CA 92691 May 26, 1993 Van Lynch Planning Technician City of Carlsbad 2075 Las Palmas Drive Carlsbad, California 92009-1576 Re: Sign Permit 93-20 Dear Mr. Lynch: Your letter of May 7, 1993 rejecting Coldwell Banker's application for a permit has been referred to me. As you must know, Sun Harbor Realty, who Coldwell Banker recently purchased, had a sign in the exact same location in which Coldwell Banker seeks approval. In 1990, the City of Carlsbad approved a master sign program for this building permitting the sign on the eastern elevation facing Interstate 5. Coldwell Banker is determined to maintain that sign where it has been in its current location. You cited in your letter to the tlcity's policyt1 not to permit signs facing the freeway. What lvpolicylt are you speaking of? Please immediately provide me with any documentation supporting that policy. I. have reviewed the Carlsbad Building Sign Criteria. I find no prohibitions with regards to eastern oriented signs. I can assure you that if you withhold permission on this request that you will be faced with a lawsuit. One has only to drive Interstate 5 and consider all of the signs facing directly towards Interstate 5 that are not "freeway servicett oriented, to conclude that you are discriminating against Coldwell Banker, denying due process and interfering with constitutional rights.
