I. RECOmENOATION That the Design Review Board ADOPT Resolutions No. 138 and 139 approving RP 88- 4 and COP 88-11. 11. PROJECT DESCRIPTIW The proposed project is an approximately 50 square foot Flower Stand as shown on Exhibits ''A'l-YY1. The Flower Stand would be located east of Carlsbad Boulevard between the 7-Eleven parking lot to the east and the Armenian Restaurant and motel to the south as shown on Exhibit "E". Both the flower stand and the restaurant are a part of the motel site. 111. 4!!ulms P1 ann i no I ssuef 1. Is this project consistent with the Carlsbad Redevelopment Program, specifically the Village Area Redevelopment Plan, Village Design Manual and Village Redevelopment Segment of the Local Coastal Program? DISCUSSION Carlsbad's Redevelopment Program encourages the elimination of blight or blighting influences and the creation of pleasant and attractive environments. The proposed project will achieve those ends. The area of the Flower Stand presently has a free standing trash bin as shown on Exhibit 'IF". The project will correct this unsightly visual impact to Carlsbad Boulevard by relocating the bin to an enclosure on the interior of the motel portion of the site, see Exhibit "G". The flower stand provides an aesthetically pleasing use that is supportive of the land uses surrounding the KELLER FLOWER STAND MARCH 15, 1989 PAGE 2 site - such as hotels and restaurants. The flower stand use is primarily visitor serving and in conformance with the City's Local Coastal Program. The goal of Subarea 5 is to serve as a major tourist or tourist commercial re1 ated area. Carl sbad 6oulevard is a special treatment area within Subarea 5. That special treatment area calls for significant street landscaping and open space amenities along Carlsbad Boulevard. The project will achieve these goals with the following actions. First, the existing exposed trash container will be removed from the site and put in a screened location near the motel. Second, the existing driveway cut on Carlsbad 6oulevard at the flower stand location will be vacated by the applicant and the City will landscape the old driveway as a part of the Carlsbad Boulevard streetscape program. Third, the present three- car asphalt parking lot in the small corner between the restaurant and 7-Eleven parking lot will be enhanced to provide a pedestrian area and outside patio for the restaurant. Closure of the driveway entrance on Carlsbad Boulevard will enhance circulation and correct an undesirable condition. There is a bus stop located on Carlsbad Boulevard next to the flower stand location. The project's approximately 4,500 square foot, "mini-plaza" would enhance this bus stop facility and the streetscape open space program along Carlsbad Boulevard. This plaza is shown on Exhibit "H". The creation of such privately developed pub1 ic spaces is encouraged by Carlsbad's Redevelopment Program. To accommodate the new trash bin location some of the motel portion of the site will need to be reconfigured. This will involve restructuring of stairs to the second story motel rooms east of the pool and some minor re-striping of the parking lot as shown on Exhibit "G". These minor changes to the hotel site will assure that, the three parking spaces that would be removed on the flower stand portion of the site will be replaced on the motel site, As such, the amount of parking will not be reduced. The total proposed demand for parking under the City's existing parking standards is 38 spaces. Thirty-two of those are required for the 27 rooms in the motel, 4 spaces are required for the 11,025 square foot restaurant, 1.5 spaces are required for the apartment in the rear of the motel, and .2 spaces are needed for the Flower Stand. This parking calculation does not include any joint use or common facilities credits. It is likely the site will have some shared parking use between the motel , restaurant and flower stand. Since the project maintains parking to the City's standards, corrects an undesirable circulation condition on Carlsbad Boulevard and provides a use that is consistent with the City's redevelopment effort; staff recommends approval of the project. FT. FLOWER STAN0 ON PROPERTY LOCATED 3126 CARLSBAO BOULEVARD. APPLICANT: KELLER FLOWER STAND CASE NO.: RP 88-4 WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Design Review Board; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Design Review Board did, on the 15th day of March, 1989, hold a duly noticed public hearing to consider said application on property described as: North end part of block 18 of the town of Carlsbad according to the map thereof #775 filed in the office of the County Recorder of San Diego County, February IS, 1984 Tract 100. WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Board considered all factors relating to RP 88-4. Approval is granted for RP 88-4/CDP 88-11, as shown on Exhibit (5) "A" - "H", dated February 21, 1989, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. This project shall comply with all conditions and mitigation required by the Zone 1 Local Facil ities Management Plan approved by the City Council on September 1, 1987 incorporated herein and on file in the Planning Department and any future amendments to the Plan made prior to the issuance of building permits. If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposed by this approval or imposed by law on this project are challenged this approval shall be suspended as provided in Government Code Section 65913.5. If any such condition is determined to be invalid this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of building permit issuance. No outdoor storage of material shall occur onsite unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief and the Redevelopment Director. No food or beverage service outside of the restaurant shall be allowed on the site. Outdoor seating in the area between the flower stand and restaurant and in conjunction with the restaurant operation is allowed upon.review and approval by the Redevelopment Director. In such instances no eaployees are allowed to serve customers outside of the restaurant. Customers must pick-up and dispose of food and beverage items themselves. Approval of RP 88-4 is granted subject to the approval of COP 88-11. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. Prior to Issuance of Business License 9. Exact location of said receptacles shall be approved by the Redevelopment Director. The applicant shall prepare a. detailed landscape and irrigation plan which shall be submitted to and approved by the Redevelopment Director prior to the issuance of business license. 11. Any signs proposed for this development shall at a minimum be designed in conformance with the City's Sign Ordinance and shall require review and approval of the Redevelopment Director prior to install ation of such signs. Prior to issuance of a Business License, the driveway shown to the subject area shall either be pennanently closed by the City's streetscape contract or shall be temporarily barricaded by the owner, to prevent vehicular access, to the satisfaction of the City Engineer.
