mail by registered or certified mail, return receipt requested, postage fully prepaid, and addressed to the respective parties as follows: or to such other address as either party may designate in writing from time to time. 37. Assignment. The benefits and.obligations of this Contract may be assigned by Owner without the consent of Contractor. The benefits and obligations of this Contract cannot be assigned by Contractor during the course of construction without the written consent of Owner. 38. Miscellaneous. This Contract shall be construed according to its fair meaning, and neither for nor against either party. Subject headings are inserted herein for convenience only. The various rights, options and remedies of Owner shall be construed as cumulative and no one of them shall be exclusive of any other, or exclusive of any of the rights or remedies allowed to Owner by law. In the event Owner shall one or more times, waive a covenant or condition hereof either before or after the breach, Owner shall not be deemed to have consented to any further waiver, modification or breach, whether new or continuing of the same or any other covenant or condition, or to have waived subsequent performance and observance of the same, or any other covenant or condition on the part of Contractor. 39. Execution. The Contract is executed in triplicate. Each is hereby declared to be an original; all, however, shall constitute but one and the same agreement.
