SUBJECT PS 94-97 - SIGN PERMIT FOR EXISTING FREE STANDING SIGN
The Planning Department has continued to research the history of the unused pole sign in
front of your new suite. With the aide of Sarah Marquez, it was discovered that a building
permit was issued for the sign structure in 1983 and it has been used by previous tenants.
The freestanding sign does not meet the requirements of the Carlsbad Municipal Code
(C.M.C.) with respect to signs, however, and is therefore a non-conforming sign.
According to Section 21.41.080 of the C.M.C., a non-conforming sign that has been in place
for seven or more years must be removed or brought into conformance within four and one-
half years. This letter serves as the notice of non-conformity, requiring removal or alteration
to a conforming state before June of 1998. Also, should an application for a
Redevelopment Permit be made for the Town Square center, bringing the sign into
conformance would be a requirement of that permit.
In the interim, you may use the sign structure to display your sign proposed through sign
permit number PS 94-97. The impending revisions to the Village Design Manual may allow
for additional signage such as projecting signs, hanging signs, or awning signs, all of which
could alleviate visibility issues when the freestanding sign is removed or modified. Please
