Dear Mr. Hull:
In response to your May 26, 1993 letter, the prohibition of freeway orien .ted signs for non freeway serviie facilities is contained in the City's SiG Ordinance (Chapter21.41, Carlsbad
Municipal Code). Basically, the only exception to the-prohibition is the allowance of the freeway
oriented signage approved as part of a discretionary action, such as a Specific Plan, Site
Development Plan, or Non-Residential Planned Unit Development. Although there have been some sign permits issued in error, the vast majority of the freeway oriented signs in Carlsbad do comply with the above noted criteria. Therefore, your allegation of discrimination is unfounded.
Notwithstanding the above, the Planning Department will approve a replacement sign for the Sun Harbor Realty that conforms to the requirements of Chapter 21.41 of the Carlsbad
Municipal Code. The basis for this decision is the approved sign program for the building. Please
be advised however, of the following:
(1) That sign program was approved in error;
(2) The City is processing a zone code amendment (ZCA) to clarify the issue and
further restrict non-freeway service facility signage; and
(3) The above ZCA is anticipated to have an amortization clause that could impact
your proposed sign.
