After careful consideration of the facts related to your request, I have concluded that the denials of the sign permit and of the request for a sign program amendment were consistent with City codes, policies and procedures. Your letter makes several allegations that are not supported by the facts. Please note that the property where your client has located, has an approved sign program that allows a 2 ft. by 8 ft. sign located adjacent to and facing the freeway. The sign permit request was not in compliance with the approved sign program. Furthermore, the City does not normally allow freeway facing signs for non-freeway oriented (tourist serving) businesses. However, since the project where your client is located has a sign program that allows a 2’x8’ facing the freeway, staff was willing to approve such a sign (but not the one that was requested in the application). The approved sign program also only allows a 2’x8’ freeway facing sign where the CB Commercial sign is located. Our records indicate that the existing sign was erected without permits or approvals. The City has initiated code enforcement related to the CB Commercial sign and the matter has been referred to the City Attorney’s office. Finally, the City’s action on the Grubb and Ellis sign has concluded (sign program amendment denied September 15, 1997) and the appeal period was complete long before November 7, 1997 (the date of your letter). We sincerely wish that your client or your client’s sign contractor had researched the sign regulations for the site before the leasing the office space. Had that occurred, your client would have been able to make a more informed decision about locating there. I can assure you that the City and the Planning Department endeavor to treat every one equally and fairly.
