The City of Carlsbad Pl~hning Department would appreciate the

SITE DEVELOPMENT PLAN/SPECIAL USE PERMIT
Developmert shall meet all requirements of the subdivision~ zoning
and building codes, laws, ordinances or regulations of the C1ty of
Carlsbad, and other governmental agencies. Some of the more pertin~nt

formation and concurrence. Please read this list carefully and feel
free.to ask for further information· or explanation.
1) All conditions for Conditional Ose Permit, Variance, Planned
Unit Development and Special Use Permit shall be completed and'
the project commenced within 18 months from final City action,
unless otherwise stated as part of the approval. There is no
time limitations for Specific Plans unless required as part

of the approval. .
Development shall substantiallY conform to the approved plan.
All public improvements shall be made in conformity w~ih City
Standards, to the satisfaction of the City Engineer, without
cost to tne City of Carlsbad and free of all liens and
encumbrances.
4) Prior to any construction, the applicant shall submit plans
to the appropriate entity providing domestic water to the
proposed development, for its approval of the location, type
and a~equacy of water lines.
5) " Prior to any construction, the applicant shall obtain approval
from the City Fire Department of the location and size of
fire hydrants.
6) The applicant shall install all' required fire hydrants ?nd
dry~stand pipes prior to framing construction, and said fire
appurtenances shall be functional prior to commencing such work.
7) Street trees, as required by the City, shall be installed by the
applicant at applicant's expense. Trees shall be of a type
approved by the Parks Department and shall be installed to their
specifications. If removal of any existing trees is required
by the City, said removal shall be at the applicant's expense.
It shall be the responsibility of the applicant to make all
arrangements with the Parks Department concerning the require-
ments of this condition. .
8) A detailed grading plan which includes proposed drainage
and erosion control landscaping or other measures such as
desilting basins shall be approved by the City Engineer.
9) Immediately after grading, erosion control landscaping and/or
other measures such as desilting basins shall be installed.
This control may be the final landscaping if so approved.

A detailed landscape and sprinkler plan shall be submitted
for Planning Director's approval for all graded slopes 5'
or greater in height and any other areas required by law.
Prior to final building inspection clearance, all landscap-
ing and irrigation systems shall be installed or adequa~e
bonding ,accepted. Said landscaping shall be maintained in
a manner acceptab"le':to the Planning Director.
No signs or advertising of any type whatsoever shall be erected
or installed until plans thereof have been appro~ed by the City
of Carl.sbad.
As part of the approval process, the City may modify these conditions or
add others, especially those of a more specific nature. The applicant
will be notified of these modifications or additions by Resolution.

PROCEDURES
AP_plic,ation to Planning Commission: ,In an effort to aid the
~icant, the Planning Department requests that ,it be given
an opportunity to evaluate and discuss the application in its
various stages of development priar to submittal. It is more
effective'if applicant meets directly with staff; however,
written or telephone communication is acceptable. It is the
responsibility of the applicant to make the initial contact
for such meeting.
Submittal: Application will be accepted only if the applica-
tion, plans and other pertinent materials are complete.
Generally, the date application will be heard will be deter-
mtned By the submittal date as indicated within the approved
planning Commission calendar.
Planning Commission Calendar: The Planning Commission:~dopts
an annual calendar that indicates application ~losjng dates)
staff review dates, staff report completion dates, and Pl~n
ning Commission hearing dates. You may acquire this calendar
at the Planning Department.
Staff Review: On the date as indicated on the Planning Commission
Calendar, City Staff conducts a review meeting on all items on
the Planning Commission agenda. The applicant is invited to
attend an~ to explain the project and respond to staff preliminary
recommendations. Upon completion of this review, Staff will pre-
pare final staff recommendations to be submitted to the Planning
Commission. The final report with recommendations will be
available at the Planning Department five days prior to the
Planning Commission hearing (Friday afternoon prior to the
Plann~ng Commission meeting date).
Hearing: The Planning Commission meets every 2nd and 4th
Wednesday· of the month at 7:30 p.m. or as indicated on the
Planning Commission calendar. Depending on the type of appli-
cation, the Planning Commission will either make a finding
and forward to City Councilor make final action.
Appeals: Final action by Planning Commission may be appealed
to the City Council, provided such appeal is filed within ten
(10), days after the Planning Commission actioh. The applicant
shou1d review with staff the procedure on the various types of
applications.
Final Decision: The City will notify the applicant and property
owner of the final decision. , .-

The undersigned, RANCHO CARLSBAD, a general partnership,

real property, (hereinafter called the "subdivision"), legally
described as follows:
The Easterly 75 feet of that portion of the
Southeast Quarter of the Southeast Quarter of
Section 2, Township 14 South, Range 4 West,
San Bernardino Base and Meridian, in the County

DECLARATION OF COVENANTS, CONDITIONS AND
RESTRICTIONS FOR RANCHO CARLSBAD MAP NO. 823
The undersigned, RANCHO CARLSBAD, a general partnership,
. '.(hereinafter called IIDeclarant II), is the fee owner of certain
rea~ property, (hereinafter called the "subdivisionll ), legally
described as follows:
Parcels 1 through 4 inclusive of Map No. 823,
in the City of Carlsbad, County of San Diego,
Stato of California.
It is intended that all of the parcels in the subdivision
shall be subject to and controlled by this Declaration of Cove-
nants, Conditions and Restrictions (hereinafter called the
IIDeclarationll ).
Declarant hereby certifies and declares that Declarant
has established and does hereby establish a general plan for
the improvement, development, protection and maintenance of
the subdivision, and the parcels located therein; and, in
order to accomplish such improvement and development, to in-
sure such protection and maintenance, to encourage the best
use and most artistic development and improvement of each par-
eel therein, to promote the construction and improvement of
tasteful and attractive residences, and maintenance of all
portions of the subdivision and, in general, to adequately pro-
vide for improvements of high type and quality, Declarant
herebY.declares that all of the parcels located in the sub-

subject to the following easements, restrictions, reservations,
provisiops, covenants, and conditions, which are for the purpose
of protecting the value and desirability of the parcels within
the subdivision, and which shall run with said real property
and be binding on all parties having any right, title or interest
therein, or in any part thereof, their heirs, successors and
assigns, and shall inure to the benefit of each owner thereof.
Said easements, restrictions, reservations, provisions, covenants
and conditions are hereby imposed upon the subdivision, and
each parcel, as a,servitude in favor of the subdivision, and
,e~ch parcel therein as the dominant temements, as follows:
ARTICLE I
DEFINITIONS
Section 1. "Owner" shall mean and refer to the record
owner, whether one or more persons or entities, of fee
simple title to any parcel, including purchasers at foreclosure
sale, but excluding those having such interest merely as
security for the performance of an obligation.
Section 2. "The subdivision" shall mean and refer to
that certain real property hereinbefore described.
Section 3. "Parcel" shall mean and refer to each lawful
parcel of r~al property located in the subdivision.
Section 4. "Declarant" shall mean and refer to RANCHO
CARLSBAD, a general par~nership, and its successors in interest
or assigns.
ARTICLE II
GENERAL RESTRICTIONS
Section 1. Uses Other than Residential Prohibited.
All of the parc~ls shall be used only for residential purposes
as herein provided; and, no part of the subdivision, ..or any
parcel contained therein, shall be used, caused to be used, or

permitted to be used, in any way, directly or indirectly,
for (i) any business or profession, '(ii) any commercial,
manufacturing, educational, religious, medical, institu-
tional, or other non-residential purpose, (iii) the carrying
on of any noxious activity or pursuit, or (iv) any act or
thing which may be, or become, an annoyance or nuisance to
any owner.
Section 2. Oil Drilling, Mining and Gravel Excavating
Prohibited. Prospecting, mining or boring for oil, natural
gas, kindred substances, ore, or minerals, on any part of
'the subdivision, or on or in any parcel, shall not be done
or permitted at any time; and, no sand, gravel, or soil shall
be excavated or dug out of any of the parcels at any time,
except for the specific purposes of laying the foundations
grading for the construction of such residences or related
improvements, improving the gardens or grounds thereof, or
installing pipes and utilities; provided, however, that
Declarant, in carrying out the initial improvement and
development of the subdivision, shall have the right to
remove or add to any soil on any parcel, and shall have the
right of ingress to and egress from all parcels for the
purposes of grading, constructing and completing street
improvements, iristallation of utilities and the carrying out
of all other matters necessary to complete Declarant's plans
of improvement.
Section 3. Regulations Regarding Live-Stock, Poultry,
Bees, Commercial Pet Raising, Etc. No animal, fish or pet
raising 'or trading as a business shall be carried on, directly
or indirectly, on any part of the subdivision or on any parcel.
Section 4. Occupancy of Unfinished Residence and
Other s.tructures Prohibited; Limitations on Use of Signs.
No residence within the subdivision shall, in any manner, be
occupied or lived in while in the course of original construc-
tion, or until made to comply with all requirements as to
area, all other conditions set forth or referred to herein
and any further restrictions established and applicable
thereto. No structure anywhere in the subdivision, other
than a residence, shall ever be lived in or used for dwelling
purposes, including tents, shacks, trailers, campers, motor
'homes, mobile homes, out-buildings, garages, or other such
structures; nor shall any sign or billboard be erected,
placed, or maintained on any parcel, except individual
"For Sale" or "For Rent" signs used in connection with the
selling or renting of individual parcels or residences. Only
one "For Sale" or "For Rent" sign may be maintained, at any
time, on a parcel or residence; and, it shall not exceed the
dimensions of 18" x 24", shall be professionally lettered,
shall contain no price,"~~~ shall contain only the usual
information concerning the name, address and telephone number
of the owner or his duly authorized broker; however, nothing
in this section shall be construed to prevent the erection,
placement or maintenance, by Declarant or duly authorized
agents, of ~igns, trailers, offices or buildings in c6nnection
with the conduct of its business, or the development and
sale of any part of the subdivision or any parcel.
Section 5. Privies. No privy shall be erected, main-
tained or used upon any part of the subdivision, except that
a temporary privy may be permitted during the course of
construction of a residence or structure. Any lavatory, toilet

or water closet 'that shall be erected, maintained or
used on any parcel shall be enclose~ and located within a
residence or structure herein permitted to be erected on
said parcel.
Section 6. Parcels to be kept Cleared of Weeds and Rubbish,
and Slopes to be Maintained. Each owner shall plant, ke~?,
maintain, water and replant all slope banks located on his
parcel" so as to prevent erosion and create an attractive appearance
appearance. ~o structure, planting or other, material shall
be placed or permitted to remain, and no activities shall be
'undertaken, on any of the slope banks, which may damage or '
interfere with established slope banks, create erosion or
sliding problems, or which may change the direction or flow
of drainage ~hannels or obstruct or retard the flow of wate~
through drainage channels.
Each owner s4all keep his parcel free and clear of all
weeds and rubbish and do all other things necessary or
desirable to keep same neat, in good order and condition,
and properly planted and. landscaped.
Section 7. Vehicle Storage or Repairs. No vehicle,
boat, or equipment of any kind or nature shall be kept,
stored, maintained, overhauled or repaired on any parcel or
in, or on any public street adjacent thereto unless the same
be, fully enclosed in a garage or other outbuilding.
Section 8. Local Law. All of the ordinances" regula-~~~~~~--~~~----
tions and resolutions of the City of Carlsbad, California,
pertaining to the construction of dwelling units or the
zoning thereof which are now in effect or which may become
effective hereafter shall be followed and observed by each
owner.

Section 9. No Offensive Activity. No noxious or
offensive activity shall be carried on, nor shall anything
be done which may be or may become an annoyance or nuisance;
normal and usual construction activities associated with the
installation or repair of any improvement permitted by this
Declaration shall not constitute noxious or offensive acitvity
or an annoyance or nuisance within the meaning of this
seqtion.
ARTICLE III
BUILDING AND PLANTING RESTRICTIONS
, " Section 1. Single Family Residences. No building,
structure or premises shall be erected, constructed, altered
or m~intained on any parcel, except one single family res i-
denoe, with garage. Such residence may include dust.omary or
necessary accessory structures appurtenant thereto. No suah
residence shall ever be used, designated, or intended to be
used, for any purpose other than exclusively for private,
single family, residential occupancy and use.
Section 2. Moving. of. Buildings or Trailers on to
Property Prohibited. Except as permitted by Section '4 of
Article II, no residence, structure or trailer, shall be
moved onto any part of the subdivision, or onto any parcel.
Section 3. Minimum Size of Residences. No residence
shall be erected, placed, permitted or maintained on any parcel
which shall have a floor area of less than 1600 square feet,
excluding any portion used for outside or open porches, patios,
basements, garages, or breezeways.
Section 4. Maintenance and Repair of Landscaping and
Improvements. The exteriors of all improvements on each parcel
shall be regularly maintained, painted and repaired (including
replacement where required) in good,. sightly and well-kept

order, repair and condition. Each owner shall maintain the
landscaping upon his parcel in good condition, removing all
. weeds, and water~ng and'trimming lawns and shrubs as.often
as the same shall become reasonably necessary.
Section 5. Roofs. The roofs shall be constructed of
noncombustible material.
Section 6. Fences. No fence shall be constructed of
barbed wire of any kind. All fences constructed shall be
painted or stai~ed and shall be maintained in 'good condition
and repair.

ASSESSMENTS

and each owner by acceptance of a deed therefor, whether or not
it shall be so expressed in such deed, is deemed to covenant
and agree to pay a special assessment for capital improvements
and as hereafter set forth, such assessments to be established
and collected as hereafter provided. Each special assessment,
together with collecting any deliquent assessments, shall be
a charge on the parcel and shall be a continuing lien upon the
parcel against which each such assessment is made, the lien
to become effective upon recordation of a notice of assessment.
Each such assessment, together with interest, costs and

reasonable attorneys' fees, shall also be the persona~ obligation
of the owner of such parcel at the time when the assessment fell
due. The personal obligation for delinquent assessments shall
not pass to his successors in title unless expressly assumed by

Section ,3. Special Assessments.
a. Owners of the parcels in the subdivision
may apply a spec~al assessment for the purpose of defraying, "
in whole or in part, the cost of any construction, reconstruction,
repair or'replacement of a capital improvement upon the Common
Area provided that any assessment for such purpose shall have
the affirmative vote of fifty-one percent (51%) of the owner-
ship of the total parcels.

Under Art i'c I'e' 'IV,' Pa'r'a'gra'ph' 3. Any action authorized': under
Article IV, Paragraph 3,. shall be. take.n at a meeting called
'for that purpose, written notice of which shall be sent to all
owners not less than ten (10) days (except in emergency
situations) nor more than forty-five (45} days in advance of
the meeting. A quorum for such meeting shall be fifty-one

present, another meeting may be called subject to the same
notice requirement, and the resuired quorum for such resumed
meeting shall remain at fifty-one percent (51%) of the owners.
If the proposed action :i...$, .favored by a majority of the votes
, cast at such meeting, but such vote is less than the requisite
fifty-one percent (51%) of the votes, owners who were not
present in person or by proxy may give their assent in writing,
provided the'same is obtained not later than thirty (30)
days from the date of such meeting.
Section 5. Division and Payment of Assessments. All
special assessments shall be charged to and divided among each
of the parcels equally. The owners of each parcel shall be
jointly and severally liable for the assessment made against
their parcel. Each owner shall be obligated to pay special
assessments within thirty (30) days after their levy.--

other parcels shall be assessed for each month or fraction thereof
from the due date until the assessment and all late charges
are paid. The other owner(s) may bring an action at law against
the owner(s) personally obligated to pay the same, or foreclose
the lien against the parcel.
Owner(s) may cause to be recorded as to any delinquent
assessment in the Office of the County Recorder of San Diego
County, California, a Notice of Assessment Lien, which shall
state the amount of the assessment and such related charges
as may be authorized by this Declaration, a description of
,t,he parcel against which the lien has been assessed, and the
name,of the record or reputed owner of the parcel. The notice
shall be signed by any owner of the other parcels in the sub-
division. The assessment lien shall also be deemed to secure
relative to the parcel subsequent to the recordation of the
Notice of Assessment Lien unt'il the completion of the enforce-
ment of the lien or the payment of the full amount secured,
by the lien, or other satisfaction to be made in connection
therewith.
Section 7. Subordination of the Lien to First Deeds of
Trust and First Mortgages; Notice of Default. The lien of the
special assessments provided for herein shall be subordinate
to the lien of any first mortgage. Sale or ~ransfer of any
parcel shall not affect the assessment lien. However, the
sale or transfer of any parcel pursuant to a judicial foreclosure
under a first mortgage or an exercise of the power of sale
under a first mortgage shall extinguish the lien of such
assessments as to payments which become due prior to such
sale or transfer. No sale or transfer shall relieve such
parcel from liability for any assessments thereafter becoming

due or from the lien thereof.
Where the mortgagee of a first mortgage of record or
other purchaser of a parcel obtains title to the same as a
result of such a judicial foreclosure, or an exercise of the
power of sale under said first mortgage, such acquirer of
title, and its successor and assigns, shall not be liable
for the share of the special assessments chargeable to such
parcel which became due prior to the acquisition of title to
such parcel by such acquirer.
Section 8. Priorities; Enforcement; Remedies. When a , ,
notice of assessment has been recorded, such assessment shall
constitute a lien on such parcel prior and superior to all
other liens except (1) all taxes, bonds, assessments and other
levies whioh, by law, would be superior thereto, and (2) the
lien or charge of any first mortgage.
Such lien, when delinquent, may be enforced by sale by
the owner(s) of the other parcels, its attorney, or any other
person authorized to make the sale; provided, however, that
no proceeding or action shall be instituted to foreclose
the lien, either judicially or under the power of sale granted
herein, until notice of intention to proceed to foreclose the
lien shall have been delivered by the other parcel owners to
the owners, of the parcel affected by the lien at least thirty
(30) days prior to the commencement of any such action or
proceeding, and such sale shall be conducted in accordance with
the provisions of Sections 2924-2924h of the California Civil
Code applicable to, the exercise of powers of sale in mortgages
and deeds of trust, or in any other manner permitted by law.
The paid parcel owners shall have the power to b~d for
the parcel at foreclosure sale, and to acquire and hold, lease,

mortgage and convey the same. Suit to recover a money judgment
for unpaid common ,expenses, rent and attorneys' fees shall be
maintainable without foreclosing or waiving the lien securing
the same.
Section 9. Separate Taxes and Assessments. Each owner
shall execute such documents and take such action as may be

reasonably required, as determined by the City of Carlsbad,
to obtain separa~a assessments for any taxes, assessments, or

charges which may under l'ocal law become liens prior, to the
first mortgage on a parcel. In the event any of the aforestated , "
taxes, assessments or charges are for any reason not separately
levied upon the parcels responsible therefor, then such taxes,
assessments or charges shall be paid by special assessment (in

two (2) installments, thirty (30) days prior to the date of
each tax installment.
ARTICLE V
ENFORCEMENT OF RESTRICTIONS
Section 1. Enforcement of Legal Action. The Declara'nt
or each owner shall have the right to enforce the provisions
of this Declaration, without liability for failure to do so.
Violation or breach of any provision of this Declaration shall
give to the Declarant and every owner in said subdivision the
right to enforce the restrictions by commencing legal ,action.
Section 2. Recordation of Notice of Breach. The Declarant,
or any other owner of a parcel in the subdivision may at any time
that it deems a breach or violation of any provision of this
Declaration ha~ occurred, execute, ,acknowledge and record in

the Office of the Recorder of San D~ego County, a Notice of
Claim of Breach setting forth the facts of such broach or viola-
tion describing the parcel or parcels upon which such broach

'notice to all persons of such breach~ provided an action has
been commenced within sixty (60) days after recording of such
notice to establish such breach; if no such action shall have
been commenced within such sixty day period, then such notice
shall thereafter, be of no force or effect, and the breach or
violation set forth in said notice shall be presumed to have
been remedied.
Section 3. Violation Constitutes Nuisance. The result
of every action or omission whereby any provision of this
Declaration is breached or violated in whole or in part is
hereby declared to be and to constitute a nuisance, and every ,-
remedy allowe~ by law or :equity against an owner, either public
or private, shall be applicable against every such event.

Section 4. Attorney's Fees. In any legal proceeding
·for the enforcement or to restrain the violation of any provision
of this Declaration, the party or parties against whom judgment
is rendered shall pay the attorney's fees of the prevailing

Section 5. Cumulative Remedies. All remedies provided
herein or at law or in equity shall be cumulative and not exclusive.
Section 6. Failure 'to Enforce. The failure to enforce
any provision of this Declaration shall in no event be deemed
to be a waiver of the right to do so thereafter nor of the right
to enforce any other provision. No liability shall be imposed
on or incurred by any person entitled to enforce such provision
~s a result of such failure.
ARTICLE VI
RIGHTS OF LENDERS AND TITLE COMPANIES
Section 1. Reliance by Encumbrancer and Title Insurance
Companies. The holder of any encumbrance made for value on
any parcel and any entity insuring the lien of any such encum-
brance may conclusively presume 'that no breach of any condition,
covenant or restriction of this Declaration exists provided such
encumbrance is recorded in the Offico of the CO\.ln'l:.y HI.1COJ:do,c oJ:
San Diego County prior to the commencement of uny action to

Section 2. Effect of Breach on Encumbrancer. The breach
or violation of any provision of this Declaration shall not affect,
impair, defeat or render invalid the lien of any encumbrance'made

in good faith and for value which may now be a lien or hereafter
become a'lien up~n any parcel but the provisions hereof shall be
binding upon and effective against any owner, or his heirs,
devisees, successors in interest, administrators, executors and
assigns, whether such owner's title was acquired under or through
any such encumbrance by foreclosure, trustee's sale, or otherwise . .. Section 3." Definition of Encumbrance. For p~~poses of
this Declaration" an encumbrance includeq a mortgage" deed of

ARTICLE VII

Section 1. Duration of Restrictions. All easements,
restrictions, reservations, provisions, covenants and conditions

set forth in this Declaration shall continue and remain in full
force and effect at all times in respect to the subdivision, the
lots and the owners, until January 1, 2008, and shall, as they
then exist, be continued automatically and without further'notice
from that time for a period of ten (10) years, and thereafter
for successive periods of ten (10) years, each without limitation
unless, within ,six (6) months prior to January 1, 2008 or within
the six (6) month period prior to the expiration of ,any success.'ive
ten (10) yea~ period thereafter, a written agreement executed by
the then owners of a majority of the parcels shall be placed on
record in the Office of the County Recorder of San Diego County,
by the provisions of which agreement any of said easements, restric-
tions, reservations, provisions, covenants, .or conditions are I I
changed', modified or extinguished in whole or in part, 'as to the

force for successive periods of ten (10) years each, unless and
until further changed, modified or extinguished in the manner
herein provided.
Section 2. Benefit of Declaration. All of said easements,
restrictions, reservations, provisions, covenants and conditions
are for the benefit of each owner, and shall inure to and pass
with each parcel, and shall apply to and bind the successors in
interest and assigns of Declarant. Each gran~ee of any parcel,
by acceptance of a deed thereto, accepts same subject to all
of such easements, restrictions, reservations, provisions,
'covenants and conditions.

MISCELLANEOUS PROVISIONS
Section 1. Construction and Validity of Restrictions.
together; but, if it shall, at any time, be held that anyone
of said provisions or any part thereof, is invalid, or for
any reason becomes unenforceable, no other provision or any
part thereof shall be tp~r~by affected or impaired; and, the
grantor or grantors and grantee or grantees, their heirs, personal
representatives, successors, heirs and assigns shall be bound by
each provision of this Declaration remaining.
Section 2. Assignment of Powers. Any of the rights and
powers of Declarant herein contained may be delegated, transferred,
assigned, or conveyed to any person, corporation or association;
and, wherever Declarant is herein referred to, such re£erence
shall be deemed to include Declarant's successors in interest and
assigns.
Section 3. Constructive Notice and Acceptance. Every
person who now or hereafter owns or acquired any right, title or
interest in or to any parcel is and,shall be conclusively deemed

to have consented and agreed to every provision of this Declaration.
Section 4. Headings. Article and section headings, where
used herein, are inserted for convenience only and are not intended
to be a part of this Declaration or in any way to define, limit or
describe the scope and intent of the particular provisions to which
they refer.
