I agree to indemnify, hold harmless, and defend the City of Carlsbad and the Carlsbad Redevelopment Agency or its officers or employees from all claims, damage or liability to persons or property arising from or caused by the installation of the subject sidewaik/freestanding sign on the public sidewalk pursuant to this permit unless the damage or liability was caused by the sole active negligence of the City or its officers or employees. I have submitted a Certificate of Insurance to the City of Cadsbad in the amount of $1 million which lists the City of Carlsbad and the Carlsbad Redevelopment Agency as "additional Insured". This Certificate shall remain in effect for as long as the sidewaik/freestanding sign is placed within the public right-of-way. This agreement is a condition of the issuance of this permit for the subject sidewaik/freestanding sign to be placed on the public right-of-way. I understand that an approved sidewaik/freestanding sign permit shall remain in effect for as long as sidewaik/freestanding signs are permitted within the Village Redevelopment Area and the permittee remains in compliance with the subject approved permit. I also understand that the Housing and Redevelopment Commission may conduct an annual review of the applicable sign regulations for sidewaik/freestanding signs and reserves the right to modify or eliminate jfjhe regulations which currently allow for these signs. MOON T-TOWN 201 OAK AVENUE, SUITE D CARLSBAD, CA 92008 Re: Approval of Sidewalk Sign Permit Dear Sook Moon: Thank you for notifying the Housing and Redevelopment Department that your window signs have been brought into conformance with the sign regulations set forth in the Village Master Plan and Design Manual. As a result, your Sidewalk Sign Permit has been approved. Attached is a copy of the approved permit for your records. Please note, the attached site plan shows the approved location of the sidewalk sign. The sign must be placed on the grass area adjacent to the sidewalk directly in front of your business on Oak Avenue. The sign may not encroach onto the sidewalk as this area must remain clear for pedestrian use. No other items may be displayed in this area. The attached permit allows you to retain your sign for; 1) as long as the Housing and Redevelopment Commission allows sidewalk signs to remain, 2) as long as the sign continues to meet the standards outlined within the Carlsbad Village Master Plan and Design Manual, and 3) as long as the sign is consistent with this permit approval. It is important to note that the Housing and Redevelopment Commission will complete an annual review ofthe sidewalk sign regulations to determine their continued applicability. Your application has been reviewed in accordance with the location and development criteria for sidewalk signs. Your permit will be approved once all the existing building signs are brought into conformance with the sign regulations set forth in the Village Master Plan and Design Manual. In order to bring the signs into conformance, the window signs must comply with the following standards: • Window sign copy should only include the business name, address, hours of operation, emergency telephone numbers, business tenant logos, generic products and brand names offered by the business; • Window sign area should not exceed 25% of any single window area or 10% of the aggregate ground floor window area; and • Sign copy should not exceed 8 inches in height. Once the window signs are brought into conformance, please contact my office at (760) 434-2813 to inform me that the condition has been met. The application will then be fonA/arded to the Housing and Redevelopment Director for final approval. A copy of the approved permit will be forwarded to you.
