Dear Chris:
As you already know, we have filed an appeal from the decision represented by your
March 10, 1999 letter to Scott Brusseau. We did so reluctantly, and only because
there appeared to be no other choice under the circumstances. As you know, I have
advised Scott that the sign program prepared by Mr. Holt for Cornerstone and
submitted to you several months ago complies with the language of the Specific Plan.
On the other hand, Scott has been willing to accept considerably less in order to
avoid delay, expense, and controversy. I further believe that the approval of the sign
program and the issuance of sign permits under it are administerial acts which the
Planning Director must take, and that if our appeal to the Planning Commission is
not successful we would be on firm ground to seek a writ of mandate. The wiser
course may be to avoid all of that by returning to the conference room table with you
and Gary, and perhaps Michael himself. Please let us know if you have any interest
in doing SO.
