Mailing Address: 3342 Bajo Court, Carlsbad, Ca, July 9, 1989 Mike Holzmiller City of Carlsbad Building Department 2075 Las Palmas Drive Carlsbad, Ca. 92009-4859 RE: Sign at rear of 5810 El Camino Real, Suite B Mike , Please consider this letter a request for relief of your department's decision regarding the name painted on the rear awning at 5810 El Camino Real, Sutie B. This request is made under Chapter 21.41 et.al. of your code. The following is provided as background to my request: 1. Description of Space The space occupied is a recent tenant improvement of 1,724 square feet of an older building on the southeast corner of El Camino Real and Faraday. The building itself has its narrow end on El Camino Real, and the length of the building is on Faraday. Our space is midway in the building and has 35 feet of frontage on the north wall which fronts Faraday, and 15 feet of frontage on the south wall which fronts the parking lot. 2. Description of Sign In the original tenant improvements, front and rear store fronts were created and over each was installed an awning, It is my understanding that there has never been a question as to the legality of the front awning, and as a July 5, 1989 phone communication with Anne Hysong of your department, the rear awning is also acceptable. The only question which is open is that the rear awning has the name of the deli painted on it. It was always my intention to paint the name of the deli on the awnings, as evidenced by the notation on the approved (CB 88-1577) set of plans which states in the awning description "w/logo painted on." Presently your department has decided that the lettering on the rear awning must be covered over. c 3. Description of Sign Exposure Even though our business address is El Camino Real, there is no direct exposure to El Camino Real. There also is no access to the parking lot off of El Camino Real. All ingress to the site is from Faraday Avenue. This commonly creates confusion for people seeking our business. We have had delivery trucks ticketed by the Carlsbad Police for parking on Faraday while the drivers looked for our business. We have provided a rear entrance on the south side of the building to our store. This rear entrance is somewhat visible to drivers going north on El Camino Real. The rear entrance serves principally for deliveries to our business. The rear awning is located in the rear parking lot, approximately 80 feet from a Federal Express kiosk which, by the way, has illuminated signs on each of each its four sides.
